HomeMy WebLinkAboutMinutes - November 17, 1971_349 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS NOVEMBER 17, 1971 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, November 17, 1971 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, _ KIRSTEN, SCHAFFER and KATNICH (Mayor) Absent: Councilmen - None Also present: City Manager Glaves, Assistant City Manager Peterson, City Attorney Mullen, Planning Director Schroeder and Public Works Director Jones. PLEDGE Mayor Katnich led the Pledge of Allegiance to the flag. PUBLIC HEARINGS APPEAL - Notice thereof having been published in accordance G. PERMAN with law, Mayor Katnich called for the public hearing DENIED on the appeal of Mrs. Gloria Perman from the decision of the Planning Commission in denying her request for a change in zoning from the R-2, Single -Family Residential District to the R -MD, Medium -Density Multiple Family Residential District for Lot 22 of the Kessell Suodivision No. 2 (835, South School j Street). I Planning Director Schroeder introduced the matter and presented a drawing of the property proposed for rezoning. -Mr. Schroeder explained that the denial of the rezoning by the Planning Commission was based on the reasoning that this would establish a "spot zone". Mr. Charles Spatola, Jr., of the law firm of Chargin & Briscoe, 40 South San Joaquin Street, Stockton, who ccas representing Mrs. Perman, spoke in favor of the rezoning. There being no other persons in the audience wishing to speak either in favor of or in opposition to the appeal, the puolic portion of the hearing was closed. After a short discussion by the Council, the appeal was denied on motion of Councilman Schaffer, Ehrhardt second, by unanimous vote. PRESENTATION J. BACARRO - Mr. Joseph Bacarre, Lodi's representative on the C.A.C. REPORT Board of Directors of the Community Action Council, reported to the Council on the activi.ties and problems of the Community Action Council. The Council commended Mr. Bacarro for the manner in which he had represented the City on this Board. PLANNING COMMISSION The City Manager gave the following report of the Planning Commission meeting of November 8, 1971: SPECIFIC PLANS The Planning Commission recommended the adoption of a Specific Plan for the future development of a north -south major arterial street along the alignment of Myrtle Street -Wells Lane between the future exten- sion of East Turner Road and East Harney Lane. The Planning Commission recommended the adoption ) of a Specific Plan for the future development of Cluff Avenue between the future extension of East Turner Road and East Lodi Avenue as a Collector Street. The Planning Commission also recommended the adoption of a Specific Plan for the future development of the . side Frontage Road as a major arterial street between Victor Road (State Highway 12) and East Harney Lane. Since the recommended a( -tion on the above matters would be to set for public hearing, City Manager Glaves suggested that no action be taken at this time. He explained that, with the remodeling of the Council Chambers, t.hP Council would be meeting in temporary quarters for a fe,,i, meetings. He suggested the matter be set for hearing after a temporary meeting place has been acquired. Councilman Schaffer then moved action on the above masters be deferred until the next regular Council meeting. The motion was seconded by Councilman Kirsten and carried unani- mously, ACTIONS OF Other actions of interest were as folicws. INT EREST -2- 351 Minutes of November I7, 1Q71 continued 1. Cancelled the Regular Planning Commission session of Mondav, December 27, i971, 2. Conditionally appro-ied the request of Autoronics Systems, Inc. for a Use Permit for a self- service automobile ser•;ice stat' -on at the location of an existing, vacant full service station at the northwest corner of West Lodi Avenue and South Hutchins Street in an area zoned C-1, Neighbor- hood Commercial, 3. Approved the request of Mr. Ronald Kayl for a Variance to permit the enlargement of a single- family dwelling with nonconforming side yards of 4 feet on the west and 3 1/2 feet on the east at 226 East Vine Street in an area zoned R -MD, Medium Density Multiple -Family Residential. 4. Denied the request of Mrs. Angiolina Lira by Mr. Robert J. McComb for a Variance to reduce the required front yard from 25 to 20 feet to permit parking and buildings within the front yard area of a commercial structure immediately adjacent to a Residential zone at 1332 South Lee Street in an area zoned C-2, General Commercial. 5. Approved the request of Mr. Ray Nickel by Mr. Lloyd Biskeborn, for a Variance to reduce the required side yard from 5 feet to 4 feet to permit the erection of an attached carport at 19 South Sunset Drive in an area zoned R-1, Single Family Residential. 6. Recommended to the San Joaquin County Board of Zoning Adjustment the approval of the request of Mr. Dan Mayer, by b1r. Harry Tremaine, for a Use Permit to expand a plant nursery on the west side of Wells Lane from 640 feet to 960 feet north of Harney Lane, east of Lodi in an area zoned I -PA, Interim -Protective Agri- cultural. 7. Asked the San Joaquin County Planning Department to continue for two weeks the request of Mr. Brad Frahm for a Use Permit to erect a 200 - unit mobilehome park at the southwest corner of West Lane (South Hutchins Street) and Harney Lane, south of Lodi in an area zoned GA -5, General Agricultural and I -PA, Interim -Protective Agricultural, COIdIV1UNICATIONS BIKE A letter was received from the George Washington ROUTES PTA bearing 43 signatures of persons who wished to commend the Council for considering the instal- lation of bike routes within the City. -3- Un Minutes of November 17, 1971 continued CHAMBER OF A letter was received from Mr. Bozant Katzakian, COMMERCE - President, Lodi District Chamber of Commerce, W. TOKAY ST. stating the Chamber's Highway and Transportation Committee had conducted a study of West Tokay Street in the area between Fairmont Avenue and Virginia Avenue and had recommended the exten- sion of West Tokay Street to connect between these two streets. The Board of Directors of the Chamber endorsed the Committee's recommendation and was requesting the City Council to adopt a Specific Plan for West Tokay Street between Fairmont Avenue and Virginia Avenue and to extend this street as soon as possible. CHAMBER OF A letter was also received from Mr. Bozant Katzakian, COMMERCE - President of the Lodi District Chamber of Commerce, RE LODI AVE. recommending that a study be conducted to determine if a traffic hazard exists in the 600 and 700 block of West Lodi between the Hot Bun and the Bank of America Branch Office. On motion of Councilman Schaffer, Ehrhardt second, the Council referred the above two items to the staff for study and recommendation. AGRICULTURAL A letter was received from the San Joaquin County PRESERVE Counsel giving notice of a public hearing before the OPPOSED Board of Supervisors to consider the establishment of an agricultural preserve that would include land within one mile of the exterior boundaries of the City of Lodi (Robert Batch property). Councilman Kirsten moved the City Council protest the estab- lishment of the above agricultural preserve. The motion was seconded by Councilman Schaffer and carried by unanimous vote. LODI The City Manager presented a letter from the Lodi AMBULANCE Ambulance Service requesting a transfer of the SERVICE Operator's Permit from Lloyd, Melvin and Calvin Helwig to Michael N. Nilssen and Dennis M. Cerruti of 705 West Turner Road. . On motion of Councilman Kirsten, Schaffer second, this matter was set for public hearing on December 1, 1971. PRESIDENT'S Mr. Glaves reported he had received an invitation ECONOMIC for the City Council and the staff to be present at POLICY - PHASE II KWG Radio Station in Stockton to hear a special presentation concerning Phase II of the President's New Economic Policy. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $530, 893. 52 were approved on motion of Councilman Ehrhardt, Schaffer second. -4- -a*4 Minutes of November 17, 1971 continued BIKE The City Council, on motion of Councilman Ehrhardt, ROUTES Schaffer second, unanimously adopted the bike routes APPROVED as proposed by the Lodi Bicycle Coalition and rec- ommended oy the Public Works Director in his report "Bicycle Routes Report" dated November 17, 1971, and approved a supplemental allocation in the amount of $1410 to provide funding for the installation of the appropriate signs for the bike routes. REPORT - RE City Manager Glaves presented a traffic survey of CALAVERAS - Lockeford and Calaveras Street, dated November LOCKEFORD ST. 16, 1971, which had been prepared by the Public Works Director in response to requests for a cross- walk at this location. A copy of this report had been received by the Council prior to this meeting. The report indicated that no crosswalk should be installed at this location since this would not be safe for pedestrian use. The City Manager recom- mended a crosswalk not be installed. Councilman Ehrhardt commended the staff on the report and said he agreed with the recommendation. He again requested the staff to investigate the possibility of establishing a safe route to schools. Mr. Leland Mounce, 530 Calaveras Street, who is president of the Lawrence School PTA, stated the parents in the area of Lawrence School would like a walkway across the railroad tracks at the Calaveras and Lockeford Street intersection for the convenience of the school children attending Lawrence School. He also asked if Calaveras Street could be extended across the railroad tracks. The City Manager and the City Attorney advised Mr. Mounce that this matter should be taken up with the Southern Pacific Transportation Company and the Public Utilities Commission. -5- Councilman Schaffer then moved the traffic survey of Lockeford and Calaveras Streets, as submitted, oe accepted and approved by the Council. The motion was seconded by Councilman Kirsten and carried by unanimous vote. TINDELL ADDN City Manager Glaves reported that annexation of WITHDRAWN the Tindell Addition had been completed and the FROM WRCFPD Addition should now be withdrawn from the Woodbridge Rural Fire District. Councilman Kirsten then moved RES. NO. 3567 the adoption of Resolution No. 3567 withdrawing the Tindell Addition from the Woodbridge Rural County Fire Protection District. The motion was seconded by Councilman Schaffer and carried unani- mously. -5- 3-55 Minutes of November 17, 1971 continued AWARD - The City Manager presented bids received for the 14.4 -KV 14.4 -KV oil circuit breaker for the Utilities Depart - OIL CIRCUIT ment as follows: BREAKER and authorized the Public Works Director to file Base Bid Alternate RES. NO. 3568 On motion of Councilman Schaffer, Ehrhardt second, STORM DRAINS Graybar Electric Co. $ 8,783.25 I -T -E Power Equipment 10, 935.75 10,473. 15 Westinghouse Electric -0- 8, 393.70 Mr. Glaves recommended the award be made to the ACCEPT low bidder, Graypar Electric Company. On motion MISCL STORM of Councilman Kirsten, Hughes second, the Council DRAINS - 1971 adopted Resolution No. 3568 awarding the bid for the furnishing of the 14.4 -KV oil circuit breaker to Graybar Electric Company for a total of $6,783.25. SPECS - On motion )f Councilman Schaffer, Ehrhardt second, DUMP TRUCK the City Council approved specifications for a one - ton dump truck and authorized advertising for bids thereon. AWARD - COUNCIL Only one bid was received for the remodeling of the CHAMBERS Council Chambers. The bid was from T.A. Molfino REMODELING for an amount of $10, 900.40. The City Manager recommended the award be made to Mr. Molfino. RES. NO. 3569 On motion of Councilman Kirsten, Ehrhardt second, the Council adopted Resolution No. 3569 awarding the contract for the remodeling of the Council Chambers to T. A. Molfino for the amount of the bid. SPECS - BRUSH The City Council approved specifications and authorized CHIPPER advertising for oids for a brush chipper for the Public Works Department on motion of Councilman Kirsten, Ehrhardt second. ACCEPT KOFU On motion of Councilman Kirsten, Ehrhardt second, PARK - MSC the City Council accepted the Kofu Park -Municipal PARKING LOT Service Center Parking Lot Improvements as complete and authorized the Public Works Director to file the Notice of Completion on the project. ACCEPT MSC On motion of Councilman Schaffer, Ehrhardt second, STORM DRAINS the Council accepted the Municipal Service Center Storm Drains as complete and authorized the Public Works Director to file the Notice of Completion on the project. ACCEPT On motion of Councilman Hughes, Schaffer second, MISCL STORM the Council accepted the Miscellaneous Storm Drains - DRAINS - 1971 1971 as complete and authorized the Public Works Director to file the Notice of Completion on the project. GINKO TREES Councilman Schaffer stated he had again received a request from the Masonic Temple for permission to remove two of the ginko trees from the front of -6- 866 Minutes of November 17, 1971 continued ORDINANCES SPECIFIC PLAN - ORDINANCE NO. 964, entitled, "AN ORDINANCE S. HUTCHINS ST. ADOPTING A SPECIFIC PLAN FOR SOUTH HUTCHINS STREET BETWEEN WEST KETTLEMAN LANE AND ORD. NO. 964 WEST HARNEY LANE, " having been introduced at ADOPTED a regular meeting on November 3, 1971 was brought up for passage on motion of Councilman Kirsten, Ehrhardt second. Second reading was omitted after reading by title and the ordinance was then passed, adopted and ordered to print by the following vote: Ayes: Councilmen - Ehrhardt, Hughes, Kirsten, Schaffer and Katnich Noes: Councilmen - None Absent: Councilmen - None ADDENDUM CROSSWALK The City Manager presented each of the Councilmen STUDY - CITY with a copy of a pedestrian crosswalk study prepared OF SAN DIEGO by the City of San Diego. He explained that the study was undertaken as part of a federal safety grant program, and felt the Council might find it of some interest. LAFCO Councilman Ehrhardt reported he vzould oe attending the Local Agency Formation Commission's Annual Conference in Monterey on November 18 and 19 on behalf of the City. FEEA The City Manager reported that all twelve positions approved under the Federal Emergency Employment Act had been filled by the Citi•. -7- their property at 315 West Pine Street. NO. 3570 adjacent property for limited major streets both with and without frontage roads. Mr. Glaves recommended adoption of the resolution. On motion of Councilman Kirsten, Ehrhardt second, the City Council adopted Resolution No. 3570 entitled "Limited Access Major Arterial_ Street Policy."
