ROLL CALL Present: Council Members - Land, Mann, Pennino, Warner and Sieglock (Mayor) Absent: Council Members - None Also Present: Deputy City Manager Keeter, Public Works Director Ronsko, City Attorney Hays and City Clerk Reimche 2. REGULAR CALENDAR a) "Contract award for Mokelumne River Tree Removal". Public Works Director Ronsko presented the City Council with the following report Bids were received on November 26, 1997 for removing fallen trees in the Mokelumne River. The trees in the base bid are located along City property and the optional bid item trees are located across the river from the Lodi Lake Wilderness Area and at the entry into the Rivergate Lagoon. After the Woodbridge Irrigation District lowered the Mokelumne River water level, a field review was held with contractors interested in bidding the project. The lower water level revealed six more trees that were added to the bid proposal as part of Addendum 1. Four trees were added to Site 5 and two trees were added to Site 7. Site 5 is part of the base bid and Site 7 is an optional bid item. The revised bid proposal has nineteen trees in the base bid and nine trees in the optional bid items. Of the nine trees in the optional bid items, three are located at Site 6, which is the entrance to the Rivergate Lagoon. Lampe Engineering, the City's consultant, estimated the cost of each tree removal to be approximately $1,500. The bids from Ford Construction and Berndt Tree Service indicate a more accurate estimate would have been $2,000 per tree. FEMA funding is available for the removal of the trees in the base bid and staff recommended that contingency funds be used to remove the trees at the Rivergate Lagoon entry as the FEMA funds cannot be used for private -sector trees. The City is also working with the County to obtain funding from another source for the trees in the optional bid items_ Staff recommended Council adopt the resolution awarding the base bid contract and Site 6 of the optional bid sites to Ford Construction in the amount of $44,950. Because Berndt Tree Service submitted the original bid proposal at the bid opening and did not acknowledge the additional trees added to the specifications, staff recommended that Council reject Berndt's bid as being non-responsive. If additional funding is found for the other optional bid items, a contract change order could be negotiated with Ford Construction. Plans and specifications for this project were approved on October 15, 1997. The City received three bids for this project. Speaking on the matter was the following person Robert Jones with Ford Construction indicated that he would not bid again on the project should Council decide to reject all bids and readvertise. Continued December 9,199 7 Following discussion, the City Council, on motion of Mayor Pro Tempore Land, Pennino second, unanimously adopted Resolution No. 97-199 awarding the contract for Mokelumne River Tree Removal to Ford Construction in the amount of $44,950 (base bid sites plus Site 6 of the optional bid sites), appropriated funds in accordance with staff recommendation and rejected the bid from Berndt Tree Service as being non-responsive.
