2. INVOCATION
The invocation was given by Pastor Jonathan Merica, Providence Reformed Church.
3. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Mann.
4. AWARDS / PROCLAMATIONS / PRESENTATIONS
a) Mayor Mann welcomed newly -appointed City Manager, Dixon Flynn, to his first City
Council meeting.
b) Larry Hansen, Police Chief, gave a report to the City Council regarding National Night Out
on August 2, 1995. Approximately 90 groups participated in neighborhood activities. Mr.
Hansen explained that the current crime of choice is auto theft. There is an average of
1.3 cars stolen per day and approximately 80% of the vehicles stolen are recovered. This
is a fifteen year high and is an area the Police Department's Street Crime Unit will focus
on when it is up and running. Chief Hansen thanked the City Council and the citizens for
it support of this worthwhile program.

5. CONSENT CALENDAR
In accordance with report and recommendation of the City Manager, Council, on motion of
Council Member Sieglock, Warner second, approved the following items hereinafter set forth
except those otherwise noted.-

b) The Minutes of June 23, 1995 (Special Meeting) and July 19, 1995 (Regular Meeting)
were approved with the following change on page four of the regular minutes (change is
indicated in bold italics):
"Adopted Resolution No. 95-94 approving the installation of "no parking" zones on
Sylvan Way, from Kettleman Lane to 300 feet south of Kettleman Lane, adjacent
to two undeveloped office sites located on both sides of Sylvan Way, by the
following vote:
Ayes: Council Members - Pennino, Sieglock, Warner and Mann (Mayor)
Noes: Council Members - Davenport
Absent: Council Members - None"
C) Adopted Resolution No. 95-95 appointing Vicky McAthie, Acting Finance Director, to the
position of Treasurer of the City of Lodi, at no compensation, effective August 2, 1995.

d) Waived the Business License Tax, in part, for vendors who do not have a Business
License and who will participate at the following events:
• "Annual Car Show" sponsored by Corvettes of Lodi on August 20, 1995 at
Hutchins Street Square, 125 South Hutchins Street;
• "Field and Fair Day" sponsored by the Old Lodi Union High School Site
Foundation on September 4, 1995 at 125 South Hutchins Street;
• "Antique Show" sponsored by the Woman's Club of Lodi on October 13, 14 and
15, 1995 at the Woman's Club House, 325 West Pine Street; and
"Downtown Lodi Certified Market" sponsored by Lodi Downtown Business
Association on Thursday night for nine weeks in Downtown Lodi.
Further, that the fee be set at $3.75 per vendor.

e) Agenda item #E-5 entitled, "Report of the sale of surplus property" was removed from the
Consent Calendar and discussed and acted upon following adoption of the Consent
Calendar. (Removed by Council Member Davenport.)
f) Approved the specifications for bids for 10,000 feet of #1/0, and 12,000 feet of 350Kcmil,
600 -volt underground triplex for the Electric Utility Department and authorized the
advertisement of said bids.

h) Agenda item #E-8 entitled, "Approve purchase of digital recorder and message repeater
system for Police Dispatch Center" was removed from the Consent Calendar and

i) Approved Employment Contract between City of Lodi and City Manager H. Dixon Flynn
with minor language changes as spelled out in memo to the City Council (copy of which is
on file in the City Clerk's office).

j) Adopted Resolution No. 95-96 expressing opposition to the recommendation of the U.S.
Fish & Wildlife Service to demolish the Woodbridge Dam.

k) Agenda item #E-11 entitled, "Specifications and advertisement for bids for the purchase of
a trim mower for the Parks Department" was removed from the Consent Calendar and
discussed and acted upon following adoption of the Consent Calendar. (Removed by
Council Member Sieglock.)
Accepted the improvements under the Phase I portion of the Civic Center
dataltelecommunication cabling contract and directed the City Engineer to file a Notice of
Completion with the County Recorder's office.

M) Adopted Resolution No. 95-97 awarding the contract for "Lane Line Painting, Various City
Streets, 1995" to Traffic Limited of Lodi, California, in the amount of 820,309.42.

n) Accepted the improvements under the "Lodi Avenue Wastewater Pipe Replacement, 200
Feet East of Crescent Avenue to Hutchins Street" contract, and directed the City Engineer
to file a Notice of Completion with the County Recorder's office.

o) Accepted the improvements under "Treated Wastewater Pump and Motor, White Slough
Water Pollution Control Facility Equalization Pond, 12751 North Thornton Road" contract,

P) Approved the plans and specifications for bids for street light installation project, various
arterial and collector streets and authorized advertisement of said bid.

6. ACTION ON ITEMS REMOVED FROM THE CONSENT CALENDAR
a) The City Council, on motion of Council Member Pennino, Sieglock second, unanimously
received the report on the sale of surplus property.

adopted Resolution No. 95-98 approving the purchase of a Dictaphone Sentinel Digital
Recorder and a Dictaphone Series 6600 Emergency Message Repeater System.

C) The City Council, on motion of Council Member Sieglock, Pennino second, unanimously
approved the specifications for bids for one Toro GroundsmasterO 325D Trim Mower for

8. COMMUNICATIONS (CITY CLERK)
- a) On recommendation of the City Attorney and/or the City's contract administrator,
Insurance Consulting Associates, Inc. (ICA), the City Council, on motion of Council
Member Sieglock, Pennino second, unanimously rejected the following claims:
1. George Hills Company for California Capital Insurance, date of loss 8/11/94; and
2. Mitch Scheflo, date of loss 6/10/95.

10. ORDINANCES
a) Ordinance No. 1619 entitled, "An Ordinance of the Lodi City Council Amending the Land
Use Element of the Lodi General Plan by Redesignating the Parcel Located at 2801 West
Turner Road (APN 015-230-39) from NCC, Neighborhood -Community Commercial to
LDR, Low Density Commercial" having been introduced at a regular meeting of the Lodi
City Council held July 19, 1995 was brought up for passage on motion of Council Member
Pennino, Sieglock second. Second reading of the ordinance was omitted after reading by
title, and the ordinance was then adopted and ordered to print by the following vote:
Ayes: Council Members - Davenport, Pennino, Sieglock, Warner and Mann (Mayor)
Noes: Council Members - None

Residential With a Condition Relating to School Facilities Funding" having been
introduced at a regular meeting of the Lodi City Council held July 19, 1995 was brought
up for passage on motion of Council Member Pennino, Sieglock second. Second reading
of the ordinance was omitted after reading by title, and the ordinance was then adopted
and ordered to print by the following vote:

11. COMMENTS BY THE PUBLIC ON NON -AGENDA ITEMS
a) Howard Babcock, 9 Chestnut Street, Lodi complained regarding the no parking in alleys.
Mr. Babcock received a ticket for parking in the alley near his house, although he has
parked there for years without any problem until now. Public Works Director Ronsko
explained that the law has been on the books since 1967, and it wasn't until recently that
it has been enforced due to public safety reasons. Mr. Babcock explained that this
causes him a hardship, and the City should allow one-way parking. He asked if the City
would make an allowance for him to park his car along the west side of his house. Mayor
Mann directed the Public Works staff to look at the area to see if there is a solution;
however, explained that the City must uniformly enforce its ordinances. Council Member
Davenport suggested that "no parking" signs be put up in the alley, and also asked if Mr.
Babcock could be allowed to hold off on paying his ticket until the matter is resolved. City
Manager Flynn reminded the Council that it has a review board set up to review ticket
disputes. Police Chief Hansen agreed that the enforcement of the parking in alleyways
has been sporadic over the years; however, since the creation of the Partners Program
enforcement has been better. Council Member Pennino agreed that staff look into the
matter and come back with a short response; however, he did not agree that signs be put
into the alleys because it would be very costly.

12. COMMENTS BY CITY COUNCIL MEMBERS ON NON -AGENDA ITEMS
a) Council Member Davenport welcomed City Manager Dixon Flynn to his first City Council
meeting and informed the public that there will be a reception in his honor after the
meeting. Mr. Davenport thanked the public for attending the meeting and commented on
the following matters: 1) Be ever mindful of the gangs; 2) The City Council held a
Shirtsleeve Session on August 8, 1995 regarding the Lodi Lake Master Plan and
discussed the possibility of a berm connecting the land masses together to stop all boat
traffic from going into the river. Mr. Davenport encourage the public to give input to the
City Council regarding the matter; 3) Received letter from a citizen concerned about the
water rates being raised by approximately 17%; 4) Received a response from Senator
Patrick Johnston regarding the Woodbridge Dam, and is glad that Mr. Johnston also feels
it is "ill-conceived" and "ill-advised"; and 5) Concerned that the Public Works Department
said it would not apply for public funds for an underpass on Lodi Avenue. Mr. Davenport
feels the City Council should discuss the matter and at least consider it.

b) Council Member Pennino reminded the citizens and youth that Lodi Wet and Wild will be
held at Lodi Lake on Saturday, August 12, 1995 from 2 p.m. - 8:00 p.m. The event is for
junior high and high school students. The cost is 85.00.
C) Council Member Sieglock welcomed newly -appointed City Manager, Dixon Flynn, and his
family. Mr. Sieglock reminded the public that there will be a reception following the
meeting and encouraged the public to come down to meet him. Mr. Sieglock also
commented on the following matters: 1) Updated the public on the Shirtsleeve Session
regarding the Lodi Lake Master Plan. There is excitement regarding the possible grant,
but a lot of issues still need to be resolved including maintenance costs, access to the
area, erosion of the banks, noise, and speed limits, just to mention a few. There will be a
public hearing in the near future for residents to speak up on the issues. City Manager
Flynn indicated the public hearing would be scheduled by mid-September; 2) Informed the
public that music teacher, Bob Romans, has retired; however, he is still active with Cell
Block 7 and the Riverboat Rascals; and 3) Thanked Police Chief Hansen and Lieutenant
McDaniels for National Night Out. Some of the areas are making progress. This program
is very positive, it keeps en eye on crime and teaches neighborhoods what to look for and
how to be proactive. Mr. Sieglock encouraged the public to start Neighborhood Watch
groups.

d) Council Member Warner also welcomed City Manager Dixon Flynn to his first City Council
meeting and welcomed back City Clerk Perrin from maternity leave. Mr. Warner further
reminded the public that Friday, August 4, 1995 will be the Beer Fest in Downtown Lodi at
5:00 p.m. and encourage everyone to attend. Mr. Warner also thanked the Lodi Police
Department for National Night Out.
e) Mayor Mann also welcomed Dixon Flynn as City Manager. Mr. Mann indicated he too
had a good time at National Night Out and thanked the Police Chief for being his driver.
He had an opportunity to meet a young man named Timothy and said, if he was watching
the meeting, it was a pleasure to meet him.

f) City Manager Flynn said this was a special occasion for him and for his family and friends,
one which he will never forget. It is also a special time for Lodi, because it represents a
changing of the guard and a new style of management and ideas. However, not new is -
the vision, policies and goals that have been set by the City Council which he will do his
utmost to carry out. Mr. Flynn looks forward to the new challenges, opportunities, serving
the citizens of the City of Lodi, and working with a competent and professional staff. Mr.
Flynn thanked the City Council for its kind words and support, thanked former City
Manager Tom Peterson for his leadership, devotion and for the solid foundation in which
he left the City, and thanked his family and friends for their support and the many people
who sent letters of congratulations. Mr. Flynn introduced his wife, Judy; daughters Shelly
and Kelly; and his grandson, Brad.

Mayor Mann announced there was not a need to adjourn to a Closed Session.
