City Clerk AMENDMENT TO AGREEMENT FOR OPERATION OF LODI PUBLIC SAFETY/COURT BUILDING THIS AGREEMENT, made and entered into(OV 8 1p3 , 1983, by and between the County of San Joaquin, a political subdivision of the State of California, hereinafter referred to as *COUNTY", and the City of Lodi, a municipal corporation, hereinafter referred to as "CITY". W I T N E S S E T H: WHEREAS, COUNTY and CITY entered into an agreement on November 25, 19-15, whereby COUNTY agreed to pay certain costs in conjunction with the operation of the Lodi Public Safety/Court Building; and WHEREAS, the second paragraph of Section 1 of said agreement provides that the amount to be paid by COUNTY to CITY may be amended annually; NOW, THEREFORE, IT IS MUTUALLY AGREED TO AMEND the second paragraph of Section 1 of said agreement to reads "The Parties do hereby agree that the amount to be paid by COUNTY to CITY for each successive fiscal year shall be based upon CITY'S prior year actual cost of furnishing the above listed services." All other terms and conditions of the agreement shall con- tinue and remain in full force and effect axcept as herein amended. The County then pays its predetermined share of these costs to the City. However, each time these costs change, the current agreement must be modified. This requires the approval of our respective governing bodies. In order to facilitate this annual review and payment, we are proposing an amendment to the agreement (copy attached) that would allow the payment to be based on the previous fiscal year's actual costs (not a combination of actual and projected costs as s presently the requirement) and without amending the agreement each yeXr. The request for payment would be reviewed and approved administratively. Mr . Jc- cry Glenn Proposed Amendment Lodi Public Safety/Court Building Agreement July 14, 1983 Page Two The second paragraph of Section 1 of the agreement reads as follows: "The Parties do hereby agree that this agreement may be amended annually by mutual agreement to adjust the amount to be paid by COUNTY to CITY, the amount to be based upon CITY'S prior year actual cost of furnishing the above listed services plus a factor for salary increases and inflation as well as the anticipated additional cost of furnishing electricity." We proposed that the paragraph be changed to read: "The Parties do hereby agree that the amount to be paid by COUNTY to CITY, for each successive fiscal year shall be based upon CITY'S prior year actual cost of furnishing the above listed services." Shortly after the close of each fiscal year, the City would submit to the County a breakdown of actual costs along with a statement.
