ROLL CALL Present: Councilmen - EHRHARDT, HUGHES KATNICH, SCHAFFER and PINKERTON Absent: Councilmen - None Also Present: City Manager Henry Glaves, Assistant City Manager Jerry Glenn, City Attorney Robert Mullen, Planning Director Jim Schroeder, and Public Works Director Shelley Jones INVOCATION The invocation was given by Councilman Ehrhardt. PLEDGE Mayor Pinkerton led the Pledge of Allegiance to the flag. MINUTES On motion of Councilman Katnich, Schaffer second, the minutes of June 19, 1974 were approved as written and mailed. On motion of Councilman Ehrhardt, Schaffer second, the minutes of June 26, 1974 were approved as written and mailed. PUBLIC HEARINGS APPEAL - MR. Notice thereof having been published in accordance WILLIAM E. RUFF with law and affidavit of publication being on file in the office of the City Clerk, the Mayor called for the continued public hearing to consider the appeal of Mr. William E. Ruff on the action of the Planning Commission regarding the rezoning of property located at the northwest corner of West Lodi Avenue and South California Street (i. e. , 231 South California Street). Planning Director Schroeder introduced the matter and reviewed the Planning Commission's actions in this matter. - 1 - 416 Minutes of July 3, 1974, continued Mr. William E. Ruff, 411 Charleston Way, Lodi, California spoke on behalf of the appeal. There being no other persons in the audience wishing to speak either in favor of or in opposition to the appeal, the public portionof the hearing was closed. Following discussion on the matter, the appeal was denied on motion of Councilman Schaffer, Hughes second. AMEND M- 1 AND Notice thereof having been published in M-2 accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton called for the public hearing on the recommendation of the City Planning Commission that the M- 1, Light Industrial District and the M-2, Heavy Industrial District be amended to eliminate the requirement for a ten -foot rear yard setback except when adjacent to an area zoned for residential purposes. ORD. NO. 1036 Planning Director James Schroeder introduced INTRODUCED the matter and answered questions directed by the Council regarding the Planning Commission's recommendation on this matter. There were no persons present who wished to speak on the matter, and the public portion of the hearing was closed. Following discussion, Councilman Katnich then moved introduction of Ordinance 1036 amending Chapter 27 (Zoning Ordinance) of the Lodi City Code and thereby eliminating the requirement for a ten -foot rear yard setback except when adjacent to an area zoned for residential purposes in the M- 1, Light Industrial District and the M-2 Heavy Industrial District. The motion was seconded by Councilman Ehrhardt and carried. PLANNING COMMISSION The City Manager gave the following report of the Planning Commission meeting of June 24, 1974. ACTIONS OF INTEREST 1. Continued consideration of the Rivergate- Mokelumne Subdivision until its regular meet- ing of Monday, August 12, 1974 as directed by the City Council on June 19, 1974. - 2 - Minutes of July 3, 1974, continued 2. Accepted the request of Mr. James Gerard to withdraw the request of Aladdin Real Estate to amend the residential density of P -D(10), Planned Development District No. 10 by reducing the number of units in the El Portal Subdivision on the south side of West Century Boulevard between South Hutchins Street and Aspen Grove Drive. 3. Determined the adequacy and certified the Final Environmental Impact Report for Construction of Water Pollution Control Facilities - 1974 at the City of.Lodi's White Slough Water Pollution Control Plant. 4. Approved the extension of the expiration date of the Tentative Map of Unit #2 and a portion of Unit #3 of English Oaks Manor Subdivision until August 26, 1975. The Planning Commission did not approve the extension of that portion of Unit #3 identified as Parcels "A" and "B" located south of Arundel Court and west of South Ham Lane which were previously approved for multiple family housing at 15 units per acre. 5. Denied the request of Mr. D. K. Lane for a Variance to permit the increase of a balcony overhang into the front yard area from 4 feet to 6 feet at 2240 Newbury Circle (Lot 11, English Oaks Manor) in an area zoned P -D(4), Planned Development District No. 4. 6. Approved the request of United Vintners, Inc. for a Variance to erect a Brandy Bottling Building at a nonconforming winery at 1 West Turner Road in an area zoned R- 1, Single - Family Residential. 7. Recommended to the San Joaquin County Zoning Administrator the approval of the request of Mr. John Lagno for a Use Permit to use a vacant shop building at 1760 North Cluff Avenue for farm equipment repair in an area zoned I -PA, Interim Protective Agriculture. COMMUNICATIONS CLAIMS A Claim was presented for fire damage filed on behalf of Mr. William J. Turner, 14953 E. Tokay Colony Road, Lodi, in the amount of $6, 540. 00. On motion of Councilman Katnich, Schaffer second, the Council rejected the claim and referred it to the City's agent of record. - 3 - -418 Minutes of July 3, 1974, continued A Claim was presented for damages to a painting displayed at the Lodi Art Center (Barengo Cellars) Art Show filed on behalf of Mr. Willard Ashford, P. O. Box 382, Diablo, California in the amount of $3, 000. 00. On motion of Councilman Ehrhardt, Schaffer, second, the Council rejected the claim and referred it to the City's agent of record. Dictaphone Corporation $10,096.51 CTSJMoxon, Inc. $12,763. 52 - 4 - A petition was received signed by some of the owners of land proposed to be annexed to the NF.UHARTH-WEST City as the "Neuharth -West Addition". Said ADDITION" annexation was approved by the Local Agency PETITION RECEIVED Formation Commission of San Joaquin County on June 24, 1974. On motion of Councilman RES. NO. 3941 Ehrhardt, Schaffer second, the Council adopted Resolution No. 3941 declaring the Council's intent to annex the "Neuharth -West Addition" and setting the public hearing thereon for August 21, 1974. APPEAL- MR. AND The City Clerk presented a letter received from MRS, D. K. LANE Mr. and Mrs. D. K. Lane, 1826 S. Hutchins Street, Apt. # 12, Lodi appealing the actions of the Planning Commission in ruling against their requested variance regarding an increase of a balcony overhang into the front yard area from 4 feet to 6 feet at 2240 Newbury Circle (Lot #11, English Oaks Manor) in an area zoned P -D 4, Planned Development District 4. On motion of Katnich, Hughes second, the matter was set for public hearing on July 17, 1974. COMPLAINT ON Councilman Ehrhardt reported that he had re - LACK OF PARKING ceived several complaints regarding lack of ENFORCEMENT parking enforcement. Staff was directed to look into the matter and prepare a report as to the validity of the complaints. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $368, 534. 38 were approved on motion of Councilman Ehrhardt, Schaffer second. AWARD. POLICE The City Manager presented bids received for a DEPT, LOGGING Police Department Logging Recorder System as RECORDER SYSTEM follows: Dictaphone Corporation $10,096.51 CTSJMoxon, Inc. $12,763. 52 - 4 - 4-1.9 Minutes of July 3, 1974, continued REST NO. 3942 City Manager Glaves recommended the award be made to the low bidder, Dictaphone Corporation, for the amount of the bid. On motion of Councilman Katnich, Schaffer second, the Council adopted Resolution 3942 awarding the contract for the Police Department Logging Recorder System to Dictaphone Corporation for a total of $10, 096. 5l. On motion of Councilman Schaffer, Katnich second the Council adopted Resolution No. 3943 awarding the contract to Claude C. Wood Company for the amount of the bid. On motion of Councilman Katnich, Schaffer second, the Council adopted Resolution 3944 awarding the contract to Claude C. Wood Company for the amount of the bid. AWARD -TILT -BED The City Manager presented the only bid received TRAILER for a Tilt -bed Trailer to be used by the Public Works Department as follows: RES, NO. 3945 Tuff Boy, Inc. $4, 197.60 It was determined that this bid was a reasonable one, and City Manager Glaves recommended that the award be made. On motion of Councilman Ehrhardt, Hughes second, the Council adopted Resolution No. 3945 awarding the contract to Tuff Boy, Inc. in the amount of $4, 197. 60. On motion of Councilman Katnich, Ehrhardt second, the Council adopted Resolution No. 3946 - 6 - City Manager Glaves presented a list of the SPECIAL consolidated precincts, polling places, and REFERENDUM election officers as prepared by the County Election ELECTION Office for the Special Referendum Election to be AUGUST 27, 1974 held August 27, 1974, and proposed that the reimbursement for the Precinct workers be set RES. NO. 3946 at $24.00 for inspectors and $21. 00 for judges and clerks. On motion of Councilman Katnich, Ehrhardt second, the Council adopted Resolution No. 3946 - 6 - Minutes of July 3, :974, continued establishing the polling places, appointing the election officers, and setting the reimbursement for precinct workers as outlined by City Manager Glave s. On motion of Councilman Ehrhardt, Schaffer second, the Council adopted Resolution 3949 withdrawing the "Geweke Addition" from the Woodbridge Rural Fire Protection District. NO PARKING ZONES City Manager Glaves reported that the intersection ON SOUTH HAM of Lodi Avenue and Ham Lane is provided with LANE left -turn pockets on Lodi Avenue only, and the City has received sevetal requests for the same RES. NO. 3950 installation on Ham Lane. The installation of these - 7 - The City Manager presented the Assessment ASSESSMENT Diagrams for Willow Avenue Sanitary Sewer DIAGRAM- Assessment District and Peach Street Sanitary WILLOW AVENUE Sewer Assessment District for Council approval. S. S. A. D. Councilman Ehrhardt moved that the Council PEACH STREET adopt Resolution No. 3947 approving the Assess- S.S.A.D, ment Diagram for Willow Avenue Sanitary Sewer Assessment District. The motion was seconded RES. NO. 3947 by Councilman Schaffer and carried. - RES. NO. 3948 On motion of Councilman Ehrhardt, Katnich second, the Council adopted Resolution 3948 approving the Assessment Diagram for Peach Street Sanitary Sewer Assessment District. City Manager Claves reported that a change in the Government Code now provides that terms of TERMS OF OFFICE office of Planning Commission members be PLANNING COMM, provided by local ordinance, and that the City MEMBERS Attorney has therefore proposed an addition of Section 2-34. 1 to Article 3, Planning Commission, ORD. NO. 1037 of the Lodi City Code, providing for the terms of INTRODUCED office of the Planning Commission members. Councilman Ehrhardt moved for introduction of Ordinance 1037 adding Section 2-34. 1 to Article 3, Planning Commission, of the Lodi City Code, providing for terms of office of the members of the Planning Commission. The motion was seconded by Councilman Hughes and carried. The City Manager reported that all annexation pro - WITHDRAW "GEWEKE ceedings have now been completed on the "Geweke ADDITION" FROM Addition", and pursuant to California Health and WRCFPD Safety Code Section 13952, it would now be in order for the Council to adopt a resolution withdrawing the RES. NO. 3949 "Geweke Addition" from the Woodbridge Rural County Fire Protection District. On motion of Councilman Ehrhardt, Schaffer second, the Council adopted Resolution 3949 withdrawing the "Geweke Addition" from the Woodbridge Rural Fire Protection District. NO PARKING ZONES City Manager Glaves reported that the intersection ON SOUTH HAM of Lodi Avenue and Ham Lane is provided with LANE left -turn pockets on Lodi Avenue only, and the City has received sevetal requests for the same RES. NO. 3950 installation on Ham Lane. The installation of these - 7 - 422 Minutes of July 3, 1974, continued pockets will require the prohibition of parking on Ham Lane at various points. The installation of left -turn pockets on Ham Lane should reduce the number of rear -end and turning movement accidents at the intersection and should also provide greater convenience for drivers. Following discussion on the matter, Councilman Ehrhardt moved that the Council adopt Resolution No. 3950 prohibiting parking on the east side of Ham Lane from 315 feet south of the centerline of Lodi Avenue to 125 feet north of the centerline of Lodi Avenue, and on the west side of Ham Lane from 315 feet south of the centerline of Lodi Avenue to 135 feet north of the centerline of Lodi Avenue. The motion was seconded by Councilman Schaffer and carried. City Manager Glaves reported that the City has had a lease agreement with R. M. Lipelt for a portion R. M. LIPELT of Lodi City lake property along the waters' edge LEASE AGREEMENT in the area of Mr. Lipelt's trailer court since APPROVED April 1961. A new lease has been drawn up showing a more detailed boundary description, and it was requested that the Council approve the new lease agreement and authorize the City Manager to execute the lease agreement on behalf of the City. On motion of Councilman Katnich, Ehrhardt second, the Council approved the lease agreement with Mr. R. M. Lipelt and authorized the City Manager to execute the agreement on behalf of the City. RECESS Mayor Pinkerton declared a five-minute recess, and the Council reconvened at 9:40 P.M. On motion of Councilman Schaffer, Ehrhardt second, the Council increased the proposed budget by an additional $500. 00 for the Chamber of Commerce. - 8 - Following an introduction on the matter by City Manager Glaves, the Council on motion of Councilman Schaffer, Katnich second, authorized the expenditure of $200. 00 to the National League of FAIR LABOR Cities Fair Labor Standards Litigation, which STANDARDS ACT monies are to be used to challenge the constitu- SUIT tionality of the Fair Labor Standards Act by suit being filed by California and Arizona. r Council continued its review of the City Managers 1974-75 proposed Operating Budget for 1974-75, and OPERATING BUDGET additions to the budget were approved as follows: On motion of Councilman Schaffer, Ehrhardt second, the Council increased the proposed budget by an additional $500. 00 for the Chamber of Commerce. - 8 - 423 Minutes of July 3, 1974, continued On motion of Councilman Ehrhardt, Schaffer second, the Council increased the proposed budget by $14, 000. 00 for an additional Fire Captain and Fireman. ORD. NO. 1038 INTRODUCED Following additional review of the proposed Operating Budget, on motion of Councilman Katnich, Schaffer second, the Council then introduced Ordinance No. 1038 adopting the Operating Budget for 1974-75. Council requested that Staff present a report on WHITE SLOUGH WATER the White Slough Water Pollution Plant at the POLLUTION CONTROL July 17, 1974 regular City Council meeting. PLANT REPORT Public Works Director Stelley Jones informed the Council that the engineering consultants were presently working on this, and that a report would be ready for presentation at the July 17, 1974 meeting.
