Roll was recorded by the City Clerk as follows: Present: Council Members - Davenport, Mann (left at approximately 7:10 a.m. and returned at 8:05 a.m.), Sieglock, Snider and Pennino (Mayor) Absent: Council Members - None Also Present: City Manager Peterson, Assistant City Manager Glenn, Finance Director Flynn, Revenue Manager Cadwallader, Accounts Manager McAthie, Administrative Assistants to the City Manager Evans and Keeter, Personnel Director Narloch, City Attorney McNatt, and City Clerk Perrin Mayor Pennino called the meeting to order. 1993-94 OPERATING BUDGET REVIEW CC -21(b) City Manager Peterson presented an overview of the budget and of the schedule for the budget review meetings. Assistant City Manager Glenn made a presentation on the following budgets: COUNCIL; CITY.CLERK; ELECTION Mr. Glenn outlined where the reductions were made for the 1993-94 Operating Budget and questions followed among the City Council and staff. Council Member Davenport made a motion that each City Council Member be given a separate account with $500.00 to be used at the individual's discretion (purchase of supplies and materials, etc). The motion died for lack of a second. GENERAL CHARGES Mr. Glenn outlined the reductions in General Charges. On motion of Council Member Sieglock, Mann second, the City Council directed that the funds allocated for the purchase of balloons for Field and Fair Day be moved to the 1 Continued June 8, 1993 Community Center budget under insurance (Function 399) by the following vote: Ayes: Council Members - Mann, Sieglock and Pennino (Mayor) Noes: Council Members - Davenport and Snider Absent: Council Members - None Frank Alegre, 2000 Edgewood Drive, Lodi made several comments throughout the meeting. PLAYGROUND EQUIPMENT AT HENRY GLAVES PARK CC -20 Parks and Recreation Director Williamson presented the CC -27(c) following report. CC -47 The Parks and Recreation Department received a call from a concerned citizen who was complaining about the design of the equipment at Henry Glaves Park. Her concern was that her child fell through a hole in the center of the equipment that had no safety rails. In the days when this equipment was installed it met the standards of the day. However, we now have new regulations. However, staff did not want to make modifications to the existing equipment unless we could get a recommendation from the manufacturer as to how this might be done. Therefore, Duane Wright contacted the original manufacturer for their recommendations. Below are the results of that inquiry. "Pursuant to my phone call of this afternoon (May 20, 1993), and following my visit and inspection of the above system, delivered 14 years ago, Columbia Cascade Company is advising that the system has exceeded useful life. The system does not meet current U.S. Consumer Project Safety Commission Guidelines for safety, and cannot be brought up to these standards. In addition, one support beam and possibly two others are deteriorating effecting the structural integrity of the equipment. This system should be taken out of service immediately and replaced. If you have any questions please feel free to call (800 -368 -1366) - Alex Tsitovich Sales Representative David F. O'Keefe Co." 2 Continued June 8, 1993 Unfortunately, the manufacturer is telling us that this equipment has outlived its expected life and they recommend new equipment. The City now has a recommendation that says our equipment is unsafe and no recommendation as to what to do to bring it up to code other than the costliest one imaginable. Obviously, a total replacement of this equipment is not in our budget and is unlikely to be in the near future. The City has citizen complaints, a recommendation from Duane Wright and a similar one from the manufacturer. All of them indicate this equipment needs replacement. The equipment could be torn out as unsafe. However, this is a popular playground. Our other alternative is to try to get this project funded. Staff is sure it meets the requirements under the Americans with Disabilities Act (ADA) requirements, but community block grant funds are already committed. Staff, therefore, recommended that the equipment be replaced. Cost to replace same would be approximately $15,000 plus $3,500 to $5,000 for company installation. This does not include eventual ground cover replacement to meet ADA requirements, that would be another $4,000 to $5,000. Following discussion, on motion of Council Member Snider, Mann second, the City Council authorized the expenditure of $21,131.48 to replace the playground equipment at Henry Glaves Park by the following vote: Ayes: Council Members - Mann, Sieglock, Snider and Pennino (Mayor) Noes: Council Members - Davenport Absent: Council Members - None CLOSED SESSION At approximately 9:40 a.m., the City Council adjourned to a Closed Session to discuss the following matter: a) Labor Negotiations The City Council meeting reconvened at approximately 10:25 a.m. ADJOURNMENT There being no further business to come before the City Council, Mayor Pennino adjourned the meeting at approximately 10:25 a.m. to June 9, 1993 at 7:00 p.m. Attest: er � Peian C ty Clerk 3
