CITY COUNCIL, CITY OF LODI
CITY HALL COUNCIL CHAMBERS
DECEMBER 18, 1974
A regular meeting of the City Council of the City cf Lc -d., was held
beginning at 8:00 p. m. on Wednesday, December 18, i974 in the City
Hall Council Chambers.

INVOCATION The invocation was given by Councilman Ehrhardt.
PLEDGE Mayor Pinkerton led the Pledge of Allegiance to the
flag.
MINUTES On motion of Councilman Schaffer, Katnich second,
the Llinutes of December 11, 1974 were approved as
written and mailed.
PUBLIC HEARINGS
APPEAL - FOSCOE
COLLIER Notice thereof having been published in accordance
_ with law and affidavit of publication being on file in
C� S C�� office of the Citv Clerk, Mavor Pinkerton called
for the public hearing to ccnside:r the appeal of Mr.
Frscoe Collier of the action c: the Planning
Commission in denying his request for various zor.in

,;%ith kitchen at 500 Hilborn Street in an arca zoned
R -MI), Medium Density :Multiple Family Residential.
The City Clerk presented a letter which had been
received from Mr. Collier dated December 17, 1174
requesting that his appeal be withdrawn.
There were no persons in the audience w:siun, to
soeak either in favor of or in opposition to the appeal.
On motion of Councilman Schaffer, Hughes second.

Commission's actions in denying Mr. Collier's
request for various zoning variances to permit
the creation of a duplex unit, from an existing
single-family home and detached garage with
kitchen at 500 Hilborn Street, Lodi in an area
zoned R -MD, Medium Density- Multiple Family
Residential.
PUBLIC Nlavor Pinkerton called for the hearing regarding
NUISANCE & Notice of Public Nuisance and Order to Abate on
ORDER TO ABATE- property located at 11 S. Garfield Street, Lodi.

1974 regarding the structure.

4) Pictures of the structure taken January 9, 1974
There were no persons in the audience wishing to
speak on the matter.
Following discussion by the Council, on motion of
Councilman Ehrhardt, Schaffer second, Council
adopted Order No. 1 - In the Matter of the Public
Nuisance by Reason of the Maintenance of a
Structure located at 11 S. Garfield Street, ordering
the removal of said structure.
COMMt;NICATIONS
CLAIM A Claim filed on behalf of Harold W. Vanderzanden,
10329 Childress Road, Stockton, California, for
damages in the amount of $15, 000. 00 was presented
by the City Clerk.
On motion of Councilman Ehrhardt, Schaffer second,
the Claim was rejected and referred to the City's
Agent of Record.
Mr. Max Elson of Max Elson Insurance, Inc. ,
832. S. Fairmont Avenue, addressed the Council
advising that for the past several ,years, the City's
Liability Insurance had been carried with the Pacific
Indemnity Co. Pacific Indemnity has advised that
they are not longer affording a market for this type
of coverage. Mr. Elson stated that their company

Councilman Ehrhardt informed the Council that he
had received praise for the Lodi City street crews
for the manner in which they had cleaned up the
tumbleweeds after the last storm in the area of
Cherokee and Walnut Streets.
COMPLAINT-
has submitted proposals on behalf of the City to

SPECS APPROVED Specifications for the "Lodi Lake Storm Drain" were

approved the plans and specfications for "Lodi Lake
Storm Drain" and authorized the City Clerk to
advertise for bids thereon.
SPECS APPROVED City Manager Glaves presented to the Council the
HENNING SUB- plans and specifications for the "Henning Substation
STATION IM- Improvements". On motion of Councilman Hughes,
PROVEMENTS Schaffer second, the plans and specifications for

and Council authorized the Purchasing Agent to
advertise for bids thereon.
City Manager Glaves presented to the Council for
its approval Change Order No. 1 for City Hall
Remodel IV in the amount of $2, 2 15. 00 describing
the items covered in this change order as follows:
CHANGE ORDER Item 1, Structural: Upon opening the existing ceiling,

structure, it became necessary to add a steel
beem and to plywood sheath an interior wall to
carry the loads. Because of the structural
changes, it was necessary to reroute some of
the duct work for which there was no additional
charge. Some carpenter labor was involved in
building an air duct/soffit in one office, however.
Two steel brackets were also fabricated to rein-
force an eccentric loading condition uncovered
at one location. The Contractor's charges have
been reviewed and are reasonable for the work
performed.
Item 2, Electrical: Some of the work which was
originally to be done by a separate communications
system contract seemed more practical to be done
by the electrician. Also, some additional conduit
was installed as directed by the Communications
system contractor. The Contractor's charges are
reasonable for the work.
Architect Arlie Preszler answered questions
regarding this Change Order as directed by the
Council. On motion of Councilman Schaffer,
Ehrhardt second, Council approved Change Order
No. 1 - City Hall Remodel Phase IV in the amount
of $2, 2 15. 00.
CCCJ GRANT Mr. Dave Barton, Business Manager for the Lodi
APPLICATION- Unified School District, presented to the Council
LUSD - an application that has been prepared for the
SECURITY California Council on Criminal Justice for grant
funds to set up a monitoring system in all of the
District's school buildings. Mr. Barton asked that
the City sponsor this application, stating that
sponsorship of this project would not require any
expenditure of funds by the City.

Following discussion by the Council, with questions
being directed to Mr. Barton regarding this applica-
tion, on motion of Councilman Katnich, Schaffer
second, Council adopted Resolution No. 4020

endorsing California Council on Criminal Justice
Grant Application entitled, "School District
Security" as presented by the Lodi Unified School
District and agreed to the City's sponsorship of this
program.
City Manager Claves reported to the Council that
the City is having problems with the new land at Lodi
Lake regarding mosquitos. The little lake (Pigs
Lake) and the drainage ditch provide area for weed
growth which encourages mosquito breeding. A
solution to the problem has been received proposing
the steepening of the slopes of Pig's Lake to dis-
courage tule and weed growth and thus encourage

man Ehrhardt moved that the City Manager be
authorized to negotiate with Robert Paoluccio, of
Robert Paoluccio Consulting Engineers to develop
specifications on repairs to the Public Safety Building

Councilman Katnich, Ehrhardt second, the matter
was continued to January 2, 1975 requesting that
staff provide Council with a feasibility- report on re-
pair versus replacement of this range.
AIR CONDITION-

Building has been malfunctioning and finally has

become inoperable. Mr. Robert Paoluccio of
Robert Paoluccio Consulting Engineers, Sacramento,
California has looked over the systern and identified
the problem. The major problem deals with the
evaporative condenser which is inoperable. Mr.
Paoluccio has recommended that this unit be re-
placed at a cost of $10, 000 to $14, 000, the difference
in price depending on whether copper or steel tubes
are used in the condensers. Mr. Paoluccio believes
that the water conditions in Lodi will not make the
more expensive copper tubing necessary. Mr. Glaves
recommended to Council that Mr. Paoluccio be
engaged to prepare bidding specifications at a fee not
to exceed $1200.00.
A lengthy discussion on this matter followed. Council-
man Ehrhardt moved that the City Manager be
authorized to negotiate with Robert Paoluccio, of
Robert Paoluccio Consulting Engineers to develop

air conditioning system per "Project A", as
specified in a letter from Mr. Paoluccio dated
October 16, 1974, not to exceed $1200.00. The
motion was seconded by Councilman Katnieh and
carried.
JACK L. RONSKO City Manager Glaves announced she appointment of
NAMED PUBLIC Jack L. Ronsko as the City's Public Works Director,
WORKS DIRECTOR stating that Mr. Ronsko will be assuming his new

LETTER RE PLEA Councilman Ehrhardt informed the Council that a
FOR MOTOR- letter had appeared in the Lodi News Sentinel on
CYCLING AREA 12/18/74 pleading for a motorcycling area, which
article, Councilman Ehrhardt charged, contained
inaccurate information. In checking with the
Cities of Antioch and Vallejo, Councilman Ehrhardt
reported that neither City operates nor has issued
permits for motorcycle park operations in their
respective cities. Councilman Ehrhardt continued
stating that the City has researched the feasibility
of such an operation.
Councilman Ehrhardt challenged the group to set
down rules and provide insurance estimates: to
provide Council with information as to how the pro-
posed operation should be policed; how the proposed
area should be fenced; how the group should be
governed, and the operation regulated.
Councilman Katnich interjected that this is the 3rd time
in the last five years the Council has been approached
relative to this type of activity. The City at the
present time does not have the necessary land nor
the finances to go outside the City to purchase land,
and believes this group of people should be so advised,
rather than giving them false hopes.

Councilman Ehrhardt stressed that he would be
opposed to something that would cost the citizens more
than the benefits the community would reap therefrom.
REQUEST FOR
Councilman Hughes stated that he has an inquiry that

serve energy, there seems to be a garish display of
energy usage at the City's tennis courts, primarily at
Kofu Park and Legion Park. Councilman Hughes pro-
posed the installation of an automatic switch of some
type. Staff indicated that supposedly there is some type
of switching device presently installed; however, it
may not be properly functioning. Mayor Pinkerton
directed staff to check into the matter.

REACTIVATION There was no action taken by the Council
OF MALL following a discussion regarding reactivation

HOLIDAY
GREETINGS Seasons Greetings were extended to the citizens
of Lodi by Mayor Pinkerton on behalf of the
Council, staff and all City employees.
ADJOURNMENT There being no further business to come before
the Council, on motion of Councilman Ehrhardt,
Katnich second, the meeting was adjourned at
9:35 P.M.
