SPECIAL CITY COUNCIL MEETING-
CARNEGIE FORUM, 305 WEST PINE STREET
TUESDAY, FEBRUARY 14, 1995
7:00 A.M.
1. ROLL CALL
Present: Council Members - Davenport, Pennino, Sieglock, Warner and Mann (Mayor)
Absent: Council Members - None
Also Present: City Manager Peterson, Assistant City Manager Glenn, City Attorney McNatt and
Acting City Clerk Taylor
2. CLOSED SESSION
Mayor Mann adjourned the meeting to a Closed Session to discuss the following matter:
a) Dibromochloropropane (DBCP) (City of Lodi v. Shell, et al.)
3. RETURN TO OPEN SESSION / DISCLOSURE OF ACTION
The City Council meeting reconvened at approximately 9:09 a.m. and Mayor Mann disclosed that
final action was taken on this matter, and a settlement approved with AMVAC Chemical
Corporation ( see City Attorney's memorandum.)

There being no further business to come before the City Council, Mayor Mann adjourned the
meeting at approximately 9:09 a.m.

RE: PARTIAL SETTLEMENTS OF DBCP LITIGATION
Pursuant to Government Code Section 54957.1 (a) (3) (B), this memo shall constitute a public
report on final action in connection with litigation in the matter of City of Lodi v. Shell Oil
Company et. al., Case Numbers 939483 and 966045 (1)I3CP contamination). Final settlements
with the defendants named below have now been approved by the courts.

Solchem $ 25,000.00
CIGNA Insurance Company on behalfof $ 25,000.00
Dead Seal Bromine, Inc.
Gowan, Inc. $ 25,000.00
Sunseeds Genetics, Inc. $ 25,000.00
FMC Corporation $ 88,000.00
Wilbur Ellis, Inc. $ 5,000.00
AMVAC Chemical Corporation $ 276,795.00
TOTAL TO DATE $ 469,795.00
These amounts do not reflect possible future recoveries from the remaining defendants. Pursuant
to Council instruction, this money has and will be placed into the water fund.
