HomeMy WebLinkAboutMinutes - September 3, 1974459 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS September 3, 1974 An adjourned regular meeting of the City Council of the City of Lodi was held beginning at 7:00 P.M. on Tuesday, September 3, 1974 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, and PINKER TON Absent: Councilmen - KATNICH and SCHAFFER Also Present: Assistant City Manager Glenn, City Attorney Mullen, and Planning Director Schroeder INVOCATION rhe invocation was given by Councilman Ehrhardt PLEDGE Mayor Pinkerton led the Pledge of Allegiance to the flag. SPECIAL REFERENDUM The City Clerk certified that she had canvassed ELECTION 8/27/74 the returns of the Special Referendum Election RESULTS held August 27, 1974 and reported the results thereof. On motion of Councilman Ehrhardt, Hughes second, the Council adopted the follow- ing resolution: RESOLUTION NO. 3977 DECLARING RESULT OF ELECTION WHEREAS, a Special Referendum Election was held and conducted in the City of Lodi on Tuesday, the 27th day of August 1974, as required by law, and WHEREAS, it appears from the report of the City Clerk and the records on file in her office that voting precincts were properly established and the polling places thereof designated; that election officers were appointed and qualified; that election supplies, including official ballots, were furnished each of said precincts; and that in all respects, said election was held and_ conducted and the votes received thereat received and canvassed and the returns thereof made, determined and declared in time, form and manner as required by the laws of the State providing for and regulating elections in general law cities; and, WHEREAS, in accordance with Resolution No. 3957, the City Clerk conducted the canvass of the returns of said election; and, BE nm Minutes of September 3, 1974, continued WHEREAS, the City Council of the City of Lodi, meeting at the City Council Chambers this 3rd day of September, 1974, to declare the results of the election, finds, determines and declares, as a result of said count and canvass as certified by the City Clerk: (1) That said Special Referendum Election was held and conducted in the City of Lodi, California, on the 27th day of August, 1974, in time, form and manner required by law; (2) That there were eleven voting precincts established in said City for the purpose of holding said election, viz: VOTING PREGINCT 1, comprising State and County precinct numbers L2401, L2402 and L2403, VOTING PRECINCT 2, comprising State and County precinct - numbers L2404 and L2406, VOTING PRECINCT 3, comprising State and County precinct numbers L2407, L2408 and L2409, VOTING PRECINCT 4, comprising State and County precinct numbers L2405, L2413 and L2414, VOTING PRECINCT 5, comprising State and County precinct numbers L2410, L2411 and L2427, VOTING PRECINCT 6, comprising State and County precinct numbers L2 : )2, L2415 and L2428, VOTING PRECINCT 7, comprising State and County precinct numbers L2416, L2417 and L2418, VOTING PRECINC"T 8, comprising State and County precinct numbers L2419 and L2420, VOTING PRECINCT 9, comprising State and County precinct numbers L2421, L2422 and L2431, VOTING PRECINCT 10, comprising State and County precinct numbers L2423, L2424 and L2430, VOTING PRECINCT 11, comprising State and County precinct numbers L2425, L2426 and L2429. (3) That the whole number of votes cast at said election was five thousand seventeen (5, 017). (4) That the total number of votes cast for and against the measure "Shall Ordinance 1022 of the City of Lodi entitled, 'AN ORDINANCE AMENDING THE OFFICIAL DISTRICT MAP OF THE CLTY OF LODI AND 'THEREBY REZONING AN APPROXII&IA TELY 47 ACRE PARCEL LOCATED AT THE SOUTHWEST CORNER OF SOUTH HAM LANE AND WEST LODI AVENUE FROM R- I TO PD- 11 PLANNED DEVELOPMENT DISTRICT NO. 11', be adopted?" was as follows: -2- For % gains t Total 461 Minutes of September 3, 1974, continued PRECINCTS Abs. 1 2 3 4 5 6 7 8 9 10 11 Votes Total 63 41 93 70 99 121'107 48 106 84 8Z 19 933 260 164 280 295 501 547 387 222 426 400 451 112 4045 323 20S 373 365 6o0668 494 270 532 484 533 131 RESOLVED, that the results of the Special Referendum Election held in the City of Lodi on August 27, 1974 show that a majority of the voters have voted against the measure to adopt Ordinance I022 and, therefore, Ordinance 1022 is null and void. Upon the adoption of this resolution, the City Clerk shall enter a full copy thereof on the records of the City Council of the City of Lodi for its meeting held this 3rd day of September 1974.
