HomeMy WebLinkAboutMinutes - August 16, 1972M CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS AUGUST 16, 1972 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, August 16, 1972, in the City Hall Council Chambers. ROLL CALL Present: Councilmen - KATNICH, PINKERTON, SCHAFFER & EHRHARDT (Mayor) Absent: Councilmen - HUGHES Also present: City Manager Glaves, City Attorney Mullen, Public Works Director Jones and -Planning Director Schroeder. INVOCATION The invocation was given by Mayor Ehrhardt. MINUTES The Minutes of July 19, 1972, were approved as written and mailed on motion of Councilman Katnich, Schaffer second. On motion of Councilman Schaffer, Katnich second, the Minutes of July 26, 1972, were approved as written and mailed. On motion of Councilman Schaffer, Pinkerton second, the Minutes of July 28, 1972, were approved as written and mailed. PRESENTATIONS EXPLORER Police Chief Marc Yates introduced members and P.O.S. T. sponsors of the Lodi Police Department Explorer P. O• S. T. who were in the audience. Chief Yates explained this group was recently organized and consists of some thirty young people between the ages of 14 and 21. The sponsors are employees of the Police Department, NISEI CIVIC Recreation and Parks Director Ed DeBenedetti SOCIETY - introduced Mr. Ed Tanaka and Mr. Mas Okahara KOFU PARK who were in the audience and representing the SHADE Lodi Nisei Civic Society. STRUCTURE APPROVED Mr. Tanaka presented to the Council a proposal for construction of a shade structure over the seats at Kofu Park baseball diamond. He said the proposal had met with the approval of the Recreation Com- mission. He said the total estimated cost of the project was $3, 000. Mr. Tanaka said the Nisei Civic Society proposed to contribute $2, 000 for the cost of materials for the structure and suggested the remaining costs for labor be provided by the Parks Department. W Minutes of August 16, 1972, continued Councilman Schaffer moved the Council go on record accepting the proposal as presented. The motion was seconded by Councilman Pinkerton and carried by unanimous vote. LODI HOUSE Mr. Jed Diamond, Coordinator of the San Joaquin REQUEST County Office of Drug Abuse, addressed the Council ..� ( requesting a financial contribution from the City of Lodi to the San Joaquin County Coordinated Drug Abuse Plan. He said the requested funds would be used for the support of the Lodi House, The request was for leo of the law enforcement budget of the City of Lodi which would be $6, 241, Mr. Thomas Bandelin, President. of the Board of Directors of Lodi House, was in the audience and spoke in support of the request. Mr. Bandelin answered questions of the Council concerning the Lodi House staff. Councilman Pinkerton questioned if the Lodi Unified School District was carrying out a drug abuse pro- gram in the school system. Mr, Bandelin explained that Lodi House programs were intended to only sup- plement whatever drug education was being offered in the schools. Miss Arlene Ackerman, Director of Lodi House, dis- cussed its activities stating it was involved in family assistance referral service, crisis intervention and community education. She answered questions of the Council concerning her background and education. Police Chief Marcus Yates was in the audience and was asked if the Police Department called upon Lodi House for assistance. Police Chief Yates responded that the Department had made referrals to Lodi House. After discussion, Councilman Schaffer moved dis- cussion of the request for funds from the City of Lodi for support of Lodi House be continued to the meeting of September 6, 1972. The motion was seconded by Councilman Katnich and carried. PUBLIC HEARINGS SPECIFIC PLAN - Notice thereof having been published in accordance TOKAY STREET with law and affidavit of publication being on file in BTWN S. FAIRMONT the office of the City Clerk, Mayor Ehrhardt called & VIRGINIA AVE. for the public hearing on the recommendation of the Planning Commission to adopt a Specific Plan for RES. Mr. Sam Sala s, i 19 North Avera Attorney Stewart Adams, i21 West Pine Street, representing the estate of Ada Hutchins, Attorney Robert K, Ellictt, Z28 West Pine Street, representing Mrs, Martie Smith and Niro., Eva Sturia, spoke in opposition to the proposal, „1r. Elliott said the proposed extension of Tokay Street would have an adverse affect on his clients' property and he felt it did not agree kvith the. General Plan. He pointed out if the street is developed as proposed, his clients' property would decrease in value since it would be necessary to develop it in lour different parcels. There being no other persons in the audience .vishing to speak on the matter, the public portion of the hear- ing was closed. After discussion, on motion of Councilman Schaffer, Pinkerton second, the Coun.il adopted Resolution No. 3665 recommending a Specific Plan for Lower. Approved the Tentative �NIap of the H:xson Tract, an approximate 2 -acre, 10 -lot subdivision on the south side of West Tokay Street at Alto Way with certain conditions. 2. Approved the request of ti1r . Kenneth Lane for a Variance to reduce the front yard from 20 feet to 18 feet to permit the erection of upright supports for a roof over a front porch at 833 Holly Drive in an area zoned R-2, Single -Family Residential. 3. Approved the request of 141r. R. Rudy Wright for a Variance to reduce the street side yard from 10 feet to 5 feet to permit a swimrnin.g pool cabana to remain at 2333 Oxford Way in an area zoned R-2, Single -Family Residential. 4. Recommended the approval to the San Joaquin County Board of Zoning Adjustment of the request of Mr. William Sandeen for a Use Permit for tnobilehome sales within an existing Mobilehome Park at the northeast corner of East Woodbridge Road and the U. S. 50-99 Freeway- in an area zoned C-2, Commercial and I -PA, Interim - Protected Agricultural. 5. Recommended the approval to the San Joaquin County Board of Zoning Adjustment of the request of Bailey's Nursery, Inc. , for a Use Permit for the construction of three green houses at an existing plant nursery- on the West side of Wells Lane from 640 feet to 960 feet north of Harney Lane in an area zoned I -PA, Interim -Protected Agricultural. Recommended the denial to the San Joaquin County Board of Zoning Adjustment of the request cf Douglas Oil Company of a Use Permit to erect an automobile service station at the southeast cornea of Lower Sacramento Read and Kettleman Lane (Highway 12) in an area zoned I -PA, Interim - Protected Agricultural because of the following guidelines concerning commercial development at the corner of two major streets; a. Commercial development shouid consist of a shopping center and should be limited to one corner of an intersection; and b. When a service station is proposed as part of a shopping center, it shall be included as part of the second or later stage of develop- ment. This assures the City that something more than a service station wit! be developed. Councilman Schaffer moved the request be approved subject to ( 1, execution of the City's standard agreement, and (2) appre-ral of that agreement by the City Attorney, and (3) said agreement to be recorded with the County Recorder. The motion was seconded by Councilman. Councilman Schaffer moved that �:layor Ehrhardt be designated as the City's voting delegate and Mayor Hughes the alternate voting delegate. The motion vias seconded by Councilman Fink..�rt,:z_ and carried by unanimous vote. CCCJ GRANT On motion of Councilman Schaffer, Pinkert:;. r:cond, RES. NO. 3666 the City Council adopted Resolution No, S: r_6 cew- C questing second -year funding of the Grant for Z California Council on Criminal Justi:e Pianai_ .-, and Development Project. QUONSET City Manager Claves explained that the C: -y had HUT USE previously received requests from the Ecology C.0 L Action group and Junior Achievement of Lod'., Lnc. for permission to use the City -owned quonse; rut located on North Stockton Street. He reported that the two groups had worked out an arrann­ment whereby both groups could use the facility. He said arrangements had been ;nada 'c. - the lapidary group to use a portion of the Bey Sco= building and this was agreeable with the Sc^onl District. -5- 41 Minutes of August 16, 1972, continued The Council then authorized, on motion cf Council- man Schaffer, Katnich second, the use of the Quonset Hut by the Ecology Action group and Junicr Achieve- ment of Lodi, Inc. as outlined by the City Manager, 1972-73 CAPITAL The City Manager presented the proposed 1972-73 IMPROVEMENT & Capital Improvement and Ut;.lity Outlay Budget for UTILITY OUTLAY Council review. The Council reviewed and discussed BUDGET the proposed budget. On motion of Councilman Katnich, Schaffer second, the Council introduced ORD. NO. 981 Ordinance No. 981 adopting the Capital Improvement C! PLANS & SPECS - On motion of Councilman Schaffer, Pinkerton second, RECONSTRUCT the City Council approved plans and specifications VINE STREET for reconstruction of Vine Street from Mills Avenue to Ham Lane and authorized advertising for bids thereon. ORDINANCES REZONE 8 ACRES ORDINANCE NO. 980, entitled, "AN ORDINANCE N OF ALMOND DR. AMENDING THE OFFICIAL DISTRICT M,;P OF THE W OF CHEROKEE CITY OF LODI AND THEREBY REZONING AN TO R -HID DISTRICT APPROXIMATE 8 -ACRE PARCEL ON THE NORTH SIDE OF ALMOND DRIVE BETWEEN 657, 60 FEET O :D. NO. 980 AND 1030 FEET WEST OF THE CENTERLINE OF ADOPTED CHEROKEE LANE TO BE IN THE R -HD, HIGH DENSITY, MULTIPLE -FAMILY RESIDENTIAL DISTRICT,'' having been introduced at a regular meeting on August 2, 1972, was brought up for passage on motion of Councilman Katnich, Schaffer second.
