In the Matter of the Expedited } Application of Pacific Bell ) (U 1001 C), a Corporation, for ) authority to restructure and ) EXPEDITED APPLICATION DOCKET reprice certain high speed } digital service rates, and to ) implement an off -setting } surcharge for intra LATA services. ) EXPEDITED APPLICATION TO RESTRUCTURE HIGH SPEED DIGITAL PRIVATE LINE SERVICES AND IMPLEMENT OFF -SETTING SURCHARGE Pursuant to Decision Nos. 88-08-059 and 88-09-059 of this Commission dated August 24, 1988, and September 28, 1988 respectively, the Modified Phase I Settlement adopted therein, and the expedited application procedures contained in Appendix A attached thereto, Pacific Bell (U 1001 C; "Pacific") respectfully-; requests approval of this Applicationtorestructure' high speed digital private line services, including changes to permit limited intraLATA use of high speed,digital services under Pacific's special access tariff, Schedule Cal.P.U.C. No. 175-T, .and to implement an off -setting surcharge. I. r' INTRODUCTION On November 125, 1987, the Commiss• son commence Investigation No. 87-11-033 to investigate, j ntPr Al i L, changes in the regulatory treatment of Local Exchange Companies (LECs) in .;California. The Commiss2°ridrrected that a host of issues be considered in three separate Phases, the first of which was limited pricing flexibility for centrex, vertical, and high speed digital private line services, and the introduction of further intraUTA high speed digital competition (D. 88-08-059, August •- 24, 1988, p. 4). Just prior to the commencement of hearings, settlement negotiations began, resulting in a proposed Settlement which was submitted to the Commission for review (Id.). In Decision No. 88-08-059, the Commission indicated that it intended to adopt the SettlemeTf the parties accepted certain modifications. After soliciting and reviewing the parties' responses to its modifications, the Commission, on September 2$,;. 1988, issued the Modified Phase I Settlement (hereinafter z - "S�ttlament"). These Commission decisions and the Settlement contai!R the conditions by which Pac;may effect changes in the 960 restructuring its intraLATA (Schedule Cal. P. U.C. 89; hereinafter ""911 tariff) and special access (Schedule Cal.P.U.C. 175-T; hereinafter 111.75-T") tariffs to adopt a common element of private line service from a customer's premise to the serving central office (D. 88-08-059, mimeo, conclusion of Law No. 7, p. 84; r.. Appendix A, p. 4). Pacific was also directed to adopt a rate element in its intrastate special "access tar ced at cost_. for connections from an interexchange carrier's premise to its T serving wire center (Id., Appendix A, p - 10). Additionally, Facific was permitted to provide i.ntraLATA access for authorized high speed data providers (Id., Appendix A, p. 8) . The Ccmnission also authorized Pacific to implement an off -setting surcharge for revenue requirement increases resulting from these changes (Id., Appendix A, p. 10). Last, the Commission authorized Pacific to adopt, if it chooses, flexible prices for certain elements of its B9 high speed digital service (Id., Appendix A, p. 12) . Pursuant to the Commission's directives and the Settlement, Pacific has revised its B-9 and 175-T tariffs arid, by this Application, Pacific seeks the Commission's approval of the 0 the limited intraLATA use of such services consistent with the terms and conditions approved in Decision Nos. 88-08-059 and 88-09-059. As revised, Pacific's 175-T wi11 provide in-.raLATA -access for high speed digital services. FORMAL REOUIREMENTS Applicant,. Pacific Bell, is a corporation organized under the laws of the State of California. Its principal place of business is 140 New Montgomery Street, San Francisco, California 94105. Correspondence and communications in regard to this Application may be addressed to: 4 '00"' A copy of Pacific's Articles of Incorporation, as amended, was filed with the Commission on April 11, 1954. '7 RF.T.TF.F RFQTTFCTF.T) Pacific requests the following relief: r 1. Changes in the intraLATA B9 tariffs; 2. Changes in the special access 175-T tariffs; and, 3. Approval of the requested off -setting surcharge, Each is discussed below. Pacific otters connections between a customer's premise and its serving wire center (central office) through a Local Distribution Channel ("LDC") . Four LDCs (Types A, B, C and D) are available, with Type A constituting the basic, i non -multiplexed, digital facility offered by PaMIZ1 -: x 1:544 Mpbs �--: Type B LDC. offers one or two full dupleLcs- le channels (64 channels with the equivalent of 24 or 48 vo' Kbps DS -4) delivered at the customer's prem similar to Type B, with multiplexing (24 or 48 voice gradeTYPe D channels) available at Pacific's serving central office. pe D provides non -multiplexed high speed.di itall e cs t"__ Pacific's central offices. Today, it s tYplmiY asWintfi Centrgk g@rvice. - 5 Consistent with the Settlement terms, Pacific requests that the ti Commission approve these changes to its B9 tariffs: The recurring charge for Type A LDC is lowered from $725.00 to $162.59, which still covers its embedded direct costs. This same charge will apply to the comparable connection available under Pacific's special access tariffs, as described below. This comports with the Settlement provision requiring Pacific to price its connections from a customers premise to the serving central office at the same these services under its pricing flexibility' tariffs. On the basis of the price reductions discussed herein, Pacific requests permission to eliminate its bulk discount for Type A LDC. 1--- 4. Pacific proposes a set of rates which shall apply to the physical moves and changes in tariff designations. 5. Pacific proposes adding tariff language making , clear that other local exchange private line services (B tariff services) may be connected to Pacific's intraLATA high speed digital service 6 Pacific intends ta_. implement the tracking and monitoring requirements contained in the Commission ; decisions and the Settlement. These provisions are reflected in the proposed tariff sheets in Attachment 1.. Also, Pacific has provided to the �? Commission staff (Legal, CACD and DRA) the cost support and workpapers upon which the price changes are predicated. _- a Pacific's cost support data and associated workpapers are : K.; in providing high speed intraLATA digital services; therefore, `'" Pacific can be. competitively disadvantaged by having to indiscriminately share its cost support data and demand estimates with all parties. For these reasons, Pacific, pursuant to the Commission's directive, asserts the confidentiality of its workpapers and cost support data (D. 88-08-059, mimeo, Appendix A p. a). Pacific will make these materials available to requesting parties upon the execution of an appropriate non -disclosure agreement. Pacific strongly urges adoption of these changes. First, they are in line with the terms of the Settlement aqg„ aforementioned Commission decisions, understanding of the partiest-expecta agreement. Second, they prepare Pacific for the substantial competition that now exists and which can be expected to increase as a result of further intraLATA high speed data competition,: allowed by the Settlement. Special Access High. Speed Digital Services (175-T) . Pacific requests that the Commission approve the following changes= 1, In conformance with the Settlement, the end user to central office connection price reduction identified above in the B9 tariffs (a recurring charge of $162.59 for a Type A LDC) will be matched in the 175-T tariff. 2. Further, as required by the Settlement, the connection from an interexchange carrier's premise to the serving central office (CO to POP) will be repriced to recover its direct embedded cost, and no mord. This results in a substantial price reduction to $60.57 per access connection. 3. These changes result in substantial cost reductions, however, the transport rates have been 4. They are aimed at complying with the terms of the Settlement, and will permit Pacific to meet the rapidly emerging Competition for these types of facilities and services. r. _Off -Setting Si,rrharsP The Settlement permits Pacific to recover in a surcharge, revenues lost due to some of the price reductions explained above. Pacific has limited recognition of lost revenues due to price reductions to price anges in the B9 and 175-T tariff elements for the end user to serving central office connection, and, in 175-T, for the interLATA access connection (interexchange carrier to serving aI office). Pacific has also reflected cost savings and revenue losses estimated due to shifts in demand for cross -elastic services. Attachment 3 states the estimated revenue requirement shift. Attachment 4 has the proposed tariff an increased surcharge) by approximately two-tenths of one percent.2 The Commission directed all carriers who file surcharge proposals in an expedited application docket to provide notice of that filing at the time it is made (D. 88-08-059, mimeo, p. 67). Pursuant thereto, Pacific will give notice as follows: 1. Provide a copy to the State of California through the office of the Attorney General and the Department of General Services. 2. Provide a copy to each county by mailing same to the County Counsel and County Clerk: 3. Provide a copy to each city, by mailing sams :o the City Attorney and City Clerk; 4. Provide a copy to all parties of record to proceedings A. 85-01-034 and I. 87-11-033; 5. Publish a notice of this Application i -n a newspaper of W 6. Provide notice of this Application to all of its customers by use of bill insert in the next regular billing cycle. IV. V. EX PARTE RELIEF IS REQUESTED The Settlement and its related decisions set forth a procedure designating workshops to review Expedited Applications such as this one (D. 88-08-059, mimeo, Appendix A, p. 4). Pacific is prepared to begin those workshops as soon as possible in order that prompt approval of its Application may be obtained. F Customer -provided terminal equipment may be connected at the premises of the customer or authorized user to HCDS subject to the following: no service will be provided to the premises of an other common carrier where the sole purpose of the service, including any bit streams derived therefrom, is to effect direct connection for through transmission with communications channels of an other common carrier, except that service may be provided to the premises of an other common carrier for connection to overseas channels furnished by that carrier. 3.
