ROLL CALL Present: Council Members - Hinchman, Olson, Pinkerton, Reid and Snider (Mayor) Absent: Council Members - None Also Present: City Manager Peterson, Assistant City Manager Glenn, Community Development Director Schroeder, Public Works Director Ronsko, City Attorney McNatt, and City Clerk Reimche INVOCATION The invocation was given by Pastor Craig Pierson, Temple Baptist Church. PLEDGE OF The Pledge of Allegiance was led by Mayor Snider. ALLEGIANCE NOVEMBER 6, 1990 GENERAL MUNICIPAL ELECTION RESULTS CERTIFIED RESOLUTION NO. 90-179 CC -18 City Clerk Reimche presented a report regarding the official canvass of the November 6, 1990 General Municipal Election. On motion of Mayor Pro Tempore Hinchman, Olson second, the City Council adopted Resolution No. 90-179 entitled, "A Resolution of the City Council of the City of Lodi Reciting the Fact of the General Municipal Election Held on November 6, 1990, Declaring the Result and Such Other Matters as Provided by Law". The subject resolution is hereinafter set forth in its entirety: 1 Continued December 5, 1990 RESOLUTION NO. 90-179 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 6, 1990, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Lodi, California, on Tuesday, November 6, 1990, as required by law; and WHEREAS, notice of the provided by law; that voting officers were appointed and conducted and the votes were and declared in time, form Elections Code of the State general law cities; and election was given in time, form and manner as precincts were properly established; that election that in all respects the election was held and cast, received and canvassed and the returns made and manner as required by the provisions of the of California for the holding of elections in WHEREAS, pursuant to Resolution No. 90-179 adopted August 1, 1990, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of votes (ballots) cast in the City for Member, City Council except absent voter ballots was 13,241. That the whole number of absentee voter ballots cast in the City for Member, City Council was 2,631, making a total of 15,872 votes (ballots) cast in the City for Member, City Council. That the whole number of votes (ballots) cast in the City for Measure M except absent voter ballots was 13,240. That the whole number of absentee voter ballots cast in the City for Measure M was 2,623 making a total of 15,863 votes (ballots) cast in the City for Measure M. SECTION 2. That the names of persons voted for at the election for Member of the City Council are as follows: Ray G. Davenport Dwight D. Dauber Gerald J. Vanderlans Evelyn M. Olson Jack A. Sieglock 2 Continued December 5, 1990 John R. (Randy) Snider Fred M. Reid Willis Lee Marzolf Phillip Anthony Pennino That the measure voted upon at the election is as follows: Measure M SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates and for and against the measure was as listed in Exhibit A attached. SECTION 4. The City Council does declare and determine that: Phillip A. Pennino was elected as Council Member for the full term of four years; Jack A. Sieglock was elected as Council Member for the full term of four years; John R. (Randy) Snider was elected as Council Member for the full term of four years. That as a result of the election, a majority of the voters voting on the measure relating to prohibiting smoking in certain public places and in places of employment did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes (ballots) cast in the City; (2) The names of the persons voted for; (3) The measure voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6) The total number of votes given to each person, and for and against each measure. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. 3 Continued December 5, 19909 Dated: December 5, 1990 I hereby certify that Resolution No. 90-179 was passed and adopted by the City Council of the City of Lodi in a regular meeting held December 5, 1990 by the following vote: Ayes: Council Members - Hinchman, Olson, Pinkerton, Reid and Snider (Mayor) Noes: Council Members - None Absent: Council Members - None Alice M. Reimche City Clerk City Clerk Reimche then presented a gift from the City of Lodi to Council Member Olson and Council Member Reid and expressed sincere appreciation on their untiring efforts on behalf of the City. City Clerk Reimche administered the oath of office to Lodi City Council Members Elect: Phillip A. Pennino Jack A. Sieglock John R. (Randy) Snider City Clerk Reimche presented Council Members Pennino, Sieglock and Snider with Certificates of Election and framed copies of the pen and ink drawing of City Hall done by Engineering Assistant, Mark White. City Clerk Reimche then joined the members of the City Council at the Council- table and conducted the election for the Mayor of the City of Lodi. Council Member Pennino nominated Mayor Pro Tempore David M. Hinchman for the office. There being no other nominations, nominations were declared closed. David M. Hinchman was elected Mayor of the City of Lodi by unanimous vote of the City Council. City Clerk Reimche then handed the gavel to Mayor Hinchman who conducted the election for Mayor Pro Tempore. Council Member Snider nominated Council Member Pinkerton for the office of Mayor Pro Tempore. There being no further nominations, nominations were declared closed. Council 4 71U JContinued December 5, 1990 AMR/imp Member Pinkerton was elected Mayor Pro Tempore by a — unanimous vote of the City Council. City Clerk Reimche presented a gift to Council Member Snider expressing sincere appreciation for his exemplary and energetic leadership in the vital accomplishments of the City Council during the past year in which he served as Mayor. City Manager Peterson expressed his sincere appreciation to Council Member Olson and Reid and indicated that he was looking forward to working with the new Council Members.
