BACKGROUND INFORMATION: Thee two easements were provided for the express purpose of obtaining sanitary sewer service from City lines. However, they have not been in use for a number of years - actuall; more than we can determine - and they are not necessary for any prospective use. Because of the time it has not been in use, it is not necessary to refer the matter to the Planning Commission or to post and publish. That the easement is no longer used, nor has it been used for the last five years, for the purpose for which it was dedicated or for any purpose whatsoever, and that said described easement is unneccessary for present or prospective use. NOW, ZiEREFORE, pursuant to the foregoing findings and under the authority of Section. 8300 et seq of the Streets and Highway Code of the State of California, it is hereby ordered that there is hereby abandoned and vacated the easenment which is described on Exhibit A attached hereto and thereby made a part hereof. The City Manager and City Clerk are hereby authorized to execute on behalf of the City, a Quitclaim Deed to the appropriate persons. Dated: December 7, 1953 I hereby oertify that Order No. 83-02 was passed and adopted by she City Council of the City of'Lodi in a regular meeting held Decker 7, 1983 by the following vote.: Ayes: Council Members - Murphy, Snider, Reid, Pinkerton & Olson (Mayor) Noes; Council Menbers - Non, Absent: Council Members - None Alice M. Reiw-he City Clerk 15 Op r► That certain piece of land, situate, lying and being in the City of Lodi, County of San Joaquin, State of California, and particularly described as follows: Being a portion of Lot 71 of the Lodi Barnhart Tract as per map filed November 5, 1906, in Volume 3, at Page 48, Book of Maps and Plats, San Joaquin County Records, and more particularly described as follows: Beginning at a point on the South line of East Tokay Street (being also the North line of said Lot 81) 221.6 feet South 86° 23' West as measured along the South line of said Fast Tokay Street frau the West line of South Stockton Street, thence South 3° 30' West 137.1 feet to a point on the boundary line between the property of the Central California Traction Carpany and Foster and Wood Canning Carpany, thence North along said boundary line 81.9 feet to a point, thence North 3° 30' East along said boundary line and its Northerly projection 54.7 feet to a point on the South line of said East Tokay Street, thence North 860 23' East along the South line of said East Tokay Street, 5.05 feet to the point of beginning. �.4.rf ,�momm1 CEDER N0. 83-03' CEDER VACATING EASBMgr CN 733-737 SCL11H SICaCI N SMM nE CITY CCLWIL OF THE CITY OF L(DI FIDS: That on January 26, 1935, there was dedicated an easement for public utilities located on 733-737 South Stockton Street, Lodi, and filed for record on February 13, 1958, in Book 2042, Page 258, San Joaquin County Records. That the easement is no longer used, nor has it been used for the last five years, for the purpose for which it was dedicated or for any purpose whatsoever, and that said described easement is unneccessary for present or prospective -ase. NCW, TiEREFCRE, pursuant to the foregoing findings and under the authority of Section 8300 et seq of the Streets and Higtnvay Code of the State of California, it is hereby ordered that there is hereby abandoned and vacated the easement which is described on Exhibit A attached hereto and thereby made a part hereof.
