HomeMy WebLinkAboutMinutes - July 1, 1970RA CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS JULY 1, -1970 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, July 1, 1970 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - Ehrhardt, Hughes, Katnich, Kirsten and Schaffer (Mayor) Absent: Councilmen - None Also present: City Manager Glaves, Assistant City Manager Peterson, and City Attorney Mullen. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. MINUTES: Minutes of the meeting of June 17, 1970 were approved as written and mailed on motion of Councilman Kirsten, Katnich second, after correcting the last paragraph on Page 9 as follows: change "12:45 p. m. " to "12:45 a. m. " PUBLIC HEARINGS ALLEY Mayor Schaffer stated the public hearing on the VACATION recommendation of the Public Works Director ADJACENT TO to vacate an alley adjacent to the Resubdivision RESUBD. BLK. 2, of Block 2, Ayers and Pitchers Addition had AYERS & been continued from the meeting of June 17, PITCHERS ADDN. 1970, and called for continuation of the hearing. The City Manager explained that the alley is an unimproved 10 -foot strip running from First Street to Olive Street between Pleasant Avenue and Church Street. There was no one present to speak for or against the alley at:andonment. After a brief discussion during which it was noted that there is no present or future public use of this alley, it was moved by Councilman Kirsten, Ehrhardt second, the Council adopted its Order abandoning the 10 -foot wide alley running from First Street to Olive Street between Pleasant Avenue and Church Street. HUNTER Mr. Hilton Bergstrom, Hunter Training Safety SAFETY Officer, Department of Fish and Game, was PRESENTA- introduced to present Hunter Safety Training TIONS Certificates to six Lodi police officers who have completed ti -at program. Sergeant Arlon Thornesberry, one of the recipients, accepted the certificates for Sergeant Norman Mauch and Officers Bruce Dick, Albert Schultz, Leland Schmidt, and Donald Hawkinson. -I- Minutes of July 1, 1970 continued FOLSOM DAM Mayor Schaffer announced that State Senator WATER RE- Alan Short has introduced a Senate joint reso- LEASES - lution (SJR 33) calling for the release of a SJR 33 specified amount of Folsom Dam water into the American River. Such releases would reduce RES. NO. 3393 the amount of water available for the Folsom - South Canal. Mr. Bob Carter, president of the North San Joaquin Water Conservation District, was in the audience and was introduced by the mayor. Mr. Carter said it is the District's responsibility to insure that this area does not lose water. He said the primary need for this water is for agricultural rather than recreational purposes. City Manager Glaves explained that Folsom - South Canal water will reduce the need for pumping for agricultural purposes, thus improving the area's underground water picture. Emil Sender, District General Manager, also spoke in opposition to the joint resolution. After a brief discussion, Councilman Kirsten moved, Katnich second, that Council adopt Resolution No. 3393 urging completion of the Folsom -South Canal project, and that the waters intended for that canal be put to that use. Councilman Kirsten asked that copies of the resolution be sent to interested legislators. The adoption of Resolution No. 3393 was approved unanimously. PLANNING COMMISSION The City Manager gave the following report of the City Planning Commission meeting of June 22, 1970: OF INTEREST 1. Approved the request of Mr. Vernon Ekstrom for a Variance to permit an addition to a nonconforming duplex located on an interior lot at 1009 South Lee Street in an area zoned R-2, Single -Family Residential. 2. Approved the request of the Lodi Nut Company by Mr. Ted Hochhalter for a Variance to permit the addition of a building to a non- conforming, light industrial use at 1230 South Fairmont Avenue in an area zoned R-1, Single -Family Residential. In approving this Variance, the Planning Commission determined that the new building, ''will be of distinct benefit to the district in which it is Located. " M., Minutes of July 1, 19?0 continued 3. Denied the request of the Ehlers and Roget Development Company for a change in zoning from the R-1, Single -Family Residential District and the C-1, Neighborhood Com- mercial District for a parcel at the southeast corner of West Lodi Avenue and Lower Sac ramento Road. The above action was taken by two roll call votes. The C-1 portion of the request was denied by a unanimous vote of 9 to 0 while the R -GA section was refused by a vote of 6 to 3 with Commissioners Katzakian, Reid and Robinson dissenting from the majority, COMMUNICATIONS ABC LICENSE A notice of Application for Alcoholic Beverage License was read from Russel A. and Barbara Dickhoff, Happy Times Liquor Store, 115 North Cherokee Lane, person to person transfer, dropping partner and adding wife. TRAINS A resolution prepared by the City of Modesto to CARRYING be introduced at the annual League of California EXPLOSIVES Cities Conference in San Diego in October calling & TOXIC for updated safety standards on railroads was SUBSTANCES read. The resolution urges the Interstate Commerce Commission, the California Public Utilities Com - RES. NO. 3394 mission and railroads operating within the State of California to immediately take the necessary steps to review and update railroad safety standards, including road bed and rolling stock maintenance, and the speed of trains through urban areas, especially on rail lines and trains which carry explosive and toxic substances. On motion of Councilman Ehrhardt, Kirsten second, the City Council adopted Resolution No. 3394 calling for the updating of railroad safety standards and ordered that the Interstate Commerce Commission, the State Public Utilities Commission, and the railroads be advised of this action. OPPOSITION City Manager Glaves informed the Council of TO AB 23.15 Assembly Bill 2345 calling for the establishment ESTABLISHING of an Environmental Planning Council to review ENVIRON- City applications for financial assistance to insure MENTAL conformance to an environmental quality plan. PLANNING The Council, viewing the establishment of such a COUNCIL body as a threat to home rule, unanimously adopted Resolution No. 3395 opposing this bill RES. REPORT ON The City Manager presented a report to the PARKING City Council on the estimated receipts and DISTRICT NO. 1 disburs eme nts for the fiscal year 1970-71 for Parking District No. i, He explained that -peter revenue ?lus 'interest earned on reserve and surplus __:titer funds will be sufficient to meet expenditures this coming year. Mr. Roger INTRODUCED Karr, Chairman of the Board of Directors of the Lodi Junior Chamber of Commerce, JR. CHAMBER presented that organization's budget request. OF COMMERCE He explained that the request was the same ALLOCATION as last year, $500, and that the money would be expended in community prom-iction events and attempts to bring meetings and other events to Lodi. Councilman Kirsten *:loved, Hughes second: tha: the Lodi Junior Chamber of Commerce be allocated the sum of $500 for community promotional activities to be included in the 1970-71 Operating Budget. The motion carried unanimously. City Manager Glaves reviewed the budget pro- cedure. Councilman Katnich requested uniform estimates for iterr_s where possible, The City Manager said he would instruct the Finance Director to prepare a list of standard prices for future budgets. Councilman Kirsten asked about the feasibility of a motor pool, The City Manager explained that at this time such a rnove would free a very small number of cars for general use since many employees carry specialized equipment and work out cf their cars. Councilman_ Kirsten moved the introduction of Ordinance No. 933 adopt``-r..g the Operating Budget for 1970-71. The ^oticn was seconded by Courc_lzman Ehrhardt and carried. ORDINANCES MOBILE HOME Ordinance No. 932 entatled, "An Ordinance PARK REGU- Adding Section 27-13A to the Code of the City LATIONS of Lodi 'Thereby Regulating the Location and Develop -Hent cf Mobilehcme Parks" having been ORD. NO. 932 introduced at the meeting of June 17., 1970 ADOPTED was brought up for passage on motion of Councilman Kirsten, Ehrhardt second. Second reading was orni*.ted after reading by title, and the ordinance was then_ passed, adopted and ordered to print by the following vote: Ayes; Councilmen - Ehrhardt, Hughes, Katnich, Kirsten ar_d Schaffer Noes: Ccuncil.^-ten - ^Tone -5- W, Minutes of July 1, 1970 continued BID City Manager Glaves said that in answer to a PROCEDURE Council request he had compiled a packet illustrating the •,•aricus steps taken in the advertisement for bids, and that it is available for Council review at any time, CVD EXECU- Councilman Ehrhardt reported on the Central TIVE MEETING Valley Division Executive Meeting held in Modesto June 25, 1970. TTHe noted that former Councilman James F. Culbertson was presented with a plaque citing his service to the Central Valley Division of he League of California Cities as a member of the Board of Directors. He was also made an honorary life member of the Division. Councilman Ehrhardt announced that the next Executive Committee meeting is scheduled for Escalon on September 24, 1970. HONOR Mayor Schaffer announced that July 4, 1970 AMERICA will be Honor America Day throughout the DAY nation. He asked and received Council con- currence in proclaiming this day Honor America Day in the City of Lodi. VISIT OF Councilman Katnich reported that plans are JAPANESE underway for the hosting of fifteen Japanese STUDENTS university students in Lodi from August 2 through August 26, 1970. He said additional SISTER -CITY housing is needed for these students and asked COMMITTEE the assistance of the community, SISTER -CITY On motion of Councilman Kirsten, Ehrhardt CONFERENCE second, the Council authorized Councilman Katnich to attend the annual national conference of the Tov�n Affiliation. Association in San Diego in August.. ADVISORY Mayor Schaffer asked the Council's concurrence PLANNING in the appointment of the Planning Director ASSOCIATION to the technical Ccr mittee of the Advisory Planning Association in accordance with that body's request. The appointment was ratified on motion of Councilrr--an Kirsten., Katnich second.
