NO. 81-164 - 81-168 1982 GENERAL MUNICIPAL ELECTION Alice Rai" -and discussion, Council took the following actions pertaining to the 1982 General Municipal Election: 4) On motion of Councilman Pinkerton, Murphy second, determined not to consolidate with the County for they 1982 General Municipal Election. On motion of :Mayor Pro Tempore Murphy, Katnich second, adopted Resolution. No- -al--164 - Resolution calling a General Municipal Election to be held April 13, 1982. on motion of Councilman Katnich, Murphy second, adopted Resolution No. 81-16S determining that no limit shall: be established on the amount of expenditures or contributions -for campaigns for the April 13, 1982 General Municipal Election. On motion of Councilman Katnich, Pinkerton second, adopted Resolution No. 81-166 - Resolution adopting regulations pertaining to the=Candi-dates Statement for the April 13, 1982 General Municipal Election in that 1) No charges --shall be levied to the candidate for the Printing, handling, or distribution of the Candidate's Statement. 2) The Candidate's Statement shall be limited to a of 200 words. RES. NO. 81-164-81-168 3) Candidates for elective office will not be permitted to (Cont' d) prepare separately other materials to be sent to each voter in addition to the sample ballot and the voters Pamphlet. On motion of Councilman Pinkerton, Hughes second, Council adopted Resolution No. 81-167 determining that there will be filing fee charged for the processing of a candidate's nomination papers for the April 13, 1982 General Municipal Election. On motion of Mayor Pro Tempore Murphy, Pinkerton second, Council adopted Resolution No.81-168 approving agreement with the County of San Joaquin Election Department to provide equipment and various services for the April 13, 1982 General Municipal Election. On motion of Councilman Katnich, Pinkerton second, Council reaffirmed •its earlier position of providing oral assistance only regarding bilingual voting requirements for the April 13, 1982 General Municipal Election. U11 £IL �A[UNICAT If the Council elects not to consolidate there are a number of items Council needs to consider at this time as nominations will open on January 14, 1982 (Election Date - April 13, 1982). 1) We have enclosed a proposed resolution calling a General Municipal Election to be held April 13, 1982. Prior to the date nominations open, Council must determine whether charges will be levied against candidates requesting Statements of Candidates or other mailings. Candidates must be provided with a written statement of charges and regu- lations at the time they pick up their nomination papers (Section 10012 Elections Code). Mote: Such regulations established by the City Council shall not be revoked or modified after the seventh day prior to the opening of the nomination period (January 7,. 1982). The City Council shall make the following determination concerning rules governing submission by cand.'.dates of "Candidates Statements": a.. ;Whether the City or the candidate will pay for the cost of printing, handling, and mailing of the "Candidates Statement". b. Whether to permit the candidate to submit more than 200 words - (may be increased to 400 words). c. Whether other mailings will be permitted to be handled by the City Clerk on behalf of the candidates. d. And if other, mailings are permitted, if the cost of handling, packaging and mailing Will be borne by the local agency authorizing the same or will be billed in whole or in part to the candidate submitting the materials. A filing.fee proportionate to the costs of processing a candidate's nom' - nation papers as determined by the City Council and set by ordinance, but not exceeding twenty-five ($25.00) may be imposed, to be paid upon the filing of such nomination papers. T `IIAANAtiR'S December 9 , 11:31 . $UaIEETlgreement_With San Joaquin County Election Department for Various Services �r for''the.April 13, 1982 General Municipal Election If th'e.City Council elects not to consolidate with the County, and the General Municipal Election is held April 13, 1982, it is requested that Council adopt a resolution authorizing: the Mayor anC City C)erk to execute an agreement with the County of San Joaquin Election Department whereby the County agrees to provide certain services of this election. A copy of the subject agreement is attached and provides for the following services: a. Furnish the governing body of the City upon request of the City Clerk, with as many copies as may be needed of the index of registration for each precinct. b. Furnish map indicating all precincts embraced within the City of Lodi. c. Address voter pamphlet containing sample ballot and absentee voter information. d. Prepare list of number of registered voters in each precinct. e. Prepare index to precinct consolidation as to polling place. f. Prepare precinct consolidation. labels for sample ballots and registra- tion data for official ballots. g. Check and package official ballots for consolidated precincts. h. Package election supplies for delivery to precinct inspectors. i. Select polling places and election officers and mail Notice of Appointment to the election officers. J. Perform such other services as may be required by the City Clerk. The City, in turn, agrees to pay the County for all services, facilities, and equipment furnished by the Counti'to the City in connection with this election. RECOMMENDED ACTION: Adopt resolution approving agreement with the County of San Joaquin Election Department to provide equipment and various service for the April 13, 1982 General Municipal Election and authorize the Mayor and City Clerk to execute the agreement on behalf of the City. REIMCHE City Clerk 81-165 .D RESOLUTION NO. 81-166 RESOLUTION ADOPTING REGULATIONS PERTAINING TO THE CANDIDATES STATEMENT FOR THE APRIL 13, 1982 GENERAL MUNICIPAL ELECTION WHEREAS, Section 10012 of the Elections Code of the State of California specifies that before the nomination period opens, the local agency for that election shall deter- mine whether a charge shall be levied against the candidate for the Candidates Statement; whether or not the limitation on words for such statement shall be increased from 200 to 400 words; and whether or riot the candidate for elective office will be permitted to prepare --eparately other materials to be sent to each voter in additio,. to the sample ballot and the voter°3 pamphlet.; WHEREAS, Section 10012 of the Elections Code of the State of California further provides that a written statement of the regulations wi::'i respect to charges for handling, packaging and mailing shall be provided to each candidate or his representative at the time he picks up his nomination papers; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby set forth the following regu- lations pertaining to the General Municipal Election to be held April 13, 1982: a) No charges shall be levied to the candidate for the printing, handling or distribution of the Candidates Statement. b) The Candidates Statement scall be limited to a maximum of 200 words. c) Candidates for elective office will not be per- mitted to prepare separately other materials to be sent to each voter in addition to the sample ballot and the voters pamphlet. REIMCNE City Clerk 81-166 -2- 0 RESOLUTION NO. 81-167 11 RESOLUTION DETERMINING THAT THERE WILL BE NO FILING FEE CHARGED FOR THE PROCESSING OF A CANDIDATE'S NOMINATION PAPERS FOR THE APRIL 13, 1982 GENERAL MUNICIPAL ELECTION WHEREAS, Section 22843 of the Elections Code of the State of California provides that the City Council may impose a filing fee proportionate to the cost of processing a candi- date's nomination papers, but not exceeding t:renty-five dollars ($25.00) to be paid upon the filing of such nomination papers; WHEREAS, Section 10012 of the Elections Code of the State of California further provides that a written statement of the regulations with respect to charges for handling, packaging and mailing shall be provided to each candidate or his representative at the time he picks up his nomination papers; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby set forth the following regulation pertaining to the General Municipal Election to be held April 13, 1982: a) No filing fee will be imposed for the processing of candidate's nomination papers. NOW, THEREFORE, BE FURTHER RESOLVED that each candi- date or his representative shall be provided with a copy of this Resolution at the time he picks up his nomination papers. (A copy of the referenced agreement is attached, marked Exhibit "A", and thereby made a part hereof.) BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the subject agreement on behalf of the City. RESOLUTION NO. 81-168 RESOLUTION APPROVING AGREF44ENT WITH THE COUNTY OF SAN JOAQUIN ELECTION DEPARTMENT TO.PROVIDE EQUIPMENT AND VARIOUS SERVICES FOR THE APRIL 13, 1982 GENERAL MUNICIPAL ELECTION RESOLVED, that the City Council of the City of Lodi does hereby approve the agreement between the City of Lodi and the County of San Joaquin whereby the San Joaquin County Election Department will provide certain services and equipment for the April 13, 1992 General Municipal Election. IMCHE City Clerk 81-168 AGREEMENT THIS ACREEXENT, made this 9th day of December 1981, between the COUNTY OF SAN JOAQUZN, a Political Subdivision of the State of California, hereinafter called "CVUNTr", and the CITY OF LODZ, a Municipal Corporation, hereinafter called 'CITY". MZTHESSETH; NNEREAS, the City desires to hold a Municipal Election to be held on the l3th day of April, 1982, and the City desires to make use of certain services, facilities, and equipment of the Registration -Election Department of the County and to pay the County for its cost thereof, pursuant to the provisions of. this Agreement. NOW, 4NEREFORE, it is hereby agreed as follows: 1. County agrees to make no changes in precinct boundaries within ninety (90) days of the City of Lodi Municipal Election on April 13, 1982. 2. County agrees that the Registration -Election Department shall do the following things for the City: (a) Furnish the governing body of the City, upon request of the City Clerk, with as many copies as may be needed of the index of registration for each precinct contained in the City of Lodi, up to and including twenty-nine (29) days prior to the election. (b) Furnish one map showing all precincts embraced in the City of Lodi. (c) Address and mail voters pamphlet containing sample ballot, absentee voter information and any other election matter required to be mailed to the voters. (d) Prepare list of number of registered voters in each precinct. (e) Prepare index to precinct consolidation as to polling places. (f) Prepare precinct consolidations, labels for sample ballots and registration data for official ballots. (g) Check and package official ballots for consolidated precincts. (h) Package election supplies for delivery to Precinct Inspectors, It being understood the City will arrange for delivery of same. City agrees to pay the County for its costs for all services, facilities, and equipment furnished to the City in connection with said Municipal Election, immediately upon receipt by the City of a statement from the County Clerk setting forth the actual cost to the County for services, facilities, and equipmentso furnished.
