HomeMy WebLinkAboutMinutes - March 7, 1994 SM/ CITY COUNCIL SPECIAL CITY COUNCIL MEETING CARNEGIE FORUM, 305 WEST PINE STREET MONDAY, MARCH 7, 1994 7:00 P.M. Mayor Sieglock called the meeting to order at approximately 7:00 p.m. Roll call was recorded as follows: Present: Council Members - Davenport, Mann, Pennino, Snider and Sieglock (Mayor) Absent: Council Members - None Also Present: City Manager Peterson, Assistant City Manager Glenn, City Attorney McNatt and City Clerk Perrin The topic of discussion was: 1. Refuse rate application request Assistant City Manager Glenn presented a report regarding the matter and informed the City Council that, upon reviewing the refuse rate application, the numbers appear to be in accordance with the rate methodology. Cindy Kline with Barakat and Chamberlin, Inc. spoke on behalf of Sanitary City Disposal Company and presented detailed information regarding the requested 8.5% rate increase and how those numbers were derived. Following questions from the City Council Members, Mayor Sieglock opened the meeting to the public. The following persons spoke on the matter: 1. Stan Harper spoke in opposition to the requested rate increase and complained about the service provided by Sanitary City Disposal; 2. Eileen St, Yves, 310 South Orange Street, Lodi, spoke in opposition to the high rate increase request and suggested that something be done to assist the apartment complexes who are paying the same rate as everyone else; but not receiving the same benefits; 3. John Connelly, representing "retired people", spoke in opposition to the requested rate increase and said that the 12% profit that Sanitary City Disposal Company receives is too high; 4. Richard Lucas spoke in opposition to the requested rate increase and stated that the City needed free enterprise. Council Member Davenport asked the City Attorney to explain what the contract with Sanitary City Disposal says regarding termination of the contract. City Attorney McNatt replied that the contract is dated September of 1988, it runs for seven years and there is an option for the City to renew. The City, therefore, has bound itself for the seven years of the contract, and, therefore, we cannot terminate and go out to bid until the contract has run out. Council Member Davenport requested that the following language from the contract between the City of Lodi and Sanitary City Disposal Company be stated into the record, "In the event City exercises its right to terminate this Agreement, City may, at its option, either directly undertake performance of the services or arrange with other persons to perform the services with or without a written agreement". 5. O. C. Lawson thanked Council Member Davenport for the fortitude and ability to offset all of the things that were brought up against him not too long ago and further complained about the requested rate increase for refuse rates; Continued March 7, 1994 6. John Young spoke in opposition to the requested rate increase and stated that the City should lower and then freeze the rates. Mr. Young also commented that the franchise with Sanitary City Disposal is more like a monopoly; 7. Fred Erickson spoke in opposition to the rates and questioned whether or not there was a "vacation rate"; 8. Stan Harkness spoke in opposition to the requested rate increase and questioned whether or not the audit that was prepared of the Sanitary City Disposal Company's records was going to be used when setting these rates; 9. Penny Mattos questioned why the citizens of this community were being penalized with a rate increase for doing such a good job at recycling; 10. Curtis Jenkins spoke in opposition to the requested rate increase and complained about how terrible the streets look on garbage day; 11. Dennis Cochran, 935 Coloma Street, Lodi, spoke against the requested rate increase and stated that competing companies would help keep the costs down; 12. Warren Mantz spoke in opposition to the requested rate increase and stated that now is the time to start looking at ways to reduce costs and how to save money; 13. Virginia Snyder, representing the Lodi East Side Improvement Committee, again recommended to the City Council that it consider a curb -side recycling program to pick up discarded household items. Ms. Snyder, upon asking Sanitary City Disposal Company, confirmed that it may cost only $0.25 a month for a yearly pick up, and she urged the City to discuss this matter with Sanitary City; 14. Thomas Murphy, representing associations in general, spoke in opposition to the requested rate increase and also requested that the City Council look into ways to help apartment complexes, condominium communities, etc.; 15. Frank Alegre commented that Sanitary City Disposal Company does a good job; however, he does not support the requested rate increase of 8.5% and feels that its profit of 12% is too high. Mr. Alegre further suggested that the Efficiency Committee should look into this matter; and 16. Lee Miuns, 1416 Keagle Way, Lodi, stated that the language about percentages is a "smoke screen" and urged that the increase be referred to in the dollar amount. Further, Mr. Miuns opposes the requested increase. FILE NO.
