The esti,aate for this portion of the project is $214,000.00. The Federal contribution (Federal Aid Urban funds) will be $184,488.00. The City's responsibility is $29,512 which has been budgeted out of City TDA funds. STORM DRAIN APPROVED Council was apprised that in the design of the EDA project, it became necessary to install a storm drain under the Central California Traction Company tracks at Cluff and Lodi Avenue. The agreement calls for standard construction procedures similar to other agreements the City has had with the various railroads. Ii :4 REMOVED FROM A�A With the tacit concurrence of the Council, agenda item e 1 M - "Approve Limited Parking Changes, Various Schools, was removed frcm the agenda. -4- Conti7aed December 8, 1982 Council was apprised that Homer Beldt, owner of Casa de Lodi, has requested no parking zones on the south side of Turner Road from the Casa de Lodi driveway to 200 feet east and between the driveway and Beckman Road to the west. The zones would provide sight distance for motorists exiting the mobile home park onto Turner Road. The proposed No Parking Zones will provide residents of Casa de Lodi with essentially the same -sight distance afforded any other motorist driving a typical City of Lodi residential street. Because of the number of motorists using the driveway, curve of the street and the existing speed zone of 45 mph, it is recommended that parking be restricted on both sides of the driveway. Council discussion followed. Council, on C motion of Council Member Snider, Murphy second, adopted Resolution No. 82-132 awarding the bid for the purchase RES.1;0.82-132 of one 3,000 lb. capacity Industrial Lift Truck to the low bidder, Watts Equipment Company in the amount of $12,252.01. PLANNING COPMMISSION City Manager Glaves gave the following report of the Planning Commission meeting of November 22, 1982: The Planning Commission - 1. Conditionally approved the request of Ron Slate on behalf of 312 Investment Company for a Tentative Parcel Map to create Parcels A, B and C from Lot 3, Maxwell Industrial Park, and the Maggio property at 1935 South Stockton Street in an area zoned M-2, Heavy Industrial. 2. Conditionally approved the request of Lucky Stores, Inc. for a Tentative Subdivision Map to divide the old Albertson's/Pay 'n Save (i.e. Euclid Shopping Center) into 8 parcels, located at the south-east corner of West Kettleman Lane and South Hutchins Street in an area zoned C -S, Cotmnrcial Shopping. 3. Anoroved an 18 -month extension of the Use Pernit of Guarantee Savings and Loan to establish a branch office at 1300 West Kettleman Lane in an area zoned P -D(15), Planned Development District No. 15. At the request of the applicant, took no action to extend the Use Permit for a temporary portable office building on the Holz Rubber Company property at 1129 South Sacramento Street in an area zoned 214-2, Heavy Industrial. 6. Recommended that the San Joaquin County Board of Zoning Adjustment deny the request of Frank Lucchesi for a Use Permit to operate an agriculturally -related trucking operation on the east side of State Route 99 Frontage Road (i.e. 18566 North Highway 99). 7. Recommended that the San Joaquin Planning Commission approve the request of JSG Trucking to rezone property from GA -20, General Agriculture to M -1/L, Limited ;Manufacturing in the southwest quadrant of the bdoodbridge Road, State Route 99 interchange (i.e. 19400 North Highway 99). Kautz and Co., the City's Contract Administrator. \ PUC APPLICATIONS City Clerk presented information which had been received on Order granting rehearing for the purposes of further consideration re PG&E Docket No. ER80-214-002. The City Clerk presented a letter which had been received from PG&E Co. giving notice that on November 19, 1982, it filed an amendment to Application No. 82-09-17 pertaining to its Conservation Financing Adjustment. The Amendment asks for a smaller increase in gas rates than the original filing and for a decrease rather than an increase in electric rates. LETTER REC'D FROM CONGRESS.' Shurway acknowledging support for legislative efforts to repeal the Davis -Bacon Act. REPORT FROM S. J. PROPOSAL TO APPROVE 5 CENTS INCREASE IN FEDERAL GAS TAX DISCUSSED Council took no formal action on the matter following a lengthy discussion. CO11k1ENTS BY CITY COUNCIL MEMBERS Council Member Pinkerton apprised the Council that UDID (United Downtown Immorovement District) discussions have presently reached the point where it is iterative to have the expertise of a qualified bonding attorney and other consultants to provide important information required in the formation of the proposed downtown. It is therefore requested that the Lodi City Council appropriate an amount not to exceed $1,000.00 for legal fees and consultant fees as needed in the formation of the proposed downtown improvement district. Following an inquiry, Council was assured by Council Member Pinkerton that this amount would become a cost of the district and would be so assessed. FUNDS APPROPRIATED FOR UDID Following discussion, on motion of Mayor Pro Tempore Murphy, Olson second, the Council appropriated an amount not to exceed $1,000.00 from the Hotel -Motel Beautification fund for legal fees for a bonding attorney and consulting fees as needed in the formation of the proposed downtown improvement district. PRESENTIAATION RE LODI CABLE T.V. ADULT ENTERTAM4EN T CHAZIZ4.iS A presentation was made by Brenton Bleier under "Comments by the Public on non -agenda items", whereby Mr. Bleier asked the Council to adopt a Resolution relating to the provision of so-called adult entertainment channels by -9- 343 Continued December 8, 1982 -10- the Dodi Cable Television and an Ordinance prohibiting showing of sexually explicit cablecast programming to minors without parental presence or permission. Council continued consideration of the matter for additional information until the first meeting in January. REGULAR CALENDAR REPORTS OF THE CITY MANAGER REPORT BY ._ STAFF RE . INQUIRY BY DR. CARLTON Community Development Director Schroeder presented, for the perusal of the Council, information pertaining to the Rosa Variance (A-81-7), 305 West Lockeford Street, Lodi, which had previously been requested following an inquiry by Dr. Thomas Carlton. Dr. Carlton was not present although he was apprised by the City Clerk that the matter was on the agenda for this meeting. No formal action was taken by the Council on the matter. CONSIDERATION OF APPROVAL OF CONTRACTS FOR BILLBOARDS AT ENTRANCES TO CITY CONT'D Following discussion, Council, on motion of Mayor Pro Tempore Murphy, Reid second, continued agenda item k-2 "Approve contracts for billboards at entrances to City" until the first meeting in January requesting additional information. ITE21 REMOVED FROM THE AGENDA With the tacit concurrence of the Council, agenda item k-3 - "Approve consultant to analyze Utility Departrrmt Computer Requirements" was removed from the agenda. ORDINANCES ordinance No. 1278 - An Ordinance adopting numerous amendments to the Specific Plan of Lower Sacramento Road between Kettleman Lane and Lodi Avenue having been introduced at a regular adjourned meeting of the Council held November 17, 1982 was brought up for passage on ORDINANCE motion of Council Member Pinkerton, Olson second. RECEPTION HELD HONORING CITY MANAGER GIAVES City Manager Glaves was given an invitation to read by Mayor Reid, which invitation invited the City Manager to attend a reception being held in his honor.
