CITY HALL COUNCIL CHAMBERS
AUGUST 2, 1972
A regular meeting of the City Council of the City of Lodi was held beginning
at 8:00 p.m. on Wednesday, August 2, 1972, in the City Hall Council Chambers.

INVOCATION The invocation was given by Mayor Ehrhardt.
PLEDGE Mayor Ehrhardt led the Pledge of Allegiance to the
flag.

Notice thereof having been published in accordance
with law and affidavit of publication being on file in
the office of the City Clerk, Mayor Ehrhardt called
for the public hearing on the recommendation of the
Planning Commission to approve the request of
Mobile Park Properties, Inc. by Mr. Edwin Colledge
for a change in zoning from the R- 1, Single -Family
Residential District to the R -HD, High Density,
Multiple -Family Residential District for an approxi-
mate 8 -acre parcel on the north side of Almond
Drive between 657. 60 feet and 1030 feet west of the
centerline of Cherokee Lane. Planning Director
Schroeder introduced the matter and presented a
drawing of the area proposed for rezoning.
Mr. Edwin Colledge, representing Mobile Park
Properties, Inc., spoke in favor of the proposed
rezoning stating the proposed development would be
an asset to the City of Lodi.
There being no otner persons in the audience wish-
ing to speak on the matter, the public portion of the
hearing was closed.
After Council discussion, Councilman Katnich moved
the Introduction of Ordinance No, 980 rezoning an
approximate 8 -acre parcel on the north side of
Almond Drive between 657. 60 feet and 1030 feet
west of the centerline of Cherokee Lane to be in the
R -HD, High Density, Multiple -Family Residential
District. Ihe•motion was seconded by Councilman
Hughes and carried by unanimous vote.

PLANNING COMMISSION
The City Manager gave the following report of the
Planning Commission meEt_ng of Tu',_ = 7.972:
SPECIFIC PLAN - The Planning Commission recorn_r:ended the
L. SACTO. RD. adoption of a Specific Plan for Low—, Sacramento
Road between `Vest Lodi Avenue and Kettleman
Lane. On motion of Councilman Schaffer, Katnich
second, the matter was scheduled for oublic hear-
ing on August 16, 1972.
SPECIFIC PLAN - The Planning Commission also recommended the
E. VINE S.F. adoption of a Specific Plan for East Vire Street
between. Garfield Street and Cherokee Lane. On
motion. of Councilman Katnich, Schaffer second,
the matter was scheduled for public hearing on
September 6, 1972.
ACTIONS OF The Planning Commission also took rhe following
INTEREST actions of interest to the City Council:
Continued until its Regular Meeting, August 14,
1972, consideration of the Hixon. Tract - an
approximately 2 -acre subdivision on the south
side of West Tokay Street at Alto Way.
Continued until a specially -scheduled meeting
on July 31, 1972, consideration of EL PORTAL,
THE VINEYARD, and DELTA PACIFIC TRACTS
an approximately 81 -acre subdivision located -
on the east side of South Hutchins Street across
from English Oaks Manor and consisting of
221 single family lots, 64 duple: lots, =7 four-
piex lots, and 1 multiple family lot.
3. Approved the request of far. Frank Alegre for
a Use Permit for a 10 -foot by 60 -foot mobiie-
home which has been converted into an office
to be temporarily located at the site of a truck
yard located at 720 East Lodi Avenue in an
area zoned C-2, General Commercial District,
with certain conditions.
Recommended that the San Joaquin Coa:_ty
Planning Cornmission deny the request of
Mr. Donald R. Faszer for a change in zoning
from the I -PA, Interim -Protected Agriculcure
District to the M- 1, Industrial District for an
approximately 5 -acre parcel on the south side
of Kettleman Lane, from 660-.fe;:t to 836 -feet
east of Stockton Street and extending 353 feet
to the south, south of Lodi.
In making this recon mar_darion, the Commission
determined that the entire area bounded by
Kettleniar_ Lane, Cherokee Lane, Almond Drive,
and Stockton Street should be studied in depth
prior to perm'_tting a zoning cha^ge which would
have significant impact on the area in the future.

"T,dT _'FS of the Planning Commission meeting of July 3 i,
1972: The Planning Commission approved the
Revised Tentative Map cs El Portal, The Vine•.ard
and The Valley (formerly Delta -pacific` Subdivisions
which comprise an 81 -acre parcel at the northeast
corner of Harney Lane and Sou•h Hutchins Street
with certain conditions.
COMMUNICATIONS
ABC LICENSE Applications for alcoholic beverage license were
received as follows:
1. John B. Girard, Pastime Club, Z5 North
Sacramento Street, on -sale beer, new license.
2. Bert Ca.stelar_eili, et al, Mike's Texaco, 500
West Lodi Avenue, off -sale beer and wine, new
license.
JR. ACHIEVEMENT The City Clerk read a letter received from Dr. C.
RE QUONSET HUT Robert Breckenridge, President of the Junior Achieve -
CC - Lo ment of Lodi, Inc., requesting that organization be
<A-) granted use of the Quonset Hut on g= Stockton Street.
The organization proposed to rent the building for $30
per month and to refurbish the facility, at its expense.

A letter was also read from Mrs. Ruth Wright,

A letter was received from the Lodi Sportsman's
SPORTSMAN'S
Club requesting access rights to its property located
CLUB
on the Mokelumne River. City Manager Glaves ex-
plained that the property on the Mokelumne River had
been owned by the City of Lodi and the County of
San Joaquin and had been used as a dump. The
County sold their property to the Sportsman's Club
and the only access to the property was a roadway
adjacent to the Southern Pacific Railroad tracks.
City Attorney Mullen stated he had requested the
Sportsman's Club to furnish a copy of their deed
to determine if they presently have access rights
to the property.
The Council referred the request to the City staff
for study and recomm,-ndation.

be made to the low bidder, Communications Con-
struction and Excavating Company.
On motion of Councilman Katnich, Schaffer second,
the Council adopted Resolution No. 3661 awarding
the contract for the Turner Road duct and precast
vault to Communications Construction and Excavat-
ing Company for a total amount of $11, 845. 00.
AWARD - Mr. Glaves presented bids received for the demo -

the Council adopted Resolution No. 3662 awarding
the demolition of the dwelling unit at 324 1/2 Louie
Avenue to World Enterprises for a total amount of
$430.00.
VACATE FOR. The City _lanager reported the Public Works
EASEMENTS Director had recommended the City Council abandon
ROYAL CREST portions of certain easements in Tract No. 791,
UNIT NO. 1 Royal Crest Unit No. 1 Subdivision. The easements
��' were dedicated to the City on October 18, 1967. The
Public Worcs Deoartment had determined there was no
present or future use for the easements.

On motion of Councilman Katnich, Schaf_`er second,
the City Council adopted Resolution No. 3660 award-
ing the above contract to Malott & Peterson -Grundy
for a total amount of $3, 587. 00.

On motion of Councilman Hughes, Pinkerton
second, the City Council adopted its Order
vacating portions of easements in Royal Crest
Unit No. 1 Subdivision.
QUONSET
The City Manager stated that at its meeting of

July 19, 1972, the City Council had received a

request from the Ecology Action, Inc. request -

ing use of the City -owned Quonset Hut located on
South Stockton Street. The Council requested the
City staff to investigate the possible use of this
facility by the Ecology Action group and to report
to the Council. Mr. Glaves reported. that a por-
tion of the building was presently being used by
a lapidary group sponsored by the Adult Division
of the Lodi Unified School District. He said interest
in usage of the facility had also been indicated by
other groups such as the Junior Achievement of
Lodi, Inc.
After Council discussion, Councilman Hughes
moved the matter be continued to the next regular
at which time the staff was directed to report on
othdr City -awned facilities which might be available
for use by interested clubs and organizations. The
motion was seconded by Councilman Katnich and
carried by unanimous vote.

dary of the Zion Reformed Church property was
received from Mr. Raymond M. Jansen, Superin-
tendent of the Lodi Unified School District. The
City Manager recommended that no action be
taken on the request until further information is
received. The Council discussed the request and
generally agreed that this street was dedicated
as a public street and it was not anxious to close
it. On motion of Councilman Schaffer, Katnich
second, the Council directed the City staff to meet
with representatives of the Lodi Unified School
District to discuss the above request.
DRUG ABUSE Councilmen Hughes and Pinkerton presented two
ORDWANCES ordinances designed to ensure that the maximum
«}G sentence permitted by law is imposed upon those
persons who, within the City of Lodi, sell, possess
for sale, transport, administer, give away or
attempt to sell, transport, administer, or give
away marijuana, norcotics or restricted dangerous
drugs. The Ordinances were directed to the Judges
of the Superior Courts of California and the District
Attorney of the State of California.
After considerable discussion of the two ordinarc es,
on motion of Councilman Schaffer, Hughes second,
the Council continued discussion of the ordinances
to the meeting of August 16, 1972.

Councilman Pinkerton suggested that a member of the
City Council and ffie Board of Supervisors be present

Councilman Hughes then moved the above recommen-
dations of the City Manager oe adopted by the City
Council and requested that a member of the City
Council and of the'Board of Supervisors be present
at future meetings of the City- and County stairs.

Supervisors 6 -•request the County to assum the
operation of the-'Rarney Lane Sanitary Land=ill. He
said the Board had taken the matter under advisement
and had requested the City to submit additional infor-
mation. A subsequent meeting was scheduled with
the County for August 18. Tne City Manager recorn-
mended the City make the following requasts of the
County:
(1) County pay 807/c of the operating costs of the
Landfill for this fiscal year,
(2) immediate discussions oetween the City and the
County staffs to discuss replacement site in
Northern San Joaquin County and pian for
County operations at earliest possible date.

At approximately 10:10 p.m. the City Council
