ORDINANCES Council on motion of Council Member Reid, Snider second,
adopted Ordinance No. 1410 entitled "An Ordinance of the
ORDINANCE OF LODI Lodi City Council Adding Chapter 10.52, Section
CITY COUNCIL ADDING 10.52.010 through 10.52.070 to the Lodi Municipal Code,
CHAPTER 10.52, Regulating Vehicles and Traffic Upon the Streets Within the

TO THE LODI The motion carried by a unanimous vote of the Council.
MUNICIPAL CODE
Council was reminded that at its October 21, 1987 meetinq,
ORD. NO. 1410 the City Council introduced the new Traffic Ordinance
ADOPTED excluding the section on regulation of commercial
vehicles. Staff was directed to return with an ordinance
CC -45(a) covering commercial vehicles but not to include
CC -48(a) establishment of truck routes.
CC -149
On November 18, the proposed ordinance on commercial
vehicles was introduced. it contains the following
sections:
10.52.010 - Allows establishment of prohibitions of
commercial vehicles and/or vehicle weight limits. This is
essentially the same as the old City Code except the actual
streets would be named in the Traffic Resolution.
10.52.020 - Allows posting of signs on streets accessible
to STAR (extra -length) trucks. The actual streets would be
named in the Traffic Resolution..
10.52.030 - Requires vehicles to comply with signed
restrictions.
10.52.040 - Allows Public Works Director to issue special
permits. These include STAA trucks on streets not signed,
house moving, other large loads, etc.
10.52.050 - Prohibits commercial vehicles over five tons
from parking in residential areas.
10.52.060 - Prohibits parking of detached trailers except
for loading/ unloading and certain circumstances; does not
apply to small (utility) trailers or travel trailers.
10.52.070 - Exempts certain vehicles per the Vehicle Code.

Section ii;.B2.v5U regarding Truck Parking nas been reworded
to clarify the points raised by the public and the City
Council on November 18, 1987. It specifically indicates
"R-" zoned districts. It also lists the nonresidential
uses that are allowed in residential zones and indicates
they are considered part of the residential district.
Thus, truck parking would be prohibited in front of a park
or school in a residential area. It would be allowed in a
park in an industrial area such as C -Basin.
Since this modification is a clarification and does not
change the intent of the ordinance as introduced, it was
recommiended that the ordinance be adopted without
reintroduction.

RECOMMENDED ACTION: That the attached ordinance regulU;iny commercial
vehicle travel and parking be adopted.
BACKGROUND INFORMATION: At its October 21, 1987 meeting, the City Council
introduced the new Traffic Ordinance excluding the section on regulation of
commercial vehicles. Staff was directed to return with an ordinance covering
commercial vehicles but not to include establishment of truck routes.
On November 18, the proposed ordinance on commercial vehicles was
introduced. It contains the following sections:
10.52.010 - Allows establishment of prohibitions of commercial vehicles

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS:
SECTION 1 There is hereby added to the Lodi Municipal Code, Title 10, a
new Chapter 10.52 regulating commercial vehicle travel and parking upon the
streets, sidewalks, and other public and private places within the City of
Lodi, as follows:
"Chapter 10.52
REGULATION OF COMMERCIAL VEHICLE TRAVEL AND PARKING
Section 10.52.010 - Vehicle Weight Limits in City Streets
Whenever the Traffic Resolution of this City designates and describes
any street or portion thereof as a street, the use of which is prohibited by
any commercial vehicle and/or by any vehicles exceeding a maximum gross
weight as is therein specified, the Pubic Works Director shall erect and
maintain appropriate signs on those streets affected.
No vehicle weight limit or restriction shall be established under this
section without a public hearing.

Section 10.52.020 - Vehicle Size Limits in City Streets
Whenever the Traffic Resolution of this City designates and describes
any street or portion thereof as a street, the use of which is permitted by
vehicles within the length limitations described in Section 35401.5 of the
Vehicle Code, the Public Works Director is hereby authorized to designate
such street by appropriate signs as a route for the movement of such vehicles.
When signs are erected giving notice thereof, streets or portions of
streets are hereby declared to be routes for the movement of vehicles within
the maximum lengths allowed by Section 35401.5 of the Vehicle Code.

Section 10.52.030 - Route Restrictions
A. When any commercial vehicle and/or maximum gross weight limit
restrictions are established and designated by appropriate signs, the
operator of any vehicle not in compliance with the specified restrictions
shall not drive on such street except as otherwise provided by City
ordinance or in the Vehicle Code. (VC 21101)
B. Nothing in this ordinance shall prohibit any vehicle exceeding the limits
established under Section 13.0 of this ordinance coming from an
unrestricted street having ingress and egress by direct route to and from
a restricted street when necessary for the purpose of making pick-ups or
deliveries of goods, wares and merchandise from or to any building or
structure located on such restricted streets or for the purpose of
delivering materials to be used in the actual and bona -fide repair,
alteration, remodeling, or consy.ructior. of any building or structure upon
such restricted streets for which a tuildirg permit has previously been

C. When any truck length route is established under Section 13.1 of this

Section 10.52.040 - Permits
The Public Works Director may issue permits in accordance with the
applicable provisions of the Vehicle Code for the operation of vehicles
exceeding the weight/length limitations imposed by this ordinance and the
Vehicle Code. (VC 35401.5, 35780 et seq.)
Section 10.52.050 - Parking Restrictions
It is unlawful to park a commercial vehicle exceeding a maximum gross
weight of five tons on any street in a residential district. For purposes of
this section, "residential district" is defined as residentially zoned areas
designated by the City Zoning Code (any "R-" district) and includes schools,
parks, playgrounds, community centers, churches, museums, golf courses
(excluding miniature golf courses) and similar recreational uses of a
noncommercial nature, and public utility service buildings where they are
located in a residential district.
This section shall not prohibit parking of commercial vehicles in the
process of being loaded or unloaded. (VC 22507.5)
Section 10.52.060 - Parking of Trailers Prohibited
No person who owns or has possession, custody, or control of any trailer
or semitrailer shall park such trailer or semitrailer upon any street, alley,
public way or public place, unless such trailer or semitrailer, at all such
times it is so parked, is attached to a motor vehicle capable of providing
the motive power for moving the trailer or semitrailer upon the street,
alley, public way or public place.
This section shall not prohibit the parking of a trailer or semitrailer
in the process of being loaded or unloaded, nor of a trailer or semitrailer
which 's disabled in such a manner and to such an extent that it requires
some vehicle or facility other than its normal means of motivation to move
the same along said street, alley, public way or public place; provided,
however, such trailer or semitrailer so disabled may remain so parked while
unattached to the motor vehicle described in this section only for the time
necessary for the vehicle or facility to be provided for its removal, and in
no event longer than two hours.
This section shall not apply to utility trailers or trailer coaches
(travel trailers) as defined in the Vehicle Code.

Section 10.52.070 - Bus and Utility Vehicles -
The provisions of this article shall not apply to school buses and buses
under the jurisdiction of the Public Utilities Commission, or to any vehicle
owned by a public utility or licensed contractor while necessarily in use in
the construction, installation, or repair of any public utility. (VC 22512,

SECTION 2. All ordinances and parts of ordinances in conflict herewith are
repealed insofar as such conflict may exist.
SECTION 3. This ordinance shall be published one tiime in the "Lodi -News
Sentinel`, a daily newspaper of general c-ircu.at+o;-t printed and published ir.
the City of Lodi and shall be in force and take effect thirty days from and
after its passage and approval.
