HomeMy WebLinkAboutMinutes - April 28, 1971CITY COUNCIL, CITY OF LODI C:TY HALL COUNCIL CHAMBERS APRIL 28, 1971 An adjourned regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, April 28, 1971 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - HUGHES, KIRSTEN, SCHAFFER, and KATNICH (Mayor) Absent: Councilmen - EHRHARDT Also present: Assistant City Manager Peterson PLEDGE Mayor Katnich led the Pledge of Allegiance to the flag. LEGISLATION Assistant City Manager Tom Peterson explained that the meeting of April 21 had been adjourned to this date for the purpose of reviewing current proposed state legis- lation. He then presented the following Assembly and Senate bills for Council review. SB 333 Senate Bill 333 (Dills) --- Compulsory and Binding Arbitration. Policemen and Firemen. This bili provides for compulsory and binding arbitration of wages, hours, pens ions and all other terms and conditions of employ- ment of policemen and firemen. At the Council meeting of April 21, 1971 the City Council adopted a resolution vigorously opposing this bill and both Senator Short and Assemblyman Monagan were notified of this action. Mayor Katnich stated he would send a tele- gramto Senator Short again expressing the Council's opposition to the bill . AB 1208 Assembly Bill 1208 (Townsend) --- Gas Tax Expenditure Limitations Restored. This would nullify the 1970 legislation sponsored by the League of California Cities which gave almost full discretion to local officials on the use of City gas tax funds. Councilman Kirsten moved that a letter be sent to Assemblyman Monagan to express the Council's opposition to passage of AB 1208. The motion was seconded by Councilman Schaffer and carried by unanimous rote. AB 813 Assembly Bill 813 (Knox) --- Uniform City Annexation Act. This would provide for a comprehensive revision of California's annexation laws. It provides for council initiation of annexation proceedings of inhabited territory and it facilitates initiation of annexation proceedings by petition but retains the right of a majority of owners and voters to defeat an annexation. Consent of a city would not be required to annexation.proceedings. After discussion of the above bill, Councilman Hughes moved the Council oppose the consent clause included in the bill and requested the City staff to notify the League of California Cities Board of Directors of this opposition. •IA&I Minutes of April 28, 1971 continued The motion was seconded by Councilman Schaffer and carr:ed'by unanimous vote. AB 429 Assembly Bill 429 (Quimby) --- Insuring Policemen Against Punitive Damages. This would require local agencies including cities, to insure policemen against liability arising from acts within the scope of their employment even though such acts may have been wilful and malicious and even though punitive damages are awarded because such acts were wilful and malicious. Councilman Kirsten moved the City Council oppose this bill and that the appropriate legislators be advised of this action. The motion was seconded by Mayor Katnich and carried by unanimous vote. SB 534 Senate Bill 534 (Alquist) - -- State Registration of SB 624 Building Inspectors. Provides for the registration of construction inspectors by the State Board of Archi- tecture within standards established by a Registered Construction Advisory Committee. Journeyman experience in the trades is a requirement for such registration. Senate Bill 624 (Carrell) --- Requirement of Civil Engineering Degree for Building Inspectors. Councilman Schaffer moved the Council oppose both SB 534 and SB 624. The motion was seconded by Councilman Kirsten and carried by unanimous vote. AB 1107 Assembly Bill 1107 (B. Greene) --- Indirectly Authorize Public Employees to Engage in "Concerted Activities." This bill would indirectly authorize public employees to engage in concerted activities for the purpose of collective bargaining or other mutual aid for protection. The Council took no action on AB 1107. AB 1190 Assembly Biil 1190 (Karabian) --- Expenses of Printing Candidates' Statement of Qualifications. Pro- vides that the cost of printing and handling statements of candidates' qualifications be paid by public agencies as a part of the cost of conducting an election rather than by the candidates. On motion of Councilman Schaffer, Hughes second, the City Council supported enactment of Assembly Bill 1190. AB 52 Assembly Bill 52 (Thomas) --- Zoning or other Permits. Compensation for Dedication. This bill pro- vides that a city shall not require a property owner, as a condition of granting a zoning variance, a conditional use permit or other permit, or an exception, to dedi- cate all or a portion of his property to the city for street widening purposes, without paying compensation for such property. Mr. Peterson reported that City Manager Glaves had corresponded with the appropriate legislators - 2 - Minutes of April 28, 1971 continued concerning the above bill and recommended its defeat. The Council took no action on the bill. SB 489 Senate Bill 489 (Coombs) --- Zoning and Use Permits. Prohibited Conditions. This bill would prohibit a county or city from conditioning the issuance of a use permit or zone variance on (a) the approval of any other govern- mental body or regulatory agency, (b) the dedication of land for any purpose not directly related to the improve- ment or structure for which the variance or use permit is requested, or (c) the posting of a bond to guarantee installation of street improvements not directly related to the variance or use permit. Mr. Peterson said City Manager Glaves had also corre- sponded with legislators concerning SB 489 and recom- mended its defeat. The Council took no action on the bill. AB 263 Assembly Bill 263 (Warren) --- Tax Override for General Law Cities. A permissive measure which would authorize the city council to exceed the dollar limit by whatever rate is required to pay all of the costs of police and fire protection, including but not limited to wages, hours and fringe benefits. Councilman Hughes moved the City Council oppose enact- ment of Assembly Bill 263. The motion was seconded by Councilman Schaffer and carried by unanimous vote. SB 299 Senate Bill 299 (Carrell) --- Earthquake Relief. Public Highways. The bill would increase the Motor Vehicle Fuel License Tax and the Use Fuel Tax from 7� to 8fi per gallon to finance repair, restoration, or replace- ment of public highways that were damaged or destroyed by earthquakes, and conditions resulting therefrom occurring between February 8, 1971 and May 8, 1971. The Council took no action on this bill. AB 634 Assembly Bill 634 (Dunlop) --- Housing Authorities. Required in Every City. This bill would require rather than permit the governing bodies of counties and cities to determine that there is need for a housing authority to function within such counties and cities. On motion of Councilman Schaffer, Hughes second, the Council opposed passage of Assembly Bill 634. SB 118 Senate Bill 118 (Nejedly) SB 213 Senate Bill 213 (Petris) AB 163 Assembly Bill 163 (Fong) -- All concerned With Litter Prevention: Bottles and Cans. The Council took no action on these three bills. - 3 - 24a Minutes of April 28, 1971 continued PUC Public Utilities Rule Changes --- Would prohibit RULE anyone other than an attorney from representing a CHANGE person, public or private corporation or association before the State Public Utilities Commission. The Council took no action on this matter. ADDENDUM SCOUT An invitation was received for the City Council to EXPOSITION attend and participate in the Boy Scouts Exposition, Fun Fair and parade to be held Saturday, May 1, 1971. TEACHER OF Mayor Walter Katnich introduced Mrs. Norma Gates, THE YEAR - who last year was named, "Teacher of the Year" in N. GATES the State of California. On motion of Councilman Schaffer, Kirsten second, the City Council adopted a resolution of commendation to be presented to Mrs. Gates in recognition of this award. COUNCIL Councilman Kirsten questioned the progress being made CHAMBERS on the light installation in the Council Chambers. He also REMODELING requested the City staff to study the podium in the San Joaquin County Supervisors' board room to determine if the same design could be used in the Council Chambers. Councilman Kirsten also asked the staff to determine if the Council table could be elevated approximately 12 inches and arranged in a semi -circular position.
