ROLL CALL Present: Council Members - Pennino, Sieglock, Snider, and Pinkerton (Mayor) Absent: Council Members - Hinchman Also Present: City Manager Peterson, Assistant City Manager Glenn, Community Development Director Schroeder, Public Works Director Ronsko, City Attorney McNatt, and City Clerk Reimche INVOCATION The invocation was given by Pastor Lee Hamby, Temple Baptist Church PLEDGE OF The Pledge of Allegiance was led by Mayor Pinkerton. ALLEGIANCE PRESENTATIONS There were no awards or presentations made at this meeting. CONSENT CALENDAR In accordance with report and recommendation of the City Manager, Council, on motion of Mayor Pro Tempore Pennino, Sieglock second, approved the following items hereinafter set forth. Agenda item 4F-6 entitled, "Acceptance of improvements under Well 24 Chain Link Fence, 640 North Stockton Street (North of Grape Bowl Stadium)" was removed from the agenda. CLAIMS CC -21(a) Claims were approved in the amount of $3,290,413.35. MINUTES The Minutes of October 21, 1992 (Regular Meeting), November 3, 1992 (Special Meeting), November 4, 1992 (Regular Meeting) and November 10, 1992 (Adjourned Regular Meeting) were approved as written. SPECIFICATIONS APPROVED FOR THE CONSTRUCTION OF BERMS AND TRANSFORMER PAD CC -12.1(c) The City Council approved the specifications and authorized advertisement for bids for the construction of oil containment berms and transformer pad. The City Council was advised that this oil containment structures will be installed at McLane Substation around oil -filled electrical equipment to confine an oil spill or 1 Continued December 3, 1992 leak. Environmental Protection Agency regulations require that equipment storing oil in volumes, as in this case, be equipped with a confinement system that will prevent an oil spill or leak to extend beyond the immediate area of the equipment and not migrate into the soil, the water table or the site drainage system. The transformer pad is being constructed to accommodate the transformer bank replacement at McLane Substation. The bid opening date has been set for Tuesday, December 22, 1992. SALARY ADJUSTMENTS FOR EMPLOYEES IN THE FIREFIGHTERS UNIT AND POLICE OFFICERS UNIT APPROVED RESOLUTION NOS. 92-187 AND 92-188 CC -34 The City Council was advised that the Assistant City CC -300 Manager, Police Chief, Police Captain Hansen, and the Personnel Director, have meet each Wednesday since mid-September with representatives of the Police Officers' Association of Lodi. The proposed agreement resulting from these meetings is generally expenditure neutral in that the negotiated salary increases are in large measure offset by elimination of the City's contribution to deferred compensation and reductions in certain allowances. The major provisions of this Agreement are: 1. Clean up and clarification of language. 2. A 2% salary increase retroactive to the pay period beginning October 5, 1992. 3. Eliminate City's contribution to deferred compensation. 4. Two additional vacation days for employees with 12-14 years of service. 5. An additional paid holiday for a total of 12 holidays. 6. Changes in medical insurance to conform with other City employees., The employee will pay $20 per month for dependent medical. 7. Redistribute special payments for bilingual pay, overtime for motor officers and K-9 officers, and special assignment so that all 2 Continued December 3, 1992 are paid equally. Members of the SWAT unit will also be included. In addition Field Training Officers will be designated supervisors and will not receive upgrade pay for incidental occasions. 8. Eliminate education incentive pay for Associate of Arts degree and Intermediate POST certificate and an increase for Bachelor's Degree and an Advanced POST certificate. 9. Establish a catastrophe bank which allows officers to donate time to cover others in case of personal catastrophe. 10. Establish a $25,000 accidental death benefit. 11. Agree to continue medical insurance to a remarried widows of officers who is killed or dies during the performance of official duties. Further, the City Council was advised that the Memorandum of Understanding (MOU) with the UFL calls for a general salary increase of firefighter employees based on a salary survey and an adjustment based on the cost of the single highest year. It has taken some time to agree on the salary increase for October 1992. We have reached an agreement with the firefighters on that salary increase. Council was requested to adopt a resolution which includes the proposed salary adjustments. There is a provision in the MOU which is in dispute relative to an additional adjustment for the single highest year. On November 24 the Assistant City Manager met with the representatives of the UFL and reached an agreement on an additional adjustment. Monday, November 30, 1992, Assistant City Manager Glenn received a telephone call from their representative that the United Firefighters of Lodi (UFL) had additional questions. Today, December 2, 1992 he received a telephone call from the Vice President of the UFL that the membership did not agree with the agreement reached at the table. Rather than hold up the known amount, the Assistant City Manager recommends the City grant that salary increase now and with the disputed numbers at a later date. The City Council adopted Resolution No. 92-188 entitled, "A Resolution of the Lodi City Council Approving Salary Adjustments for Members of the Police Officers' Unit". 3 Y9 Continued December 3, 1992 The City Council adopted Resolution No. 92-187 entitled, "A Resolution of the Lodi City Council Approving Salary Schedule for Members of the Firefights Unit". ACCEPTANCE OF IMPROVEMENTS UNDER LODI LAKE PICNIC FACILITIES CONTRACT APPROVED CC -90 The City Council accepted the improvements under the "Lodi Lake Picnic Facilities" contract, and directed the Public Works Director to file a Notice of Completion with the County Recorder's office. The contract was awarded to H. Max Lee, Inc. of Lodi on April 15, 1992 in the amount of $97,500. The contract has been completed in substantial conformance with the plans and specifications approved by the City Council. The contract completion date was November 16, 1992, and the actual completion date was November 13, 1992. The final contract price was $118,055. The difference between the contract amount and the final contract price is mainly due to additional work done by the contractor to use up more of the State grant money. This work included lighting the South Point and Hughes Beach picnic areas and adding more pavement in the Hughes Beach parking lot. ACCEPTANCE OF IMPROVEMENTS UNDER WELL 24 CHAIN LINK FENCE, 640 NORTH STOCKTON STREET REMOVED FROM THE AGENDA CC -90 Agenda item #F-6 entitled, "Acceptance of improvements under Well 24 Chain Link Fence, 640 North Stockton Street (North of Grape Bowl Stadium)" was removed from the agenda. COMMENTS BY CITY COUNCIL MEMBERS No comments were received under the "Comments by City Council Members" segment of the agenda: COMMENTS BY THE PUBLIC ON NON AGENDA ITEMS The following comments were received under the "Comments by the public on non -agenda items" segment of the agenda: CITIZEN COMMENDS MAYOR PINKERTON FOR HIS YEARS OF SERVICE John J. Lagno, P. O. Box 857, Lodi commended Mayor Pinkerton on his many years of outstanding service to this community and presented a contribution to Mayor Pinkerton which is to be used toward his campaign in running for supervisor of the 4th Supervisorial District. 4 a'' Continued December 3, 1992 PUBLIC HEARINGS There were no public hearings scheduled for this meeting. PLANNING COMMISSION The Planning Commission did not meet since the City Council received its last report. COMMUNICATIONS (CITY CLERK) No items of communication were presented under this segment of the agenda. REGULAR CALENDAR REPORT REGARDING UNQUALIFIED AUDIT OPINION CC -21(a) The City Council was informed that for the first time in the City's history, the City of Lodi has received an unqualified audit opinion from the City's auditors for the 1991-92 fiscal year. This means that not only are the City's financial record keeping practices in order, but that the auditor's report is submitted to the City without qualifications or exceptions. The report was delivered Tuesday. The City has never been able to achieve such a report - although the record keeping practices have always been in order - because until now the City did not have in place a fixed asset accounting system. Such a system is now in place as a result of the efforts of Finance Director Dixon Flynn and his staff. The Finance Director coordinated this project with major participation by the departments of Community Development, Public Works and Electric Utility. A copy of the audit and the unqualified audit opinion has been sent to the offices of the Government Finance Officers Association (GFOA) in Chicago. There, an evaluation team will examine the City of Lodi's report. We are optimistic that GFOA will then issue our City a Certificate of Excellence for Financial Reporting which is the highest award a City can receive. Finance Director Dixon Flynn was in attendance at the meeting and gave a brief report concerning this matter to the City Council. Mr. Flynn, his staff and the staffs of the participating departments were commended. NOVEMBER 3, 1992 GENERAL MUNICIPAL ELECTION RESULTS CERTIFIED RESOLUTION NO. 92-189 CC -18 City Clerk Reimche presented a report regarding the CC -300 official canvass of the November 3, 1992 General Municipal Election. On motion of Council Member Snider, Sieglock second, the City Council adopted Resolution No. 92-189 entitled, "A Resolution of the City Council of the City of Lodi Reciting 5 Continued December 3, 1992 the Fact of the General Municipal Election Held on November 3, 1992, Declaring the Result and Such Other Matters as Provided by Law". The subject resolution is hereinafter set forth in its entirety: RESOLUTION NO. 92-189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 3, 1992, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Lodi, California, on Tuesday, November 3, 1992, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State -of California for the holding of elections in general law cities; and WHEREAS, pursuant to State Statute, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit All. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS SHOWN ON EXHIBIT A: SECTION 1. That the names of persons voted for at the election for Member, City Council are as follows: Bob Fisher Robert J. Johnson Eileen M. St. Yves Thomas M. (Mike) Zane James E. Griffith Elizabeth Romero Rosenquist Stephen J. Mann Kenneth D. Heffel Ray G. Davenport Marlon DeGrandmont Barbara L. Knight N. Anthony Corona Jesse Cordova - 6 Continued December 3, 1992 SECTION 2. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates was as listed in Exhibit A attached. SECTION 3. The City Council does declare and determine that: Ray G. Davenport was elected as Council Member for the full term of four years; Stephen J. Mann was elected as Council Member for the full term of four years. SECTION 4. The City Clerk shall enter on the records of the City Council of the City, as statement of the result of the election, showing: (1) The whole number of votes (ballots) cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; and (5) The total number of votes given to each person. SECTION 5. That the City Council shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. Reimche City Clerk PRESENTATIONS MADE TO OUTGOING MEMBERS OF THE CITY COUNCIL City Clerk Reimche then presented a gift from the City of Lodi to Council Members Hinchman and Pinkerton and expressed sincere appreciation for their untiring efforts on behalf of the City. Council Member Hinchman was ill and not able to attend this meeting. PRESENTATION MADE TO MAYOR JAMES W. PINKERTON, Jr. City Clerk Reimche then presented a gift from the City of Lodi to Mayor Pinkerton and expressed sincere appreciation to him for serving as Mayor this past year and for his many years of dedication and outstanding service to this community. Further, a portrait of the Mayor done by Walter Synawicke was given to Mayor Pinkerton. Mr. Synawicke was introduced. OATH OF OFFICE ADMINISTERED TO CITY COUNCIL MEMBEFS ELECT City Clerk Reimche administered the oath of office to Lodi City Council Members Elect: Ray G. Davenport Stephen J. Mann City Clerk Reimche presented Council Members Davenport and Mann with Certificates of Election and framed copies of the pen and ink drawing of City Hall done by Engineering Assistant, Mark White. Council Members Davenport and Mann then executed the Oath of Office form provided and administered by the City Clerk. REORGANIZATION OF COUNCIL CC -6 City Clerk Reimche then joined the members of the City Council at the Council table and conducted the election for the Mayor of Lodi. 8 .%. Continued December 3, 1992 Council Member Sieglock nominated Mayor Pro Tempore Pennino for the office of Mayor. The motion was seconded by Council Member Snider. There being no other nominations, nominations were declared closed. Phillip A. Pennino was elected Mayor of the City of Lodi by unanimous vote of the City Council. 1 City Clerk Reimche then handed the gavel to Mayor Pennino who conducted the election for Mayor Pro Tempore. Council Member Snider nominated Council Member Jack A. Sieglock for the office of Mayor Pro Tempore. The motion was seconded by Council Member Mann. There being no further nominations, nominations were declared closed. Council Member Sieglock was elected Mayor Pro Tempore by a unanimous vote of the City Council. COMMENTS Comments were made by Council Members Davenport and Mann, Mayor Pennino and City Manager Peterson. ORDINANCES There were no ordinances presented for adoption.
