HomeMy WebLinkAboutMinutes - July 15, 19701.01: CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS JULY 15, 1970 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, July 15, 1970 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, KATNICH, KIRSTEN and SCHAFFER (Mayor) Absent: Councilmen - None Also present: City Manager Glaves, Assistant City Manager Peterson, City Attorney Mullen and Public Works Director Jones. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. MINUTES Minutes of June 24, 1970 and July 1, 1970 were approved as written and mailed on motion of Councilman Ehrhardt, Kirsten second, after changing the name "Kerr" to "Karr" in the first paragraph of page 5 of the Minutes of July 1. DRUG Mr. Trevor Pendray, 1012 Lake Home Drive, PROGRAM addressed the Council concerning the drug abuse program being considered by a committee of local citizens. Mr. Pendray asked Council support of the program. He explained at this point it was not financial support he was seeking, but rather support in the area of education. Mayor Schaffer requested the staff to work with Mr. Pendray on the program. BEAUTY Mrs. Dorothy McClaine of Dot's Beauty COLLEGE Spot, 5435 East Lockeford Street, and Mrs. OPPOSED Marlene Sprinkle of Argie's Beauty Salon, 820 South Church Street, spoke in behalf of local cosmetologists requesting the Council to prohibit the establishment of a proposed beauty college in Lodi. The proposed college is to be located at the northeast corner of Elm and School Streets. Both the Mayor and the City Manager explained that it would be unlawful for the Council to prohibit a legitimate business from coming into the City if all requirements of the City had been met. Upon being questioned by Mrs. McClaine as to where the beauty operators might obtain help in this matter, City Attorney Mullen suggested the cosmetology association could take the issue to their State legislators. -I- Minutes of July 15, 1970 continued COMPLAINT - Mr. John Zenco, 225 North Hutchins Street, GARBAGE CO., complained to the Council that he is being DOGS, MOTOR- awakened in the early morning hours by CYCLES noises created by the Sanitary City Disposal Company's garbage trucks as well as barking dogs. He also complained that motorcycles are creating excessive noise on several streets in his area, particularly Lockeford Street. Mayor Schaffer thanked Mr. Zenco for calling these matters to the Council's attention and assured him the staff would investigate the matter to determine if some- thing could be done to minimize the noise. PLANNING COMMISSION SPECIFIC At its meeting of July 13, 1970 the City PLAN - Planning Commission recommended adoption TURNER ROAD of a Specific Plan for Turner Road between Church Street and Myrtle Road. On motion of Councilman Kirsten, Ehrhardt second, the matter was set for public hearing on August 5, 1970. OF INTEREST Other actions of interest to the City Council were as follows: 1. Set 7:30, Monday, July 27, 1970 as the time and place to consider the Tentative Map for Westmont Oaks Subdivision. Z. Set a public hearing for 7:30 p.m., Monday, July 27, 1970 to consider the request of Westmont Development Company for the rezoning from the R-1, Single -Family Residential District to the P -D, Planned -Development District; the C -P, Commercial -Professional District; the C -S, Commercial Shopping District, and the R -GA, Residential - Garden Apartment District for the former J. C. Beckman property located generally west of West Lane and south of Century Boulevard. 3. Denied the request of Mr. W. R. Provan for a variance to permit the erection -.of'a six-foot fence 14 feet from the property line in the required front yard on a corner parcel at 838 South Mills Avenue in an area zoned R- 1. 4. Recommended that the San Joaquin County Board of Zoning Adjustment deny the request of Mr. Vernon Sperling by Community Planning Services for a Use Permit to excavate 300,000 cubic yards of material on the north side of -2- Minutes of July 15, 1970 continued the Mokelumne River across from the Willow Glen Subdivision in an area zoned RA- 15. 5. Recommended .that the San Joaquin County Zoning Administrator approve the request of Coloma Cellars for a Use Permit for the installation of a 4 -foot by 8 -foot directional sign on the West side of the U.S. 50-99 Frontage Road, 800 feet south of Woodbridge Road in an area zoned I- PA. 6, Recommended that the San Joaquin County Zoning Administrator deny the request of Mr. Raymond Wintersteen for a Use Permit for a repair shop for campers and trailers at 248 East Kettleman Lane in an area zoned I- PA. 7. Received a preliminary report from the staff on examples of site plan approval provisions from selected zoning ordinances - to be continued. 8. Received a report from the staff on preliminary findings regarding the signing and locational conformance of fruit and vegetable stands in the City of Lodi. COMMUNICATIONS IBC. LICENSE Notices of Application for Alcoholic Beverage License were read as follows: 1. Billy D. Barton, 35 North Cherokee Lane, Bill's Beacon Station, off -sale beer and wine. 2. James R. Haddox, 401 West Kettleman Lane, Ron's Beacon Station, off -sale beer and wine. 3, Rocco D. Benigno and Frank A. Costanza, Z12 South School Street, Costanza's Golden Husk, off -sale beer and wine, eating place. 4. John H. Holmes, 121 - 23 North Cherokee Lane, Del Monte Club, on -sale general eating place, person-to-person transfer. 5. Safeway Stores, Inc., 215 East Lodi Avenue, off -sale general, person-to- person, premises -to -premises transfer. -3- Minutes of July 15, 1970 continued LCC -CVD - A notice was read of the quarterly dinner QUARTERLY meeting of the Central Valley Division of DINNER MEETING the League of California Cities to- be held in Modesto, Friday, July 24, 1970. LEGISLATION A letter was read from Senator Randolph Collier requesting the Council to adopt a resolution opposing legislation pending in the legislature concerning the diversion of gasoline tax. No action was taken. APPEAL - A letter was read from Mr. Leland Ehlers EHLERS AND and Dr. Gordon Roget of Ehlers and Roget ROGET Development Company appealing the decision of the City Planning Commission in denying their request for a change in zoning from the R-1, Single -Family Residential District to the R -GA, Garden Apartment Residential District and the C-1, Neighborhood Com- mercial District for a parcel located at the southeast corner of West Lodi Avenue and Lower Sacramento Road. Mr, Victor Meyer, 41 South Sacramento Street, who was in the audience, stated he had been retained to represent the Ehlers and Roget Development Company in the above matter. Mr. Meyer requested the C-1 zoning be deleted from the request and the entire area be considered for R -GA zoning. He asked if the request with the above change could be sent back to the Planning Commission for consideration before the public hearing is scheduled. City Attorney Mullen stated that the appeal must be set for public hearing, but the Council could, at a future meeting, refer the matter back to the Planning Commission for a report. On motion of Councilman Kirsten. Katnich second, the matter was then set for public hearing on August 19, 1970, REPORTS OF THE CITY MANAGER $40,367.38 CLAIMS Claims in the amount of $ w��ec/re�a proved on motion of Councilman 2� Minutes of 8/5 0 �S . CLASSIFICATIttOs�N City Manager Glaves presented a limited STUDY & CLASS classification study performed by Cooperative SPECS APPROVED Personnel Services, State Personnel Board, for certain positions in the Recreation and RES. NO. 3399 Parks, Public Works, Police and Utilities Departments. Mr. Glaves recommended the study, be approved with the exception of two clirssifications - that of Identification !Za 1©5 Minutes of July 15, 1970 continued Officer and Records Officer. The study recommended these two positions should be assigned a lower salary range, and the City Manager explained that the City employees' representative, Mr. Robert Cole of the San Joaquin County Employees' Association.. had requested further information on the two positions before this action is taken by the Council. Mr. Glaves then presented class specifi- cations and salary ranges for the Fire Training Officer and Parking Enforcement Assistant positions. These positions were authorized in the 1970-71 Operating Budget. After a brief discussion, the City Council, on motion of Councilman Kirsten, Ehrhardt second, adopted Resolution No. 3399 approving the findings of the classification study, with the exception of the recommendations for the Identification Officer and the Records Officer positions, and adopting class specifi- cations and salary ranges for Fire Training Officer and Parking Enforcement Assistant; above to be effective July 1, 1970. RECLASSIFY The City Manager then explained that the POSITION IN one clerical position in the Recreation and R & P DEPT, Parks Department classified as Typist Clerk II had been reviewed by the City staff, and it RES. NO. 3400 had been determined that the position warranted reclassification to that of Stenographer -Clerk II. He recommended the Council approve this reclassification. On motion of Councilman Kirsten, Katnich second, the Council adopted Resolution No. 3400 reclassifying the above pooition as recommended, effective July 1, 1970. ACCEPT TOWN The City Manager reported that subdivision & COUNTRY improvements in the Town & Country Park, PARK Tract No. 847, had been completed in accordance with plans and specifications, RES. NO. 3401 and it was nowin order to accept the streets therein for inclusion in the City street system. On motion of Councilman Katnich, Kirsten second, the Council unanimously adopted Resolution No. 3401 accepting the streets in Town & Country Park as public streets. PLANS & SPECS - On motion of Councilman Ehrhardt, Kirsten SUBD. PAVING second, the Council approved plans and specifications for Subdivision Paving - 1970 and authorized advertising for bids thereon. -5- iG& Minutes of July 15, 1970 continued HAM -TURNER City Manager Glaves presented right-of- R/W AGREEMENT way agreements between the City of Lodi and Jennie A. Burlington and Julia C. Graffigna, Earl E. Burlington, Jr. and Liewella A. Burlington and William H. and Bertha Gretsinger. Said right of way is necessary to complete street improvements at the intersection of Ham Lane and Turner Road which were approved by the Council on May Z7, 1970. After discussion of the proposed improvements, Councilman Ehrhardt moved -the deeds for acquisition of the right of way be accepted and the City Manager be authorised to sign the agreements subject to conditions as specified therein. The motion was seconded by Councilman Kirsten and carried with Councilman Hughes voting no, PLANS & SPECS - On motion of Councilman Kirsten, Katnich HAM -TURNER second, the Courkcil approved plans and ST. IMPRVMTS specifications for Ham Lane and Turner Road Street Improvements and authorized advertising for bids thereon. DESIGNATE The City Manager presented a memorandum TURNER RD. from the Public Works Director recommending THRU STREET that Turner Road be designated as a through street. This action would facilitate stop RES. NO. 3402 signs being erected at each intersecting street on Turner Road. Councilman Ehrhardt then moved adoption of Resolution No. 3402 designating Turner Road as a through street. The motion was seconded by Councilman Kirsten. Mrs. Carol Goehring, 1227 Edgewood Drive, asked if this action would affect future plans . for improvement of this street. Mayor Schaffer assured Mrs. Goehring it would not. The motion then carried by unanimous vote. LEGISLATION Councilman Kirsten reported that Assembly AB 908 Bill 908 designed to impose a 14 per cent tax on all publicly -owned eLectrical systems had been defeated. LAFCO Councilman Ehrhardt reported that a meeting MEETING of the San Joaquin County Local Agency Formation Commission would be held on Friday, July 17, 1970. ORDINANCES ADOPTS 1970-71 Ordinance No, 933 entitled, "ADOPTING AN OPERATING OPERATING BUDGET FOR THE SUPPORT BUDGET OF THE VARIOUS DEPARTMENTS OF THE CITY OF LODI FOR THE FISCAL YEAR ORD. NO. 933 BEGINNItNG JULY 1, 1970 AND ENDING ADOPTED JUNE 30, 1971," having been introduced -6- Minutes of July 15, 1970 continued at the meeting of July 1, 1970 was brought up for passage on motion of Councilman Kirsten. Ehrhardt second. Second reading was omitted after reading by title, and the ordinance was then passed, adopted and ordered to print by the following vote: Ayes: Councilmen - Ehrhardt, Hughes, Katnich, Kirsten and Schaffer Noes; Councilmen - None EXECUTIVE The Council adjourned to an executive SESSION session at approximately 9:45 p.m. to discuss personnel matters.
