HomeMy WebLinkAboutMinutes - June 19, 1974393 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS JUNE 19, 1974 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, June 19, 1974, in the City Hall Council Chambers. ROLL CALL Present: Councilmen - HUGHES, KATNICH, and PINKERTON (Mayor) Absent: Councilmen - EHRHARDT and SCHAFFER Mayor Pinkerton noted that Councilman Schaffer was unable to attend as he is under doctor's care and that Councilman Ehrhardt was attending a conference in Fresno, and therefore was not able to be present. Also present: City Manager Glaves, Assistant City Manager Glenn, City Attorney Mullen, Planning Director Schroeder, and Public Works Director Jones. PLEDGE Mayor Pinkerton led the Pledge of Allegiance to the flag. MINUTES Councilman Hughes moved that the minutes of June 5, 1974 be approved as written and mailed. The motion was seconded by Councilman Katnich and carried. PROCLAMATIONS Mayor Pinkerton took the following actions: PUBLIC HEARINGS Proclaimed June 23 through June 30, 1974 as "Teen Challenge Week" in Lodi and presented the Proclamation to Mr. Calvin Krienke. Proclaimed June 23 through June 29, 1974 as "Burglary Prevention Week". Notice thereof having been published in accord- ance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton called for the public hearing on proposed Ordinance No. 1029 - An ordinance adopting the "Uniform Building Code", 1973 Edition, and the secondary Code referred to therein; namely, the "Uniform Building Code Standards", 1973 Edition. BE Minutes of June 19, 1974, continued Public Works Director Shelley Jones introduced Public Works Director Shelley Jones then pointed out to the Council the changes recommended in each of the proposed Uniform Codes and sub- mitted a document entitled, "Proposed Changes to the 1973 Uniform Codes". He recommended that Council specifically adopt the changes for the reasons set forth in the "Proposed Changes to the 1973 Uniform Codes". Upon motion of Councilman Katnich, Hughes second, the reasons for the changes in the various codes as outlined in the "Proposed Changes to the 1973 Uniform Codes" submitted by the Public Works Director were thereby specifically approved by the City Council of the City of Lodi, and the City Clerk was directed to file a copy of the "Proposed Changes to the 1973 Uniform Codes" with the copies of the various codes she has on file in her office. There being no persons in the audience wishing to speak on the matter, the public portion of the hearing was closed. Councilman Katnich moved the introduction of Ordinance No. 1029 - An Ordinance adopting the "Uniform Building Code", 1973 Edition, and the secondary code referred to therein; namely, the "Uniform Building Code Standards", 1973 Edition, which codes regulate the design, construction, quality of materials, use and occupancy, location and maintenance of buildings or structures in the City of Lodi, providing for the issuance of permits and collection of fees therefor, providing penalties for the violations thereof; repealing Sections 5. 1 and 5. 2, inclusive, of the code of the City of Lodi, and all other ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Hughes and carried. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton called for the public hearing on proposed Ordinance No. 1030 - An ordinance adopting the "Uniform Housing Code", 1973 Edition. -2- the matter stating that Section 17958 of the Health and Safety Code requires that every City "UNIFORM BUILDING shall adopt ordinances or regulations imposing CODE", 1973 EDITION the same requirements as outlined in Section 17922 of the Health and Safety Code. Recent Commission of Housing and Community ORD. NO. 1029 Development regulations have updated codes to INTRODUCED essentially require local agencies to enforce the building regulations provided in the 1973 Uniform Codes and the 1971 National Electric Code. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton called for the public hearing on proposed Ordinance No. 1030 - An ordinance adopting the "Uniform Housing Code", 1973 Edition. -2- •If Minutes of June 19, 1974, continued Public Works Director Shelley Jones presented background information on proposed Ordinance 1030, stating that if the City were to adopt the 1973 Uniform Housing Code, the City Building Department and the County Public Health Department would have the means by which they could categorically state unsafe and unsanitary conditions by citing the specifications clearly "UNIFORM HOUSING outlined in the Code. The City would also be in CODE", 1973 EDITION compliance with State Code regulations and in step with current trends in other municipalities through the State. NO. 1030 Ordinance No. 1030 - An Ordinance adopting the INTRODUCED "Uniform Housing Code", 1973 Edition, which code orovides for the minimum requirements for the protection of life, limb, health, property, safety and welfare of the general public and the owners and occupants of residential buildings; Providing penalties for violation thereof; Repealing Section 5-50 through 5-69 inclusive of the Code of the City of Lodi and all other ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Katnich and carried. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton called for the public hearing on proposed Ordinance No. 1031 - An Ordinance adopting the "Uniform Plumbing Code", 1973 Edition. Public Works Director Shelley Jones introduced the matter stating that Chapter 4, Drainage Systems (Revised in 1973) had been revised to add new requirements that plastic sewer pipe of the ABS -type cannot be put under a concrete slab in residential constructions with two stories or less. There being no persons in the audience wishing to speak on the matter, the public portion of the hearing was closed. Councilman Katnich moved the introduction of "UNIFORM Ordinance 1031 - An Ordinance adopting the "Uniform PLUMBING CODE", Plumbing Code", 1973 Edition, providing for the 1973 EDITION establishing of minimum regulations for the installa- tion, alteration or repair of plumbing and drainage ORD. NO. 1031 systems and the inspection thereof; providing INTRODUCED penalties for the violation thereof; and repealing Sections 18. 1, 18. Z, 18. 3 and 18. 4, inclusive of the Code of the City of Lodi and all other ordinances and -3- 4.09 Minutes of June 19, 1974, continued There being no persons in the audience wishing to speak on the matter, the public portion of the hearing was closed. Following discussion Councilman Hughes moved the introduction of Ordinance No. 1032 - An Ordinance adopting the "Uniform Mechanical Code", 1973 Edition, which code provides regula- tions controlling the design, construction, installation, quality of materials, location, opera- tion, and maintenance of heating, ventilating, comfort cooling, refrigeration systems, incinera- tors and other heat producing appliances in the City of Lodi, providing for the issuance of permits and collection of fees therefor; providing penalties for the violations thereof; and repealing Sections 13A-1, 13A_2 and 13A-3, inclusive of the Code of the City of Lodi, and all other ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Katnich and carried. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton then called for the public hearing on proposed Ordinance No. 1033 - An Ordinance adopting the "National Electrical Code", 1971 Edition. Public Works Director Shelley Jones introduced the matter stating that Section 230-95. Ground Fault Protection Equipment (New addition) had been added, which section establishes regulations regarding use of electrical shock protection equipment in all phases of construction. Article 410 Lighting -4- parts of ordinances in conflict therewith. The motion was seconded by Councilman Hughes and carried. Notice thereof having been published in accordance with law, and affidavit of publica- tion being on file in the office of the City Clerk, Mayor Pinkerton then called for the public hearing on proposed Ordinance No. 1032 - An "UNIFORM Ordinance adopting the "Uniform Mechanical MECHANICAL CODE" Code", 1973 Edition. 1973 EDITION Public Works Director Shelley Jones introduced the matter stating that Chapter 15, Mechanical ORD. NO. 1032 Refrigeration Equipment (Revised in 1973) had INTRODUCED been modified to include new enclosure and safety equipment regulations for commercial refrigera- tion units and Appendix No. 43-6. Fire Signaling Systems (Revised in 19 7 3) adds new specifications for photo -electric type combustion products detectors and other fire detecting equipment in residential and commercial structures. Following discussion Councilman Hughes moved the introduction of Ordinance No. 1032 - An Ordinance adopting the "Uniform Mechanical Code", 1973 Edition, which code provides regula- tions controlling the design, construction, installation, quality of materials, location, opera- tion, and maintenance of heating, ventilating, comfort cooling, refrigeration systems, incinera- tors and other heat producing appliances in the City of Lodi, providing for the issuance of permits and collection of fees therefor; providing penalties for the violations thereof; and repealing Sections 13A-1, 13A_2 and 13A-3, inclusive of the Code of the City of Lodi, and all other ordinances and parts of ordinances in conflict therewith. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton then called for the public hearing on proposed Ordinance No. 1033 - An Ordinance adopting the "National Electrical Code", 1971 Edition. Public Works Director Shelley Jones introduced the matter stating that Section 230-95. Article 410 Lighting -4- 402 Minutes of June 19, 1974, continued -5- Fixtures (Revised) - There have been numerous changes in the general location, type and installation requirements of lighting fixtures, arc lamps, electrical discharge lamps, etc. This article sets the Code up- to-date with respect to these changes. Article 680. Swimming and Wading Pools (Revised). This article reflects new State requirements for wiring and safety protection equipment, plus outlines new standards on various types of recreation equipment. NO. 1033 installation, alteration, or addition of electri- INTRODUCED cal wiring, devices, appliances, or equipment in the City of Lodi; and repealing Sections 9- 1, 9- 10, 9- 11, 9- 12, 9 -13, 9- 14, 9- 16 and 9- 17 of the Code of the City of Lodi, and all other ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Hughes and carried. Notice thereof having been published in accordance with law and affidavit of publication being on file in the office of the City Clerk, Mayor Pinkerton then called for the public hearing on proposed Ordinance No. 1034, An Ordinance adopting the "Uniform Fire Code", 1973 Edition. "UNIFORM FIRE Public Works Director Shelley Jones introduced CODE", 1973 the matter stating that the Fire Chief had EDITION requested that the Uniform Fire Code be updated to bring it in line with other codes that are proposed for adoption. Councilman Hughes then moved the introduction of Ordinance No. 1034 - An Ordinance adopting the "Uniform Fire Code", 1973 Edition, and the appendixes thereto, which code provides regula- tions governing the conditions hazardous to life and property from fire or explosion; repealing -5- 40` Minutes of June 19, 1974, continued Sections 10- 1 and 10-7 of the Code of the City of Lodi and all other ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Katnich. and carried. ORD. NO. 1035 Public Works Director Shelley Jones introduced INTRODUCED the matter stating that in the ordinance proposing the adoption of the Housing Code, it includes the recommendation to repeal Article 6 of Chapter 5 which is the City's abatement of unsafe buildings ordinance. The Housing Code proposed provides a method of abating dangerous residential buildings, and this new Uniform Code on the Abatement of Dangerous buildings would provide a orocedure to abate other buildings not classified as residential. Councilman Katnich then moved the introduction of Ordinance No. 1035, An Ordinance adopting the "Uniform Code for the Abatement of Dangerous Buildings", 1973 Edition, which code provides regulations, cumulative with and in addition to those of the "Uniform Building Code", 1973 Edition and the "Uniform Housing Code", 1973 Edition, for the repair, vacation, and demolition of buildings or structures endangering the life, limb, health, property, safety and welfare of the general public and their occupants; providing procedures and penalties for the viola- tion thereof; and repealing all ordinances and parts of ordinances in conflict therewith. The motion was seconded by Councilman Hughes and carried. Mayor Pinkerton declared that now was the time and place for the continued public hearing on the WILLIAM E. RUFF appeal of Mr. William E. Ruff on the action of APPEAL -CONTINUED the Planning Commission regarding the rezoning of property located at the northwest corner of West Lodi Avenue and South California Street (i. e. , 231 South California Street). M m Minutes of June 19, 1974, continued The City Clerk presented a letter that had been received from Mr. William E. Ruff stating that it had been brought to his attention that one or two City Councilmen would be absent from the June 19, 1974 City Council meeting. Mr. Ruff, therefore, requested that the public hearing be postponed for an additional two weeks, so that the matter could be heard by a full Council at its meeting on July 3, 1974, On the motion of Councilman Katnich, Hughes second, the continued Public Hearing on the appeal of Mr. William E. Ruff on the action of the Planning Commission regarding the rezoning of property located at the northwest corner of West Lodi Avenue and South California Street (i. e. , 23 1 South California Street) was continued to July 3, 1974. PLANNING COMMISSION The City Manager gave the following report of the Planning Commission meeting of June 10, 1974. 1. Recommended that the M-1, Light RECOMMENDED Industrial District and the M-2, Heavy AMENDMENT TO Industrial District be amended to eliminate M- 1 AND M-2 the requirement for a ten -foot rear yard setback except when adjacent to an area zoned for residential purposes. On motion of Councilman Katnich, Hughes second, the matter was set for public hearing on July 3, 1974. 2. Recommended that the property at the northwest corner of West Lodi Avenue and South California Street (i. e. , 231 South California Street) remain zoned R -MD, Medium Density Multiple Family Residential rather than C -P, Commercial -Professional. ACTIONS OF INTEREST The Planning Commission also took the following actions of interest to the City Council. 1. Conditionally approved the request of Mr. Wayne Richmond on behalf of Stone Brothers for a Use Permit for a Photograph Kiosk in the parking lot on the Elm Street side of the Lakewood Mail Shopping Center in an area zoned C -S, -Commercial Shopping. -7- A ® . Minutes of June 19, 1974, continued 2. Directed the staff to file a statement con- cerning the Draft Environmental Impact Report for the Replacement Site of Tokay High School at the northeast corner of South Ham Lane and Century Boulevard with the Board of Trustees of the Lodi Unified School District. 3. Directed the staff to correspond with the San Joaquin County Planning Department and express its opposition to the request of Mr. Karl Grupe by Meyer, Baumbach and Piazza to divide 2 parcels into 4 parcels each containing 1. 12 acres on the west side of Kennison Lane, 1350 feet north of Victor Road (State Highway 12) east of Lodi in an area zoned I -PA, Interim Protective Agriculture. COMMUNICATIONS Mayor Pinkerton read a letter that had been received from David Shintani, Safety Patrol OFFICER REX HEGWER Commissioner of Lakewood School praising AND LODI POLICE EX- Officer Rex Hegwer for his outstanding service PLORERS PRAISED in helping the Safety Patrol members in being more responsible on the job and also the Police Explorers for keeping order at the baseball game and at the movie. Mayor Pinkerton added his commendations to both Officer Rex Heg-er and the Lodi Police Explorers. COMPLAINTS OF Mayor Pinkerton reported that he had received TRAFFIC PROBLEM several complaints of an existing traffic problem EXISTING ON on Murray Street. The Mayor asked that staff MURRAY STREET look into this reported problem. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $439, 682. 03 were approved on motion of Councilman Katnich, Hughes second. The City Manager introduced the matter of the Lodi Avenue Widening Project. Following considerable discussion on the matter, Council- LODI AVENUE man Hughes moved that the Lodi Avenue Widening WIDENING PROJECT Project be continued to a date uncertain when CONTINUED Dr. D. Jackson Faustman would be available to appear before the Council. The motion was seconded by Councilman Katnich and carried. Speaking on behalf of the Rivergate-Mokelumne developers was Mr. William B. Sutphin, 41 Cervantes Boulevard, San Francisco, California. Following considerable discussion on this matter, and with the approval of Mr. William G. Sutphin, the Council on motion of Councilman Hughes, Katnich second, continued the request for exception to the curtailment of the Tentative Subdivision Map of the Rivergate-Mokelumne Subdivision until the August 7, 1974 City Council meeting and requested that the Planning Commission reset the Public Hearing on the con- sideration of the Revised Tentative Map of the River gate -Mokelumne Subdivision; request of Mr. William Sutphin to reduce the density of r-_)(5), Planned Development District No. 5 and to rezone a portion of the Rivergate- Mokelumne Subdivision from the R- I Single Family Residential District to P -D (5), Planned Development District No. 5; and consideration of the Final Environmental Impact Report for the Rive rgate- Mo kelumne Subdivision located on the north side of West Turner Road at North Church Street to its meeting of August 12, 1974. City Manager Glaves presented a letter that was directed to Mr. James Schroeder, Planning Director from Glen I. Baumbach, Meyer, Baumbach and Piazza, 221 West Oak Street, Lodi, California requesting a one year extension of the English Oaks tentative map. The letter states that the present approved tentative map expires August 23, 1974 and that they would like this matter to be brought before the Planning Commiss- ion on June 24, 1974. Following a lengthy discussion on the matter in which Glen I. Baumbach of Meyer, Baumbach -9- City Manager Glaves reintroduced the re- quest from the developers of the Rivergate- Mokelumne Subdivision (Turner Road at RIVERGATE SUBDI- the north end of Church Street) for exception VISION REQUEST FOR to curtailment of Tentative Subdivision Maps. Following considerable discussion on this matter, and with the approval of Mr. William G. SUPPLEMENTAL The motion was seconded by Councilman APPROPRIATIONS Katnich and carried. RECESS Mayor Pinkerton declared a five-minute recess, and the Council reconvened at 10:38 P.M. City Manager Glaves reported that subdivision improvements in "The Valley" have been "THE VALLEY" completed in substantial conformance with the TRACT NO. 985 requirements of the Subdivision Agreement SUBDIVISION between the City of Lodi and Lloyd and Larson IMPROVEMENTS AND Investments, dated February 2, 1973, and as STREETS ACCEPTED specifically set forth in the plans and specifi- cations approved by the City Council. The developer has deposited with the City of Lodi $9, 657.60 to cover the final asphalt concrete surfacing as set forth in the Agreement. On motion of Councilman Katnich, Hughes RES, NO. 3939 second, the Council adopted Resolution 3939 accepting the subdivision improvements and streets included in Tract No. 985, "The Valley". The City Manager presented an agreement with the County of San Joaquin for its services for COUNTY ELECTION the City of Lodi Special Referendum Election SERVICES to be held August 27, 1974. On motion of . RES. NO. 3940 Councilman Katnich, Hughes second, the City Council adopted Resolution 3940 authorizing execution of the agreement with the County. On motion of Mayor Pinkerton, Katnich second, SAMUEL D. SALAS the Council postponed designating the location PARK D BASIN and authorization of acquisition of the Samuel PQSTPONED D. Salas Park D Basin to give the entire Council an opportunity to inspect the property. City Manager Glaves presented to the Council several documents regarding City of Lodi Federal Revenue Sharing Appropriations; one REVENUE SHARING document was entitled, "Federal Revenue Sharing SUPPLEMENTAL Appropriations Revised May 1974" and another APPROPRIATIONS document entitled "1973-74 Revenue Sharing Recap", APPROVED which document is outlined below. D.) 3,081 Partial cost of jail padding 3, 524 $ 36,044 $317,382 The City Manager reported that the petty cash fund, which is the day-to-day working funds of the City, and which monies are used for travel advances and operation of the Finance Department, presently has an PETTY CASH FUND authorized amount of $Z, 000 which was INCREASED authorized in 1959. Because of increases in costs and growing workload, the $2, 000 is no longer adequate. City Manager Glaves requested that the Council authorize the petty cash fund be increased to $3, 000. On motion of Councilman Hughes, Katnich second, the Council authorized that the petty cash fund be increased from $2, 000 to $3, 000. City Manager Glaves reported that on November 2 1, 1973, the City Council awarded the contract to T. A. Molfino in the amount of $29, 897 for the remodeling of Hale Park Recreation Center. The City is in receipt of a letter from Haight/ Morris /Wenell, Inc., the M Minutes of June 19, 1974, continued - 12- architects for the project, indicating that they have made a final inspection of the "HALE PARK project and that the project has been completed RECREATION CENTER in substantial conformance to the plans and REMODEL" ACCEPTED specifications. The final contract amount was $30, 647. There was one change order in the amount of $750 covering the work in- volved in the repair of termite damage to the building that was not anticipated at the time the contract was awarded. On motion of Councilman Katnich, Hughes second, the City Council accepted the improvements in "Hale Park Recreation Center Remodel" and directed the Public Works Director to file a Notice of Completion with the County Recorder's Office. City Nianager Glaves reported that on February 20, 1974, the contract for "Downtown Underground District 1" was awarded to . Graffigna Electric. The City Manager stated that the contract has been completed in sub- stantial conformance with the plans and speci- DOWNTOWN fications approved by the City Council. Written UNDERGROUND acceptance has been received from the Pacific DISTRICT 1 Telephone Company and from Lodi Cable T. V. ACCEPTED The contract completion date was June 6, 1974, and the actual completion date was June 14, 1974. The contract amount was $6 1, 890. 00 and the final contract price was $61, 870. 50. On motion of Councilman Hughes, Katnich second, the City Council accepted the improve- ments in "Downtown Underground District 1" and directed the Public Works Director to, file a Notice of Completion with the County Recorder's office. The City Manager related to the Council that in July 1969, the Council instructed the Staff to CURB, GUTTER cause the installation of sidewalks on City - AND SIDEWALK owned property and that as a part of this program, IMPROVEMENTS the City Manager is recommending curb, gutter APPROVED and sidewalk installation on the West side of Stockton Street, Lawrence Avenue and Washington Street at an estimated cost of $34, 600. During the preparation of plans for this project, the Utility Department estimated the cost of street lights for lighting this area of public property to be $11, 400. If the City Council determines that work should proceed on the street lights, the bases and conduit will be included with the con- tract, but the erection of the standards and the wiring will be provided by the Utility Department. The City Manager also recommended that the balance of sidewalk on Stockton Stre et between - 12- 410 Minutes of June 19, 1974, continued Lockeford and Lawrence and on Lockeford Street between Stockton Street and Washitigton Street be installed. Both of these streets will be widened in the future and any work done in _ this area will have to be redone when the street is widened. The estimated cost for this work is $1Z, 500. In order to place this side- walk in its ultimate location, it would necessi- tate street widening and the removal of several large Sycamore trees and some modification to the Lawrence Park Softball Diamond. Or. motion of Councilman Katnich, Hughes second, the Council approved the installation of curb, gutter and sidewalk on the West side of Stockton Street, Lawrence Avenue and Washington Street at an estimated cost of $34, 600; the installation of street lights in the above area at an estimated cost of $11, 400; and sidewalk on the balance of Stockton Street and Lockeford Street at an estimated cost of $12, 500. On motion of Councilman Hughes, Katnich second, the Council authorized the installation of curb, gutter, and sidewalk in the area of the storm drain located on the south side of the 2000 block of West Tokay Street at an estimated cost of $400. 00. The City Manager reported that Utility Truck #27 had been extensively damaged in an accident and that a local agency has in their inventory a cab and chassis which would be suitable for replacing this damaged vehicle. PURCHASE OF CAB On motion of Councilman Katnich, Hughes second, & CHASSIS the Council authorized the purchase of a new cab AUTHORIZED- and chassis for the Utility Department to replace UTILITY DEPT. Truck #27 extensively damaged in an accident, which purchase is to be made from Geweke Ford in the amount of $3, 998. -13- Specifications for a Logging Recorder System SPECS- POLICE for the Police Department were presented to DEPARTMENT the Council. On motion of Councilman Hughes, LOGGING RECORDER Pinkerton second, the Council approved the SYSTEM specifications for a Police Department Logging Recorder System and authorized the advertising for bids thereon.
