CITY COUNCIL, CITY OF LODI
CITY HALL COUNCIL CHAMBERS
SEPTEMBER 2, 1970
A regular meeting of the City Council of the City of Lodi was held beginning
at 8:00 p.m. on Wednesday, September 2, 1970 in the City Hall Council
Chambers.
ROLL CALL Present: Councilmen - EHRHARDT, HUGHES,
KATNICH, KIRSTEN and
SCHAFFER (Mayor)
Also present: City Manager Glaves, Assistant
City Manager Peterson, City Attorney Mullen,
Planning Director Schroeder and Public Works
Director Jones.
PLEDGE Mayor Schaffer led the Pledge of Allegiance to
the flag.
MINUTES On motion of Councilman Kirsten, Ehrhardt second,
the Minutes of September 2, 1970 were approved
as written and mailed.
PRESENTATION
DRUG Mr. Trevor Pendray, 1012 Lake Home Drive,
ABUSE reported on the progress of the drug abuse program,
PROGRAM which is now underway in the City. He introduced
two students, Miss Susan Freitas and Mr. David
Torres, who are both involved in the program.
Miss Freitas commented on the program and Mr.
Torres presented to the Council and City staff a
"capsule" containing a fact sheet concerning the
terms of drug abuse. The capsules will be dis-
tributed throughout the community.
PLANNING COMMISSION
S. CRESCENT At its meeting of August 24, 1970 the City Planning
AVENUE Commission recommended the acceptance of a new,
improved portion of South Crescent Avenue between
West Lodi Avenue and Kimberly Drive with certain
conditions. No action was taken by the Council
at this time.
OF INTEREST Other actions of interest to the City Council were
as follows:
1. Approved Unit #1 of the Westmont Oaks Sub-
division which is a portion of the former J. C.
Beckman property located west of West Lane
and south of Century Boulevard.

2. Approved the request of Mr. Fredrick Auch
for a variance to permit an addition to and the
reconstruction of a portion of a single-family
dwelling with a non -conforming side yard of
one -foot at 106 North Orange Avenue in an
area zoned R-1.
3. Denied the request of Mrs. Robert G. Minor
for a variance to permit the establishment of
a day care center for eight or more children
at 603 North Loma Drive in an area zoned
R- 1.
4. Reviewed the land use and zoning study of
East Kettleman Lane .between Cherokee Lane
and Stockton Street.
5. Reviewed the West Lodi Avenue Traffic Study.
6. Approved on a one-year trial basis the request of
Mr. Robert Ross for permission to operate a
motorized, licensed train in areas zoned C -S.
COMMUNICATIONS
ABC LICENSE
A notice of Application for Alcoholic Beverage
License was received from Mar -Val Food Store,
No. 5, Inc. , 429 West Lockeford Street, Person-
to-person transfer, off -sale beer and wine.
APPRECIATION -
A letter was read from Mr. Greg Costa, expressing
G. COSTA
appreciation for having been given the opportunity
to serve on the Recreation Commission last year.
FOLSOM
Letters were read from the Stockton and East San
SOUTH CANAL
Joaquin Water Conservation District and the
RES. NO. 3417
Stockton City Council requesting the City of Lodi
to adopt a resolution urging support of the earliest
possible completion of the Folsom South Canal.
On motion of Councilman Kirsten, Mayor Schaffer
second, the Council unanimously adopted Resolution
No. 3417 urging support of the earliest possible
completion of the Folsom South Canal. The Council
requested that copies of the resolution be forwarded
to the appropriate legislators.
LCC VOTING
Correspondence was received from the League
DELEGATE
of California Cities requesting that each City
Council designate a voting delegate and an alternate
voting delegate for the business session at the
Annual League Conference in San Diego, October
25-28, 1970.

Councilman Kirsten moved that Mayor Schaffer be
designated as the City's voting delegate and Vice
Mayor Hughes the alternate voting delegate. The
motion was seconded by Councilman Katnich and
carried by unanimous vote.
B. KENNEDY A letter was read requesting the Mayor to proclaim
FOOTBALL WEEK the week of September 6 as Bobby Kennedy Football
Week to promote and publicize the Bobby Kennedy
Football Foundation. Mayor Schaffer then proclaimed
the week of September 6 as Bobby Kennedy Football
Week in the City of Lodi.
TRAINING City Manager Glaves presented a check in the
FUNDS amount of $1, 148.85 from the California Peace
RECEIVED Officer Training Fund. The funds were received
as a result of Police personnel participating in the
Peace Officers Standards and Training certified
courses.
REPORTS OF THE CITY MANAGER
CLAIMS Claims in the amount of $418, 560. 90 were approved
on motion of Councilman Ehrhardt, Katnich second.
WAGE SCALE - Councilman Kirsten moved adoption of Resolution
BUILDING AND No. 3414 adopting prevailing rates of per diem
CONSTRUCTION wages as required by Section 1770 of the State
Labor Code. The motion was seconded by
RES. NO. 3414 Councilman Ehrhardt and carried by unanimous
vote.
STREET LIGHT - City Manager GLaves reported that he had received
HAM & PINE a number of complaints about the darkness at the
intersection of Ham Lane and Pine Street. He
said that the need for street lights on Ham Lane
is apparent, but to date no one has been successful
in getting a petition circulated for formation of a
lighting district. He pointed out that if the City
installs a street light at this intersection, it then
might become more difficult to get property owners
in the vicinity of the light to become interested
in forming a lighting district at a later date. The
City Manager said the matter should be considered
in terms of the degree of public need and safety.
The light, if approved, would be installed on the
Pacific Gas & Electric Company's pole at the
southeast corner of Ham Lane and Pine Street.
The cost for the installation as proposed is $125.00.
After discussion, Councilman Ehrhardt moved
Council approval of the installation of a street
light at the intersection of Ham Lane and Pine
Street for an approximate cost of $125.00. The

motion was seconded by Councilman Kirsten.
Under the question, Councilman Katnich stated
_ he was concerned that a precedent might be
established if the light is installed. It was the
general consensus of the Council that it was not
their intent to set a precedent, and each request
should be considered on its own merit taking into
consideration the safety factor and degree of
public need. The motion passed by unanimous
vote.
Mayor Schaffer then requested the staff to determine

a school crosswalk across Turner Road on the
east side of Lower Sacramento Road.
PLANS & SPECS - On motion of Councilman Kirsten, Katnich second,

SAN. SEWER the Lower Sacramento Road sanitary sewer instal-
lation from 1/4 miles south of Kettleman Lane to
Tokay Street and authorized advertising for bids
thereon.

NO PARKING -
On motion of Councilman Ehrhardt, Katnich second,

City Code be amended to place the general restriction

Councilman Kirsten, Ehrhardt second, the Council
introduced Ordinance No. 936 amending Section
14-59 of the Code of the City of Lodi and amending
Section 195 of Ordinance No. 493 establishing
parking time limits on certain streets.
SCHOOL CROSSING
The City Manager presented a memorandum from

the Public Works Director recommending a school
crosswalk be established across Turner Road at
RES. NO. 3416
Lower Sacramento Road. The City Manager
recommended the crosswalk be installed.
On motion of Councilman Ehrhardt, Kirsten second,
the Council adopted Resolution No. 3416 establishing
a school crosswalk across Turner Road on the
east side of Lower Sacramento Road.

WIDENING The City Manager reported that the County of San
W. LANE - Joaquin is proposing to widen West Lane to the
S. J. COUNTY ultimate four -lane width from Hammer Lane to
Harney Lane in the Spring of 1971. Mr. Glaves
said both he and Public Works Director Jones
had reviewed the plans and they had no objections
to them. He recommended the County be notified
of the City's approval of the plans. The Council
concurred with the Manager's recommendation.
APA - Councilman Ehrhardt reported on recent meetings
LAFCO of the Cities and County of San Joaquin Advisory
Planning Association and the San Joaquin County
Local Agency Formation Commission.
SISTER -CITY Mayor Schaffer commended the Sister -City Committee,
COMMITTEE and especially Assistant City Manager Tom Peterson
ACTIVITIES and Councilman Katnich, for their efforts in the
dedication of Kofu Park.
Councilman Katnich then stated he would like to
thank all of those persons involved in entertaining
the students from Japan who visited in Lodi during
the month of August.
ORDINANCES
ADOPTING Ordinance No. 935 entitled, "ADOPTING A UTILITY
UTILITY & CAPITAL AND CAPITAL OUTLAY BUDGET FOR THE CITY
OUTLAY BUDGET OF LODI FOR THE FISCAL YEAR BEGINNING
FOR FISCAL 1970-71 JULY 1, 1970 AND ENDING JUNE 30, 1971,1f
having been introduced at the meeting of August
ORD. NO. 935 19, I970 was brought up for passage on motion of
ADOPTED Councilman Kirsten, Katnich second. Second
reading was omitted after reading by title, and
the ordinance was then passed, adopted and ordered
to print by the following vote:
Ayes: Councilmen - EHRHARDT, HUGHES,
KATNICH, KIRSTEN and
SCHAFFER
Noes: Councilmen - None
EXECUTIVE The Council adjourned to an executive session at
SESSION approximately 9:15 p.m.
ADJOURNMENT
There being no further business, the meeting was
adjourned on motion of Councilman Katnich, Kirsten
second, at approximately 11:23 p. m.
