RESOLUTION NO. 631
BEFORE THE LOCAL AGENCY FORMATION COMMISSION OF SAN JOAQUIN COUNTY
RESOLUTION ADOPTING SPHERE OF INFLUENCE FOR THE
NORTHEAST COUNTY FIRE PROTECTION DISTRICTS: CLEMENTS# MOKELUMNE,
AND LIBERTY (LAFC S-13-84)
WHEREAS, Section 54774 of the Government Code provides that
the Local Agency Formation Commission shall develop and determine
the Sphere of Influence of each local gover-nmentaleagency within
the County; and,
WHEREAS, said Code Section further provides that "Sphere of
Influence" means a plan for the probable ultimate physical boundazies
and service area of a local governmental agency; and,
WHEREAS, this Commission has duly considered Sphere of
Influence report (LAFC S-13-84) which is a Sphere of Influence
proposal pertaining to the Clements, Mokelumne, and Liberty Fire
Protection Districts; and,
WHEREAS, the Commission held a public hearing on the proposed
sphere on November 9, 1984, in the Board of Supervisors Chambers,
County Courthouse, pursuant to notice of hearing which was published,
posted and mailed in accordance with State law;: and,
WHEREAS, at said hearing the Commission heard and received_
evidence, both oral and documentary, submitted in favor of and
in opposition to the Drowsed Sphere of Influence and all persons
present were given an opportunity to hear and be heard in respect;,
to any matter relating to said proposal; z_

NOW, THEREFORE, the Local Agencv Formation Commission of
San Joaquin County DOES HEREBY RESOLVE, LETERMINE, AND ORDER AS .
follows:
Section 1. Said Spheres of Influence qualify as a Class
20 exemption under the State CEQA Guidelines.

Section 2. In review, the Commission has considered all
factors listed in Section 54774 of the Government Code.
Section 3. The Sphere of Influence for the Clements,
Mokelumnes, and Liberty Fire District is hereby adopted as recommended
in report WC S-13-84, dated November 9, 1984, said report being
made a part of this resolution.
Section 4. The Executive Officer is hereby Authorized and
directed to distribute copies of the adopted Sphere of Influence
and resolution to affected agencies and interested parties.
PASSED AND ADOPTED this 9th day of November 1984, by the
following vote of the Local Agency Formation Commission of San
Joaquin County, to wit:

SUBJECT: PROPOSED SPH'E'RE OF INFLUENCE FOR THE NORTHEAST COUNTY
FIRE PROTECTION DISTRICTS CLEMENTS, MOKELUMNE, AND
LIBERTY (LAFC S-13-84)
SUMMARY:
In accordance with State law, this report proposes Spheres of
influence for the Clements Fire Distzict, the Mokelumne Fire
District, and the Liberty Fire District.
The northeast county fire Districts are well established by
adjacent fire protection boundaries which establish a logica3
service area for each. None of the Districts desire a change
in boundary or consolidation.
consequently, it is recommended that the Sphere of Influence
of each be the existing District boundary, while recognizing
t -hat the City of Lodi will eventually serve a limited portion of
the Mokelumne Fire District upon annexation to the city..
CLEMENTS FIRE DISTRICT PROFILE:
The Clements Fire Protection District was formed in 1942 and
protects 115 square miles of rural -residential and agricultural
area, as shown on Map No. 1. The District operates a single
fire station which is located in Clements. No additional
stations are planned. The District is served by a force consis-
ting of a Chief (paced as part-time) and 25 volunteer fireman. The
District's equipment includes 3 pumpers, 2 water tankers, and 1
rescue pickup. Seven fireman are trained as Emergency Medical
technicians (EMT) and all others are trained in First Aid.

The District is governed by a five -member, locally elected Boaxd
of Directors. Its annual budget is about $113,000. The District
voters have approved a special tax to supplement property tax
revenue.
MOKELUMNE FIRE DISTRICT PROFILE:
The Mokelumne Fire Protection District was formed in 1947 and
protects 68 square miles of rural residential and agricultural area,
as shown on Map No. 1
The District operates from a single station located on Highway 12
in Victor. No additional stations are planned; however, a second
station would likely be built in Lockeford if sufficient money was
available.
The District is served by a force of 4 full-time and 22 volunteer
fireman. Its equipment includes 3 pumpers, 1 water tanker, and a
rescue truck. Four firemen are trained EMTs and the remaining are
trained in advanced First Aid.
The District is governed by a five -member locally elected Board of
Directors. Its annual budget is about $264,000. The District has
no plans for a special tax.
LIBERTY FIRE DISTRICT PROFILE:
The Liberty Fire Protection District was formod in 1946 and protects
36 square miles of rural residential and agricultural area, as shown
on Map No. 1.
The district operates from a single station located or Jahant Road
and Bruella Road. No additional stations are planned.
The District is served by a force of 3 full-time and 19 volunteer
fireman. Its equipment includes 2 pumpers, 2 water tankers, and
1 rescue truck. All fireman are trainedin First Aid.
The Districtis :governed by a three --member locally elected Board of
Directors. Its annual budget is $161,000. The District has no
plans for a special tax.
SPHERE OF INFLUENCE DEFINED :
As prcvided for in Governme.:t Code Section 54774, a "Sphere of
Influence" (SOI) is a plan for the probable ultimate boundaries
and service area of a local governmental agency as determined
by LAFCo. I.AFCo must periodically review and update the SOI.
Factors the Commission must consider in determining a Sphere of
Influence are:

1. The maximum possible service aroa of the agency based upon
present and possible service capabilities of the agency.
2. The range of services the agency is providing or could provide.
3. The projected future population growth of the area.
4. The type of development occurring or planned for the area,
including but not limited to, residential, commercial and
industrial development.
5. The present and probable frture service needs of the area.
6. Local governmental agencies presently providing services
to such area and the present level, range and adequancy
of services provided by such existing local governmental
agencies.
7. The existence of social and economic interdependence and
interaction between the area within the boundaries of a
local governmental agency and the area which surrounds it
and which could be considered within the agency's Sphere
of Influence.
8. The existence of agricultural preserves in the area which
could be considered within an agency's Sphere of Influence
and the effect on maintaining the physical and economic
integrity of such preserves in the event that such preserves
are within a Sphere of Influence of a local governmental
agency.
BOUNDARY DISCUSSION:

As shown on Map No. 1, the three subject Districts are surrounded
by fire protection services in San Joaquin County and adjacent
counties. The majority of the Clements Fire District and a
small portion of the Liberty Fire District are covered by the
California Department of Forestry (CDF) wild land protection area.
All three Districts and adjacent Districts are satisfied with
their existing coordinating boundaries and have no plans for a
boundary change or consolidation. The Liberty Chief indicated
support of cooperative agreements for functional consolidation.
These could include administrative, training, dispatch, etc.
The Mokelumne Fire District adjoins the City of Lodi and a limited
area of the District is within the City's Sphere of Influence.
The City's Sphere generally extends easterly to the Central

California Traction Co. railroad tracks between the Mokelumne River
on the north and Kettleman Lane on the south.
Where a City -Sphere overlaps a District, the Commission generally
adopts a "Zero Sphere" for that portion of the District, indicating
that there would be a future detachment from.the District upon
annexation to the City.
ENVIRONMENTAL REVIEW:
If the Sphere of Influence of each district is limited essentially
to the existing boundary of the district, the proposal qualifies
as a Class 20 categorical exemption under the State CEQA Guidelines.
RECOMMENDATION:
It is therefore recommended that the Commission adopt a Sphere of
Influence (SOI) for each district as follows, referring to Map No. 1:
• Clements: SOI is the same as the existing Fire District
Boundary,
• Mokelumne: SOI is the same as the existing Fire District
Boundary, except for the portion of the District that is
within the City SOI, which is given a "zero SOI,"
• Liberty: SOI is the same as the existing Fire District
Boundary,
with the finding that all applicable factors contained in Section
5477 of the Government Code have been considered.
