Mayor Pinkerton called the Adjourned Regular City Council Meeting of Wednesday, June 22, 1988 to order at 7:30 p.m. City Clerk Reimche recorded roll as follows: ROLL CALL Present: Council Members - Hinchman, Olson, Reid, Snider and Pinkerton (Mayor) Absent: Council Members - None Also Present: City Manager Peterson, Assistant City Manager Glenn, Community Development Director Schroeder, Finance Director Holm, Public Works Director Ronsko, City Attorney McNatt and City Clerk Reimche FLOOD DAMAGE PREVENTION ORDINANCE INTRODUCED ORD. NO. 1426 This agenda item was introduced by City Manager Peterson. Community Development Director Schroeder gave the staff CC -24(b) report indicating that, in June 1987, the City Council CC -53(a) adopted the Flood Damage Prevention Ordinance which is CC -149 required if our citizens are to be eligible for Flood Hazard Insurance. Upon review by both the state and federal agencies a number of minor revision were requested. These changes were oversights by the Community Development staff at the time the Ordinance was prepared. Mr. Schroeder presented a draft ordinance for Council review advising that it had been approved by the State Department of Water Resources and the City Attorney. The Federal Emergency Management Administration will accept the Ordinance based on the Water Resources approval. There were no persons in the audience wishing to speak on this matter. Following discussion, Mayor Pro Tempore Snider introduced Ordinance No. 1426 entitled, "Flood Damage Prevention". The motion was seconded by Council Member Olson and carried by unanimous vote. 1988-89 BUDGET URGENCY ORDINANCE NO. 1427 ADOPTED The City Council continued its review of the proposed 1988-89 Budget. The Public Works Department proposed CC -21(b) budget was reviewed in detail. A lengthy discussion followed with questions being directed to staff. On motion of Council Member Hinchman, Olson second, the City Council adopted Ordinance No. 1427 entitled, "An Urgency Ordinance Adopting An Operating Budget For The Support Of Various Departments Of The City Of Lodi And A Utility Outlay Budget For The Fiscal Year Beginning July 1, 1988 and Ending June 30, 1989". Ordinance No. 1427 is hereinafter set forth in its entirety. The City Council hereby adopts by reference as if fully set forth herein the document entitled "1988-89 RECOMMENDED BUDGET," copies of which are on file with and available from the City Clerk. SECTION 3. An appropriation spending limit for 1988-89, in compliance with Proposition 4, Article XIII B of the California Constitution, as specified in Gov. Code Section 37200, is $26,918,609, and the 1988-89 appropriation subject to the limit is $16,178,704. This section shall be deemed a part of the budget. SECTION 4. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 5. This urgency ordinance shall be published one time in the "Lodi News -Sentinel," a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect immediately. McNatt Bob McNatt City Attorney PERSONNEL BOARD OF REVIEW Mrs. Ray Davenport, 23324 North Dustin Road, Acampo, addressed the City Council asking why Mr. Lloyd Kuehne CC -2(f) (Board Chairman of the Personnel Board of Review) was here tonight meeting with Mr. Peterson, Mr. Glenn, and Mr. McNatt. City Manager Peterson responded that he was here just to discuss the Personnel Board. Mrs. Davenport then asked why another Board Member wasn't here with him - - - why was he the sole person here. Mr. Peterson responded that he did not have the answer. It was not a called meeting of the Board and that he (Mr. Kuehne) is perfectly free to come and talk as a Council appointed Board Member with Council or staff whenever he wishes. Mrs. Davenport then asked City Attorney McNatt if that is true. City Attorney McNatt responded that he really has no desire to discuss the matter further other than to assure Mrs. Davenport that the topic of discussion was not the merits nor the procedures of the matter that is now pending. CLOSED SESSION At approximately 8:45 p.m., the City Council adjourned to a Closed Session regarding: a) Personnel Board of Review Proceedings b) Labor Relations The City Council reconvened at approximately 10:00 p.m. ADJOURNMENT There being no further business to come before the City Council, Mayor Pinkerton adjourned the meeting at approximately 10:02 p.m. ATTEST: 6 J& 71h P Alice M.
