HomeMy WebLinkAboutMinutes - October 15, 1975A-' #J CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS OCTOBER 15, 1975 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p. m. , Wednesday, October 15, 1975, in the City Hall Council Chambers. ROLL CALL Present: Councilmen EHRHARDT, HUGHES, KATNICH, PINKERTON, and SCHAFFER (Mayor) Absent: Councilmen - None Also Present: City Manager Glaves, Assistant City Manager Glenn, Assistant City Attorney Sullivan, Community Development Director Schroeder, Public Works Director Ronsko, and City Clerk Reimche INVOCATION The invocation was given by Dr. Richard E. Morton. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. MINUTES Councilman Katnich moved the minutes of October 1, 1975 be approved as written and mailed. The motion was seconded by Councilman Pinkerton and carried. COMPLAINT Mr. Terry Knutson, 29 N. Allen Drive, Lodi, REC'D RE California addressed the Council expressing his con - DOWNTOWN AREA cern of the problems being encountered in the down- town area involving young people regarding customer interference, loitering, jamming of sidewalks, open drinking by young people and littering. Mr. Knutson stated that it is a real mess and added that Lodi businessmen are willing to do their share in chaining their lots and properly posting their property. Mr. Knutson stated that the thing that really bothers him is that there is a process going on in our community, which is being created by a loss or lack of authority. Mr. Knutson added that he feels the citizens of this community have a real responsibility to these young people; that he feels an outcry is needed from the public to bring to the attention of these young people the fact that the citizens of this community will not tolerate these conditions any place within the City. A lengthy discussion followed with Council expressing its concern regarding this situation. Councilman Ehrhardt indicated his willingness to meet with the young people involved to discuss their wants and needs. -1- 257 Minutes of October 15, 1975, continued There was additional discussion with Council concurring that additional time would be needed so that all aspects and legal ramifications of this problem can be studied prior to action being taken on this matter by the Council. Mayor Schaffer then directed that the matter be set over for further discussion by the Council at the next Shirtsleeve Session. Mr. Dave Dillon, 610 S. Mills Avenue, Lodi addressed the Council, stating that he represented a group of concerned parents living in the area of Mills Avenue and expressed the group's concern regarding the Mills and Tokay intersection. Mr. Dillon stated that they were aware that a recent staff report had indicated that this intersection didn't meet the warrants for a 4 -way stop; however it is felt that this is a unique situation inasmuch as approximately 36% of the children attending Vinewood School live in the Mills Avenue area. Mr. Dillon stated that there are 100 plus children crossing this intersection every day. CITIZENS REQUEST Dr. Thomas E. Barnett, 741 S. Mills Avenue, Lodi MILLS & TOKAY BE stated that a survey had been made of the number of DESIGNATED AS A children living on S. Mills Avenue between Lodi 4 -WAY STOP Avenue and Vine Street and that the survey indicated INTERSECTION 84 children living inthe:surveyed area. Dr. Barnett stated that it is a unique corner, because it is the only one that these children can cross to get to Vine - wood School. Dr. Barnett pled that this intersection be established as a 4 -way stop intersection. Mr. Charles Simpson, 531 S. Mills Avenue, Lodi indicated that in the Traffic Investigation Study done by City staff of this intersection last June, it was Staff's recommendation that there be additional enforcement. Mr. Simpson emphasized that if the problem is one of enforcement, "then let's have some enforcement". A lengthy Council discussion followed with questions being directed to staff. Public Works Director Ronsko briefed Council on the Traffic Investigation study that had been prepared by staff in June. Mr. Ronsko stated that it is staff's position that with the information available, a recommendation for a 4 -way stop at this intersection could not be made at this time. Continued discussion followed on this matter, with Staff being"directed by Council to restudy this inter- section and prepare a Traflic Investigation report for presentation to the Council at the November 5, 1975 regular Council meeting. PLANNING COMMISSION ACTIONS OF The City Manager gave the following report of the INTEREST Planning Commission meeting of October 13, 1975: -2- Minutes of October 15, 1975, continued The Planning Commission - 1. Certified the Final Environmental Impact Report for the Master Plan for the Development of Lodi Lake Park as being adequate. 2. Approved the request of Mr. Ron Thomas to divide a 9. 53 -acre industrial parcel into 4 sites, three of which would have access to a public street via a private acces sway at 16 11 South Stockton Street in an area zoned M-2, Heavy Industrial conditioned on necessary easements, utility solu- tions, bonds and agreements. 3. Determined that the lot shape constituted a Zoning Hardship and approved the request of R and W Construction Company by Mr. James E. Watson for a Variance to reduce the required off-street parking from 5 spaces to 4 spaces to permit the construction of a triplex at the northwest corner of West Elm Street and Rutledge Drive in an area zoned Planned -Development District No. 6(P -D(6)). INTERIOR Councilman Hughes questioned Community Develop - PARKING FOR ment Director Schroeder regarding Item 3 of the DUPLEX Planning Commission Report concerning the CONSTRUCTION October 13, 1975 meeting. Councilman Hughes then ENCOURAGED expressed his feelings that the Planning Department should be encouraged to very strongly review any future building plans where multi -family dwellings front out on the street and that interior or alley -type parking should be encouraged for this type of structure. COMMUNICATIONS ABC LICENSES The City Clerk presented an application which had been received for Alcoholic Beverage License for Joseph R. , Jr, and Linda S. Morphis, 548 S. Sacramento Street, Lodi, "Bent Pretzel". This is an Or. Sale Beer and Wine Eating Place License and is a Person to Person Transfer. The City Clerk also presented an application which had been received for Alcoholic Beverage License for Ladon J. Strapp, Don Strapp's Arco, 800 E. Kettleman Lane, Lodi. This is an Off Sale Beer and Wine License and is a new license. PUBLIC HEARING An announcement of a Public Meeting which had been DEPT. OF THE received from the Department of the Army was ARMY presented by the City Clerk. The meeting is to be held Tuesday, October 2 1, 1975 at the Sacramento Municipal Utility District Auditorium, 6201 "S" Street, Sacramento, California. The meeting is being held to describe the Corps' involvement in the permit program and will explain the revised regulations published July 25, 1975 in the Federal Register, defining the actions to be taken by the Corps of Engineers under Section 404 of Public Law 92-500, the Federal Water Pollution Contract Act Amendments of 1972. -3- 25G Minutes of October 15, 1975, continued PROPOSAL City Clerk R.eimche presented a letter which had RECEIVED FOR been received from Mr. Patrick B. Purdy, 310 S. MINI BUS Washington Street, Lodi proposing to initiate a SERVICE mini bus service within the City of Lodi. Mr. Purdy proposes to originally purchase one I976 club wagon which would carry 12 passengers and intends to charge 50� for a ride anywhere within the City Limits. Council consideration of this proposal was requested by Mr. Purdy. Following Council discussion, Mayor Schaffer requested that Councilman Ehrhardt and a commit- tee of Councilman Ehrha;dt's selection meet with Mr. Patrick Purdy regarding Mr. Purdy's proposal. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $627, 611. 34 were approved on motion of Councilman Ehrhardt, Pinkerton second. As requested by the City Council at the regular Council meeting of October 1, 1975, Profit and Loss Statements were submitted by the Lodi Ambulance Service for periods covering January 1, 1974 to September 30, 1974 and January 1, 1975 to September 30, 1975 for Council's perusal. LODI AMBULANCE Mr. Perry Schimke, co-owner of the Lodi Ambulance SERVICE RATE Service addressed the Council answering questions as INCREASES were directed by the Council. APPROVED On motion of Councilman Pinkerton, Ehrhardt second, Council accepted the Profit and Loss Statements as submitted by the Lodi Ambulance Service and approved the rate increases as were conditionally approved by Resolution No. 4106 which had been adopted by the Lodi City Council October 1, 1975. SPECS APPRVD. Specifications for an Electronic Cash Register for the FOR ELECTRONIC Recreation and Parks Department were presented by CASH REGISTER the City Manager for Council approval. Following FOR RECREATION Council discussion with questions being directed to AND PARKS DEPT. staff, Councilman Ehrhardt moved that Council approve the specifications as were presented and authorize the Purchasing Agent to advertise for bids thereon. The motion was seconded by Councilman Pinkerton and carried. SPECS APPROVED FOR STREET SWEEPER City Manager Glaves presented specifications for a Street Sweeper for the Public Works Department stating that a normal life for this type of equipment is from five to seven years. No trade-in will be made on this piece of equipment, and, therefore, the City will be able to continue on its street sweeping schedule and provide citizens better service during periods of mechanical breakdown or maintenance of the new sweeper with the availability of the older piece of equipment. On motion of Councilman Pinkerton, Katnich second, the City Council approved the, specifications for the pur- chase of a new Street Sweeper, and authorized the Purchasing Agent to advertise for bids thereon. 2 Minutes of October 1c., i9715, ccntirued SPECS APPROVED Specifications for the zes,.irfacing of the Hale Park FOR RESURFACING Tennis Courts were prevented to the Council by OF HALE PARK City Manager Graves, Mr. Graves s=ated that these TENNIS COURTS courts had been co.^s`-z ac :ed in 1944 or 1945, and this will be the first resurfacing work that has ever been done on these courts. The work will consist of cleaning and repairing of existing surface, applying prime tack coat, filler coat, finish color coat, and court lines. Councilman Hughes moved that the specifications for the resurfacing of the Hale Park Tennis Courts be approved and that the Purchasing Agent be authorized to advertise for bids thereon., The motion was seconded by Councilman. Pinkerton and carried by unanimous vote. PLANS AND SPECS The City Manager presented plans and specifications FOR CLEARING OF for "Building Demolition/Cle wring of the Library LIBRARY SITE Site located at 210 N. Pleasant Avenue and 223 West APPROVED Locust Street". Mr. Glaves apprised the Council that in general, the work would consist of demolition of the remaining accessory building on the site, con- crete removal, filling the basements, and general cleanup. Included in the specifications is an alternate bid for the removal of the concrete slab and foundation from the easterly portion of the site. On motion of Councilman Ehrhardt, Hughes secorrl, Council approved the plans and specifications for "Building Demolition/Clearing, 210 N. Pleasant Avenue and 223 West Locust Street" and authorized the City Clerk to advertise for bids thereon. PROPOSED City Manager Glaves presented a proposed ordinance ORDINANCE RE entitled, "Ordinance Repealing Chapter 4 of the Code BICYCLE of the City of Lodi and Re-enacting said Chapter 4 LICENSING to be entitled 'Bicycles - Licensing Required' This proposed ordinance incorporates requirements as mandated by passage c.f recent State legislation and sections of the City's existing ordinance pertaining to this subject. A lengthy discussion followed with particular concern being expressed by the Ccuncil regarding Section 14 of the proposed ordinance whereby "all persons engaged in the business of buying second-hand bicycles are required to make a daily report to the Police Department --------" Additional discussion followed with the Council concurring that additional study of this matter was necessary. On mciion of Councilman Pinkerton, Ehrhardt second, the matter was held over to the next regular Council meeting to be held November 5, 1975 and the Chief of Police was directed by Council to operate under the existing ordinance whereby bicycle licenses are to be sold at a fee of S1. 00 until such time as the existing ordinance is amended or repealed. -5- 261 Minutes of October 15, :975, continued At the regular Counc=: meetlr_g of September 17, 1975, the City Council directed staff to study a request from the Lodi Sa_e`y Council for the installation of sidewalk on the east side of Cherokee Lane from the Tokay Bowl to Lodi Avenue. Public Works Director Ronsko apprised the Council that in May 1973, the Engineering Division prepared a 'Traffic Engineering Investi- gation for the City Council regarding pedestrian protection for school children and others in crossing Cherokee Lane, between Kettleman Lane and Lodi Avenue, and a copy of this study was presented for Ccuncil's perusal. Mr. Ronsko informed the Council that the estimated cost of installing sidewalk in the area of the East side of Cherokee Lane from the Tokay Bowl to Lodi Avenue, depending upon width, landscaping, and other incidentals could vary between $8, 000 and $12, 000 and that if immediate action were taken by the City Council for the sidewalk installation, it could take until March 1976 before the sidewalk is finally completed. It is staff's understanding that Lincoln School is to be closed once Garf ield School is reopened. Mr. Ronsko stated that because of 1) the period of actual use of the proposed sidewalk, 2) the cost of installing sidewalk; 3) the hazards involved in operating an Adult Crossing Guard an Cherokee Lane; 4) the unmet warrants for traffic signal installation; 5) the unreliability of flashing yellow warning devices; and 6) the possible reimbursement by the State for bus transportation, it is Staff's recommendation that the Lodi Unified School District, investigate the use of buses to transport children to Lincoln School from east of r'herokee Lane. '. construct a temporary walkway on the east side of Cherokee Lane from the bowling alley north to the signalized intersection of Lodi Avenue to serve children traversing this area. The motion was seconded by Councilman Katnich and carried. BIRTHDAY Birthday greetings were extended by the Council to GREETINGS TO Councilman Katnich. COUNCILMAN KATNICH City Manager Glaves presented bids which had been received for a 1976 standard size 4 -door sedan to be used by the City Manager. On motion of Councilman Pinkerton, Katnich second, Council adopted Resolution No. 4108 awarding the bid for a 1976 four door sedan to be used by the City Manager to the low bidder, Swearingen-Jentoft (Oldsmobile 88) in the amount of $4, 012. 55. SPECS APPRVD City Manager Glaves presented specifications for a FOR 1976 COM- compact vehicle to be used to replace the Assistant PACT 4 -DOOR Utility Director's automobile. On motion of SEDAN FOR Councilman Katnich, Ehrhardt second, Council UTILITY DEPT. approved the specifications for a 1976 compact size, 4 -door sedan for the Utility Department and authorized the Purchasing Agent to advertise for bids thereon. LOAD LIMITS & Councilman Pinkerton expressed his feelings that TRAFFIC due to recent changes in State laws regarding increased INVESTIGATION - load limits for trucks, and due to the fact that Turner TURNER ROAD Road is not designated for this type of traffic, Councilman Pinkerton feels that a sign should be posted stating that "Thru Trucks are Forebidden". Following an inquiry by Councilman Pinkerton, City Manager Glaves apprised the Council that the re- quested traffic investigation of Turner Road is partially completed and will be forthcoming to the Council shortly. Councilman Ehrhardt reported on a luncheon that he and other Council and staff members had recently CONCERN RE attended. The subject of the I-5 Cry to the State I-5 GAP Highway Commission was brought up at this luncheon. Councilman Ehrhardt expressed his concerns regarding vehicular safety resulting from the "I-5 Gap" and suggested that the City Council as well as the citizens of Lodi join with KJOY and the Stockton Chamber of Commerce in sending cards to the Governor encouraging the completion of the "1-5 Gap". Mayor Pro Tempore Hughes reported on a meeting that he had recently had with Ms. Cortopossi in which she PROPOSED indicated her concern about the position that had been NUCLEAR taken by the Lodi News Sentinel on nuclear power INITIATIVE plants. The article indicated that the proposed nuclear initiative for all practical purposes eliminates nuclear power plants. Following careful scrutiny of the proposed nuclear initiative by Mayor Pro Tempore Hughes, he drafted a letter to Ms. Cortopossi explaining his concerns -7- 26� Minutes of October 15, _1971, .continued and opposition tc. this __._ti3ti','e in detail, A copy of this letter was given each Councilman for perusal. Counc_lman Ehrhardt ~eFcr'.t.d z)r. a recent meeting he had attended of the. League cf University Women which incorporated a workshop on the theme of "Nuclear Energy -Safe or Sorry". E.I.R. LODI LAKE Community Development Director Schroeder distri- MASTER PLAN buted to the Council final E. I.R.'s on the Lodi Lake Master Plan. Mr. Schroeder indicated that this report will now be submitted to the State and the Federal Government as the City's Environmental documentation on this project. COUNCIL URGED Mayor Schaffer encouraged all Councilmen to attend TO ATTEND the Annual League of California Cities Conference WORKSHOP ON Workshop on Land Use Controls and their impact LAND USE upon California to be held Sunday, October 19, 1975 CONTROL at 2:00 p.m. ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at approximately 10.45 p.m. by Mayor Schaffer on motion of Council- man Pinkerton, Ehrhardt second. 7b � Attest: ALICE M.
