HomeMy WebLinkAboutMinutes - November 18, 1970160 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS NOVEMBER 18, 1970 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, November 18, 1970, in the City Hall Council Chambers. ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, KA TNICH, KIRSTEN and SCHAFFER (Mayor) Absent: Councilmen - None Also present: City Manager Glaves, Assistant City Manager Peterson, City Attorney Mullen, Planning Director Schroeder and Public Works Director Jones. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. MINUTES On motion of Councilman Ehrhardt, Katnich second, the Minutes of October 21, 1970 and November 4, 1970 were approved as written and mailed. PUBLIC HEARINGS AMEND Notice thereof having been published in accordance ZONING with law, Mayor Schaffer called for the public ORDINANCE hearing on the proposal of the City Planning Commission to amend Section 27-18 of the Code ORD. NO. 939 of the City of Lodi (Zoning Ordinance) to require INTRODUCED Site Plan and Architectural Approval for certain buildings proposed to be constructed within the City Limits. Planning Director Schroeder intro- duced the matter and reviewed the Commission's recommendation. There was no one in the audience who wished to speak in favor of the proposal Mr. John Talbot, 800 Maplewood Drive, spoke against the proposal. The public portion of the hearing was then closed. After Council discussion, Councilman Kirsten moved introduction of Ordinance No. 939 amending Section 27-18 of the Code of the City of Lodi to require Site Plan and Architectural Approval for certain buildings proposed to be constructed within the City limits. The motion was seconded by Councilman Ehrhardt and carried by the following vote. KOFU PARK Mayor Schaffer presented a letter from Mayor DEDICATION Kiyashi Akiyama of Kofu; Japan in which he expressed gratitude to the citizens of Lodi for the-dedicatidn of Kofu Park. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $307,270.29 were approved on motion of Councilman Kirsten, Katnich second. AWARD - The City Manager presented bids received for the WOOD POLES wood poles for the Utilities Department as follows: RES. NO. 3438 Anixter-Pruzan Co. McCormick & Baxter Koppers Company, Inc. J. H. Baxter & Co. Niede rmeye r- Martin Co -2- 161 $11,542.65 $11,542.65 13, 684. 18 14, 78 1.43 -0- 13, 653.36 13, 474. 55 -0- 0- 14,810.55 14,810.55 -0- 162 Minutes; of„November 18, 1970 continued Mr., Ron Thomas, 730 Maplewood Drive, stated he was concerned if there would be sufficient funds, inthe.-hotel-motel tax fund, if the signs are approved, for improvements needed on Cherokee Lane. He urged the Council to give consideration to the improvement of Cherokee Lane. After further Council discussion, Councilman Kirsten remarked that the Chamber of Commerce had performed a very valuable service for the City in researching this project. He then moved that the Chamber of Commerce and its committee be thanked for their efforts in the matter and the Council's discussion of the matter be continued to a future meeting. The motion was seconded by Councilman Hughes and carried with Councilman Katnich voting no. -3- The City Manager recommended.,the contract be awarded to Anixter-Pruzan Company for their alternate. bid... -,..On. -motion of :Councilman Kirsten, -i.. WELCOME The Council resumed their discussion of the "Welcome TO LODI to Lodi”-, signs :which had been continued from the SIGNS last meeting -. ;At that .meeting the Council had requested the Civic Affairs Committee of the Chamber of Commerce to give_.further_.consideration to the signs and to make a recommendation at —this ;meeting. , _... .. :. Dr. -Frank. Johnson, Second Vice President of the ChgMber. of -Commerce, stated that the Civic Affairs Committee had again reviewed the matter -, and .had -unanimously recommended the Council give„appr9va-1 ,to. the installation of the two_.signs as originally proposed. :The..,Goupcil. discussed the maintenance agreement and costs of, insurance for the, signs. Mr. Tom Bivins,. _;Executive Vice President of the Chamber of. Commerce„ recommended the maintenance agreement be disregarded and the signs be repaired as needed. NO. 3440 the streets therein for inclusion in the City street system. Mayor Schaffer requested Vice Mayor Hughes to assume the chair. The Mayor explained that because of a conflict of interest he would abstain from discussion and voting on the matter. Vice Mayor Hughes took the chair and, on motion of Councilman Kirsten, Schaffer second, the Council adopted Resolution No. 3440 accepting the streets in Cherokee Subdivision as public streets by the following vote: Ayes: Councilmen - Ehrhardt, Hughes, Katnich and Kirsten -4- Abstain: Councilmen - Schaffer Mayor Schaffer then resumed the chair. VACATE EASEMENTS - City Manager Glaves reported that the Public WESTLAKE # 1 Works Director had recommended that the City Council abandon portions of certain easements in the Westlake Unit No. 1 Subdivision, Tract No. 797. The easements were dedicated to the City on June 7, 1967. The Public Works Depart- ment had determined there was no present or future use for the easements. On motion of Councilman Kirsten, Hughes second, the City Council adopted its Order vacating portions of easements in the Westlake Unit No. I Subdivision. ELIMINATE Upon the recommendation of the City Manager, DETECTIVE Councilman Katnich moved the adoption of Reso- POSITION - lution No. 3441 eliminating one Detective position ESTABLISH and establishing an additional Police Sergeant SERGEANT position in the Police Department. The motion POSITION was seconded by Councilman Kirsten and carried by unanimous vote. RES. NO. 3441 WITHDRAW On February 18, 1970 the City Council adopted HALLINAN ADDN Resolution No. 3351 withdrawing the Hallinan FROM WRCFPD Addition from the Woodbridge Rural County Fire & MRCFPD & Protection District. Upon review by the County RESCIND RES. Counsel, it was determined while this Addition NO. 3351 is primarily in the Woodbridge Fire District, a very small portion of it also lies within the RES. NO. 3442 Mokelumne Fire District, which necessitates withdrawal from both fire districts. The City Manager recommended the Council rescind Resolution No. 3351 withdrawing the Hallinan Addition from the Woodbridge Fire District and adopt a new resolution withdrawing it from both the Woodbridge and the Mokelumne Fire Districts. On motion of Councilman Kirsten, Ehrhardt second, the Council then unanimously adopted Resolution No. 3442 withdrawing the Hallinan Addition from -4- A� . 1.54 Minutes of November 18, 1970 continued the Woodbridge Rural County Fire Protection District and the Mokelumne Rural County Fire Protection District and rescinded Resolution No. 3351. COMMITTEE Mayor Schaffer called for committee reports REPORTS from the Council. Councilman Ehrhardt stated he would be attending meetings of the Advisory Planning Association on November 24, the Highway 12 Association on November 19 and ithe Local Agency Formation Commission on November 20. PRISONER OF Mayor Schaffer proclaimed Thursday, November WAR DAY 26, 1970 as "Prisoner of War Day" in the City PROCLAIMED of Lodi and urged all citizens to show their respect and concern for these servicemen.
