REPORTS OF THE CITY MANAGER In accordance with report and recommendation of the City Manager, Council, on motion of Council Member Pinkerton, Snider second, approved the following actions hereinafter set forth. ACCEPT IMPROVE- COUNCIL ADOPTED RESOLUTION NO. 83-68 ACCEPTING THE SUB - MEWS - DIVISION IKWVEMERrS INCLUDED IN TRACT MAP NO. 1796 LAKE- �.� LAM SHORE SHORE. The matters were introduced by Assistant Planner David Morimoto who presented diagrams of the subject area and responded to questions as were posed by members of the Council. Speaking on behalf of the matter was Mr. Dennis Bennett, 503 Hampton Drive, Lodi. There being no other persons wishing to speak on the matter, the Public portion of the hearing was closed. -2- Continued July 20, 1983 473 On motion of Council Member Pinkerton, Snider second, Council certified the filing of a Negative Declaration on the project at 1900, 1904, 1905, 1907, 1908, 1909, 1910, 1911, and 1920 South Church Street, Lodi. ORD. NO. 1290 Mayor Pro Tempore Snider moved for introduction of Ordinance AND ORD. NO. No. 1290 amending the Land Use Element of the Lodi General 1291 INTRODUCED Plan by redesignating 1900, 1904, 1905, 1907, 1908, 1909, 1910, 1911, and 1920 South Church Street from Low Density Residential to Medium Density Residential. The motion was seconded by Council Member Pinkerton and carried by unanimous vote of all members of the Council present. Mayor Pro Tempore Snider moved for introduction of Ordinance No. 1291 rezoning 1900, 1904, 1905, 1907, 1908, 1909, 1910, 1911, 1916, and 1920 South Church Street from R-1, Single -Family Residential to R -MD, Medium Density Multiple Family Residential. The motion was seconded by Council Member Pinkerton and carried by a unanimous vote of all Council Members present. PLANNING City Manager Glaves gave the following report of the COMMISSION Planning CcnTdssion Meeting of July 11, 1983: The Planning Commission - ITEMS OF 1. Recommended to the City Council that the Final Environ- INTERA.ST mental Impact Report for Sunwest IV, a 52.6 acre mixed residential or residential -Institutional project proposed for the east side of Lower Sacramento Road, one-quarter mile north of Kettleman Lane was adequate; SUNWEST IV 2. Recommended that Sunwest IV be prezoned to P -D (25), Planned Develognent District No. 25 with the following f conditions: a. that the single-family areas in the project conform to the City's R-1, Single -Family Residential District; b. that the cluster homes development be limited to 15 units per acre and conform to the City's R -GA, Garden Apartment Residential District. On motion of Council Mwber Pinkerton, Snider second, Council set the heretofore listed items for Public Hearing at 8:00 p.m., on August 3, 1983. The Planning Commission also - ITEMS OF 1. Conditionally approved the request of Ronald B. Thomas INTEREST on behalf of James D. S. Kim for a Tentative Parcel Map to divide APN 041-250-36 (i.e. 800 North church street) into two parts with Parcel "A" containing 3.00 acres, and Parcel "B" containing 1.50 acres in an area zoned P -D (17), Planned Development District No. 17. 2. Recommended that the San Joaquin County Planning Commission approve the request of Albert Thomas to rezone a 2.52 acre parcel at the northwest corner of State Route 99 and Woodbridge Road (i.e. 19555 North Highway 99) from 1 -PA, Interior Protected Agriculture to M -1/L, Light Manufacturing/Limited. COMMUNICATIONS CITY CLERK / ABC LICENSES Application for the following Alcoholic Beverage License was received: -3- 474 Continued July 20, 1983 Lodi Cable TV is camEtted to making available a full-time dedicated community channel. Our community bulletin board information now seen part-time on channel 7 will be expanded. New equipment now being installed will allow us to program more information and will be updated daily to keep the community up to date on information that effects their daily lives. Cammumity programming, such as City Council meeting, currently seen on channel 13 will move to channel 7. This will allow us to provide Christian Broadcast Network uninterrupted to those viewers and we will be able to improve the broadcast quality of our live programming. Most importantly, the move to channel 7 will open an access channel to the community for use by individuals or groups, schools, churches, and others who have programming for entertainment, information or education. Lodi Cable TV has not made changes without concern for our customers. Changes to the cable TV industry have given us hundred of choices in programming. We rely on marketing information, combined with customer and community feedback to make decisions for change. We, as much as any other local business, answer to our customers, but we must also change to continue'to grow. When we began service 15 years ago we had 10 channels, with 4 duplicated network stations. No -333) LETTER RE City Clerk Reimche presented a letter which had been COMPULSORY received from Robert Williams, Legislative Consultant, AND BINDING Governors Office, thanking the City for its correspondence ARBITRATION to Governor Deukmejian regarding the enactment of LEGISLATION compulsory and binding arbitration legislation. LETTER EGRESS- City Clerk Reimche presented a letter from Rene and Laurie ING DISPLEASURE Urias expressing their displeasure with Lodi Cable ; WITH LODI CABLE Television program changes. TELEVISION PROGRAM CHANGES LETTER FROM City Clerk Reimche presented the following letter which had LODI CABLE been received from Lodi Cable Television regarding certain ,. TELEVISION RE programming changes. PROGRAM CSS "I am pleased to announce effective August 15, 1983, the establishment of channel 7 on Lodi Cable TV as a community channel. On August 15 KGO, channel 7 from San Francisco will replace KPIX on cable channel 19. At that time Lodi Cable TV will make available free - converters to those customers whose sets will not tune in cable channel 19 or who do not already have converters and wish to continue viewing KGO. Customers currently renting converters will not be charged after August 15. Lodi Cable TV is camEtted to making available a full-time dedicated community channel. As it is likely the cost of the improvements will exceed the development's fees, the agreement includes provisions for repayment from other land in the "E" Drainage area as it develops. CITY BOARDS AND COMMISSIONS LETTER REC'D Mayor Olson directed the City Clerk to place the FROM ASSEMBLY- correspondence received from Assemblyman Phillip Isenberg MAN ISENBERG RE regarding critical problems involving water resources -" WATER RESOURCES facing Northern California on the agenda for the August 3, PROBLEMS IN 1983 Council Meeting. REPORTS OF THE CITY MANAGER REGUTAR CALENDAR City Manager Glaves presented the final map and improvement plans for Tract No. 1732 - Lodi Park West apprising the Council that this is a subdivision of 13.7 acres lying on the west side of Lader Sacramento Road, north of Elm Street. This subdivision is zoned PD -23 and contains 62 - single-family lots. APPROVAL OF The developers, Lodi West, a limited partnership, have - i LODI PARK WEST furnished the City with the improvement plans as well as the SUBDIVISION necessary agreement, guarantees for faithful performance and labor and materials and insurance certificate. The final map is being checked by San Joaquin County and will be ready shortly. A condition of this development was that the developer provide Master Storm Drain facilities at no cost to the City. Details of the agreement were presented orally. -5- 4% Continued July 20, 1983 Following discussion, on motion of Council Member Pinkerton, Snider second, Council approved the final map and improvement plans for Tract No. 1732, Lodi Park West, and authorized the City Manager and City Clerk to execute the Subdivision Agreement (Master Storm Drain) on behalf of the City. ENTRANCE FEE AT Agenda item K-1 - "Discussion re possible amend[?+ents to Lodi LODI LAKE Lake Entry Fee Schedule" was introduced by City Manager REDUCED FOR Glaves. A lengthy discussion followed with questions being SENIOR CITIZENS directed to Staff. On motion of Mayor Pro Tempore Snider, Olson second, Council by the following vote, reduced the entrance fee at Lodi Lake Park for Senior Citizens (60 years or older) from $1.00 to $.50: Ayes: Council Members - Snider and Olson Noes: Council Members - Pinkerton Absent: Council Members - Murphy and Reid VOTING DELEGATE On motion of Council Member Pinkerton, Snider second, Mayor AND ALTERNATE Olson was designated as the City's Voting Delegate for the FOR ANNUAL Annual League of California Cities Conference to be held in LEAGUE CONFERIIJCE San Francisco in October. DESIGNATED on motion of Council Member Pinkerton, Olson Second, Mayor Pro Tempore Snider was designated as the City's voting alternate for the Annual League of California Cities Conference to be held in San Francisco in October. COMPUTER NEEDS Following introduction of the matter by City Manager Glaves STUDY AUTHORIZED and a lengthy discussion, Council, on motion of Mayor Pro Tenpore Snider, Olson second, authorized the firm of Ernst and Whinney to perform a Computer Information System Plan for the City at a cost not to exceed $12,300. The motion carried by the following vote: Ayes: Council Members - Snider and Olson (Mayor) Noes, Council Members - Pinkerton Absent: Council Members - Murphy and Reid City Manager Glaves presented the following bids which had been received for the Washington Street Storm Drain: BIDDER BID Crutchfield Construction $17,217.00 Anderson & Sons Constr. $19,062.20 Claude C. NO. 83-72 CITY TO Agenda item K-5 - Consideration of City's participation in PARTICIPATE IN the NCPA Haas -Kings Project was introduced by City Manager ..HAAS -KINGS Glaves. Presenting an overview of the project and respond - PROJECT ing to questions concerning the matter was Utility Director -6- 477 Continued July 20, 1983 Dave Curry as well as the City Manager. A very lengthy RES. NO. 83-73 discussion followed. On motion of Mayor Olson, Snider second, Council, by the following vote adopted Resolution No. 83-73 authorizing the City's participation in the NCPA Haas -Kings Project and authorized the Mayor and City Clerk to execute the Agreement covering the City's participation on behalf of the City. Council Members - Pinkerton Absent: Council Members-- Murphy and Reid CITY ELECTS NOT City Manager Glaves apprised the Council that the City was ' v TO INCREASE ITS in receipt of a letter from the Northern California Power PARTICIPATION Agency advising that they had received a letter from the - _ IN THE City of Redding confirming its desire to withdraw from the CALAVERAS Calaveras Project and offering its interest to the other PRQTECI' m enbers of NCPA as provided for in the Calaveras Project Member Agreement. Following discussion, with questions being directed to Staff, Council, on motion of Mayor Pro,.,_ Tempore Snider, Olson second, elected not to increase its participation in the Calaveras Project. The motion carried by unanimous vote of all Council Members present. PLANS AND SPECS Following discussion of the matter by City Manager Glaves FOR SALAS PARK and Public Works Director Ronsko, Council, on motion of _ ;y IMPROVEMENTS Mayor Pro Tenpore Snider, Pinkerton second, approved the " - APPROVED plans and specifications for Salas Park Improvements and authorized the City Clerk to advertise for bids thereo �- Council was apprised that this project includes the street, storm drainage, water and sewer improvements fronting Salas Park, together with an on-site 180 stall parking lot. The City Council at their last regular meeting approved the preparation of the plans and specifications. Funding for this work has not yet officially been allocated. Allocation of funds will be proposed prior to the award of this contract. The estimates of improvement costs are-as_'ollows:' Street, storm drainage and utilties $120,000 Parking Lot $103,000 Total $223,000 ORDINANCES Ordinance No. 1289 - An Ordinance Amending Section 11-3 of the City Code of the City of Lodi, entitled "Collection Rates for Garbage Services" was introduced for adoption. Mr. George Bruns, Sales Manager for Central Valley Disposal, 860 East Pine Street, Lodi, addressed the Council indicating that Sanitary City Disposal Company had reduced fees to its County customers. Mr. Bruns stated that it is interesting that Sanitary City Disposal can reduce its rates in the county and at the same time request an increase in the City and asked if the City is supporting the County services. ORD. INCREASING Ordinance No. 1289 A- An Ordnance Amending Section 11-3 of COLLECTION RATES the City Code of the City of -Lodi, entitled, "Collection FOR GARBAGE Rates for Garbage Services" with an amendment to Page No. 4 SERVICES of an addition of the last sentence which reads, "All of t the above rates schedules shall be effective on all bills ORD. NO. 1289A which are prepared on or after August 1, 1983" having been ADOPTED introduced at a regular meeting of the Lodi City Council -7- 471 Continued July 20, 1983 held July 6, 1983 was brought up for passage on motion of Council Member Pinkerton, Snider second. Second reading of the Ordinance was omitted after reading by title, and the Ordinance was then adopted as amended and ordered to print by the following vote: Ayes: Council Members - Pinkerton, Snider, and Olson (Mayor) Noes: Council Members - None Absent: Council Members - Murphy and Reid AWOURNMENT There being no further business to cane before the Council :Mayor Olson adjourned the meeting at approximately 9:55 p.m. -8- Attest: Alice M.
