HomeMy WebLinkAboutMinutes - February 4, 197635: CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS FEBRUARY 4, 1976 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, February 4, 1976 in the City Hall Council Chambers, ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, KATNICH, PINKERTON and SCHAFFER (Mayor) Absent: Councilmen - None Also Present: City Manager Glaves, Assistant City Manager Glenn, Public Works Director Ronsko, City Attorney Mullen, and City Clerk Reimche. INVOCATION The invocation was given by Reverend Larry Childers, 7th Day Church of God. PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag. Dr. Thomas Car:eton, 325 W. Lockeford Street, Lodi, addressed the Council stating that it had come to his attention that a busi- ness that was planning to locate in Lodi might not do so, because of a technicality. An Agreement to purchase had been signed DR. THOMAS for the building located at 401 W. Lockeford CARLETON Street, Lodi by a gentleman intending to EXPRESSES locate a retail business at that location. The CONCERNS RE prospective purchaser of this property had, PROVIDING OF according to Dr. Carleton, stated that unless ADDITIONAL he can provide some sort of arrangement to PARKING park eight cars there, he would not be allowed to open the business. Dr. Carleton further related that because of recent structural alterations to his business located at 325 W. Lockeford Street, Lodi, he is being required to provide additional parking spaces. Dr. Carleton stated that he has had a veterinary practice at this location since 1951, but has now decided to divide this practice; the veterinary practice to have one opening, and the pet supplies and grooming a second door. Now, because-,valls have been constructed around a roof that was existing, suddenly, Dr.. Carleton stated that he is being required to have two more parking stalls that he cannot provide. -I- 3 ? Minutes of February 4, 1976, continued Council discussion followed with questions being directed to Staff and Dr. Carleton. Dr. Carleton together with a representative of the business proposing to locate at 401 W. Lockeford Street, Lodi were asked to meet with City Manager Glaves regarding the concerns expressed by Dr. Carleton. COMMUNICATIONS ABC LICENSE The City Clerk presented an application for Alcoholic Beverage License which had been re- ceived for Zidan Supiaban, The Winery, 548 S. Sacramento Street, Lodi - On Sale Beer and Wine Eating Place License, Person to Person transfer. P.U.C. APPLICATION A Notice of Hearing before the Public Utilities Commission of the State of California was pre- sented by the City Clerk. This pertains to Application No. 56160 of the Pacific Gas and Electric Co. applying for authority to increase rates for electric service due to fuel cost adjust- ments. The hearing has been set for February 13, 1976 at 10:00 a.m. , Commission Courtroom, State Building, 350 McAllister Street, San Francisco, California. REPORTS OF THE CITY MANAGER CONSENT In accordance with the report and recommendation CALENDAR of the City Manager, the following actions hereby set forth between asterisks, on motion of Council- man Pinkerton, Katnich second, were approved by the Council. AGREEMENTS WITH City Manager Glaves presented for Council's LAWRENCE P. & scrutiny two agreements between Lawrence P. ANNE MEYERS & and Anne Meyers and the City of Lodi covering CITY OF LODI the dedication to the City of two parcels for the APPROVED installation of facilities under the "Downtown Underground District III" project, explaining that no payrne.nt is included in the agreements; however, replacement of existing paving and other areas affected during construction is included. COUNCIL A - i HORIZED THE CITY MANAGER TO SIGN THE TWO AGREEMENTS BETWEEN LAWRENCE P. AND ANNE MEYERS AND THE CITY OF LODI ON BEHALF OF THE CITY AND AUTHORIZED THE CITY CLERK TO ACCEPT THE EASE-MENT DEEDS. City Manager Glave_ introduced the matter of the Turner Rvad Truck Traffic investigation. Public Works D1 ec to Ronsko highlighted the Staff report as req ess ed by Mayor Schaffer. Diagrams of the types of trucks using Turner Road were presan`_ed for Council's perusal by Mr. Ronsko. Results cf traffic counts taken on THROUGH TRUCK Turner R. ad were presented also to the Council. Alternate 2 Section 14-24 of the Lodi City C --de skates, in brief, that the City may designate any 34,eet as a street the use of which is prohibited by any - eh c_e exceeding a maximum gross weight as specified by the City Council. This approach essentially closes ::nly those streets so designated and leaves all other streets open to truck traffic. An excellent example of the result of this approach is that portion of Tokay Street that has been pro- hibited to heavy trucks. In :hat case, the Engineering Department has :ece-ved nume-cus complaints from resi- dents on Maple Street that, since the prohibition on Tokay Street, trucks are now usi :Q Map -'e Street as an east -west route between Cherokee Lane and Stockton Street. LAW ENFORCEMENT _he City Council was advised that a body of law SAFETY EQUIPMENT now exists which requires the City to provide a POLICY ADOPTED full rar_ge of Safety Equipment to Police Officers. COUNCIL RECOM- Assistant City Manager Glenn presented for MENDS ADOPTION Council's perusal a proposed Law Enforcement OF JOINT POWERS Safety Equipment Policy. Discussion followed AGREEMENT with questions being directed to staff. APPLICATION Councilman Ehrhardt then moved that the Council adopt the Law Enforcement Safety Equipment Policy as proposed by Staff. The motion was seconded by Councilman Katnich and carried. Plans and specifications for "Cherokee Lane Storm Drain -West Side, 600' S/o Kettleman Lane to Kettleman Lane" were presented for Council approval. PLANS & SPECS FOR Public Works Director Ronsko apprised the "CHEROKEE LANE Council that in general the work consists of STORM DRAIN -WEST constructing a 12 -inch storm drain line from the SIDE" APPROVED existing catch basin at Cherokee Lane and _. Kettleman Lane southerly in the future median to a new catch basin at the south property line of the Lit,fin Rock Sales property. This is to provide drainage for Mr. Litfin's property as well as all properties to the south that have constructed, or wish to construct, new curb and gutter. VISITOR WELCOMED Mayor Schaffer welcomed Mr. R. J. Sailer of Bismark, North Dakota who was in the audience. COUNCIL TO HEAR Mayor Schaffer apprised the Council that the PRESENTATION ON owners of the Lodi Ambulance Service had PARAMEDIC PRO - requested time at the Informal Informational GRAM meeting of February 17, 1976 to address the Council on the subject of a Paramedic Program. It was suggested that Supervisor George Barber be invited to attend that session, and Staff was directed to make the necessary ar rangements . DATES OF INTEREST Mayor Schaffer reminded the Council that on February 12, 197 6, the City of Lodi is hosting the Cities and County meeting at Croce's, and that on the same night Councilman Katnich will represent the City at the Hall of Fame Sports Banquet. Councilman Ehrhardt announced that the COG Transportation Planning -Policy Committee meeting has been changed to February 20, 1976 at 3:30 p. m. Mayor Schaffer reminded the Council that a request had been made sometime ago to appear before the California Highway Commis- sion regarding the completion of I-5 at that body's meeting to be held on February 18 and 19, 19'6 and asked that confirmation of thio appearance be made. RECOMMENDATIONS Following an inquiry by Councilman Pinkerton OF LODI HIGH regarding the recemmendatior.s made by the PARKING LOT Lodi High Parking Lot Committee, City COMMITTEE Attorney Mullen stated that the proposed sticker and Courtesy card would constitute "special pri•,iieges" as well as a denial of the students' rights to equal protection of the law; however, he stated that two hour parking could be estab- lished in the area. Staff was directed to place on the Agenda for the City Council meeting of February 18, 1976 consideration of the establishment of two-hour pa:kirg in the area of Lodi High School.
