PLEDGE OF The Pledge of Allegiance was led by Mayor Reid. ALLEGIANCE Construction of Lodi on February 5, 1986 in the amount of PRESENTATIONS Mayor Reid presented Resolution No. 86-64 to Ruth Diekman, Immediate Past President of the Lodi Education Association RES. No. 86-64 (L.E.A.) recognizing the "Day of the Teacher". PROCLAMATIONS Mayor Reid presented the following Proclamations: CC -37 a) "Sister City Week" the project over -run. b) "Public Works Week" REPORTS OF THE CITY MANAGER CONSENT CALENDAR In accordance with report and recomrendation of the City Manager, Council, on motion of Council Member Pinkerton, Olson second, approved the following actions hereinafter set forth. CC -21(a) Claims were approved in the amount of $2,232,997.10. MINUTES The Minutes of March 3, 1986, March 5, 1986, April 2, 1986, and April 15, 1986 were approved as written. SPECS FOR ASPHALT REJUVENATING AGENT APPRDVED Council approved the specifications for Asphalt Rejuvenating Agent and authorized the advertising for bids CC -12.1(c) thereon. ACCEPT IMPROVEMENTS, SALAS PARK PICNIC SHELTER Council accepted the improvements for "Salas Park Picnic Shelter" and directed the Public works Director to file a CC -14(a) Notice of Completion with the County Recorder's Office. Council was apprised that the contract was awarded to Diede Construction of Lodi on February 5, 1986 in the amount of $24,988. The contract has been completed in substantial conformance with the plans and specifications approved by the City Council. The final contract price was $25,209. The necessary transfers will be made within the HUD Block Grant to cover the project over -run. 1 Continued May 7, 1986 AWARD - ARMORY PARK FENCE RES. NO. 86-65 City Manager Peterson presented the following bids which had been received for "Amory Park Fence": CC -201 Central Fence Co., Base $15,981.00, Alt. A $1,847.36, Alt. B $4,648.69 - total $25,574.63 On recanrendation of the City Manager, Council adopted Resolution No. 86-65 awarding the contract, Base + Alt. B for "Armory Park Fence" to Central Fence Co., in the amount of $20,674.75. RENEWAL, OF JANITORIAL MAINTENANCE CONTRACT Council approved and authorized the City Manager and City CC -6 Clerk to execute the renewal of the Janitorial Maintenance Contract for the 1986-87 fiscal year to Korean Building Maintenance Company at an annual cost of $36,300. FINAL MAP AND AGREEMES fTS FOR LODI PARK WEST, UNIT NO. 6 AND 7 APPROVED Council approved the final maps for Lodi Park West, Units No. 6 and 7, Tract Nos. 2015 and 2028, and directed the CC -46 City Manager and City Clerk to execute the Subdivision Agreements on behalf of the City. Lodi Park West, a partnership, the developer of these two subdivisions, has furnished the City with the final maps and the improvement plans, as well as the necessary agreements, guarantees and insurance certificates for these proposed subdivisions. Lodi Park West, Unit No. 6, is located at the northeast corner of Park West Drive and Lower Sacramento Road and contains 68 single-family lots. Unit No. 7 is located north of Lodi Park West, No. 4 and contains 47 single- family lots. PETITION FOR ROADWAY ABANDONMENT IN AREA OF WHITE SLOUGH PROPERTY Council was requested to authorize the Mayor and City Clerk to execute a petition requesting roadway abandonment in an CC -6 area adjacent to the White Slough Property. The roadway is CC -27(a) a frontage road on the west side of I-5 which serves only three parcels. The property owners are experiencing problems with hunters, fishermen, and other types of trespassers. The abandonment does not affect the public roadway adjacent to the City's property and has no effect on the entrance to the White Slough treatment plant. 2 Continued May 7, 1986 Council authorized the Mayor and City Clerk to execute the petition for the subject roadway abandonment. 1986 POPULATION AND HOUSING ESTIMATES CERTIFICATION REQUEST RES. NO. 86-66 Annually, the California State Department of Finance prepares population and housing estimates for each city and CC -36 county in the state. The estimates are based on information provided by the local agencies and include data on new residential construction, school enrollment, utility accounts and mobilehcme occupancy. Copies, of the January 1, 1985 and January 1, 1986 estimates, which indicates a growth in population of 1970 and in housing units of 984. Staff reported that both of the estimates appear to be in line with the City's present growth activities. In order to use the 1986 population estimate of 43,293 for the City of Lodi as of 1/1/86, as estimated by the California State Department of Finance as the basis for state subventions, Council adopted Resolution No. 86-66 authorizing the City Manager and City Clerk to request certification of the population and housing estimates as required by Section 2077.2 of the Streets and Highway Code. ITEM REYLVED FROM AGENDA With the tacit concurrence of the Council, Agenda item e -l -J "Approve Agreement with Lodi Unified School District covering use of the Lodi Grape Bowl" was removed from the agenda. CITY ADMINISTRATION OF LIBRARY MAINTIIVANCE AMID OPERATIONS FUND APPROVED RES. NO. 86-67 Council was apprised that one of the recommendations of the City auditors last year was that the City's Finance CC -29 Department assume the responsibility for the administration CC -21(c)- of the Library's Maintenance and Operations Fund. The Library Board of Trustees concurs. Council adopted Resolution No. 86-67 approving Agreement between the City of Lodi and the Lodi Library Board of Trustees providing for administration of the Library Maintenance and Operating Fund and authorized the City Manager and City Clerk to execute the subject Agreement on behalf of the City. AGREEMENT WITH NCPA FOR ENGINEERING SERVICES APPROVED RES. NO. 86-68 City Manager Peterson apprised the Council that the City of Lodi is desirous of obtaining the services of NCPA CC -7(j) engineers in the development of a Request for Proposal for design and construction of required transmission upgrades serving the City of Lodi. The Agreement provides for these services in an amount not to exceed $5,000.00. This transmission upgrade involves the construction of an additional 60-kv transmission line into Lodi to enhance system reliability. Continued May 7, 1986 Council adopted Resolution No. 86-68 approving an agreement between the City of Lodi and the Northern California Power Agency (NCPA) for certain engineering services and authorized the City Manager and City Clerk to execute the subject Agreement on behalf of the City. GOLF DRIVING RANGE LEASE ASSIGNMENT Council was apprised by City Manager Peterson that the City leases the Golf Driving Range located at the Grape Festival CC -27(b) grounds to Mr. Bob J. Gasaway. Mr. Gasaway desires to sell his business to Mr. George Sakurai and Mr. Ken Wollenberg. To complete this transaction it is necessary for the City Council to approve the assignment of the lease to the new owners. Council authorized the assignment of the Golf Driving Range Lease and authorized the City Manager and City Clerk to execute the Consent to Assignment on behalf of the City. AWARD OF BID FOR LODI LAKE PARK CONCESSION OPERATIONS RFS. NO. 86-69 City Manager Peterson apprised the Council that the following bids which been received for the Lodi Lake Park CC -6 J Concession Operation for a period of 32 months ending May 3°J 1, 1988: Four Gals' Commissary - 258 of gross receipts after taxes Herr/McCarty - 218 of gross receipts after taxes Vandergriff - 208 of gross receipts after taxes Council adopted Resolution No. 86-69 awarding the Lodi Lake Park Concession Operation to Four Gals' Ccmndssary for the percentage figure of 258 of gross receipts after taxes. PUBLIC HEARINGS There were no Public Hearings scheduled for this meeting. PLANNING COMMISSION City Manager Peterson presented the following Planning REPORT Commission Report of the Planning Cannission Meeting of of April 14, 1986: ITEMS OF INTEREST The Planning Ccmaission - CC -35 1. Conditionally approved the request of Terry Piazza, c/o Baumbach and Piazza, Consulting Engineers, on behalf of Dan Anderson for a Tentative Parcel Map to divide Assessor Parcel No. 049-050-52, a 3.8 acre lot on the north side of East Pine Street, approximately 490 feet east of Cluff Avenue into three parts with Parcel "A" containing 1.2 acres, parcel "B" containing 1.6 acres, and Parcel "C" containing 1.0 acres in an area zoned M- 2, Heavy Industrial. 2. Denied the appeal of Alex Paraskevas concerning conditions set forth by the Site Plan and Architectural Review Committee for the development of an apartment complex at 720 South Washington Street and ordered (1) that the roof -mounted air conditioning units be screened and (2) that the rock and stucco facade be installed in accordance with the approved plans. Conditionally approved the request of Glen I. Baumbach, c/o Baumbach and Piazza Consulting Engineers, on behalf of Bennett and Campton, Inc., for a Tentative Parcel Map to create Parcel "1/2 A" by joining Lots 9 and 10, Parcel "B" by joining Lots 23 and 24, and Parcel "C" by joining Lots 29 and 30 in the Burgundy village Subdivision in an area zoned R-2, Single -Family Residential. Council received a letter frau the residents of Liebig Street requesting street lights be installed on the perimeter of Blakely Park. Speaking on behalf of the neighborhood was Mr. Bob Sorgensen, 1239 Liebig Street, Lodi. Council discussion followed with questions being directed to Staff. On motion of Council Member Hinci¢nan, Snider second, Council referred the matter to Staff directing that a study be undertaken regarding lighting in all City parks. MEMBERS MEASURE A TASK FORCE UPDATE Council Member Hinclmian presented an update on the progress of the Measure A Task Force. CONCERNS REGARDING TRUCK PARKING ON CHEROKEE LANE Council Member Hirschman addressed the Council regarding problems that are being encountered with trucks parking on CC -16 Cherokee Lane. Council Member Hinchman suggested that the CC -45(e) , City look into the feasibility of using Hotel -Motel tax funds for the development of truck parking in that area. Discussion followed with Council being informed that this subject is presently on the Lodi District Chamber of Commerce Work Program for study and recommendation TERMS ON VARIOUS CITY BOARDS AND COMMISSIONS DUE TO EXPIRE Mayor Reid directed the City Clerk to post for the following terms on various City Boards and Commissions due CC -2(g),, to expire: CC -2(d) CC -2(a) Planning Commission (4 year term) - term of Joanne Hoffman expiring June 30, 1986 Library Board of Trustees (3 year terms) - terms of Sachiko A. Ishida and Louise Zastrow expiring on June 30, 1986 San Joaquin County Economic Development Association (4 year term) term of Michael Bradley expiring June 30, 1986 COMFITS BY THE PUBLIC ON NON AGENDA TRAFFIC ENFORCEMENT COMPLAINT RECEIVED Council received a complaint regarding the City's motorcycle traffic enforcement unit from citizen Carl Vogt, CC -16 514 Brandywine Drive, Lodi. 6 Continued May 7, 1986 COMPLk-M REGARDING IMPROVEMENTS BEIM MADE AT 1127 INDUSTRIAL WAY, LODI Council referred to the City Manager complaint received from Jeff Duckett, 1127 Industrial Way, Lodi regarding CC -16 disagreement on improvements being made at that location and City requirements regarding the subject improvements. REPORTS OF THE CITY MAIC REGULAR CALENDAR COK41UNITY CRIME RESISTANCE PROGRAM RFS. No. 86-70 Council was informed that the Lodi Police Department is currently using patrol officers to perform services needed CC -6 to provide a variety of crime prevention programs. CC -24(b) C As a part of the Career Criminal Apprehension Program (C -CAP), the City is eligible for a Community Crime Resistance Grant through the Office of Criminal Justice Planning. This Grant would provide funds to hire two non - sworn Community Service Officers which the Police Department would use in their crime prevention programs. The grant is twelve months in duration and will pay 100% of the cost of personnel, plus equipment. The City of Lodi is eligible for a $60,000 grant which requires a 10% hard match of City funds. Chief of Police Williams and Captain Larry Hansen were in the audience and responded to questions regarding the matter as were posed by Council. Following discussion, on motion of Council Member Hirschman, Olson second, Council adopted Resolution No. 86-70 indicating the City's desire to undertake the proposed Lodi Police Department Community Crime Resistance Program, which program is to be funded in part with funds made available through State General Funds. STOC KTON STREET SIDEWALK DEFICIENCY - VINE TO TOKAY STREET Council was apprised that the City has let the improvement RES. NO. 86-71 for Stockton Street between Vine and Tokay Street to Claude Woods Company. The underground work on this project has CC -45(e) already started. C C Zoo At an earlier Informal Informational Meeting, the City staff reviewed with the Council the sidewalk deficiencies on Stockton Street between Vine and Tokay Street. There are 14 parcels on the east side of the Street which are deficient in sidewalk. On the west side, there is an area which does not have sidewalk, however, the walkway area is paved with asphalt and concrete. A lengthy discussion followed with questions being directed to Staff. On motion of Council Member Hirschman, Snider second, Council adopted Resolution No. 86-71 determining the public need for sidewalk installations on the east side of Stockton Street between Vine Street and Tokay Street and set the matter for Public Hearing at the Regular Council Meeting of June 4, 1986. ZG5 Continued May 7, 1986 Further, Council directed Staff to develop alternates for adopting a City policy for implementing and financing sidewalk installations in areas determined to qualify for Ccn wnity Block Grant Funds. It was requested that this report be provided to Council at its May 21, 1986 meeting. DESIGNATE FIRE SHIFT SUPERVISORS AS MID- MANAGE24E 7T EMPLOYEES RFS. NO. 86-72 Following introduction of the matter by Staff, Council, on motion of Council Member Pinkerton, Olson second, adopted CC -34, Resolution No. 86-72 designating Fire Shift Supervisors as C C 3 mid -management employees, effective April 15, 1986, and authorizing the crediting to each Fire Shift Supervisor of 12 hours of Administrative heave as of that date. TERMINATION OF LOCAL EMERGENCY APPROVED RES. NO. 86-73 Following introduction of the matter by City Manager Peterson, Council, on motion of Council Member Pinkerton, CC -6 Olson second, adopted Resolution No. 86-73 proclaiming CC -24(b) termination of the local emergency established with the Cc =b') adoption of Resolution No. 86-31 on February 18, 1986. REPORT ON IMPLEMENTATION OF PERMIT PARKING IN AREA OF PCP City Manager Peterson reported on the implementation of permit parking in the area of the Pacific Coast Producers CC -48(1) Plant.
