ALLEGIANCE PRESENTATIONS AAA PEDESTRIAN PROTECTION PROGRAM AWARD Frank Stevenson, Lodi District Manager of the California State Automobile Association presented Mayor Hinchman and Chief of Police Williams with a Special Citation Award - AAA Pedestrian Protection Program. CONSENT CALENDAR In accordance with report and recommendation of the City Manager, Council, on motion of Council Member Pennino, Snider second, approved the following items hereinafter set forth. Further agenda item E-5 - "Zupo Field Backstop and Fencing, 350 North Washington Street" was removed from the Consent Calendar and acted upon immediately following the approval of the Consent Calendar. CLAIMS CC -21(a) Claims were approved in the amount of $2,991,145.46. MINUTES The Minutes of November 28, 1990 (Adjourned Regular Meeting) were approved as written. AWARD OF BID FOR PURCHASE OF ONE THREE -REEL TURRET TRAILER e RESOLUTION NO. 91-1 CC -12(d) The City Council adopted Resolution No. 91-1 awarding the CC -300 purchase of one three -reel turret trailer for the Electric 1 Continued January 2, 1991 Utility Department Manufacturing Company, $39,645.06. to the sole bidder, Sauber Virgil, Illinois, in the amount of The City Council was advised that on November 28, 1990, the City Council approved specifications and authorized advertisement for bids. Bids were opened on December 18, 1990, with the following results: Sauber Manufacturing Company Virgil, IL $39,645.06 Altec, by Pac power Dixon, CA No Bid Glenn Engineering Co. Delhi, CA No Response Truck & Trailer Sales, Inc. Arnold, MO No Response Standard Trailer San Leandro, CA No Response This trailer is a very specialized, hydraulically -operated wire and cable installation/removal unit. Although all the potential bidders had expressed a desire to bid the unit, only the manufacturer that has specialized in utility -type equipment like this chose to bid. The specifications for this unit included some features that significantly increase the versatility of the trailer. These features were not available at the time of budget preparation in early 1990. Therefore, the funding appropriated ($35,000) in the 1990-91 fiscal year budget does not meet the requirements for the trailer as specified and bid. Based on the above, it was recommended that the bid be awarded to the sole bidder and that the appropriate funding for this purchase be augmented by $4,645.06 made available from the recent advantageous purchase of the aerial line truck. CONTRACT AWARD FOR WELL DRILLING, WELL #24, 640 NORTH STOCKTON STREET RESOLUTION NO. 91-2 CC -12(a) The City Council adopted Resolution No. 91-2 awarding the CC -300 contract for Well Drilling, Well #24, 640 North Stockton Street (North of Grape Bowl Stadium) to Beylik Drilling Inc. in the amount of $71,590.00. The City Council also 2 f7 Continued January 2, 1991 certified the filing of a negative declaration by the Community Development Director as adequate environmental documentation for Well #24. This project consists of drilling a production water well to a depth of 473 feet. Development of the site and the purchase of pumping equipment will be handled by separate contracts at a later date. Plans and specifications for this project were approved on November 28, 1990. The City received the following four bids for this project: Bidder Engineer's Estimate Beylik Drilling Inc. Watsonville $78,095.00 Stockton $79,495.00 Woodland $99,848.00 CC -12.1(b) The City Council approved the specifications for a paratransit van for Dial -A -Ride and authorized advertising for bids to be received Wednesday, January 16, 1991. The City Council was advised that a second paratransit van is needed by the Dial -A -Ride program to meet the increasing need to service their users restricted to wheelchairs, and provide additional transportation for ambulatory passengers as well. Funds were allocated in the 1990/91 budget for the purchase. SPECIFICATIONS FOR BIDS FOR A SECTIONAL SEWER RODDING MACHINE FOR WATER/ WASTEWATER DIVISION'S SERVICE CREWS APPROVED CC -12.1(b) The City Council approved the specifications for a sectional sewer rodding machine for Water/Wastewater Division's service crews and authorized advertising for bids thereon to be received Wednesday, January 30, 1991. Funds to purchase a sectional sewer rodding machine for the Water/Wastewater Division's service crews were approved in the 1989-90 Operations/Maintenance Budget. A special allocation request was approved July 17, 1990 to carry over the funds to the 1990-91 fiscal year. 3 Continued January 2, 1991 The sectional rodding machine will replace an old unit for regular maintenance of sewers and for emergency cleaning of blocked sewers. SPECIFICATIONS FOR A UTILITY VEHICLE FOR WHITE SLOUGH WATER POLLUTION CONTROL FACILITY APPROVED CC -12.1(c) The City Council approved the specifications for a utility vehicle for White Slough Water Pollution Control Facility and authorized advertising for bids to be received Wednesday, January 16, 1991. Funds to purchase a utility vehicle for White Slough Water Pollution Control Facility were approved in the 1990-91 operating budget. This unit is listed in the budget as a "truckster" type vehicle. It will be similar to the maintenance vehicles used by crews maintaining golf courses and parks. This unit will be used to move tools, parts, and various lubricants around the facility. It will also be used by the operations staff to check the ponds and outlying portions of the facility. PURCHASE AGREEMENTS FOR SOUTH CHURCH STREET RIGHTS-OF-WAY CC -27(a) The City Council authorized the City Manager and City Clerk to approve the right-of-way agreements for 1729 and 1771 South Church Street. The City has reached agreement for property acquisition with two of the four property owners along the west side of South Church Street where property is needed for the Church Street Improvements, Century Boulevard to Kettleman Lane, project. The signed agreements are on file in the City Clerk's office. In exchange for the property, the City will install the curb, gutter, and sidewalk along the frontage of the property, the street structural section including paving, the sanitary sewer tap, pay the connection fee and sanitary sewer main reimbursement fee, and upgrade the existing water service. In addition to the improvements, the property owner at 1729 South Church Street will receive $1,000 and the property owner at 1771 South Church will receive $1,500. The compensation is based on the City's appraisals with the estimated value of the improvements deducted from the total appraised amount of the property. CC -12(c) The City Council on motion of Council Member Pennino, CC -300 Pinkerton second adopted Resolution No. 91-3 awarding the bid for Zupo Field Backstop and Fencing, 350 North Washington Street to Scrimsher and Mineni of Modesto in the amount of $35,921.39. Further the City Council approved the transfer to this project of $20,000 of the $37,000 appropriated for the fuel tank replacement at the Parks and Recreation Corporation Yard. This project is presently being evaluated for low cost alternates. This project will replace the existing backstop at Zupo Field with a higher backstop. The existing backstop has been in use for many years and is in need of major repairs. The new backstop will be 40 feet high and will provide additional safety for the spectators. Ball clubs playing in the park have also been complaining about foul balls that are lost because our backstop is too low. The 40 -foot backstop will keep more balls in the field and save teams the cost of replacing them. This project will also install fencing around the left field bullpen area and the field drinking fountains to provide additional protection for the ball players. The plans and specifications called for a "design/build" concept as was done for the protective shade structure at the Softball Complex on Stockton Street. The following three bids have been received: Scrimsher and Mineni, Modesto $ 35,921.39 West Coast Fence Co., San Jose $ 39,807.00 Economy Fence Co., Stockton $ 53,314.52 Allowing for contract administration, inspection and contingencies, the total project cost is $43,000; only $23,000 has been appropriated. Staff recommended that the City proceed with the project by transferring $20,000 of the $37,000 appropriated for fuel tank replacement at the Parks and Recreation Corporation Yard. This project is presently being evaluated for low 5 Continued January 2, 1991 cost alternates. The remaining appropriation will allow the City to proceed with the project in phases. COMMENTS BY CITY COUNCIL MEMBERS The following comments were received under the "Comments by City Council Members" segment of the agenda: CITY EMPLOYEES COMMENDED FOR THEIR OUTSTANDING WORK DURING THE RECENT COLD SNAP CC -34 Members of the Lodi City Council and the City Manager expressed sincere appreciation to the various City Department and their employees who worked so diligently to resolve the very large number of problems caused by the recent cold snap. REPORT REGARDING NEW YEAR'S EVE TAXI RIDE PROGRAM Following a request by Mayor Pro Tempore Pinkerton, it was announced that 255 requests were received New Year's Eve (from 7:00 p.m. December 31, 1990 to 3:00 a.m. January 1, 1991) for taxi cab rides. It was also announced that the program costs were less than $700. INQUIRY AS TO DISPOSAL OF PRUNING MATERIALS Following an inquiry by Mayor Pro Tempore Pinkerton, citizens were urged to cut up pruning materials and place them in their trash can or save the materials for the Annual Sanitary Disposal Company's Spring cleanup program. DOWNTOWN PARKING ENFORCEMENT Following an inquiry by Council Member Pennino regarding cars parking over parking T's in the vicinity of City Hall, it was announced that the subject of the January 29, 1991 Shirtsleeve Session will be downtown parking enforcement. PUBLIC WORKS DEPARTMENT RECEIVES COMPLIMENT ON THE CATCH BASIN Mayor Hinchman complimented the Public Works Department on their newsletter, The Catch Basin and the recently adopted mission statement of that department. 0 Continued January 2, 1991 COMMUNITY DEVELOPMENT DEPARTMENT COMPLIMENTED ON RECENT REPORT ON HOUSING REHABILITATION Mayor Hinchman complimented the Community Development Department on its recent report on housing rehabilitation. Mayor Hinchman stated that he would like to see the City further publicize what it is doing with this program. CITY OF LODI SOLID WASTE MANAGEMENT TASK FORCE TO BE ESTABLISHED Mayor Hinchman stated that he will be establishing a City of Lodi Solid Waste Management Task Force shortly and asked for nominations from the community. VEHICLE TOW COMPLAINT CC -16 Mayor Hinchman, following receipt of a vehicle tow complaint, suggested that in the future when the City is doing street repairs, requiring that no cars be parked in a particular area for a prescribed period of time, that doorhangers advising citizens of the project and the requirements be placed on residences in the affected area. COMMENTS BY THE PUBLIC ON NON AGENDA ITEMS The following comments were received under the "Comments by the public on non -agenda items" segment of the agenda: ANNUAL CHRISTMAS TREE PICKUP PROGRAM David Vaccarezza announced that on Saturday, January 5, 1991, the Cub Scouts and California Waste Removal Systems will conduct their Annual Christmas Tree pickup program. If this is an inconvenient time for citizens, special tree pickups will be made on regular trash pickup days from January 7 - 11, 1991. PUBLIC HEARINGS No public hearings were schedule for this Council Meeting. PLANNING COMMISSION No meetings of the Lodi Planning Commission had been held since the City Council received the last report. COMMUNICATIONS (CITY CLERK) CLAIMS CC -4(c) On recommendation of the City Attorney and Insurance Consulting Association, Inc. (ICA), the City's Contract N Continued January 2, 1991 REGULAR CALENDAR Administrator, the City Council, on motion of Mayor Pro Tempore Pinkerton, Sieglock second, denied the following claim and referred it back to ICA: a) Frank Grenko, Date of loss 11/11/90 SEWER RATE ADJUSTMENT RESOLUTION NO. 91-4 CC -44 The City Council, at its regular meeting of November 28, CC -51(a) 1990, adopted Ordinance 1501 which provided for CC -300 establishing sanitary sewer fees by resolution. In 1986, the Council adopted a 15% annual increase on October 1 of each year until the White Slough Water Pollution Control Facility expansion is completed. The last increase went into effect on January 1, 1990. This increase will be effective February 1, 1991. Storm drain system fees are not affected by the increase and remain the same. V Presented for the City Council's review was a residential sewer charge rate comparison which was completed this month. With the new rate, Lodi will still be below the average of the 16 cities for a 3 -bedroom house. Following a lengthy discussion, with questions being posed by the City Council to staff, the City Council on motion of Mayor Pro Tempore Pinkerton, Sieglock second, adopted Resolution No. 91-4 increasing the fees for the domestic sewer system service charges and connection fees and holding tank waste charges as provided in Ordinance 1501 effective February 1, 1991.. BECKMAN SCHOOL - ADULT CROSSING GUARDS RESOLUTION NO. 91-5 CC -7(e) The City Council was reminded that an agreement between the CC -43 City of Lodi and the Lodi Unified School District provides CC -48(a) that the City will reimburse the District for the costs of CC -300 adult crossing guards at intersections that meet the minimum guidelines established by the State Department of Transportation (Caltrans). At present, six locations have adult crossing guards. The cost to the City is approximately $15,000 to $20,000 per year. At the request of the Lodi Unified School District, the Public Works Department has performed adult crossing guard studies for Beckman School on Century Boulevard at Hutchins Street, Scarborough Drive, and Ham Lane. The surveys were performed between the hours of 7:10 am. and 8:10 a.m. and Continued January 2, 1991 2:10 p.m. and 3:10 p.m. shown below. �i The results of these studies are Century Boulevard/Hutchins Street The Caltrans guidelines for adult crossing guards are not met at this location. At signalized intersections, Caltrans guidelines are satisfied where there are at least 40 elementary school pedestrians and 300 vehicular turning movements through the crosswalk for each of any two hours of the day. The curb -to -curb width on Century Boulevard is 84 feet and on Hutchins Street it is 94 feet. Although this is more than the 80 feet specified in the guidelines, a 5 -foot intermediate refuge (raised median) exists on all legs of the intersection with a pedestrian activated crossing button. The District has provided a guard at this location since the opening of Beckman School. Ordinarily, staff would not recommend approval of an adult crossing guard without the guidelines being met, however, since the speed limit and classification of the streets are comparable to the Kettleman/Hutchins and Turner/Ham intersections where adult crossing guards have been approved, Council may wish to give additional consideration to this location. Century Boulevard/Scarborough Drive The guidelines for adult crossing guards are met at this location. At uncontrolled intersections, Caltrans guidelines are satisfied where there are at least 40 elementary school pedestrians and 350 vehicles across the crosswalk for each of any two hours of the day. Century Boulevard/Ham Lane The guidelines for adult crossing guards are not met at this location. Caltrans guidelines at stop sign controlled intersections are designed for undivided highways of four lanes or more. The minimum requirements are 40 elementary school pedestrians and 500 vehicles per hour during any period of the day. No unusual conditions were observed at this location. Staff does not recommend approval of an adult crossing guard at this ocation. This matter has been reviewed with Lodi Unified School District staff and they are strongly in favor of an adult crossing guard at Hutchins and Century. Addressing the City Council regarding the matter were the following people: a) Jack Dunn, Vice Principal Beckman School b) Heidi Kizer representing the Beckman School P.T.A. Following a lengthy discussion with questions being directed to staff, the City Council, on motion of Council Member Snider, Hinchman second, adopted Resolution No. 91-5 approving the placement of adult crossing guards at Century Boulevard/Scarborough Drive. 10 Continued January 2, 1991 WASHINGTON STREET AND ACACIA STREET - INTERSECTION CONTROL RESOLUTION NO. 91-7 CC -48(h) The City Council was advised that at the November 28, 1990 CC -300 City Council meeting, a petition requesting installation of four-way stops at Washington and Acacia was referred to the Public Works Department. Normally such a request received directly by staff is prioritized for future or immediate study based on accident rate and other factors. When the request is made directly to the City Council, staff would report back at a later meeting with a recommendation based on the information used to establish the priority. In this case, since we already had data due to previous complaints, the number of signatures on the petition and the fact that it is the first of many four-way stop requests that the new Councilmembers will receive, the Public Works staff prepared a more detailed report with additional background material. The installation of four-way stop signs is designed to control traffic at the intersection of streets with high volumes and near -equal volume splits, or where accidents correctable by their use can be eliminated, after trying less restrictive remedies. Existing Conditions Currently, Acacia Street yields at Washington Street. The prima facie speed limit on both streets is 25 mph. Approach volumes on Acacia Street and Washington Street are approximately 300 (35%) and 560 (65%) vehicles per day, respectively. Study Results Caltrans guidelines for the installation of four-way stops are not satisfied at this location. The number of correctable accidents and traffic volumes are far below the required minimums. A review of accidents on Washington Street from Watson Street to Kettleman Lane from 1987 to the present indicates that one of the nine accidents in this segment occurred at Acacia Street. This 1987 accident (left turn versus thru) was not speed -related. None of the other eight accidents in this segment were identified as being caused by excessive speed. 11 Continued January 2, 1991 It does not appear that the alignment offset on Acacia as it crosses Washington has been a problem. Discussion The submitted petition indicates that four-way stops are speeds on Washington Street. Studies show that the installation of stop signs has little or no effect on reducing overall speeds except at the immediate vicinity of the stop sign. In many cases, speeds will increase on segments adjacent to stop signs as drivers will attempt to "make-up" travel time after having to stop at an unwarranted stop sign. In a similar situation, staff found that 85th percentile speeds increased by 1 to 2 mph on School Street after the installation of an unwarranted four-way stop at Vine Street. In addition to the possible increase in speeds, unneeded stop signs may increase accidents (particularly rear -end accidents), waste time and energy, cause air and noise pollution, and encourage noncompliance. Recommendation Based on the study results and proven ineffectiveness of stop signs used for speed control, staff did not recommend the installation of four-way stop signs at this location. Increased enforcement is the most effective way to control speeds in these types of situations. Addressing the City Council regarding the matter were: a) Mrs. Kenny Krenz, 1239 South Washington Street, Lodi; b) Mr. Joel Cisnowski, 1301 South Washington Street, Lodi; and c) Mrs. Theodore Rodacker, 317 East Acacia Street, Lodi. Following a lengthy discussion with questions being directed to staff, the City Council, on motion of Council Member Snider, Sieglock second, adopted Resolution No. 91-7 directing that the existing "Yield" signs at the intersection of Washington Street and Acacia Street be converted to stop signs. Further the City Council directed that the City beef up traffic enforcement in the area and that the request for a "No Parking" zone in the area be placed on a future agenda. 12 Continued January 2, 1991 CONSULTANT SELECTED FOR THE PREPARATION OF THE CITY OF LODI SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT CC -54 The City Council was advised that AB 939 requires the City of Lodi to prepare a Source Reduction and Recycling Element and Household Hazardous Waste Element by July 1, 1991. In October/November 1990, the City received proposals from R. W. Beck and Associates, EMCON Associates, and AllWest Environmental Inc., for the preparation of the required elements. City staff reviewed these proposals and invited EMCON Associates to present their organization at the City Council Shirtsleeve Session of December 11, 1990. After careful consideration, it was recommended that City Council select EMCON Associates as the City's consultant. Although EMCON did not submit the lowest bid for this project, their qualifications and experience indicates the greatest potential for preparing a quality product which will consider the unique nature of our community. The project will be undertaken on a time and expense basis for a not -to -exceed price of $37,516. Funding for the project will be obtained from the Refuse Surcharge Fund. On motion of Mayor Pro Tempore Pinkerton, Pennino second, the City Council approved the retention of EMCON Associates as the City's consultant for preparing planning elements as required by Assembly Bill 939, and authorized the City Manager and City Clerk to execute an agreement on behalf of the City of Lodi subject to approval as to form of the subject agreement by the City Attorney. APPOINTMENT TO INTERCITY RAIL COORDINATING COMMITTEE RESOLUTION NO. 91-6 CC -2(a) The City Council was advised that Caltrans District 3 is CC -50(b) conducting a feasibility study of consolidation of railroad CC -300 freight traffic between Sacramento and Stockton as required by Assembly Bill 3436 (Isenberg). This bill directs Caltrans to establish the Sacramento -San Joaquin Intercity Rail Coordinating Committee (IRCC), composed of specified representatives who will serve as advisors for the rail feasibility study. It is anticipated that the first meeting of the committee will be held in mid or late January. 13 Continued January 2, 1991 Caltrans will advise of the meeting dates, time and location as soon as they are determined. On motion of Mayor Hinchman, Snider second, the City Council adopted Resolution No. 91-6 appointing Council Member Phil Pennino as a representative to serve on the Sacramento -San Joaquin Intercity Rail Coordinating Committee (IRCC). SPECIAL SHIRTSLEEVE SESSION TO BE HELD ON JANUARY 11, 1991 REGARDING THE GROWTH MANAGEMENT PLAN EVALUATION CRITERIA UPDATE The City Council concurred that it would hold a Special Shirtsleeve Session on Friday, January 11, 1991 regarding the Growth Management Plan Evaluation Criteria Update. The City Council will receive on that date a schedule regarding the City of Lodi General Plan update.
