ROLL CALL Present: Councilmen - Ehrhardt, Hughes, Katzakian, Pinkerton and Katnich(Mayor) Absent: Councilmen - None Also Present: City Manager Glaves, Assistant City Manager Glenn, Public Works Director Ronsko, City Attorney Mullen, and Community Development Director/Deputy City Clerk Schroeder. INVOCATION The invocation was given by Reverend Richard Lungren, First Methodist Church. PLEDGE Mayor Katnich led the Pledge of Allegiance to the flag. MINUTES On motion of Councilman Pinkerton, Ehrhardt second, Council approved the Minutes of October I9, 1977 as written and mailed. PLANNING COMMISSION The City Manager gave the following report of the Planning Commission meeting of November la, 1977: The Planning Commission - REZONE 12.93 ACRE 1. Recommended approval of the request of Mr. PARCEL AT 710 S. Cye G. Vaughan, Jr. to rezone a 12.93 acre BECKMAN ROAD parcel at 730 South Beckman Road from R-1, FROM R- 1 TO M- 1 Single -Family Residential to M- 1, Light Indus- t -ial ndus-t-ial in conformance with the Land Use Element of the General Plan. On motion of Councilman Ehrhardt, Katzakian second, the matter was set for public hearing on December 7, 1977. CONSIDER AMENDIMEN= 2. Conditionally approved the request of Grupe Development Company on behalf of Federal Pro- jects, Inc. for a Use Permit to construct a 160 - unit apartment complex on the west side of Winchester Drive between Wimbledon Drive and Harney Lane in an area zoned Planned Develop- ment District No. 4 (P -D(4) ). COMMUNICATIONS Deputy City Clerk Schroeder presented the following communications: PUBLIC HEARING BEFORE BOARD OF a) A notice of the San Joaquin County Board of SUPERVISORS Supervisors' Public Hearing regarding an Agri- cultural Preserve, to reclassify to GA -40 (General Agriculture) the property located (1) on the north and south sides of Taylor Road, 1322' west of Lower Sacramento Road; and (2) on the west side of Lower Sacramento Road, 662' north of Taylor Road, west of Lodi and which is now _ classified as I -PA (Interim Protected Agriculture). Howell, 1709 W. Kent Street, Lodi. On motion of Councilman Pinkerton, Ehrhardt second, the Claim was rejected and referred to the City's Contract Administrator. DAVID SMITH DAY Mayor Katnich proclaimed December 22, 1977 as 12 /22 177 "David Smith Day" and stated that a 24 hour tele- thon will be held that day on David's behalf. The City Manager also presented a letter which had been received from the Southern Pacific Transpor- tation Company advising that it will commence painting of its Lodi station on December 5, 1977. CONSENT CALENDAR In accordance with the report and recommendation of the City Manager, the following actions hereby set forth between asterisks, on motion of Council- man Pinkerton, Ehrhardt second, were approved by Council. Alternate 1 $12,497.40 Alternate 2 $12, 265.80 Subgrade Construction Alternate 1 $15,070.00 Corp. Alternate 2 $11,250.00 Following the City Manager's recommendation,. Council adopted the following Resolution: RESOLUTION NO. 4421 AWARD - CONTRACT FOR "LODI LAKE STORM PUMPS" TO SAN JOAQUIN PUMP COMPANY, THE LOW BIDDER (ALTERNATE 1) IN THE AMOUNT OF $12,497.40. ELIMINATING VARIOUS Council was apprised that because of the recent. PARKING & TRAFFIC construction of the new high school at Century RESTRICTIONS IN AREA Boulevard and Ham Lane, it will no longer be OF OLD TOKAY HIGH necessary to retain certain traffic restrictions in the vicinity of Old Tokay High School. Those RES. NO. 4422 restrictions that will remain are, according to Constantine Baranoff, Facilities and Planning Director for the Lodi Unified School District, necessary for the use of those students still using the old campus site. A no parking zone on the north and south sides of Walnut Street between California Street and Hutchins Street (not established by resolution or ordinance.) 12 -MINUTE PARKING Council was apprised of Staff's recommendation that ZONE EST. ON ELM a 12 -minute parking zone be established on Elm ST. ADJACENT TO Street adjacent to the Pacific Telephone Business P. T. &. T. office. There are presently 23 "no limit" on -street parking stalls on Elm Street between Lee Avenue and RES. NO. 4423 Pleasant Avenue. Most of these stalls, including _ - those in front of the Pacific Telephone Building, are occupied during the day by downtown employees. The 12 -minute zone would, in most cases, provide enough time for those people doing business at the telephone office. The proposed plan has the approval of the Police Department and Len de Gallery, manager of Pacific Telephone. RESOLUTION NO. 4423 RESOLUTION ESTABLISHING 12 -MINUTE PARKING ZONE ON ELM STREET ADJACENT TO PACIFIC TELEPHONE BUSINESS OFFICE. Following receipt of notices that pursuant to Section RES. Max Lee '105, 568.00 Teichert Construction Company $132,234.50 On motion of Councilman Ehrhardt, Katzakian second, Council adopted Resolution No. 4426 awarding the contract for "Lodi Avenue Street Improvements, WID Canal to Cabrillo Circle" to Claude C. Wood Company, the low bidder, in the amount of $102, 655. 20, subject to concurrence from the Federal Highway Administration. PRESENTATION- Mrs. Beryl Geo-guson, 2223 Cochran Road, Lodi ZONING MATTERS addressed the City Council concerning the section of the Municipal Code which permits residential B. GEORGLISON development in areas zoned C -P, Commercial - Professional. She claimed that the present re- quirements were misleading because the general public did not expect apartment complexes to be erected in areas designated for professional offices. Mrs. Georguson's specific concern was a 34 -unit apartment structure under construction at the southwest corner of Lower Sacramento Road and Cochran Road north of the Community Hospital. She felt that the people of the neighborhood had been misled by the Environmental Impact Report prepared in 1974 by the City Planning Department on the General Plan Amendment to expand the Commercial -Professional which stated that "low- density" residential development would be permitted. She said the current project could go as high as 40 units per acre while low-density was 10 units per acre. Mrs. Georguson felt that a new EIR should be pre- pared which outlines the "cumulative" affect of apartments in the subject area and stuggested that the C -P, Commercial -Professional District be amended to exclude residential construction. Mr. William H. Gretsirger, 904 West Turner Road, Lodi. He stated that he had visited the home of each Planning Commissioner and none of the members of that body had apartments in their neighborhoods. He also urged the City Council to save natural resources and to "Buy American". Mrs. Bonnie Meyers, 1619 West Elm Street, Lodi. She asked questions of the Council concerning Mrs. Georguson's presentation. 375 A general discussion among Council and Staff followed her presentation. GIFT OF OLD Council was apprised that the San Joaquin County RECORDS AUTHORIZED Historical Museum had agreed to receive as a deed of gift for preservation and display certain RES. NO. 4427 old City records dating back to the early 1900'x, - The City Attorney has reviewed the inventory of these records and concurs that it would be in order for such a deed of gift to be made to the Museum. On motion of Councilman Ehrhardt, Katzakian second, Council by unanimous vote adopted Resolution No. 4427 authorizing a Deed of Gift of certain old City Records to the San Joaquin County Historical Museum for permanent storage and dis- play at the Museum. M Minutes of November 16, '_977, continued PRESENTATION- Mrs. Ann Cerney, 900 West Vire Street, Lodi. ZONING MATTERS She stated that she was a practicing Attorney - B. GEORGUSON at -Lasa and wished to speak to four points. First, (Continued) she felt that high density livir_g arrangements were - of citizen concern throughout the community. Secondly, she said C -P zoning allows more than meets the eye and the City Council should make a committmert to correct this problem. Thirdly, the Community Hospital EIR was misleading to the public and finally it did not meet the Title 14 guidelines as promulgated on January 1, 1977. Mayor Katnich stated that the City Council would take the above comments under advisement and place the matter on the agenda of the next regular session. RECESS Mayor Katnich declared a five-minute recess, and the Council re -convened at 9:30 p.m. TRANSPORTATION PLAN Mrs. Athena Moran, Executive Director, Easter PRESENTATION Seal Society for Crippled Children and Adults of A. MORAN San Joaquin and Stanislaus Counties, Inc., 1700 EASTER SEAL SOCIETY McHenry Way, McHenry Medical Center, Modesto was present and addressed the Council on the pro- posed Transportation Plan. She urged the Council to obtain a van equipped with a wheelchair lift and stated that her organization knew of 35 people in Lodi confined to wheelchairs. She said that the proposal to use taxi cabs would not work for these people because of the difficulty of getting wheel- chair users in and out of standard automobiles. Mrs. Moran stated that motorized wheelchairs can not be transported in standard automobiles. Mrs. Moran stated that the wheelchair lift equipped -tan could be purchased with UMTA funds. A general discussion among Council and Staff followed her presentation. M 376 Min 1a,es of November 16, 1977, continued AWARD -CHEROKEE LANE WATERMAIN, City- Manager Glaves presented the following 200'S/ALMOND DRIVE, bids which had been received for "Cherokee TO KETTLEMAN LANE Lane Watermain, 200' S/Almond Drive to Kettleman Lane", EDA Project No. 07 -51 - RES. NO. 4428 26803: BIDDER BID Claude C. Wood Co. $110,905.25 W. M. Lyles Co. $127,841.80 Council was apprised that the Engineer's estimate. was $74, 806. 50. The estimate according to Staff was low mainly because of underestimating the cost of repaving and traffic control which was in- cluded in the cost of 8 -inch pipe. The amount of the Local Public Works Project Grant for Cherokee Lane Watermain is $90, 000. Due to the amount of the low bid, and the amount of tk* grant, it was recommended that that portion of the project which is basically fronting undeveloped land on the east side of Cherokee Lane between Sta. 11+70 and ZZ+95 be eliminated. Overruns on this type of project are not anticipated; however, in order to balance the project, the City will also be responsible for funding any extra work or contingencies. Following Council discussion, Council, on motion of Councilman Pinkerton, Ehrhardt second, adopted Resolution No. 4428 awarding the contract for "Cherokee Lane Watermain, 200' S/Almond Drive to Kettlemar: Lane" to Claude C. Wood Company, the low bidder, in the amount of $84, 000, plus or minus, sutject to negotiations with the contractor for the exact contract amount. COUNCIL REJECTS Council was apprised that only one bid had been BID & AUTHORIZED received for the Grit Washer for White Slough as READVERTISING FOR follows: GRIT WASHER BIDDER AMOUNT E. C. Cooley & Co. $11,464 Staff's estimate was $7, 050. 00. It was Staff's recommendation that the Council reject and not award the sole bid and that the City Council con- sider readvertising this contract in the near future, thereby allowing more time for vendors to ready their bids. Council discussion followed with questions being directed to Staff. On motion of Councilman Katzakian, Pinkerton second, Council approved the proposed Agreement for the use of the Lodi Grape Bowl for a special playoff game in the San Joaquin Section C. I. F. PROJECT FOR CENTURY A cost estimate and diagram of the proposed PARK APPROVED Century Boulevard Park Development was pre- sented for Council's scrutiny. The City Manager apprised the Council that the estimated cost'of the proposed project was $16, 230. 00. Council discussion followed with questions regard- ing the proposed project being directed to Staff. Council, on motion of Councilman Katzakian, Ehrhardt second, unanimously approved the pro- posed Century Boulevard Park Development Project. VOTING DELEGATE Following introduction of the matter by City & ALTERNATE Manager Glaves, Council on motion of Councilman DESIGNATED FOR Pinkerton, Ehrhardt second, designated Mayor NATIONAL LEAGUE Katnich as the voting delegate and Mayor Pro CONFERENCE Tempore Pinkerton as the voting alternate for the _ - = National League Conference to be held in San Francisco December 3 - 7, 1977. Council discussion followed with questions being directed to Staff. On motion of Councilman Katzakian, Ehrhardt second, Council adopted Resolution No. 4429 awarding the contract for the restrooms only at Beckman and Twin Oaks Park to Angelo Fanos. the only bidder, in the amount of $82, 604 (Items # 1 and #2 of the bid) subject to the approval of their minority participation. City Manager Glaves presented the following bid AWARD -CONTRACT which had been received for the contract for FOR CENTURY BLVD., "Century Boulevard, Beckman Road and Kettle - BECKMAN RD. & man Lane Storm Drain": KETTLEMAN LANE BIDDER AMOUNT STORM DRAIN BIDDER AMOUNT RES. NO. 4430 Teichert Construction Co. $295,707 - The City Manager apprised the Council that the project is being funded with a Local Public Works Project Grant in the amount of $315, 600 and recommended that the award be made as the bid was reasonable. On motion of Councilman Ehrhardt, Katzakian second, Council adopted Resolution No. 4430 awarding the bid for "Century Boulevard, Beckman Road and Kettleman Lane Storm Drain, EDA Project No. 07-51-26794" to Teichert Construction, the only bidder in the amount of $295,707, subject to the approval of their minor- ity participation. Councilman Katzakian moved for adoption of Resolution. No. 4431 awarding the contract for "Century Boulevard/Stockton Street Watermain, EDA Project No. 07-51-21336" to Claude C. Wood Co. , the low bidder, in the amount of -9- The City Manager presented the following bids which had been received for the contract for "Century Boulevard/Stockton Street Watermain"i AWARD -CENTURY BIDDER AMOUNT BLVD. Lyles Co. $58,491.80 The City 1,1anager advised the Council that the project is being funded with an EDA grant in the amount of $59, 950 and recommended that the award be made to Claude C. Wood Co., the low bidder. Councilman Katzakian moved for adoption of Resolution. No. 4431 awarding the contract for "Century Boulevard/Stockton Street Watermain, EDA Project No. 07-51-21336" to Claude C. NO. 4431(Contd) $5 1, 806. 00 subject to clearance of all require- ments of the Economic Development Adminis- tration. The motion was seconded by Council- man Ehrhardt and carried. DOWNTOWN TRASH Councilmen Katzakian and Ehrhardt felt that CONTAINERS some of the recently -installed trash containers - in the downtown area should be painted because of fire damage. The Public Works Director stated that mainte- nance was being conducted on a monthly basis and would be increased if it appeared necessary.
