HomeMy WebLinkAboutMinutes - April 7, 1971CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS APRIL 7, 1971 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p. m. on Wednesday, April 7, 1971 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - HUGHES, KATNICH, KIRSTEN and SCHAFFER (Mayor) Absent: Councilmen - EHRHARDT Also present: City Manager Glaves, Assistant City Manager Peterson, City Attorney Mullen, Planning Director Schroeder and Public Works Director Jones. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. MINUTES On motion of Councilman Kirsten, Katnich second, the Minutes of March 24, 1971 were approved as written and mailed. PUBLIC HEARINGS REZONE E. Notice thereof having been published in accordance SIDE CRESCENT with law, Mayor Schaffer called for the public AVE TO R-2 hearing on the recommendation of the Planning Commission to r ezone all parcels on the east side ORD. NO. 946 of Crescent Avenue between West Locust Street and INTRODUCED West Lodi Avenue from the R -MD, Medium Density Multiple -Family Residential District, to the R-2, Single -Family Residential District. Planning Director Schroeder introduced the matter by presenting a drawing of the area proposed for rezoning. The following persons spoke in favor of the rezoning: Mr. Dennis Shepherd, 126 South Crescent Avenue Mr. Fred Spiekerman, 131 South Crescent Avenue Mrs. Beatrice Garibaldi, 136 South Crescent Avenue There being no other persons in the audience wishing to speak either in favor or against the proposal, the public portion of the hearing was closed. On motion of Councilman Kirsten, Hughes second, the City Council introduced Ordinance No. 946 rezoning all parcels on the east side of Crescent Avenue between West Locust Street and West Lodi Avenue to be in the R-2 District. - 1 - Minutes of April 7, 1971 continued REZONE 116 Notice thereof having been published in accordance N. NO. 947 North Pleasant Avenue from the R -HD, High INTRODUCED Density Multiple -Family Residential District, to the C-2, General Commercial District. Planning Director Schroeder gave a background of the Planning Commission's recommendation for rezoning and presented a drawing of the parcel. There was no one in the audience who wished to speak either in favor or against the proposal and the public portion of the hearing was closed. Councilman Kirsten then moved introduction of Ordinance No. .947 rezoning a parcel located at 116 North Pleasant Avenue to be in the C-2, General - Commercial District. The motion was seconded by Mayor Schaffer and carried by unanimous vote. AMEND CODE Notice thereof having been published in accordance TO INCLUDE with law, Mayor Schaffer called for the public SMALL THEATERS hearing on the recommendation of the Planning IN C -S DISTRICT Commission to amend, Section 27-9A (C -S, Com- mercial Shopping District) of the Code of the City _ ORD. NO. 948 of Lodi to include "Theaters with a maximum INTRODUCED seating capacity of 400" in the Uses Permitted section. City Manager Glaves stated that interest had been expressed in placing a small theater in the Lakewood Shopping Center. He explained that if the ordinance were amended to permit a theater of a maximum seating capacity of 400 in the C -S District, this would liberalize the uses in a shopping center somewhat, but should still provide sufficient control to avoid destroying the concept of a neighborhood center. There being no persons in the audience wishing to speak on the matter, the public portion of the hearing was closed. On motion of Councilman Katnich, Hughes second, the Council introduced Ordinance No. 948 amending Section 27-9A of the Code of the City of Lodi to include "Theaters with a maximum seating capacity of 400" in the Uses Permitted section. DRUG ABUSE - Mr. Joe Capobianco, 458 West Sargent Road, addressed J. CAPOBIANCO the Council concerning the "People in Christ" drug program. He explained his program and said it had been in effect for approximately six months. He requested the Council to officially recognize this program as a drug abuse program. -2- 26 Minutes of April 7, 1971 continued Mr. Phil Napper, 1420 North California Street, Stockton, discussed a drug abuse program he is involved in Stockton which is sponsored by a group called "Friends. " Mrs. Marilyn Goehring, 1913 Ayers Avenue, stated there was a definite need for a drug abuse program in the City, and she felt it was time for the various groups to work together to develop a suitable program. The Council asked questions of Mr. Capobianco and Mayor Schaffer concluded the discussion by stating that the City Council had recognized there does exist a drug problem in Lodi. He pointed out that the City Council has endorsed the Lodi Area Behavior Deterioration and Drug Abuse Council; the purpose of this Drug Abuse Council is to coordinate all drug programs in the community. He explained that the Council had not endorsed any specific drug program and it was not in a position to do so since the Lodi Area Behavior and Drug Abuse Council had been approved as the official body to coordinate the drug programs. He then suggested that Mr. Capobianco present his program to the Drug Abuse Council for its consideration. The Mayor also requested the staff to keep the City Council informed of the progress being made by the Lodi Area Behavior Deterioration and Drug Abuse Council. COMMUNICATIONS ABC LICENSE Notices of Application for Alcoholic Beverage License were received as folLows: 1. Les Clayton, The Parking Lot, Z 1Z West Kettleman Lane, on -sale beer, new license. r -3- 2. Albertson's, Inc., 340 West Kettleman Lane, off -sale general, person-to-person transfer. APPEAL - A Letter was read from Attorney Laurence E. H. `irILSON Drivon, on behalf of Mr. and Mrs. Howard Wilson, appealing the decision of the Planning Commission ., in denying their request for a change in zoning from the R-2, Single -Family Residential District, to the R -GA, Residential -Garden Apartment District, for a parcel located at the southwest corner'of West Turner Road and Parkview Avenue. On motion of Councilman Kirsten, Katnich second, the matter was set for public hearing on May 5, 1971. CVDLCC A notice was read of a quarterly dinner meeting QUARTERLY of the Central Valley Division of the League of MEETING California Cities to be held in Gustine on April 29, 1971. r -3- Minutes of April 7, 1971 continued CITY REVENUE City Manager Glaves announced that an invitation SHARING had been received for the Mayor and Councilmen to meet with _ _ M Z' Jess Unruh, who is 16 co-chairman of the Cities Revenue Sharing Com- mittee, on Monday, April 12 at 11:15 a.m. at the Lodi News -Sentinel office. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $958,665.66 were approved on motion of Councilman Kirsten, Katnich second. AWARD - 12 KV The City Manager presented bids received for TRANSFORMERS the 12KV overhead and pad -mount distribution transformers as follows: RES. NO. 3500 Federal Pacific Electric $ 6,822.90 Pruzan Company 12, 028. 64 Edwards & Gregory Company 12, 141. 15 Valley Electric Company 12, 584. 09 Westinghouse Supply Company 14, 783.41 R.T.E. Graybar lectric any ' Mr. Glaves explained that some bids received were incomplete in that the supplier did not bid on all items. Also, he pointed out that a savings of $1, 118.71 could be realized by awarding the contract to two different suppliers rather than one. He recommended the contract for the furnishing of the pole -mount type transformers be awarded to Consolidated Electric Company for a total of $11,753.70 and the contract for the furnishing of the pad -mount type transformers be awarded to R. T.E. Corporation for a total of $1,911.00. On motion of Councilman Hughes, Kirsten second, the Council adopted Reso- lution No. 3500 awarding the contract for the furnishing of the IZKV overhead and pad -mount distribution transformers as recommended by the City Manager. TREES - On motion of Mayor Schaffer, Councilman Kirsten REMOVAL BY second, the Council approved the request of the FESTIVAL Lodi Grape Festival Board to remove four walnut APPROVED trees in the Lockeford Street frontage of the Festival grounds; said removal to be at the expense of the Lodi Grape Festival. The Council agreed that appro- priate shrubbery should be planted in the semi -circle in front of the Festival entrance gate on Lockeford Street. ACCEPT CENTURY On motion of Councilman Kirsten, Katnich second, the BOULEVARD & W. Council accepted the Century Boulevard and West LANE SAN SEWER Lane Sanitary Sewer and Storm Drain improvements as complete and authorized the Public Works Director to file a Notice of Completion on the project. -4- ?A.6 Minutes of April 7, 1971 continued DEFENSIVE The City Manager reported that a course in defensive DRIVING driving prepared by the National Safety Council COURSE had recently been given to all City employees. He commended the following six employees who served as instructors for the course: Floyd Williams, Don MacLeod, Leyland Lourdeau, Kenneth De Walt, Lester Schlabs and Vernon Aman. PLANS & SPECS - On motion of Councilman Kirsten, Katnich second, KOFU PARK the Council approved plans and specifications for CURB AND the Kofu Park concrete curbing and walkways and WALKWAYS authorized advertising for bids thereon. COUNCIL Mayor Schaffer requested that the reorganization REORGANIZATION of the City Council be delayed until the next regular DELAYED meeting on April 21, 1971. He explained that Councilman Ehrhardt was out of town, and he felt the entire Council should be present for the reor- ganization. On motion of Councilman Kirsten, Hughes second, the Council agreed to postpone the reorganization of the City Council until the meeting of April 21, 1971. KIRSTEN - Councilman Kirsten, who is chairman of the Cities C & C OF SJA and County of San Joaquin Association, announced MEETING there would be a discussion concerning the future of the San Joaquin Local Health District at the Association's meeting on April 8, 1971. He urged the Councilmen to attend this meeting. REMODEL Councilman Kirsten said some modest improvements COUNCIL should be made to the Council Chambers immediately. CHAMBERS He requested the City Manager to determine the light level in the Chambers and to inform the Council of this at the next regular meeting. He also requested the Council Chambers be painted and a new podium and new sound system be installed. City Manager Glaves stated the staff is presently preparing information concerning remodeling of the Council Chambers for presentation to the Council. ORDINANCES REZONE 1401 WEST ORDINANCE NO. 945 entitled, "AMENDING THE LOCKEFORD ST. OFFICIAL DISTRICT MAP OF THE CITY OF LODI TO R -GA DIST. AND THEREBY REZONING A PARCEL LOCATED AT 1401 WEST LOCKEFORD STREET TO BE IN ORD. NO. 945 THE R -GA, RESIDENTIAL -GARDEN APARTMENT ADOPTED DISTRICT," having been introduced at an adjourned regular meeting March 24, 1971, was brought up - for passage on motion of Councilman Kirsten, Katnich second.
