1. ROLL CALL

2. INVOCATION
The invocation was given by Pastor Vernon Janzen, Vinewood Community Church.
Council Member Pennino commended and thanked Pastor Vernon Janzen, who is leaving Lodi
for Visalia, for his dedicated service to this community.
3. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Sieglock.
4. AWARDS / PROCLAMATIONS / PRESENTATIONS
a) Mayor Sieglock presented proclamations to Larry Johnson, Erik Espera and Carol
Sorenson who saved the life of senior swimmer, Dan Maranise, at the Hutchins Street
Square pool by performing CPR on the heart attack victim. Mr. Maranise thanked the
three individuals and the paramedics and doctors for saving his life.

b) Mayor Sieglock presented a proclamation to Melita Heli and Zee Hendrix of the
Daughters of Isabella proclaiming April 22, 1994 as "Daughters of Isabella Day".

C) Mayor Sieglock acknowledged the beautiful plaque that the City of Lodi received from
Maria Gloria Comejo Benaventa, a representative of Chile who was visiting Lodi with a
Rotarian club,

d) Arilee Pollard of the Junior Garden Club presented a check to City of Lodi Naturalist
Barbara Brown in the amount of $250 which is monies from a grant from the Shell Oil
Company to allow planting of flowers in the Mokel Indian Village at the Lodi Lake Nature
Area.

e) Prior to hearing the following reports, Council Member Davenport made a motion to limit
the presentations to five minutes. The motion died for lack of a second.
1. Bob Johnson, President of the Lodi District Chamber of Commerce presented a
quarterly report to the City Council of its activities and accomplishments. Mr.
Johnson presented the City Council with the newly -revised City of Lodi map and
a copy of the "Lodi District Chamber of Commerce Membership Survey,
Subject: Proposed City of Lodi Business License Tax Ordinance" (a copy
of which is on file in the City Clerk's office).
Evelyn Olson presented the Lodi City Council with a quarterly report of the Joint
Lodi District Chamber of Commerce and City of Lodi Economic Development
Task Force.
3. Dorean Rice and Les Dabritz presented the Lodi City Council with a report
regarding the upcoming Lodi Street Faire scheduled for May 1, 1994 and
presented the City Council and staff with a complimentary sun visor and raffle
ticket for the event. Mr. Dabritz commended Dorean Rice and her son, Dean
Newhall, for achieving the Lifetime Honorary Member status for their efforts in
the Lodi Street Faire.

5. CONSENT CALENDAR
In accordance with report and recommendation of the City Manager, Council, on motion of Mayor
Sieglock, Pennino second, approved the following items hereinafter set forth except those
otherwise noted:
a) Claims were approved in the amount of $1,259,870.40.

b) The Minutes of April 6, 1994 (Regular Meeting) were approved as written.
c) Agenda item #E-3 entitled, "Plans and specifications and advertisement for bids for Well
Drilling, Well #25, 1014 Holly Drive, Lodi" was removed from the Consent Calendar and
discussed and acted upon under the Regular Calendar. (Removed by Council Member
Davenport.)
d) Approved the specifications and authorized advertisement for bids for ten portable
communications radios for use by the Lodi Police Department's Partners volunteers.

from the Consent Calendar and discussed and acted upon under the Regular Calendar.

Police Department" was removed from the Consent Calendar and discussed and acted

g) Agenda item #E-7 entitled, "Contract Award for Dial -A -Ride office renovation, 303 West
Elm Street" was removed from the Consent Calendar and discussed and acted upon

h) Agenda item #E-8 entitled, "Final Map and Improvement Agreement for Century
Meadows One, Unit No. 1, Tract No. 2570" was pulled from the agenda pursuant to
staffs request.
Adopted Resolution No. 94-38 appropriating $290,000 and $289,000 in Federal Hazard
Elimination Safety Program funds for the Cherokee Lane and various arterial/collector
street lighting projects, respectively.

j) Agenda item #E-10 entitled, "Reorganization of the Finance Department" was removed
from the Consent Calendar and discussed and acted upon under the Regular Calendar.

k) Agenda item #E-11 entitled, "Contract for hazardous materials emergency response
equipment" was pulled from the agenda pursuant to staffs request.
Mayor Sieglock informed the public that the items removed from the Consent Calendar would be
discussed under the Regular Calendar. Council Member Davenport objected and called for
"orders of the day". However, the City Council, on motion of Mayor Sieglock, Mann second,
voted to hear these items under the Regular Calendar by the following vote:

6. COMMENTS BY CITY COUNCIL MEMBERS ON NON -AGENDA ITEMS
a) Mayor Sieglock reminded the public that the second workshop with Freedman Tung &
Bottomley to discuss the Downtown and Cherokee Lane Revitalization is scheduled for
Thursday, April 21, 1994 at 7:00 p.m. at Hutchins Street Square. Mr. Freedman will
present his impressions and make preliminary recommendations.
Mayor Sieglock also announced the upcoming workshop scheduled for Wednesday, April
27, 1994 to discuss the proposed business license fee increase. The workshop will be
held at the Carnegie Forum from 7:00 - 9:00 p.m.

b) Council Member Davenport thanked everyone for coming and made the following
comments: (1) The agenda contains an item in which staff is requesting a $3.2 million
expense for the City Hall remodel project; (2) Urged everyone to be ever mindful of
gangs; (3) Commented that he went to the bank to inquire how much money the City has
and discovered that the "signature cards" are not in order. He is glad to see that the
Finance Director took care of this situation and hopes to not see it happen again; (4)
Informed the public that the decision from the arbitrator in regards to the grievance filed
by the United Firefighters of Lodi (UFL) has been finalized. Mr. Davenport alleged that
the decision will cost the City approximately $100,000 and hopes that these
"management mistakes" will no longer occur; (5) Commented that the Fire Department
has not received any funds from the Proposition 172 monies and wondered why that
was; (6) Urged the importance of business retention in Lodi and complimented Paul's
Safe Lock and Key who has been in business in this community for approximately 37
years. Mr. Davenport wished Paul a "Happy Birthday"; (7) Expressed his concern with
the position the League of California Cities took on SB 1823 in regards to Public Safety

Officers - Procedural Bill of Rights. Mr. Davenport feels the Bill should be supported,
because of problems with management in administration. Mr. Davenport further
encouraged the public to contact the Senate Judiciary Committee to support the Bill; and
(8) Commented that the workshops for the Downtown and Cherokee Lane Revitalization
effort is a step in the right direction.

C) Council Member Pennino commented that he would like to see the City send out
information with the June utility billing of the City's 1993/94 budget showing both income
and expenses, similar to what the Department of Motor Vehicles (DMV) sends out to
those who renew drivers' licenses. This would be a great resource to the public.
Council Member Pennino announced that the Lodi High Flame Foundation will be having
its 4th Annual Red and White Night Dinner/Dance on Saturday, April 23, 1994, from 6
p.m. - 1 a.m. at the Grape Pavilion. Tickets are $18.00 per person.
Further, Mr. Pennino asked that the matter regarding the arbitration decision be clarified.

d) City Manager Peterson announced that the 6th Annual Lodi Day at the Stick will be on
Saturday, May 14, 1994, Giants v. Reds. The proceeds go to Lodi-Tokay Rotary Club's
community charity fund.
Mr. Peterson clarified that there were no "mistakes" made in regards to the UFL
grievance. The arbitrator upheld the City's position (in the agreed-upon final binding
arbitration) that it owed the firefighters 1.9% in compensation as it contended from the
start.

e) Mayor Sieglock informed the public that the Shirtsleeve Sessions in May will be
designated for the 1994/95 budget review and urged the public to attend these sessions.
Mayor Sieglock asked the City Attorney to share the results of the case in which the City
was being sued for a rekindle fire. City Attorney McNatt informed the City Council that
the case was dismissed without a need to amend. This matter was handled in-house by
the new Deputy City Attorney which is a savings to the City.
Mayor Sieglock also reiterated that the arbitrator upheld the City's position in the UFL
grievance.

f) Council Member Davenport responded that the City Manager's statements concerning
the UFL grievance was misleading. The total cost included the 1.9% plus interest, the
figure for the "call outs", the arbitrator's fee, and the City Attorney's time. Mr. Davenport
believes this was all due to management error and stated that the City should get all
costs agreed upon before entering into an agreement.
Mr. Davenport also commented that the only reason the City won the case regarding the
rekindle fire is because public safety officers have immunity. Mr. Davenport believes this
rekindle is due to negligence by the fire administration and bad management.

g) Mayor Sieglock clarified that the final figure for the UFL arbitration decision was
approximately $60,000 not $100,000 as quoted by Council Member Davenport.

COMMENTS BY THE PUBLIC ON NON -AGENDA ITEMS
a) Arthur Price, Lodi resident, commented on an article that appeared in the Lodi News
Sentinel that contained a statement by Mr. Tony Canton that the City Council is not doing
what it can to help the east side. Mr. Price feels that statement is unfair. The City
Council is vitally interested in the east side. It has created an East Side Improvement
Committee and funds it with Community Development Block Grant (CDBG) funds, many
staff and Council Members attend the East Side Improvement Committee meetings, the
Council conducted an on -location east side special Council meeting, it conducted a
walking tour of the east side, it is working on a transit system and multi -modal station
scheduled to be located on the east side of town, it has a successful graffiti abatement
program, the Police Department conducts sweeps on Sacramento Street to rid the area
of prostitution and drugs, the Council hired a Community Improvement Officer, it
established an anti -loitering ordinance, and it has spent CDBG funds on Hale Park and
an east side street lighting program.
Council Member Davenport commented that he attended a Neighborhood Watch meeting
on the east side and listened to many of the citizens concerns, including the need for
lighting at Central and Lodi Avenue and alley lighting, the need for a cleaner City and
more street sweeping, complaints of too much noise from the boom boxes and garbage
problems.

b) Christina Salaices, representing the Gang Altemative Project (GAP), invited the City
Council and the public to attend the 2nd Annual Cinco de Mayo celebration on Sunday,
May 8, 1994. There will be an entrance fee of $2.00 per person and any family of four
who brings "mom" will have free admittance in celebration of Mothers' Day. There will be
no alcohol served again this year and the Police Department will be in attendance. Ms.
Salaices extended an invitation to the Spanish-speaking, as well.

C) Virginia Snyder, representing the East Side Improvement Committee, informed the City
Council and the public that the citizens who were involved in suing the owner of the
building at 220 East Pine Street had successfully won its case. Ms. Snyder sent a
message to the property owners of Lodi that the citizens are serious about not tolerating
substandard living conditions. Ms. Snyder informed the public that the Code
Enforcement Officer for San Mateo will be making a presentation to the City Council at its
Shirtsleeve Session of May 3, 1994 and encouraged the public to attend.

d) Ken Owen, Director of Christian Community Concerns, expressed his opposition to
Assembly Bill 2810 which gives additional rights to homosexual couples living together.
Council Member Davenport stated it was good that this is being brought to the citizens'
attention, and that homosexuals should have no special rights.

e) Victor Goehring, Attorney at law offices located at 315 West Pine Street, Lodi, and
resident of Woodbridge, expressed his opposition to the non-resident fees for City facility
use that were adopted at the last City Council meeting, stating that it is unfair
discrimination. Mr. Goehring further commended the City Council for disbanding the
Efficiency Committee and expressed his displeasure with Council Member Davenport
using the floor to discuss his personal agenda and wasting the public's time, and that the
Council should not waste time with Closed Sessions to discuss his legal problems. Mr.
Goehring, who is a member of the Califomia State Bar Association, stated that Mr.

Davenport should not be admitted to the Bar and he plans on notifying the members of
the Bar to that affect.
Council Member Davenport responded that he hopes he does notify the Bar Association
so that it will become aware of what the City management did to him.

f) Brian C. Ochoa, Lodi resident, responded to Mr. Goehring that he did not attend any of
the meetings of the Efficiency Committee and should not make any judgments. Mr.
Ochoa further announced that the committee will be continuing with its original charge as
a private committee and requested the assistance of the public and the City Council.

g) John Kraai, Lodi resident, stated he was glad to see the committee still continue on its
own, because they will help a great deal with the budget shortfall.

h) Tony Canton, 1029 South Church Street, Lodi, congratulated the east side citizens on
their success with its lawsuit against the property owner at 220 West Pine Street.
Further, Mr. Canton responded to Mr. Price's comments regarding his statement in the
Lodi News Sentinel. He still feels the Council and the City should do more for the east
side. The Community Improvement Officer needs assistance because he cannot
possibly accomplish all that needs to be done in 20 hours a week and staff needs to

follow up on complaints from citizens and ask for permission to enter properties to
investigate. Mr. Schroeder commented that the City must have authorization from a
property owner to enter and investigate. Also the Health Department has not been
helping in this situation due to lack of staff.

Frank Winston, Lodi resident, expressed his belief that property owners would let the City
in to investigate because they want their living conditions improved; however, they must
be asked first. Mr. Winston was surprised to hear about the lack of assistance from the
Health Department and suggested that the City Council send a letter requesting help.
Mr. Winston stated that his original opinion of the Efficiency Committee was probably
wrong and that it may indeed have been political; however, he suggested that a budget
advisory committee be created with seven members (two selected by the Mayor; two
selected by the Mayor Pro Tempore; and one selected by each of the three remaining
Council Members).
The City Council determined it would send a letter to the Health Department requesting
its assistance with citizen complaints.

j} Frank Alegre, Lodi resident, commended the City Council on the good job it has done on
the east side; however, the problem is the law that prevents the City from cleaning up
and crime prevention. Mr. Alegre commented on the Efficiency Committee and said he
never would have served on the committee if he knew he was to become a scapegoat for
its disbanding. Further, the committee was not disrespectful to City employees.

k) Marty Ummel, 8615 Walnut Acres, Morada, who is running for 4th District County Board
of Supervisors, commented on a recent newspaper article in which the Sheriffs
Department expressed its endorsement for George Barber. Ms. Ummel was upset
because the Sheriffs Department did not interview any other candidate before making
this endorsement.

1) Dennis Cochran, 935 Coloma, Lodi, commended the members of the Efficiency
Committee and wondered if the now -private committee came up with ideas to save
money, would they have to "shove it down (the Council's) throats". Mr. Cochran also
encouraged Council Member Davenport that if he wanted to go all the way to the
Supreme Court with his litigation he should do it. Further, Mr. Cochran suggested that
the City install a light board in the Council chambers which indicates how each Council
Member votes.

Mayor Sieglock declared a ten-minute recess and the City Council meeting reconvened at
approximately 9:13 p.m.
9. PUBLIC HEARINGS
a) Notice thereof having been published according to law, an affidavit of which publication is
on file in the office of the City Clerk, Mayor Sieglock called for the Public Hearing to
consider the request of Randall Heinitz to amend P -D(6), Planned Development District
No. 6 to include the lots at 60 and 70 North Lower Sacramento Road to provide for an
existing single-family dwelling and two proposed duplexes.

ACTION:
The City Council, on motion of Council Member Mann, Pennino second, unanimously
introduced Ordinance No. 1593 entitled, "An Ordinance of the City Council of the City of
Lodi Amending the Official District Map of the City of Lodi and Thereby Amending
Planned Development District No. 6 (P -D 6) by Redesignating the Parcels at 60 and 70
North Lower Sacramento Road from R-1, Single -Family Residential".

b) Notice thereof having been published according to law, an affidavit of which publication is
on file in the office of the City Clerk, Mayor Sieglock called for the Public Hearing to
consider the appeal received from Faisal Sublaban regarding Notice of Public Nuisance
and Order to Abate issued by Chief Building Inspector regarding property located at 1107
South Central Avenue.
Hearing Opened to the Public
Faisal Sublaban spoke in support of his appeal and indicated he was willing to
bring the building up to code;
Colleen Dixon, 333 Hilborn, Lodi, spoke in opposition to granting the appeal; -
3. Frank Alegre, Lodi, spoke in support of granting the appeal;

4. Leon Harris, whose son lives on the north side of the house, spoke in
opposition to granting the appeal; and
Randy Heinitz, 70 North Lower Sacramento Road, Lodi, spoke in support of
granting the appeal.
Letters were also received from the following:
Ron Teunissen, 4478 Winding River Circle, Stockton, and co-owner of property
located at 1111 South Central Avenue, Lodi, expressed his opposition to granting
the appeal; and
2. Edward Hams, 340 Poplar Street, Lodi, expressed his opposition to granting the
appeal.

ACTION:
The City Council, on motion of Mayor Sieglock, Mann second, denied the appeal of
Faisal Sublaban regarding Notice of Public Nuisance and Order to Abate issued by Chief
Building Inspector on the property located at 1107 South Central Avenue by the following
vote:
Ayes: Council Members - Mann, Pennino and Sieglock (Mayor)
Noes: Council Members - Davenport
Absent: Council Members - Snider

a) City Clerk Perrin read the following ABC Licenses:

2. Gertrud and Robert Schultze, Gertie's Place, 105 West Pine Street, Lodi, On

C) The City Council, on motion of Council Member Mann, Pennino second, unanimously set
public hearing for May 18, 1994 to consider appeal received from Geweke Toyota
appealing the Planning Commission's decision that a blimp, which has been flying at
Geweke Toyota, 1200 South Beckman Road, was an illegal advertising device and that
its usage be discontinued.

11. REGULAR CALENDAR
a) The City Council, on motion of Council Member Pennino, Sieglock second, unanimously
adopted Resolution No. 94-40 amending Traffic Resolution No. 87-163 by approving the
parking restriction of vehicles 6 feet or more in height on the north side of Century
Boulevard, from Scarborough Drive to 100 feet east of Scarborough Drive. Council
Member Davenport stated for the record that this area should be monitored closely.
Speaking in support of the matter was Arthur Price, Lodi resident.

b) The City Council, on motion of Council Member Davenport, Sieglock second,
unanimously adopted Resolution No. 94-41 amending Traffic Resolution No. 87-163 by
approving a 40 mile per hour (mph) speed limit on Century Boulevard between Cherokee
Lane and Stockton Street, and further that an effort be made to contact those trucking
companies who use Century Boulevard, especially at night, and ask for cooperation in
limiting its use of this street by the following vote:

Noes: Council Members - Mann
Absent: Council Members - Snider
Speaking on the matter were the following persons:

1. Barbara Bowers, 419 Swallow, Lodi, supported the recommendation; however,
expressed concerns about the truck travel on Century Boulevard, especially
during the night;
2. Don Sorez, 359 East Century Boulevard, Lodi, supported the recommendation;
however, expressed concerns about the proposed speed limit and the truck
travel on Century Boulevard; and
3. Don Milliken, 2001 Thrush, Lodi, supported the recommendation and also
expressed concerns about the truck travel on Century Boulevard.

Mayor Sieglock declared a ten-minute recess and the City Council meeting reconvened at
approximately 11:07 p.m.
13. MEETING TO CONTINUE FOLLOWING 11 PM HOUR
Pursuant to Ordinance No. 1566, the City Council, on motion of Council Member Pennino, Mann
second, voted to continue with the remainder of the meeting following the 11 p.m. hour by the
following vote:

b) The City Council, on motion of Council Member Mann, Sieglock second, unanimously
standardized on office systems furniture manufactured by Haworth, Inc. and/or Herman
Miller, Inc. for installation and use in offices in the governmental center (City Hall,. Public
Safety Building and City Hall Annex).

C) The City Council, on motion of Mayor Sieglock, Mann second, unanimously adopted
Resolution No. 94-36 authorizing the purchase of 25 Safarilande ballistic vests from LC
Action Police Supply of San Jose, under terms of a purchase agreement between LC
Action and the County of Contra Costa, in the amount of $13,307.13.

d) The City Council, on motion of Council Member Pennino, Mann second, unanimously
adopted Resolution No. 94-37 awarding the contract for Dial -A -Ride office renovation,
303 West Elm Street to Bay Valley Construction of Livermore in the amount of
$22,270.00.

e) The City Council, on motion of Mayor Sieglock, Mann second, unanimously adopted
Resolution No. 94-39 approving the salary range and reclassification of Senior Account
Clerk to Accounting Technician and approved the reallocation of one Account Clerk
position to Senior Account Clerk in the Revenue/Collections Division of the Finance
Department.

16. ORDINANCES

17. ANNOUNCEMENT
Mayor Sieglock announced that the Shirtsleeve Session for the Week of April 25, 1994 will be
held on Thursday, April 28, 1994 instead of the regularly scheduled Tuesday.
18. CLOSED SESSION
Mayor Sieglock adjourned the meeting to a Closed Session to discuss the following matter:
a) Proposed Litigation - City of Lodi v. Central California Traction Company
19. RETURN TO OPEN SESSION / DISCLOSURE OF ACTION
The City Council meeting reconvened at approximately 12:53 a.m. The following action was
taken on the matter below:

The City Council authorized the City Attorney to file action against Central California Traction

14. REGULAR CALENDAR (Continued)
a) The City Council, on motion of Council Member Mann, Pennino second, unanimously
approved the appropriation of $5,000 to enable the City of Lodi to be entitled to a seat on
the Board of Directors of the San Joaquin Partnership.
Speaking on the matter were the following persons:
Ron Addington, Executive Director of the San Joaquin County Business Council;
and
2. Brian Ochoa, Lodi resident, spoke in support of this appropriation.

b) The City Council, on motion of Council Member Mann, Pennino second, approved the
plans and specifications for remodel of Carnegie Forum Basement, remodel of City Hall
Annex/Beckman Building, and installation of temporary trailers by the following vote:
Ayes: Council Members - Mann, Pennino and Sieglock (Mayor)
Noes: Council Members - Davenport
Absent: Council Members - Snider
Council Member Davenport stated for the record that the City should have done an
Environmental Impact Report (EIR) on the buildings to determine if there are any
pollutants/hazardous materials.
Speaking on the matter were the following persons:
Larry Wenell, Wenell Mattheis Bowe Architects, answered questions on the
design of this project; and
2. Brian Ochoa, Lodi resident, expressed his opposition to this project, except for
the required elements such as the Americans with Disabilities Act (ADA) and the
HVAC system improvements.
Further, a letter of support from the Lodi Downtown Business Association (LDBA) was
received.

15. ACTION ON ITEMS REMOVED FROM THE CONSENT CALENDAR
a) The City Council, on motion of Council Member Mann, Sieglock second, approved the
plans and specifications for Well Drilling, Well #25, 1014 Holly Drive and authorized
advertising for bids by the following vote:

Noes: Council Members - Davenport
