SUBJECT: 1984 GENERAL, KINICIPAL ELECTICN
Enclosed herewith are three resolutions for Council action pursuant to
the State of California Elections Code.
1. The first resolution sets forth the purpose of the
election; establishing nine (9) voting precincts
consisting of consolidations of twenty-six regular
election precincts in the city, designating the location
of each such polling places and appointing the election
officers for each voting precinct.
This resolution further sets the eacpensation for the
election workers as follows:
$45.00 for each inspector
$36.00 for each judge and clerk
The resolution establishes the rental for each polling
place where a charge is made at $25.00.
Finally, the resolution designates that the polls shall be
open from 7:00 a.m. to 8:00 p.m. on Election Day, April 10,
1984.
2. The second resolution establishes City Hall as the
official election return center for the April 10, 1984
General Municipal Election.
3. The third resolution authorizes the City Clerk to canvass the
results of the April 10, 1984 General Municipal Election.

Mite 1984 General Municipal Election for two council seats will be held
Tuesday, April 10, 1984. The terms of Council Member Murphy and Pinkerton
are the terms expiring.
By statute a nurber of actions and decisions must be made by the council
prior to the opening of nominations (January 11, 1983).
1. We have enclosed a resolution calling a General Municipal Election
to be held April 10, 1984.
2. Section 10012 of the State Elections Code provides that before the
nominating period opens, the local agency for that election shall
determine whether a charge shall be levied against that candidate
for the candidate's statement sent to each voter. Such decision
shall not be revoked or modified after the secenth day prior to
the opening of the nominating period. A written statement of the
regulations with respect to charges for handling, packaging, and
mailing shall be provided to each candidate or his or her
representative at the timehe or she picks up the nomination
papers.
3. Further, Section 100?2 of the Elections Code provides that the
governing body of the locpl agency may authorize an increase in
the limintations on words for such statements from 200 to 400
words.
4. Section 22843 provides that a filing fee proportionate to the
costs of processing a candidate's nomination papers as determined
by the City Council and set by ordinance, but not exceeding
twenty-five dollars ($25.00), may be imposed, to be paid upon the
filing of such nomination papers.
5. Section 22808 of the Elections Code of the State of California
provides that a city may by ordinance or resolution limit campaign
contributions in municipal elections.
As a matter of information, it should be noted that in years past, the city
council elected not to limit the amount of expenditures or contributions for
General Mnicipal Elections not to charge for the candidates statement, to
retain a 200 word limit on candidates statements; and determined that there
would be no filing fee charged for the processing of a candidates nomination
papers.

disclosure provisions of California's Political Reform Act.
Candidates and Campaign Cmmittee Treasurers are especially encouraged to
attend. We will keep you apprised of the dates as we receive them.

FOR
CANDIDATES FOR PUBLIC OFFICE
The Penal Code of the State of California Prohibits the
placement or maintenance of any sign, picture or advertisement
which is used for the purpose of advertising or which
advertises or brings to notice any person, article of
merchandise, business or profession or anything that is to be
or has been sold, bartered or given away without permission and
consent of either the public agency or the owner or occupier of
the property. The term 'advertisement' is defined in Black's
Law Dictionary as 'notice given in a manner designed to attract
public attention.'
In the opinion of the City Attorney, political advertising
would fall within the definition mentioned and would be within
the prohibition of the State law as noted above. Specifically,
the placement of political advertising on utility poles without
permission of the owner constitutes a violation of said law.
The City Code of the City of Lodi specifies:
Sec. 15-1. Advertising matter - Distribution on private
property.
It shall be unlawful for any person to distribute or
throw, or procure anyone to distribute or throw, upon any
private yard, lawn, driveway. sidewalk, porch or steps of any
residence, or upon or in any part of any structure, or upon any
vacant property, or in or upon any motor vehicle or other
vehicle in the city, any advertising sample, handbill, dodger,
circular, booklet or other notice of commercial advertising;
4 provided, that nothing in this section shall prohibit the
F distribution and delivery of any newspaper which is capable of
being entered or is entered as second-class matter under the
provisions of the United States Post Office regulations of
March 3, 1879, and other United States Statues.
Sec. 15-2. Advertising matter - Unlawful distribrution of.
Any person who shall throw or deposit, or cause or
procure to be thrown or deposited. any scraps or pieces of
paper, dodgers, handbills, advertising or business cards in or
upon any street alley, sidewalk or public place in the city is
guilty of a misdemeanor. Nothing provided herein shall be
construed to prohibit sticking or placing bills or the
attaching of handbills. dodgers or cards to posts or buildings
by or with the consent o.f the owners or persons in charge of
the same, or the sweeping or removing of the same into any
street, alley, sidewalk or place by any person who did not
place or procure the placing of such bills and similar matter
in such places.

RESOLUTION NO. 83-152
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LODI, CALIFORNIA, CALLING AND GIVING
NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL
ELECTION TO BE HELD IN SAID CITY ON TUESDAY,
THE 10TH DAY OF APRIL, 1984, FOR THE ELECTION
OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED
BY THE PROVISIONS OF THE LAWS OF THE STATE OF
CALIFORNIA RELATING TO THE GENERAL LAW CITIES
WHEREAS, under the provisions of the laws relating to
General Law Cities in the State of California, a regular
general municipal election shall be held on the 10th day of
April, 1984, for the election of two members of the City
Council of said City for the full term of four years;
NOW, THEP.EFORE, THE CITY COUNCIL OF THE CITY OF LODI,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER
AS FOLLOWS:
Section 1. - that pursuant to the requirements of the
laws of the State of California relating to General Law Cities
within said State, there shall be, and there is hereby called
and ordered, held in the City of Lodi, County of San Joaquin,
State of California, on Tuesday, the 10th day of April, 1984,•
a regular general municipal election of the qualified electors
of said City for the purpose of electing two members of the
City Council of said City for the full term of four years;

Section 2. - that the ballots to �,e used at said
election shall be, both as to form and matter contained
therein, such as may be required by law to be used thereat;
Section 3. - that the City Clerk of said City is
hereby authorized, instructed and directed to procure and
furnish any and all official ballots, notices, printed matter
and all supplies, equipment and paraphernalia that may be
necessary in order to properly and lawfully conduct said
election;
Section 4. - that for the purpose of holding said
regular general municipal election, there shall be and are
hereby established, nine (9) voting precincts consisting of
consolidations of the regular election precincts in the City
of Lodi established for the holding of State and county
elections, as said regular election precincts exist on the
date of adoption of this resolution --that the polling places
for the respective precincts shall be the places hereinafter
designated; and that the persons hereinafter named, being
competent and qualified electors and residents of said City
and hereby appointed officers of election for their respective
voting precincts and they shall hold said election and make
return thereof in the manner provided by law:

Section 5. - that the compensation of the persons
hereinbefore named as election officers is hereby fixed at the
sum of forty-five dollars ($45.00) for each Inspector and
thirty-six dollars ($36.00) for each Judge and Clerk for said
election. The rental for each of such polling places, where a
charge is made, shall be the sum of twenty-five dollars
($25.00) for said election.
Section 6. - that the polls for said election shall be
open at seven a.m, of the day of said election and shall
remain open continuously from said time until eight p.m. of
the same day when said polls shall be closed, except as
provided in Section 14301 of the elections Code of the State
of California.
Section 7. - that in all particulars not recited in
this resolution, said election shall be held and conducted as
provided by law for holding municipal elections in said City.
Section 8. - that notice of the time and place of
holding said election is hereby given and the City Clerk is
hereby authorized, instructed and directed to give such
further or additional notice of said election in time, form
and manner as required by law.

Section 9. - that the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same
in the book of original resolutions of said City; and shall
make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said City,
in the minutes of the meeting at which the same is passed and
adopted.
Section 10. - that this resolution shall take effect
immediately.
