EXECUTIVE At 4:01 p.m. Mayor Katzakian stated that the Council
SESSION would go into Executive Session to discuss pending
litigation with the City Attorney and Special Counsel
Gene G. Walton, for the railroad street crossing
closures.
RECONVENE The Council session was reconvened at 4:57 p.m.
PURPOSE OF Mayor Katzakian stated that Council was concerned
SESSION about the safety of the eight street crossings of the
Southern Pacific Railroad right-of-way in the central
portion of Lodi. He said that the Council had dis-
cussed the possibility of guards at the various
crossings, pending the installation of crossing gates,
but the City Attorney and Special Counsel discouraged
this action because of the large liability the City
would assume.
The Mayor stated that Council had instructed Special
Counsel, Gene G. Walton, to go to San Francisco
next week to get immediate action from the Southern
Pacific Company and the Public Utility Commission
to place crossing guards at the intersection.
The City Manager stated that the City had funds
budgeted to pay its share of the cost of installing
crossing gates.
ADJOURNMENT There being no further business to be brought
before Council, Mayor Katzakian adjourned the
session at 5:05 p.m.
