JUNE 7, 1978
A regular meeting of the City Council of the City of Lodi was held
beginning at 8:00 p.m., Wednesday, June 7, 1978 in the City Hall
Council Chambers.

INVOCATION The invocation was given by Reverend Mike
Seto, First Baptist Church.
PLEDGE Mayor Pinkerton led the Pledge of Allegiance
to the flag.
MINUTES On motion of Councilman Katzakian, Hughes
second, the Minutes of May 17, 1978 were
approved as written and mailed.

tection and use of cultural resources are re-
quired in the interest of the prosperity, social
and cultural enrichment and general welfare of
the people, and further proposed that the
purpose of this act would be to:
A. Safeguard the heritage of the city by preserv-
ing improvements and natural features which
reflect elements of the city's cultural history:
B. Encourage public understanding and involve-
ment in the unique architectural and environ-
mental heritage of the city through educational
programs;

PROPOSED C. Strengthen civic pride in the beauty- and
CULTURAL notable accomplishments of the past, to pro -
PRESERVATION mote their continued use today and encourage
ACT (Cont'd.) excellence in the building of the future;
D. Protect and enhance the city's attractions
to residents seeking a pleasant way of life,
tourists and visitors and thereby to support and
stimulate business and industry;
E. Enhance the visual and aesthetic character,
diversity and interest of the city; _
F. Promote the private and public use and pre-
servation of historic districts and structures for
the education, appreciation and general welfare
of the people;
G. Stabilize and improve property values;
H. Strengthen the economy of the city; and
I. Take whatever steps are reasonable and
necessary to safeguard the property rights of the
owners whose property is declared to be a land-
mark or is located in an area designated as a
landmark district.
Ms. Sherman also proposed that under the act
there would be created a Cultural Preservation
Committee, the purpose of which would be to
recognize, protect and promote the retention and
use of landmarks in the city and to promote aware-
ness of Lodi's unique heritage. �-
-Ms. Sherman presented a proposed Cultural Pre-
servation Ordinance for Council's scrutiny.
Also speaking on the subject was Ms. Naomi
Carey, 402 W. Oak Street, Lodi.

Followwing Council discussion with questions being
directed to Staff, Ms. Sherman, and Ms. Carey,
on motion of Councilman Hughes, Katzakian second,
Council asked for volunteers to serve on a
"Cultural Preservation Act" Ad Hoc Committee whose
charge would be:
a) To conduct a survey of all cultural resources in
the City which may be eligible for designation as
landmarks or landmark districts or structures of
me rit;
b) To recommend to the City Council that certain
areas, places, buildings, structures, natural
features, works of art or similar objects having a
significant historical, cultural, architectural,
archeological, community or aesthetic value as part
of the heritage of the city be designated as a land-
mark;
c) To keep current and publish a register of land-
marks, landmark districts and structures of merit;

COMMISSION .y , City Manager Glaves gave the following report of
the Planning Commission_ meeting of May 22, 1978:

Planning Commission approve the request of Mr.
Melvin Helmle to rezone a 20 acre parcel on the
north side of State Route 12 (i.e. Kettleman Lane);
2000 feet east of Lower Sacramento Road from I -PA,
Interim Protected Agriculture to GA -20 or GA -40,
General Agriculture.
Z. Recommended that the San Joaquin County
Planning Commission approve the request of Mr.
William Graffigra for a Use Permit to expand a non-
conforming mobilehome park at the northeast corner
of State Route 99 and Woodbridge Road in an area
zoned C-2, Ge:rerai Commercial.

LETTER RECEIVED City Clerk Reimc"e presented a letter which had

the period of May 24, 1978 to October 1, 1978, in
order to allow additional time for the preparation
and adoption of the safety, seismic safety, and
noise elements.
Mrs. Greene further advises that in granting the
extension, it is her understanding that the City
Council will review and approve proposed develop-
ment prior to the element's adoption on the basis
of Resolution Nos. 78-16 and 78-17. Mrs. Greene
states that it is her opinion that these adopted pro-
cedures are consistent with Goverrment Code
Section 65302.6(c) (3), which requires that the
various land use matters approved during a general
plan extension period will be consistent with plans
under study.
The letter further states that
"Additionally, the following conditions are imposed
on this time extension:
"1. No zoning ordinances shall be enacted until
such time as all mandatory elements have been
adopted according to state lain with the exception of
the following:
"a. Interim ordinances adopted pursuant to
Government Ccde Section. 65858.
"b. More restrictive zoning needed to maintain
existing and planned uses in an area following
expiration of an interim ordinance and pending final
adoption of all mandatory elements of the general
plan.
"c. Rezoning which is iess restrictive, but where
the maintenace c,f existing zc: ing would create a
hardship and the new use is contiguous to existing
compatible use.-. Such rezonings shall be accom-
plished by a finding of hardship setting forth those
social and economic reasons justifying immediate
rezoning pending the fin a.1 adoption of all mandatory
elements and setting forth the express findings of
the new zoning ordinances with each of the existing
elements of the City of Lodi General Pian.

all residential permits in C -P zones throughout
the City (Resolution No. 4443 adopted December
14, 1977) to June 21, 1978, at which time Council
will receive the report of the Committee appointed

absence of the Committee Chairman Councilman
Katnich and the fact that the Committee had just

the regular Council meeting of June 21, 1978.

78-60 and 78-61 Boulevard; and 3) Cherokee Lane and Almond

1) When the Tokay High School was built at Ham
Lane and Century Boulevard, the City of Lodi extended
the existing water system south from Kettleman Lane
to the northwest corner of the new high school to pro-
vide adequate circulation and supply to the general area.
This line will provide services, as well, to the abutting
properties being developed as part of the future Beck-
man Ranch.
2) This main provided a looped system to the indus-
trial area being developed on Stockton Street south of
Kettleman Lane. The project was funded by an
Economic Development Grant, and because of the
nature of the funding and time of construction, the
contract prices appeared to be excessively high.
Reimbursement figures have been adjusted to take
this into consideration and are being based on what
we consider a reasonable price if a developer were to
put the line in himself.
3) This main provided fire protection to the commer-
cial area on Cherokee Lane south of Kettleman and
will provide service to the properties on Almond
Drive and the east side of Cherokee Lane.
rhe City is eligible for reimbursement under Ordi-
nance No. 1012 and adoption of these resolutions will
set forth the amounts and levy the charges as outlined
in the ordinance.
Copies of sketches showing the amounts and areas of

per acre rental from $47.50 to $05.00 per acre
was presented for Council's perusal. It was pointed
out that the use of this land is restricted and regu-
lated by the State Health Department since the land
is being irrigated by plant effluent.
On motion of Councilman Katzakian, Hughes
second, Council authorized the City Manager to
execute the proposed lease agreement between the
City of Lodi and Mr. Al Bechthold covering the use
of the White Slough Property.

POPLAR STREET The City Manager advised Council that only one

Pursuant to Council's direction at the May 17,
1978 Council meeting, the City Clerk sent notices

on this contract exceeded the engineer's estimate
by more than 150/, and that the matter had been con-
tinued to the regular City Co-,ir_cil meeting of
June 7, 1978.

agreement with Fir -.t American Musicorporation for
a "soft" rock concert to be held at the Lodi Grape Bowl
between the hours of 11:00 a.m. and 5:00 p.m. on
July 15, 1978 and authorized the City Manager to
execute the Agreement on behalf of the City.

Council was advised that some commitment has
been made for the boat races and that Council
direction was being sought for the holding of these
activitie s.
A very- lengthy Council discuscion followed with
the idea of soliciting service clubs to contribute
financial support toward the holding of this cele-
bration being proposed.
Parks and Recreation Director De Benedetti was
in the audience and answered questions regarding
the matter as were directed by Council.
Councilman Hughes then moved that the Recreation
Department Staff be directed to assist in the arrange-
ments and the carrying out of the celebration, but
that the City not accept any financial responsibility
for this event.
The motion was seconded by Mayor Pinkerton and
failed to pass by the following vote:

Councilman McCarty moved that Staff be authorized
to proceed with plans for the annual 4th of July

Park and a stage show and fireworks show to be
held at the Lodi Grape Bowl. Gate fees for the fire-
works show to be increased to 75� for adults and
25� for children 12 years and under. The motion was
seconded by Councilman Kataakian and carried with
Staff being directed to formulate the stage show at
the lowest possible cost. The City Council also de-
termined that it would solicit local service clubs for
financial support for this event.
