ROLL CALL Present: Council Members - Davenport, Mann, Pennino, Snider and Sieglock (Mayor) Absent: Council Members - None Also Present: City Manager Peterson, Assistant City Manager Glenn, Public Works Director Ronsko, Acting City Attorney Sullivan and City Clerk Perrin 2. INVOCATION The invocation was given by Pastor Lyle Moms, Salvation Army. 3. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Sieglock. 4. INTRODUCTION Mayor Sieglock introduced Acting City Attorney C.M. (Bud) Sullivan who filled in for City Attorney McNatt during his absence. 5. AWARDS / PROCLAMATIONS / PRESENTATIONS a) Mayor Sieglock presented a proclamation to Ken Kramlich of the American Legion celebrating its 75th Birthday. FILE NO. CC -37 b) Mayor Sieglock presented a proclamation to Bill Dauer and Joanne Barkley proclaiming May 14, 1994 as "Walk For The Health Of It" day. Mr. Dauer presented the Mayor with a T-shirt and asked that he serve as the official starter for the walk. FILE NO. CC -37 C) Mayor Sieglock presented a proclamation to Boyd Lamberson, Post Master, and Amanda Solway of the U.S. Post Office proclaiming May 14, 1994 as "National Letter Carrier Food Drive Day". Mr. Lamberson encouraged the citizens to place canned goods at their mailboxes on the 14th, and the letter carriers will pick them up and deliver to the Salvation Army and to the Lodi Community Service Center. FILE NO. CC -37 d) Mayor Sieglock presented a proclamation to Pastor Lyle Morris of the Salvation Army proclaiming the week of May 9 - 14, 1994 as "National Salvation Army Week". FILE NO. CC -37 e) Mayor Sieglock presented a proclamation to Public Works Director Jack Ronsko proclaiming the week of May 15 - 21, 1994 as "National Public Works Week". Mr. Ronsko presented each of the Council Members with a button celebrating the event. FILE NO. CC -37 Continued May 4, 4994 f) Mayor Sieglock presented a proclamation to Brad Jones and Judy Clemmons proclaiming the week of May 1 - 7, 1994 as "Hire a Vet Week". - FILE NO. CC -37 g) Shirley Hackett, winner of the KOVR Channel 13 Jefferson Award, made a presentation to the City Council regarding the award she received for her participation in the "Grandparent Reading Program". Ms. Hacket gave public recognition to her father, Lee Miuns, and to her inspiration, Sarah Heberle, and also recognized the many volunteers who were present in the audience. h) Parks and Recreation Director Williamson and Carol Marvel of the Lodi Community Band made a presentation to the City Council regarding the "1994 Concert In The Park" musical series. Each event will have a theme and will be held on the following days: May 15, 1994 at Lodi Lake Park, "100 Years of American Popular Music"; • June 19, 1994 at Hale Park, "Music from the Stage and Screen"; • July 17, 1994 at Beckman Park, "Cartoons and Classics"; and • August 21, 1994 at Glaves Park, "Summer Memories". FILE NO. CC -40 6. COMMENTS BY THE PUBLIC ON CONSENT CALENDAR ITEMS 4 a) Lee Miuns, 1416 Keagle Way, Lodi, apologized for possibly confusing the City Council at the last meeting with some of his comments and requested that the City Council let him know if his comments seem unclear. CONSENT CALENDAR In accordance with report and recommendation of the City Manager, Council, on motion of Council Member Pennino, Sieglock second, unanimously approved the following items hereinafter set forth except those otherwise noted: a) Claims were approved in the amount of $3,385,519.42. FILE NO. CC -21(a) b) Council Member Davenport presented the City Clerk with a memo regarding possible changes and/or errors on the Minutes of April 20, 1994 (Regular Meeting). The City Council, therefore, approved the minutes of April 20, 1994 (Regular Meeting) following verification by the City Clerk of possible changes and/or errors by the City Clerk. FILE NO. CC -1(b) C) Adopted Resolution No. 94-42 authorizing the City Manager to sign the agreement to accept the Department of Toxic Substances Control grant to purchase a hazardous materials emergency response vehicle. FILE NO. CC -7(f), CC -90 AND CC -300 d) Approved the specifications and advertisement for bids for a Hazardous Materials Response Vehicle to be used by the City's specialized hazardous materials response team and authorized the advertising of said bids. FILE NO. CC -12.1(b) 2 Continued May 4, 1994 e) Approved the final map for Century Meadows One, Unit No. 1, Tract No. 2570, and directed the City Manager and City Clerk to execute the Improvement Agreement and map on behalf of the City. FILE NO. CC -46 AND CC -90 f) Agenda item #E-6 entitled, "Boosters of Boys and Girls Sports Organization (BOBS) concession agreement renewal at Zupo Field, 350 North Washington Street, Lodi" was removed from the Consent Calendar and discussed and acted upon following the adoption of the Consent Calendar. (Removed by Council Member Davenport.) g) Agenda item #E-7 entitled, "Approve the classification and salary range of Police Corporal" was removed from the Consent Calendar and discussed and acted upon following the adoption of the Consent Calendar. (Removed by Council Member Davenport.) h) Agenda item #E-8 entitled, "Receive Police Officers' Association Memorandum of Understanding (MOU) 1993-94" was removed from the Consent Calendar and discussed and acted upon following the adoption of the Consent Calendar. (Removed by Council Member Davenport.) Agenda item #E-9 entitled, "Proposed parental financial responsibility for graffiti" was removed from the Consent Calendar and discussed and acted upon following the adoption of the Consent Calendar. (Removed by Council Member Davenport.) DISCUSSION ON ITEMS REMOVED FROM THE CONSENT CALENDAR a) The City Council, on motion of Council Member Mann, Sieglock second, unanimously adopted Resolution No. 94-43 approving concession agreement between the Boosters of Boys and Girls Sports Organization (BOBS) and the City of Lodi to operate the concession facilities at Zupo Field from March 1, 1994 to midnight, December 31, 1994 and authorized the City Manager and the City Clerk to execute the agreement on behalf of the City. FILE NO. CC -27(c), CC -90 AND CC -300 b) The City Council, on motion of Council Member Mann, Pennino second, unanimously adopted Resolution No. 94-44 approving the class specifications and salary range of Police Corporal and reallocating six Police Officers to Police Corporals. FILE NO. CC -34 AND CC -300 C) The City Council, on motion of Council Member Davenport, Pennino second, unanimously received the Police Officers' Association of Lodi's (POA of L) Memorandum of Understanding (MOU) for 1993-94 (with minor typographical corrections and the City Attorney's signature as approved to form and content). FILE NO. CC -34 d) The City Council, on motion of Council Member Pennino, Davenport second, unanimously adopted Resolution No. 94-45 entitled, "A Resolution Of The Lodi City Council Urging Local Legislators To Support An Amendment To State Law Allowing Cities And Other Public Agencies To Adopt Ordinances Imposing Financial Responsibility On Both The Perpetrators And The Parents Of Minor Children Who Commit Acts Of Graffiti Vandalism". FILE NO. CC -6, CC -13 AND CC -300 Continued May 4, 1994 COMMENTS BY CITY COUNCIL MEMBERS ON NON -AGENDA ITEMS a) Council Member Pennino updated the City Council on recent actions of the San Joaquin County Council of Governments (COG). It recently authorized a cooperative agreement with Caltrans for the widening project of 1-205 near Tracy and advanced some of the Measure K funds which will speed up the project by approximately two years. COG also received word that the emergency Call Boxes, which citizens are already paying for through the Department of Motor Vehicles (DMV) fees, will be installed in San Joaquin County in June, 1994. Mr. Pennino also announced that the Lodi Leadership Prayer Breakfast will be held on Friday, May 6, 1994 at the American Legion building. FILE NO. CC -7(n) b) Council Member Davenport also mentioned that there will be a 12:00 noon prayer session on the same day and those interested should contact Bruce Logue. Council Member Davenport thanked everyone for attending the Council meeting and made the following comments: (1) Urged everyone to be ever mindful of the gang situation and to support the Gang Alternative Project's (GAP) efforts; (2) Thanked the many citizens who telephoned him to wish him "Happy Birthday" on his 50th birthday; (3) Received many phone calls from citizens regarding the misprint on watering days that was published in the newspaper and was glad to see it corrected; (4) Requested that the City Manager give a report regarding the Shirtsleeve Session of May 3, 1994 in which the Code Improvement Officer from San Mateo made a presentation regarding its program. City Manager Peterson stated that the session dealt with the consideration of fees for health and safety inspections of rental properties and, at this time, is information only. If the Council is interested, the matter will be brought to a City Council meeting. Mr. Davenport further expressed his dissatisfaction with the local Health Department and the lack of assistance the City receives from it. Mr. Davenport feels the City should hire a health officer and believes Frank Beeler, who is employed in the Municipal Service Center, would be qualified to fill this position. Further, Mr. Davenport would like the Fire Department to provide voluntary home inspections for possible fire and safety hazards as the department used to do; (5) Would still like to see the Shirtsleeve Sessions changed to the evening; (6) Informed the public that the City Clerk and the Deputy City Clerk recently attended the City Clerk's Association of California (CCAC) conference in Napa and asked the City Clerk for a report. Mrs. Perrin responded that a report will be forthcoming; (7) Informed the public that Council Member Mann recently attended a downtown revitalization conference in Monterey and requested a report on the matter. Mr. Mann responded that he is planning to give a report under "Comments by the Council" segment when it is his tum; (8) Requested an update from the Public Works ` Director regarding the speeding and trucking problem along Century Boulevard that was discussed at the last City Council meeting. Mr. Ronsko informed the Council that several letters have gone out to the local trucking companies, and he has received some feedback from companies who are willing to limit their use of Century Boulevard; (9) Would like an update regarding the golf driving range; however, he will wait until the City Attorney returns; and (10) Offered Virgil Whalen, retired fire fighter, best wishes for a quick recovery during his illness. FILE NO. CC -2(q), CC -34, CC -48(a) AND CC -183(d) 4 Ciontfnued May 4, 1994 C) Council Member Mann informed the City Council and the public that he recently attended the League of California Cities 1994 Downtown Revitalization Conference in Monterey with Economic Development Director, Janet Keeter, and Chamber of Commerce President, Bob Johnson. He is encouraged with what he heard from the conference and is happy to see other areas being revitalized successfully. Mr. Mann has no doubts that the revitalization efforts will work here, and the City of Lodi's approach seems to be correct so far. Mr. Mann commented that an article was seen that Reno recently hired Freedman, Tung & Bottomley to revitalize its downtown. Mr. Mann sent congratulations to Annie Erwin of Lodi High School who won the high school debate contest in Sacramento. FILE NO. CC -72 AND CC -400 d) Council Member Snider shared some of the citizen complaints he received regarding the length of City Council meetings. Many citizens complain about waiting until 12 - 1 a.m. to discuss an item of concern. Others complain that certain items of interest on the Regular Calendar are removed; however, it is not announced until late in the meeting. Mr. Snider passed on the following suggestions he received to the City Council: • Move the Consent Calendar to the end of the agenda; • Move "Comments by the Council" and "Comments by the Public" segments to the end of the agenda; • Stop televising Council meetings to avoid "grandstanding"; • Limit discussion; • Complaints of too much repetition; and • Advise the public at the beginning of the meeting if an item on the Regular Calendar will be removed. FILE NO. CC -6 AND CC -16 e) Mayor Sieglock informed the public that agenda item #J-5 entitled, "Consider deferral agreement with Hix Steel, Inc. for Thurman Street improvements" has been pulled from the agenda. Mayor Sieglock congratulated Larry Hughes on his appointment as Fire Chief for the city of Modesto and sent his best wishes to both Lary and his wife, Pat. Mayor Sieglock commented on the last Downtown and Cherokee Lane Revitalization Workshop and the exciting ideas that have surfaced, including the possibility of a "Town Square" and moving the train station a bit towards the south. There is still a long way to go, and Mr. Sieglock encouraged the public to continue with its input. ` Mayor Sieglock announced that Thursday, May 5, 1994 will be National Day of Prayer at Zion Reformed Church, 105 South Ham Lane. Mayor Sieglock informed the City Council that he attended his first meeting of the San Joaquin Partnership. There is an aviation company looking to relocate in the San Joaquin area and an invitation to locate in Lodi will be relayed to them. Mayor Sieglock expressed his belief that the Shirtsleeve Sessions should remain at 7:00 a.m. There are a lot of other meetings and functions in the evening, and many people spend quality family time during the evenings. Mayor Sieglock also thanked the City Clerk for collecting the anonymous fliers that were passed out around the Council Chambers prior to the meeting. These fliers were rude and done in poor taste. FILE NO. CC -6, CC -7(u), CC -72 AND CC -400 Continued May 4, 1994 f) City Manager Peterson also expressed his pleasure in the possibility of the aviation company relocating to this area. Further, Mr. Peterson extended his best wishes and congratulations to Larry Hughes for his appointment as Fire Chief in the city of Modesto. g) Council Member Davenport questioned who decided the Mayor would represent the City on the San Joaquin Partnership Board. Mayor Sieglock responded that he just went for his own interest. Council Member Pennino pointed out that most representatives on the Board are Mayors or Vice Mayors. FILE NO. CC -7(u) 10. COMMENTS BY THE PUBLIC ON NON -AGENDA ITEMS a) Frank Winston, 118 North Cherokee Lane, Lodi, introduced Gary Mack, 2313 West Alpine, Stockton, who is owner and General Manager of a professional soccer team in the area. Mr. Mack shared with the Council his desire to locate his professional soccer team in Lodi, and thanked Lodi for being so helpful in assisting him with his task. b) Larry Hansen, Police Chief, invited the City Council and the public to attend the 8th Annual Crime Prevention Fair to be held on Sunday, May 15, 1994 from 9:00 a.m. - 4:00 p.m. at the Lodi Grape Festival grounds, in conjunction with the Spring Festival. Admission is free and there will also be free parking available. Police Chief Hansen presented each of the Council Members with a Crime Prevention Fair T-shirt. Also, this year, there will be a pancake breakfast served prior to the event. FILE NO. CC -152 C) John Young, Lodi, commented on the $2.5 million budget shortfall for the 1994-95 year and suggested the following: That Administration employees cut salaries across the board by 15% (except Police and Fire employees); • That the City combine the Fire and Police Departments to be directed under a Public Safety Director; and That the City of Lodi stop subsidizing the Old Lodi Union High School Site Foundation to keep Hutchins Street Square in business. Mr. Young realizes this may be an unpopular request; however, the City needs to rectify ` the $2.5 million budget shortfall. Mr. Young also urged that the City Council not implement long-term projects with short-term funds. FILE NO. CC -6, CC -16 AND CC -34 d) Marty Ummel, 8615 Walnut Acres, Morada, and candidate for 4th District San Joaquin County Board of Supervisors, commented on a recent "Letter to the Editor" that appeared in the Lodi News Sentinel by Mike Walsh who stated that her fellow candidate did not handle his finances properly. Ms. Ummel feels it is unfair that only one or two candidate are being focused on. She has a good track record regarding her finances, and people should look at each candidate. Ms. Ummel hopes that more candidates will come forth before the Council to express their thoughts. Mayor Sieglock commented that he hopes the candidates for the 4th District race will not use this forum as a means to debate the race. FILE NO. CC -16 AND CC -18 N. i% Continued May 4, 9994 e) Dorean Rice and Les Dabritz of the Lodi District Chamber of Commerce informed the City Council of the success of the recent Street Faire held on Sunday, May 1, 1994. Further, a check in the amount of $1,177.56 was presented to Mayor Sieglock representing the business license fees for the vendors at the event. Council Member Pennino congratulated the Chamber on a successful event and stated he was glad to see many of the existing businesses open during the event. Many of the businesses have reported that they tripled their revenues that day. Ms. Rice took an opportunity to commend the group of youths the Chamber hired from Bethel Open Bible Church to help set up, barricade and clean up the area. They did an excellent job and their efforts were applauded. FILE NO. CC -7(k) f) Brian Ochoa, Lodi, commented on a recent meeting he attended at the Parks and Recreation office regarding the possibility of creating a street hockey league in Lodi. Mr. Ochoa expressed his support of the program and hopes to see it begin which will help in the fight against gangs and graffiti. Further, Mr. Ochoa recommended the following salary cuts for City of Lodi employees: Those making $70,000 a year, reduce salary by 15%; • Those making $60,000 a year, reduce salary by 10%; and • Those making $50,000 a year, reduce salary by 5%. Mr. Ochoa would like to see the rest of the employees remain at the current salary levels. FILE NO. CC -16, CC -34 AND CC -40 g) Lee Miuns, Lodi, stated that he has heard "talk on the street" as to why four of the five Council Members went to Washington D.C. for a "paid vacation". Mr. Miuns does not feel that way; however, he feels the City Council should provide justification and a report to the people. Mayor Sieglock informed Mr. Miuns that he gave a complete update of the conference to the public the first meeting following their return from Washington D.C. FILE NO. CC -16 h) Council Member Pennino reminded the public that Sunday, May 8, 1994 is the Cinco de Mayo celebration at the Grape Festival. 11. PUBLIC HEARINGS None. 12. COMMUNICATIONS (CITY CLERK) a) On recommendation of the City Attorney, staff and/or the City's contract administrator, Insurance Consulting Associates, Inc. (ICA), the City Council, on motion of Council Member Snider, Mann second, unanimously rejected the following claim and referred it back to ICA: Jerry Zahos, date of loss 4/19/94 Note: The claim for Kenneth Sammy, date of loss 4/2/94 was settled; therefore, there was no need to reject the subject claim. FILE NO. CC -4(c) 7 Continued May 4, 1994 b) City Clerk Perrin read the following ABC Licenses: 1. Lucky Stores, Inc. Delaware, 530 West Lodi Avenue and 240 West Kettleman Lane, Lodi, Off Sale General License, Person to Person Transfer; and 2. VFW Post 1968, 23 West Elm Street, Lodi, Veterans Club License, Premises to Premises Transfer. FILE NO. CC -7(f) C) The following report was presented to the City Council: 1. Planning Commission report of April 25, 1994. FILE NO. CC -35(c) d) The City Council, on motion of Council Member Snider, Mann second, unanimously reappointed the following persons to the Lodi East Side Improvement Committee: East Side Improvement Committee Virginia Snyder Colleen Dixon Saleem Khan Harry Marzolf FILE NO. CC -2(s) e) The City Council, on motion of Council Member Snider, Pennino second, unanimously appointed the following persons to the Greater Lodi Area Youth Commission: Greater Lodi Area Youth Commission Richard Jones David Wright FILE NO. CC -2 f#) f) The City Council received Application No. 94-04-002 from the Pacific Gas & Electric Company (PG&E) filed with the California Public Utilities Commission (CPUC) requesting authority to increase its rates for electric services and no increase for gas services to be effective January 1, 1995. FILE NO. CC -7(t) 13. RECESS Mayor Sieglock declared a ten-minute recess and the City Council meeting reconvened at approximately 9:02 p.m. 8 Continued May 4, 1994 14. REGULAR CALENDAR a) The City Council, on motion of Council Member Davenport, Sieglock second, unanimously authorized the City Manager to enter into personal services contracts with James E. Brown and Associates (planning and implementation) and Selena Barlow (marketing) to provide consultation services to implement a fixed -route transit system (following correction of minor errors in the contracts and addition of page listing Mr. Brown's costs). Speaking in support of the matter was Lillian Goldsmith, Lodi resident. FILE NO. CC -50(b) AND CC -90 b) Council Member Pennino made a motion, Sieglock second, to authorize the hiring of a Transit Supervisor amongst the City employees on a contractual basis to oversee the day-to-day operations of the Dial -A -Ride program; however, the motion was withdrawn. The City Council, on motion of Mayor Sieglock, Davenport second, unanimously tabled the matter to allow time for staff to create a job specification and contract and allow an opportunity for in-house employees to apply for the position. Further, the City Council, on motion of Mayor Sieglock, Pennino second, unanimously amended its motion to bring the matter back to the City Council at its next regularly scheduled meeting. Speaking on the matter were the following persons: 1. Lillian Goldsmith, Lodi resident (support); 2. Don Ochs, 1812 Burgundy Court, Lodi (support); 3. Frank Alegre, Lodi (in support of hiring from within the City; however, not for hiring an additional person); 4. Brian Ochoa, Lodi, (questioned the funding and terms of the contract and supported hiring from within City); 5. Rich Kotowski, 1152 Devine Drive, Lodi, (in support of hiring from within the City); and 6. Darrell McLaughlin, Dial -A -Ride driver (support). FILE NO, CC -34, CC -50(b) AND CC -90 C) The City Council, on motion of Council Member Pennino, Mann second, approved the recommendations for meeting the City's Economic Development Goals and Objectives by the following vote: Ayes: Council Members - Mann, Pennino, Snider and Sieglock (Mayor) Noes: Council Members - Davenport Absent: Council Members - None Council Member Davenport entered his dissent into the record that the goals and objectives does not show the costs, it does not have a cost analysis and it does not show where the money is coming from. 0 Continued May 4, 1994 Speaking on the matter was Frank Alegre, who agreed with Council Member Davenport that the costs should be shown and further suggested that the City of Lodi send prospective business tickets to travel here to see Lodi, instead of Lodi staff traveling to them. FILE NO. CC -6, CC -72 AND CC -400 d) The City Council, on motion of Council Member Mann, Snider second, unanimously approved the plans and specifications for bids for Lodi Lake Park - West Bank Cleanup Project and authorized advertising for bids. Mr. Davenport stated for the record that he wanted to be assured that this was not for flood control or erosion. Speaking on the matter was Frank Alegre, who suggested that the concrete and wood be hauled separately. Staff explained that it will be hauled separately, because both materials are located in separate areas. FILE NO. CC -12.1(c) AND CC -27(c) e) Agenda item #J-5 entitled, "Consider deferral agreement with Hix Steel, Inc. for Thurman Street improvements" was not ready for action; therefore, the matter was pulled from the agenda pursuant to staffs request. f) The City Council, on motion of Council Member Mann, Sieglock second, unanimously adopted the following resolutions which pertain to the General Municipal Election to be held on Tuesday, November 8, 1994: Resolution No. 94-46 entitled, "A Resolution Of The City Council Of The City Of Lodi, California, Calling And Giving Notice Of The Holding Of A General Municipal Election To Be Held In The City On Tuesday, November 8, 1994, For The Election Of Certain Officers Of The City As Required By The Provisions Of The Laws Of The State Of California Relating To General Law Cities"; 2. Resolution No. 94-47 entitled, "A Resolution Of The City Council Of The City Of Lodi, California, Adopting Regulations For Candidates For Elective Office Pertaining To Candidates Statements Submitted To The Voters At An Election To Be Held On Tuesday, November 8,1994"; 3. Resolution No. 94-48 entitled, "A Resolution Of The Lodi City Council Determining That There Will Be No Filing Fee Charged For The Processing Of Candidates' Nomination Papers For The November 8, 1994 General Municipal Election"; 4. Resolution No. 94-49 entitled, "A Resolution Of The City Council Of The City Of Lodi, California, Requesting The Board Of Supervisors Of The County Of San Joaquin To Render Specified Services To The City Relating To The Conduct Of A General Municipal Election To Be Held Tuesday, November 8, 1994"; 5. Resolution No. 94-50 entitled, "A Resolution Of The City Council Of The City Of Lodi, California, Providing For The Appointment To The Offices Of This City That Were To Be Elected Tuesday, November 8, 1994 Of The Persons Who Have Been Nominated If There Are Not More Candidates Than Offices To Be Elected"; and 6. Resolution No. 94-51 entitled, "A Resolution Of The City Council Of The City Of Lodi, California, Providing That The Determination Of A Tie Vote By Candidates Who Receive An Equal Number Of Votes And The Highest Number Of Votes For One Office In The November 8, 1994 General Municipal Election Will Be By Lot". FILE NO. CC -6, CC -18 AND CC -300 10 /X01' Continued May 4, 1994 15. ORDINANCES a) Ordinance No. 1593 entitled, "An Ordinance Of The City Council Of The City Of Lodi Amending The Official District Map Of The City Of Lodi And Thereby Amending Planning Development District No. 6 (P -D 6) By Redesignating The Parcels At 60 And 70 North Lower Sacramento Road From R-1, Single -Family Residential' having been introduced at a regular meeting of the Lodi City Council held April 20, 1994 was brought up for passage on motion of Council Member Pennino, Mann second.
