ROLL CALL Present: Councilmen - Ehrhardt, Hughes, Katzakian, Pinkerton and Katnich (Mayor) Absent: Councilmen - None Also Present: City Manager Glaves, Assis- tant City Manager Glenn, Public Works Director Ronsko, Community Development Director Schroeder, City Attorney Mullen, and City Clerk Reimche. INVOCATION The invocation was given by Chaplain Wayne Kildall, Ebenezer Congregational Church. PLEDGE Mayor Katnich led the Pledge of Allegiance to the flag. MINUTES On motion of Councilman Pinkerton, Ehrhardt second, the minutes of September 21, 1977 were approved as written. PUBLIC HEARINGS' APPEAL OF MIR Notice thereof having been publiehed and posted. in AFZAL (MIR HOTEL accordance with law and affidavit of publication 17-1/2 W. ELM ST, being on file in the office of the City Clerk, LODI) CONTINUED Mayor Katnich called for the hearing to con- sider the appeal of Mr. Mir Afzal, owner of the Mir Hotel at 27- 1/2 West Elm Street, Lodi, California regarding inspection made of that premises by the San Joaquin Local Health Dis- trict and the subsequent order to vacate. City Clerk Reimche apprised the Council that a letter dated October 14, 1977 advising that "re- pair work is being pushed on Mir Hotel with $3, 000. 00 expended to date'had been received from Jack Dozier; Attorney for Mir Afzal, owner. Mr. Dozier further advises that by October 31, 1977, all required items will be completed, or. a precise date of future imminent completion will be known and furnished in writing. In the meantime, Mir. Afzal, Owner, -does not wish to lose his Appeal rights, but a hearing- 345 Minutes of October 19, 1977, continued PUBLIC HEARINGS MIR HOTEL(Contd) prior to October 31, 1977, would be incon- clusive, and a waste of the Council's agenda time. Mr. Dozier requested that the hearing set for October 19, 1977 be continued until a date on: or about November 16, 1977. A report as prepared by Building Inspector Roger Houston of an inspection of the building that was made on October 18, 1977 by Mr. Houston and Acting Fire Marshal Schatz was presented for Council's scrutiny. Community Development Director Schroeder apprised the Council that his staff has been in contact with two electrical contractors who are making bids on the necessary repair work. Following Council discussion with questions being directed to staff, Mr. Schroeder stated it would be his recommendation to permit a two week extension so that they in fact can get a contract and get the work underway. Mr. Schroeder further indi- cated that if the work is not completed by the first Council meeting in November (November 2, 1977) it would be his recommendation that Council direct staff to post the hotel and have it closed. On motion of Councilman Katzakian, Pinkerton second, Council continued the appeal of Mr. Mir Afzal, Owner of the Mir Hotel at 27-1/2 W. Elm Street, Lodi, California regarding the in- spection made of that premises by the San Joaquin Local Health District and subsequent Order to Vacate to the regular Council meeting of November 2, 1977. Mr. Schroeder further advised that the Planning Commission had previously denied the rezoning of the same area to R -LD, Low Density Multiple Family Residential and R -MD, Medium Density Multiple Family Residential. Following discussion, with questions regarding the matter being directed to Staff and Mr. Piazza, Councilman Ehrhardt moved introduc- tion of Ordinance No. 1124 rezoning the propo- sal of Lodi South Subdivision on the east side of South Church Street, north and south of the easterly extension of Lambert Court from R-1, Single -Family Residential to R-2, Single -Fam- ily Residential and R -GA, Garden Apartment Residential. The motion was seconded by Councilman Katzakian and carried by unanimous vote. COMMUNICATIONS CLAIM City Clerk Reimche presented a Claim for Damages in the amount of $25, 000 which had been filed on behalf of Mrs. La Verne Chappell nam- ing the City of Lodi and the Lodi Unified School District. On motion of Councilman Pinkerton, Ehrhardt second, Council rejected the claim and referred it to the City's Contract Administrator. ABC APPLICATION An application for Alcoholic Beverage License for Beverly and Emerald Hein, Peirano's New Deli, 119 E. Pine Street, On Sale Beer and Wine Eating Place, new license, was presented by the City Clerk. MEMBERS OF KOFU The City Clerk read a letter which had been re - ASSEMBLY TO VISIT ceived from Mayor Kawaguchi of Kofu, Japan, LODI advising of a friendship visit to the City of Lodi on October 27, 1977 by two members of the Kofu City Assembly, Mr. Komiyama and Mr. Higuchi. The Mayor concluded his letter by stating that he hopes this visit to Lodi will deepen the friendly relationship between the two sister cities. LIFE & TIMES Mayor Katnich introduced Miss Lori Orman, REPORTER new reporter for Lodi Life and Times Magazine. INTRODUCED REQUEST FOR LIGHTING ON CHEROKEE LANE The City Clerk presented a letter which had been received from Mr. Walter E. Flower, 543 Flora Avenue, Lodi advising that with reference to the three remaining lights on Flora and Cherokee, the power has been cut off due to the Lodi Unified School District Heritage School playground devel- opment. Mr, Flower states that he believes that the property owners and the general public who use Cherokee Lane frequently at night still need and are entitled to light by the City and suggested that the three old lights be removed as he under- stands they have good salvage value and that they be replaced with new type light standards. -3- 34? ACTION DEFERRED ON City Manager Glaves apprised the Council that LODI ART CENTER a request had been received from the Lodi Art REQUEST FOR Center for financial support. A letter which FINANCIAL SUPPORT had been received from Mr. Richard P. Cory, Representative of the Lodi Art Center was pre- sented for Council's perusal. The letter advised that the Lodi Art Center has enjoyed rent free premises for the past 18 years; however, they have had to pay all of the utilities for the building, Last July the building they occupied was sold and it was necessary for the Art Center to find another location. The new location is costing the A rt C ente r $180. 00 pe r month rental. The A rt Center therefore is requesting financial support from the Council in the amount of $180.00 per month or $2160. 00 annually. Speaking on behalf of the request was Mrs. Delores Levy, 127 S. Fairmont Avenue, Lodi, a member of the Lodi Art Center. Lengthy Council discussion followed with questions regarding the subject being directed to Staff and to Mrs. Levy. Councilman Pinkerton then moved that action be deferred on the request to allow City representa- tives time to attend an Cultural Arts Institute sponsored by the League of California Cities to be held November 4 and 5, 1977 in Costa Mesa. The motion was seconded by Councilman Hughes and carried by the following vote: Ayes: Councilmen - Ehrhardt, Hughes, Katzakian, and Pinkerton Noes: Councilmen - Katnich Absent: Councilmen - None Per Mayor Katnich's direction at a previous ADDITIONAL meeting, Staff presented for Council's scrutiny POLICE MANPOWER an analysis of Police staffing requirements. AUTHORIZED Lengthy Council discussion followed with ques- tions regarding the report being directed to Staff by the Council. The report reflected that the City of Lodi has experienced a significant rise in pop- ulation and criminal activity over the past 10 years, Likewise, the City has added both sworn and non - sworn staff during the same period of time. At present the staffing levels of the City are slightly less than other cities of comparable size; however, due to the increasing crime rate, the increase in the size of the City in terms of population and terri- tory, the present manning levels are not adequate to provide a consistent level of service and will lead to further deterioration of service as the area -7- 351 Minutes of October 19, 1977, continued ADDITIONAL POLICE and population of the City increases. It was MANPOWER Staff's recommendation that the Council author - AUTHORIZED (C ontd) ize the immediate addition of four Police Officer positions, utilizing Anti -recession er- funds to cover the cost of the additional per- sonne1. sonnel. 'Following additional discussion, Council, on motion of Councilman Pinkerton, Ehrhardt second, authorized the addition of four Police Officers to the Police Department personnel authorizations, 3 to be assigned to the Patrol Division and I to the Detective Bureau effective November 1, 1977 with Anti -recession funds to be used to meet the costs of these positions during the remainder of fiscal year 1977-78. BUS ZONE & Council was apprised that the recent opening of PASSENGER LOADING Tokay High School necessitates the establishment & UNLOADING ZONES of special zones to relieve traffic congestion near ESTABLISHED AT NEW the main entrance to the school along the north TOKAY HIGH curb line of Century Boulevard. The City has received a formal request on this matter from the RES. NO. 4408 Lodi Unified School District. A diagram of the proposed bus zone and passenger loading and un- loading zones in the vicinity of the new Tokay High School was presented for Council's perusal. Following Council discussion, Council, on motion of Councilman Hughes, Pinkerton second, adopted Resolution No. 4408 establishing a bus zone and passenger loading and unloading zone at the new Tokay High School as proposed by Staff. On motion of Councilman Ehrhardt, Hughes second, the pro- posed limited "no parking" on Century Boulevard and Dartmoor Circle in the vicinity of Tokay High School was set for Public Hearing on November Zt 1977. REQUEST FOR Council was apprised of a communication that had EXTENSION OF ORDER been received from Juvenal Soria, Lessee, OF ABATEMENT FOR Chapalita Hotel and Cafe requesting a hearing at CHAPALITA HOTEL the October 19, 1977 Council meeting regarding DENIED the granting of an extension of 90 days to the Notice of Public Nuisance and Order to Abate which had been posted on the Hotel Chapalita, Council was apprised that on October 18, 1977 an inspection of the Hotel Chapalita was conducted by Building Inspector Roger Houston, and Acting Fire Marshal, Ray Schatz and it was found that only the following four of the 133 violations have been corrected: 1. Replacement of a handrail. 2. Installation of two new fire extinguishers. 3. Exit signs are now lighted. 4. Some cleanup has been done in the basement, Ms. Maria DeLaLuz Reyes, 205 5th Street, Roseville, California spoke on behalf of Mr. Soria advising that his lease on the hotel located at 101- 107- 1/2 North Sacramento Street, Lodi is due to expire December 31, 1977 and she requested that the Council grant him an extension until the end of the year on the Order of Abatement. Council discussion followed with questions being directed to the City Attorney, the City Staff and :vis. Reyes. Community Development Director Schroeder asked that the record show that this is one of the hotels that Mr. McClure's Staff posted last week and that it would be Staff's recommendation that the exten- sion not be granted and that the hotel be vacated until such time as it is brought up to code. On motion of Councilman Ehrhardt, Pinkerton second, Council denied the request of Juvenal Soria for a 90 - clay extension of the Order of Abatement for the Hotel Chapalita. Minutes of October 19, 1977, continued RECESS The Mayor declared a five-minute recess and the Council reconvened at 10:05 p.m. PLANS & SPECS FOR The Plans and Specifications for "Lodi Avenue "LODI AVE.ST.IMPR- Street Improvements, WID Canal to Cabrillo MTS. WID CANAL TO Circle" were presented for Council's scrutiny. CABRILLO CIR. " In general, the work consists of reconstructing APPROVED y',=- approximately 500 lineal feet of street, removing = i the existing box culvert, and constructing a box culvert to the ultimate width of Lodi Avenue. On motion of Councilman Pinkerton, Hughes second, Council approved the plans and specifi- cations for "Lodi Avenue Street Improvementa, WID Canal to Cabrillo Circle" and authorized the City Clerk to advertise for bids thereon. WATER CONSERVATION Council was advised that the City of Lodi water ORD. .AMENDED conservation program has been very successful over the past nine months, with a 23- 1/21/ re - ORD.. NO. 1125 INTRO, duction (862 million gallons) in water use over i the previous year. Although the drought situation has not been alleviated since the start of the rainy season, it is proposed that restrictions on water- ing times be curtailed for the periods from ...:.. October 1 to May 1 of each year. A graph depicting the significant reduction in water use during this period was presented for Council's scrutiny. Because of this reduction and in view of the amount of light available and cooler temperatures after 7:00 p. m., it was Staff's recommendation that the ordinance be amended. Following Council discussion, Councilman Hughes moved introduction of Ordinance No. 1125 amend, ing Section 3, paragraph 2 of Ordinance No. 1105 to read as follows: 2. "The watering of lawns, flower beds or gardens throughout the year shall be limited to: a. premises having odd house numbers on Monday, Wednesday, Friday and Sunday; b. on premises having even numbers on Tuesday, Thursday, Saturday and Sunday. The motion was seconded by Councilman Ehrhardt and carried by unanimous vote. ASSIGNMENT OF LODI GOLD DRIVING RANGE City Manager Glaves advised the City Council that CONTRACT APPROVED Mr. .Harold Walz who is presently operating the Lodi Cold Driving Range is requesting permission to assign the lease that presently has four years to run to Mr. Darrell Fitzgerald and Mr. Harold M. Moody. RENTAL OF FENCING City Manager Glaves informed the Council that at FOR COMMUNITY its regular meeting of September 21, 1977, the GARDEN SITE City Council requested that Staff prepare cost APPROVED estimates for fencing the proposed community garden site which is to be located on the future fire station site on Lodi Avenue. The following estimates as presented by City Manager Glaves, are based on fencing the north, south and west sides of the proposed garden site.
