CITY COLMIL MEETING . DECKER 3, D85 J AA PETITIONS RECEIVED FROM TRAILMY LINES TO DISCONTINUE BUS SERVICE IN CALIFORNIA RECEIVED' City Clerk Reirwhe presented a petition that had been y` received from. Trailways Lines, Inc. for permission to CC-7(f) discontinue bus service in California. Yopportunity to evaluate Trailways evidence Trailways was present 3 at77 the ,hearing The CPUC staff could have cross-examined Tral ways' witness and7or requested additonal'information. The. CPUC simply 3d.not take"advantage of'its`own rules and procedures a fi = Trailways submits that it substantially'complied.with Rule 15. . Trailways="filed its additional financial data as soon ;'as.was feasible under the circumstances and pr;ior:to the hearing. Trailways could 2 not"file the additional information at the time 'its application was filed for the reason that its traffic department.at the end of August and beginning of September was involved'in filing proposed discontinuances in approximately 20 other states. Several `weeks of work were required to compile financial data for California and other state commissions. In its'.Order the CPUC's reference to Funbus Systems, Inc. v. State of California Public Utilities Commission, 801 F.2d 1120 t9th Cir. 1986), misses the point. The CPUC itself denied Trailways right to a hearing. No party would have been prejudiced had the hearing gone forward. No one -was precluded from;.protesting Trailways' application and appearing at the hearing. No one was precluded from presenting evidence or cross-examining_ Trailways' witness. Trailways submits that.its rights have been prejudiced as a r�Gult of the involved dismissal and that the CPUC is attempting to circumvent the requirements of federal law. -5- costs of the'involved'operations or variAble costs overthe majority. >;t � of the involved routes rye: +_ ckage express'service operated by motor carriers of property, such as United, Parcel Service, Inc: and,°others, will continue o:.,, be available in,the affected area. Alternative passenger service } is.avaiable`from other bus companies at all of the affected points.:, Trailways, losses over the involved routes result in cross subsidization of these routes by other routes in California and. elsewhere. A denial of the involved discontinuance would prevent Trailways from achieving operating efficiencies necessary to _ , , ' - maintain economic allysound bus service. The proposed discontinuance in California is extensive. Trailways submits that where it intends. to go out of business in substantially all of a state, an entire state, or a several state area, if revenues do not exceed fully allocated costs, as opposed , to variable costs,permission for discontinuance should be granted. If all operations are terminated in an area, ,there will be no ,revenue "to 'support the overhead expense .in that area. In this instance a showing that revenues do not exceed the variable costs of each route is irrelevant when revenues do not exceed full.costs. If revenues -derived from all of Trailways routes exceeded variable costs but were less than full costs, Trailways would still lose money and could not operate. To survive, any carrier's overall revenues must exceed full cost.
