ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, KATNICH, SCHAFFER and PINKERTON Absent: Councilmen - None b. Proclaimed the week of October 20 through October 26, 1974 as "National Drug Abuse Prevention Week". c. Proclaimed October 24, 197" as "United States Day" FIRE STATION NO. 3 DESIGNATED "FORREST Councilman Katnich moved that Fire Station No. 3 EPROSON FIRE be designated as "Forrest Eproson Fire Station" and STATION" that an appropriate plaque be designed for presentation cc - I kZ to Mrs. Eproson at the dedication ceremonies. The motion was seconded by Councilman Ehrhardt. The motion was carried by unanimous vote, with Council setting the dedication ceremonies for November 15, 1974. The City Clerk was directed to prepare and send the proper notices and invitations for the dedication ceremonies. - 1- Also Present: Assistant City Manager Glenn, City Attorney Mullen, Planning Director Schroeder, and Assistant City Engineer Glenn Robison INVOCATION The invocation was given by Councilman Ehrhardt. PLEDGE Mayor Pinkerton led the Pledge of Allegiance to the flag. MINUTES Councilman Schaffer moved that the minutes of October 2, 1974 be approved as written and mailed. The motion was seconded by Councilman Katnich and i— fj carried. t PROCLAMATIONS Mayor Pinkerton took the following actions: a. STREET Notice thereof having been mailed to the LT. ASSESSMENT property owners and also published and CONFIRMED posted in accordance with law, the Mayor called for the public hearing on the C .00 assessment for the Park Street Street Light Assessment District. I Mr. and Mrs. Alfred Loza, 700 Park Street, ` Lodi spoke in opposition to the Park Street Street Light Assessment District stating that they felt it was unfair, that although they are opposed to the assessment district, they are required to pay their portion of the assessment. RES. NO. 3992 There being no one else in the audience wishing to speak on the matter, the public portion of the hearing was closed. On motion of Councilman Schaffer, Katnich second, the Council adopted Resolution No. 3992 confirming the assessment for the Park Street Street Light Assessment District. AMEND SECTION Notice thereof having been published in accordance 27-13A OF THE with law and affidavit of publication and mailing CITY CODE being on file in the office of the City Clerk, the A C Mayor called for the public hearing to consider the recommendation of the Planning Commission that Section 27- 13A of the City Code of the City F` of Lodi, Mobilehome Parks of the Municipal _ Code, be amended to permit mobilehomes to be used as offices at mobilehome and recreational vehicles sales lots, subject to the approval of the Planning Director and annual inspection by the Building Inspection Division of the Public Works Department. Planning Director James Schroeder presented the matter to the Council. There being no persons in the audience wishing to speak on the matter the public portion of the hearing was closed. ORD. NO. 1045 After Council discussion, Councilman Ehrhardt INTRODUCED moved the introduction of Ordinance No. 1045 - "An Ordinance Amending Section 27- 13A of the City Code of the City of Lodi, Entitled, 'Mobile Parks' Thereby Permitting Mobilehomes to be used as Offices at Mobilehome and Recreational - Vehicle Sales Lots, Subject to the Approval of the Planning Director and Annual Inspection by the Building Inspection Division of the Public Works Department". The motion was seconded by Councilman Hughes and carried. -2- Minutes of October 16, 1974, continued PLANNING COMMISSION b. that off-street parking shall be provided at a ratio of 1- 1/2 spaces per unit with Z/3 of all required off-street parking being covered; and c. that all site plans and building elevations shall be approved by the Site Plan and Architectural Review Committee. On motion of Councilman Schaffer, Katnich second, the matter was set for public hearing on November 6, 1974. ACTIONS OF INTEREST The Planning Commission also took the following actions of interest to the City Council. 1. Approved the Parcel Map of the Resubdivision of Lots 2 through 15 of the Cherry Tree Subdivision located on the west side of South Church Street between West Kettleman Lane and West Century Boulevard. 2. Determined that a Zoning Hardship existed and approved the request of Mr. Richard Entzi for a Variance to reduce the required lot width from 60 feet to 51 feet to permit the erection of a duplex on a corner lot with adequate square footage at 400 Chestnut Street in an area zoned R -GA, Garden Apartment Residential. COMMUNICATIONS CLAIM A Claim for damages was presented on behalf of -3- The Assistant City Manager gave the following report of the Planning Commission meeting of October 14, 1974: RECOMMENDED REZONE FROM R -MD TO P -D(12) 1. Recommended the approval of the request of H and M Builders by Mr. Marvin Wiebe to rezone the Cherry Tree Subdivision located on the west side of South Church Street between West Kettleman Lane and West Century Boulevard from the R -MD, Medium Density Multiple Family Residential District to P -D(12), Planned Development District No. 12 with the follow- ing conditions: a, that the Use Permitted, Height and Area Requirements and Minimum Yards conform to Section 27-8, R -MD District of the Municipal Code with the exception that an "O" side yard will be permitted between the units in the duplex -con- dominium structures; b. that off-street parking shall be provided at a ratio of 1- 1/2 spaces per unit with Z/3 of all required off-street parking being covered; and c. that all site plans and building elevations shall be approved by the Site Plan and Architectural Review Committee. On motion of Councilman Ehrhardt, Schaffer second, the claim was rejected by the Council and referred to the City's Agent of Record. PUC HEARING The City Clerk reported that a notice had been received from the Public Utilities Commission of a hearing that has been set for Tuesday, j October 15, 1974 at 10:00 a. m, in the ' Commission Courtroom, State Building, 350 McAllister Street, San Francisco on the appli- cation of the Pacific Gas and Electric Company (Application No. 55222) for authority to increase rates for electric service due to fuel cost adjustments. REQUEST RED The Assistant City Manager reported that a ZONES-LEROY letter had been received from Robert E. Tamblin, NICHOLS SCHOOL Principal of Leroy Nichols School requesting CC (-1$ that the existing loading zones (yellow) in front of Leroy Nichols School be painted red. The letter indicated that both zones are on Crescent Street, one at the north end of the school property in front of the office; the other at the south end of the building outside of the Multi- purpose Room. On motion of Councilman Ehrhardt, Katnich second, the Staff was directed to prepare a study on the request of Mr. Tamblin for Council presentation on November 6, 1974. GAS & OIL City Attorney Mullen informed the Council that LEASES Section 7058.5 of the Public Resources Code of — �C 2�cai the State of California states that the bids for gas and oil leases will be received and considered at a public meeting of the governing body at a time fixed not less than 30 days after adoption of the Council's resolution calling for such bids. The City Attorney requested that the Council adopt a resolution extending from October 16, 1974 at 5:00 p. m. for receiving bids and 8:00 p. m, for granting the bid, to November 6, 1974 at 5:00 p. m. for receiving bids and 8:00 p. m. for granting the bid for a gas and oil lease as set forth in Resolution No. 3982. RES. NO. 3993 On motion of Councilman Schaffer, Hughes second, the Council adopted Resolution No. 3993 extending from October 16, 1974 at 5:00 p.m. for receiving bids and 8:00 p.m. for granting the bid, to November 6, 1974 at 5:00 p.m. for receiving bids and 8:00 p.m. for granting the bid for a gas and oil lease as set forth in Resolution No. 3982. REQUESTS FOR USE Councilman Ehrhardt reported that he had been OF CITY FACILITIES contacted regarding the use of City grounds for a mini midget racing program planned for -4- Minutes of October 16, 1974, continued October 26, 1974. The Parks and Recreation Commission had recommended that the re- quest be denied and detailed in a report to the City Manager, its reasons. These reasons were explained in detail to the requesting party by Councilman Ehrhardt. Councilman Ehrhardt urged citizens formulating plans that would require use of City facilities to adequately plan these functions and to submit requests for City facilities well in advance of the proposed pro- grams. "PINE ALLEY" Mayor Pinkerton presented a letter that had SIGN REQUESTED been received from Anne Meyers, President, C C 4J� Tokay Players requesting an alley sign giving directions to "Pine Alley". Following discussion, on motion of Councilman Ehrhardt, Katnich second, the Council referred the matter to the Planning Commission. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $849, 150.27 were cc 2I CR') approved on motion of Councilman Katnich, Schaffer second. -5- On motion of Councilman Schaffer, Ehrhardt second, the Council adopted Resolution No. PROPOSITION 17 3994,"A Resolution Urging a 'No' Vote on Proposition No. 17 by all Citizens of the State". I RES. NO. 3994 The Council directed the City Clerk to forward CC 32. copies of this resolution to the news media and cc 30o to various individuals the Council named. Councilman Hughes indicated his concern that Mayor Gary G. Gillmor of Santa Clara would endorse this Proposition and challenged Mayor Gillmor to a debate on this vital issue to the citizens of California. Assistant City Manager Glenn reported that HENNING SUB- only two bids were received on the "Henning STATION Substation Improvements"; one bid from Case IMPROVEMENTS Construction for $ 10, 750. 00 covered only one C� S 1 item of the contract, and the second bid from Claude C. Wood Company was in the amount of $65, 803. 55, which bid exceeded the estimate by approximately $ 19, 000. 00. The Assistant City Manager recommended that the bids be rejected, that clarification of fine points within the specifi- cations be made, and elimination of other items in the specifications be made as outlined. On motion of Councilman Schaffer, Katnich second, the Council rejected bids received on the Henning Substation Improvements and directed Staff to re -evaluate -the specifications for this -5- 6 Minutes of October 16, 1974, continued project and prepare new specifications for Council approval. AWARD CITY Assistant City Manager Jerry Glenn presented HALL REMODEL the bids received for City Hall Remodel - Phase PHASE IV IV as follows: RES. NO. 3995 Bidder Amount CC- t z Ccs n C soo Ted A. Molfino $72,535.00 Angelo Fanos $71,971.00 The Assistant City Manager recommended the award be made to the low bidder, Angelo Fanos in the amount of the bid $7 1, 971. 00. On motion of Councilman Schaffer, Ehrhardt second, the Council adopted Resolution No. 3995 awarding the contract for City Hall Remodel - Phase IV to the low bidder, Angelo Fanos in the amount of the bid $7 1, 97 1. 00. The Assistant City Manager reported that the City TRAFFIC STUDY Assistant City Manager Glenn reported that a bid GARFIELD & opening was held Tuesday, October 15, 1974 at 3/4 TON PICKUP 11:00 a. m. for a 3/4 ton pickup truck for the PARKS & Parks and Recreation Department, specifications RECREATION for which were approved by Council action Cc i2,t (o� 10/2/74. Mr. Glenn advised that no bids were C yp received at this bid opening, and that it appeared that although the required legal publication requirements were met, individual vendors of this type of equipment in the community were not provided notification and specifications. Councilman Schaffer moved that the City readver- tise for bids on the 3/4 ton pickup, which specifi- cations were approved 10/2/74 and that local vendors be provided with notification and specifi- cations for this bid opening. Council also directed staff, that for future bid openings, local vendors shall be notified and supplied with specifications of the equipment for which bids are being called. The Assistant City Manager reported that the City TRAFFIC STUDY Council had directed staff to do a traffic study to GARFIELD & determine the need for traffic controls at Garfield MAPLE STREETS and Maple Streets. Council was provided with the CC- 4S �k) requested traffic engineering investigation, which Cc '00 indicated that yield signs are warranted by the number of accidents and the limited sight distance at the intersection. -6- Minutes of October 16, 1974, continued RES. NO. 3996 Following discussion on motion of Councilman Katnich, Ehrhardt second, the Council adopted Resolution No, 3996 authorizing the installation of yield signs on Maple Street at the east and west approaches to Garfield Street. Assistant City Manager Gienn presented to the Council a Traffic Engineering Investigation TRAFFIC INVESTI- at Washington Street and Maple Street. GATION- Council had requested that this study be made WASHINGTON & to determine the need for traffic controls at MAPLE STREETS Washington Street and Maple Street. The re - CC ocrt concludes that no additional traffic controls be placed at this intersection. On motion of Councilman Ehrhardt, Katnich second, Council accepted the Traffic Engineering Investigation at Washington Street and Maple Street and concurred with Staff that no controls be placed at this intersection. Councilman Hughes directed the City Clerk to send a copy of the Traffic Engineering Investigation and of the Minutes of the 10/ 16/74 meeting to Ms. Beverly Will, 801 S. Washington Street, Lodi, California. ORDER VACATING The Assistant City Manager advised the Council EASEMENT- that an easement had been obtained for a ALADDIN GARDENS temporary storm drainage ditch to drain Joaquin UNIT NO. 3 Park. With the construction of curb, gutter and Q.C. Sy. 0b storm drainage facilities in Aladdin Gardens, Unit No. 3, the easement will no longer be needed for the purpose for which it was obtained, and for this reason it is requested that Council adopt an order to abandon the easement. On motion of Councilman Schaffer, Hughes second, I he Council ordered vacating the easement located in Aladdin Gardens, Unit No. 3. The Assistant City Manager reported that the CURB, GUTTER, contract for "Beckman Park Interior Dra?nage" SIDEWALK & STREET had beer, awarded to William Burkhardt on IMPROVEMENTS- August 7, 1974.
