ROLL CALL Present: Council Members - Davenport, Mann, Pennino, Sieglock and Warner (Mayor) Absent: Council Members - None Also Present: City Manager Flynn, Interim Deputy City Manager Christofferson, City Engineer Prima, Community Development Director Bartlam, Electric Utility Director Vallow, City Attorney Hays and City Clerk Perrin INVOCATION The invocation was given by Norm Mowery, First United Methodist Church. 3. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Warner, 4. AWARDS / PROCLAMATIONS / PRESENTATIONS a) Mayor Warner presented a proclamation to Electric Utility Director Alan Vallow, proclaiming the week of October 6 - 12, 1996 as "Public Power Week" in the City of Lodi. Mr. Vallow presented the Mayor and each Council Member with a hard hat, and announced that several activities are planned during this week, including tours and informational sessions with local elementary school students. FILE NO. CC -37 b) Mayor Warner presented a proclamation to Lois Borchardt proclaiming October 11, 1996 as "Take Back the Night". A candlelight march against violence against women will take place at 6:00 p.m. at March Lane and Pershing Avenue in Stockton. FILE NO. CC -37 C) Mayor Warner presented a proclamation to Lois Borchardt with the Women's Center proclaiming the month of October, 1996 as "Domestic Violence Awareness Month" in the City of Lodi. Ms. Borchardt shared that the Lodi office has served 226 new domestic violence victims this year alone in our community. FILE NO. CC -37 d) Mayor Warner presented a proclamation to Fire Inspector Kathleen Gast, proclaiming the week of October 6 - 12, 1996 as "Fire Prevention Week" in the City of Lodi. Sparky the dog presented the City Council with Lodi Fire Department trading cards. FILE NO. CC -37 e) Mayor Warner presented a proclamation to Sally Podesta and Debbie Whitaker with Lodi Unified School District (LUSD) proclaiming the week of October 23 - 30, 1996 as "Red Ribbon Week" in the City of Lodi. LUSD thanked PG&E for its generous donation. Each school will receive a scarlet oak tree at a dedication ceremony. Schools will also receive bookmarks and will have different activities and programs during the week. FILE NO. CC -37 Continued October 2, 1996 f) Bob Johnson with the Lodi District Chamber of Commerce invited the City Council and the public to attend its "Water Summit'96" which will be held on October 8 and 15, 1996. The summit is designed to educate the public on the state of the water system and will have leaders in the water industry addressing the issue. Topics of discussion will include the history of water and water rights; current problems we are facing in this area; water in the State of California; various proposals by different agencies to solve problems in this area; and the importance of local citizens, industry and agriculture being a part of the process. The summit will be held in Jackson Hall at the Grape Festival. The cost of $20 includes lunch. Anyone interested was urged to call the Chamber of Commerce for reservations. FILE NO. CC -7(k) g) Mayor Warner, along with Mike Reese, Recreation Supervisor, presented awards to the winners of the Mayor's Cup Golf Tournament which was held on Saturday, September 28, 1996. The purpose of the tournament is to raise funds for a financial aid program for youth who cannot afford to participate in recreational programs. Sponsors included Lodi Sporting Goods, Vendange Wine Cellars, and Del Monte Foods. Thirty-six golfers participated, and the following awards were presented: 2nd place Men's Peoria, Dave Oliver; 3`d place men's low net, Bob Johnson; 2"d place men's low net, Larry Anderson, 1' place women's low gross, Denise Dobler; low net champion, Les Anderson; low gross men's, Jim Pryor; and women's low net, Elaine Hecker. The champion (overall low net player) was Les Anderson whose name will appear on the perpetual plaque. FILE NO. CC -40 5. CONSENT CALENDAR In accordance with report and recommendation of the City Manager, Council, on motion of Council Member Pennino, Warner second, unanimously approved the following items hereinafter set forth except those otherwise noted: a) Claims were approved in the amount of $2,140,254.78. FILE NO. CC -21(a) b) The Minutes of September 18, 1996 (Regular Meeting) and September 24, 1996 (Special Meeting) were approved as written. C) Approved the specifications for bids for two one -ton cab and chassis for the Electric Utility Department and authorized advertising for bids. FILE NO. CC -12.1(b) d) Agenda item #E-4 entitled, "Purchase of three police patrol vehicles" was removed from the Consent Calendar and discussed and acted upon following approval of the Consent Calendar. (Removed by Council Member Pennino.) e) Agenda item #E-5 entitled, "Contract award for Recreation office reception and lobby remodel, 125 North Stockton Street' was removed from the Consent Calendar and discussed and acted upon following approval of the Consent Calendar. (Removed by Council Member Davenport.) f) Agenda item #E-6 entitled, "Request for marked pedestrian crosswalks across Ham Lane at Lakewood Mall and across Pine Street at City Hall" was removed from the Consent Calendar and discussed and acted upon following approval of the Consent Calendar. (Removed by Council Member Davenport.) 2 Continued October 2, 1996 g) Adopted Resolution No. 96-145 authorizing the decrease in Adult Basketball 5 on 5 team registration fee from $430.00 to $300.00. FILE NO. CC -40, CC -56 AND CC -300 h) Introduced Ordinance No. 1641 entitled, "An Ordinance of the City Council of the City of Lodi Amending Chapter 13.20 of the Lodi Municipal Code by Repealing and Reenacting Sections 13.20.240 and 13.20.250, Relating to Electric Service - Rates". FILE NO. CC -51(d), CC -56, CC -149 AND CC -400 i) Set Public Hearing for October 16, 1996 to consider the Planning Commission's recommendation that the City Council adopt the 1996 Growth Management Allocations. FILE NO. CC -35(b) 6. ACTION ON ITEMS REMOVED FROM THE CONSENT CALENDAR a) Council Member Pennino made a motion, Davenport second, to table the matter regarding the purchase of the three police patrol vehicles until a vehicle policy is approved. The motion failed by the following vote: Ayes: Council Members - Davenport and Pennino Noes: Council Members - Mann, Sieglock and Warner (Mayor) Absent: Council Members - None Further, the City Council, on motion of Council Member Sieglock, Mann second, adopted Resolution No. 96-143 authorizing the purchase of three police patrol sedans under the State of California, Office of Procurement Contract for 1996 Model CHP Class -E special service vehicles from Downtown Ford of Sacramento, for a total of $68,110; authorized associated costs to equip the three vehicles for service at $1,500; and appropriated funds in accordance with staff recommendation, by the following vote: Ayes: Council Members - Mann, Sieglock and Warner (Mayor) Noes: Council Members - Davenport and Pennino Absent: Council Members - None FILE NO. CC -12(d) AND CC -300 b) The City Council, on motion of Council Member Sieglock, Warner second, unanimously adopted Resolution No. 96-144 awarding the contract for Recreation office reception and lobby remodel, 125 North Stockton Street to McFadden Construction of Stockton, in the amount of $34,880, and appropriated funds in accordance with staff recommendation. FILE NO. CC -12(a) AND CC -300 C) In regards to the request for marked pedestrian crosswalks across Ham Lane at Lakewood Mall and across Pine Street at City Hall, the City Council took the following actions: On motion of Council Member Sieglock, Mann second, unanimously adopted Resolution No. 96-147 reinstating the marked pedestrian crosswalk across Ham Lane at Locust Street; and On motion of Council Member Sieglock, Warner second, denied the request to install a marked pedestrian crosswalk across Pine Street between Church Street and Pleasant Avenue by the following vote: Ayes: Council Members - Pennino, Sieglock and Warner (Mayor) Noes: Council Members - Davenport and Mann Absent: Council Members - None FILE NO. CC -48(b) Continued October 2, 1996 7. PUBLIC HEARINGS None. 8. COMMUNICATIONS (CITY CLERK) a) On recommendation of the City Attorney and/or the City's contract administrator, Insurance Consulting Associates, Inc. (ICA), the City Council, on motion of Council Member Sieglock, Pennino second, unanimously rejected the following claims: 1. John B. Bowling, date of loss 8/10/96 2. Daniel Lowry, date of loss 8/10/96 3. Keith Ota, date of loss 8/14/96 4. Denise Schenone, date of loss 8/10/96 5. Steven Schnable, date of loss 8/10/96 6. ORDINANCES a) Ordinance No. 1638 entitled, "An Ordinance of the City Council of the City of Lodi Amending Chapter 13.20 of the Lodi Municipal Code by Repealing and Reenacting Section 13.20.280, Relating to Electric Service - Rates" having been introduced at a regular meeting of the Lodi City Council held September 18, 1996 was brought up for passage on motion of Council Member Mann, Sieglock second. Second reading of the ordinance was omitted after reading by title, and the ordinance was then adopted and ordered to print by the following vote: Ayes: Council Members - Davenport, Mann, Pennino, Sieglock and Warner (Mayor) Noes: Council Members - None Absent: Council Members - None FILE NO. CC -51(d), CC -56, CC -149 AND CC -400 4 Continued October 2, 1996 b) Ordinance No. 1639 entitled, "An Ordinance of the City Council of the City of Lodi Amending Chapter 13.12 of the Lodi Municipal Code by Repealing and Reenacting Section 13.12.195, Relating to Downtown Business District Capacity Fees; and Amending Chapter 15.04 of the Lodi Municipal Code by Repealing and Reenacting Section 15.04.55 Special Inspections -Downtown Business District' having been introduced at a regular meeting of the Lodi City Council held September 18, 1996 was brought up for passage on motion of Council Member Sieglock, Mann second. Second reading of the ordinance was omitted after reading by title, and the ordinance was then adopted and ordered to print by the following vote: Ayes: Council Members - Davenport, Mann, Pennino, Sieglock and Warner (Mayor) Noes: Council Members - None Absent: Council Members - None Further, the City Council, on motion of Council Member Sieglock, Mann second, unanimously adopted Resolution No. 96-146 approving the building permit and wastewater capacity fee discounts. CC -44, CC -72, CC -149 AND CC -300 C) Ordinance No. 1640 entitled, "An Ordinance of the City Council of the City of Lodi Amending Chapter 17.74 of the Lodi Municipal Code by Adding Thereto Section 17.74.080, Relating to Administrative Deviations" having been introduced at a regular meeting of the Lodi City Council held September 18, 1996 was brought up for passage on motion of Council Member Pennino, Sieglock second. Second reading of the ordinance was omitted after reading by title, and the ordinance was then adopted and ordered to print by the following vote: Ayes: Council Members - Mann, Pennino, Sieglock and Warner (Mayor) Noes: Council Members - Davenport Absent: Council Members - None FILE NO. CC -56 AND CC -149 11. COMMENTS BY THE PUBLIC ON NON -AGENDA ITEMS None. 12. COMMENTS BY CITY COUNCIL MEMBERS ON NON -AGENDA ITEMS a) Council Member Davenport thanked everyone for coming to the meeting and commented on the following matters: 1) Be ever mindful of gangs. Mr. Davenport still thinks the answer is parents. Graffiti appears to be down compared to four years ago, and hopefully it will just vanish; 2) Heard a Shirtsleeve Session presentation regarding economic development on Tuesday, October 1st, and encouraged everyone to come to the meetings, because they are informative; 3) Reiterated that the City needs to put more emphasis on attracting factory outlets downtown. The City is pursuing a number of alternatives; however, no one will come downtown unless there is a reason. Downtown will soon have the Hotel Lodi; however, it does not have a market. Someone needs to come forward and put a store or a butcher shop downtown. That is what will make downtown work -- things people need; 4) Have not heard any negative or positive comments regarding the GrapeLine and Dial -A -Ride transition. It appears the system is proceeding as usual; 5) Attended the Northern California Power Agency (NCPA) dedication for the turbine unit on Tuesday, October 1. Lodi owns about 40% of it, and it 5 Continued October 2, 1996 has been started about 282 times; 6) Received a letter regarding the use of advertising by the Budweiser Company at the Grape Festival, which glorifies the use of beer. We need to have more wholesome exhibits, instead of promoting beer to our youngsters; 7) Informed the public that downtown will not be torn up during the holiday season. The final plans are not yet complete, but it is in progress; and 8) Reminded everyone to register to vote by the deadline of October 7, 1996. There are many important issues on the ballot. FILE NO. CC -72 AND CC -400 b) City Manager Flynn reminded the City Council that on October 5, 1996 at Lawrence Park the Community Center is sponsoring the Community Health and Resources Fair. Citizens can get information on employment, health, nutrition, and dental care. There will be recreation, food and fun activities. On October 25th the City, along with various other entities, will kick off the United Way Campaign. Staff will do a presentation regarding the event at the next Council meeting. On October 11th, Barbara Reed, Secretary to the City Manager, will have completed 25 years of service with the City of Lodi. Mr. Flynn informed Council Members that he will be out of the office October 13 - 15, in order to attend the League of California Cities Annual Conference. Interim Deputy City Manager Bob Christofferson will act as City Manager during Mr. Flynn's absence. 13.
