STEIN City Attorney January 1962 h Mr. Jin Schroeder, secretary Lodi Planning Commission Lodi:, California Bear Hr, Schroeder, This letter is in reference to the public hearing scheduled for January 11 and at which time Dr. Swanson's request for a zoning change at 1001 Windsor Dr. to R -C -P will be heard. On Wednesday November 18, 1981 I made a statement to the city council on this issue..1 was a spokesman for the 4$ individuals who opposed a zoning change at 1001 Windsor Dr. and signed a petition to that effect. I have unclosed my statement and our petition for you to share with the mem- born of the Planning Commission. The opposition to a zoning change remains the sass. We were shocked that the council voted against the Planning Commission's earlier refusal to grant Dr.. Swanson"s request for a zoning change. I would safely estimate that 95 percent of those individuals who reside within 300 feet of 1001 Windsor Dr. are strongly opposed to any change in soning. We want the` residential character (R-1) of all the regaining properties on York, Windsor, and Vine and east of Fairmont to remain residential. I cannot begin to tell you how strongly we feel about this. It is our fervent wish that the Planning Coa mission will listen to us, the people who live there. We will be at the Planning Commission meeting on January 11 to be heard and seen. . Thank you for your time and attention to this matter. Swanson's appeal to the city council to reverse the city planning commission's denial of his re- quest to amend the land use element of the General Plan by redesig- nating the parcel'at 1001 Windsor Drive, Lodi, from low density res- idential to office institutional. We petition the city to deny Dr. Swanson's request to amend the land use element of the General Plan from lour density residential to of - institutional. We bought our homes in this neighborhood because this area had been zoned residential. Over the years we have been saddened by the planning commission's and the council's ready wil- lingness to-make.,:change after change (spot zoning) from low density residential to rofessional commercial and now the request fore face inetitutionil.',. SWANSON APPEAL Notice thereof having been published In accordance with law and affidavit of Publication being on file in the office of the City Clerk, Mayor McCarty called for the Public Hearing to consider the appeal of Dr. Dennis R. Swanson of the Lodi City Planning Commission's denial of his request to amend the Land Use Element of the General Plan by redesignating the parcel at 1001 Windsor Drive, Lodi, from Low Density Residential to Office institutional. Assistant Planner Morimoto introduced the matter and presented transparencies which illustrated the surrounding zoning, land use and general plan designations. ° The following persons were present and spoke in favor of the appeal: 1. Dr. Jack L. Gilliland, 900 South Fairmont Avenue, Lodi. He stated that the General Plan Amendment and ultimate rezoning were being sought so the subject parcel could be used for off-street parking for an existing professional officc building at 916-924 South Fairmont Avenue which was proposed for remodeling. He gave the history of professional office development in the area of Memorial Hospital. The .following correspondence was received in opposition to the appeal: 1. A letter from Mr. Del Caywood, 921 Windsor Drive, Lodi. 2. A petition signed by 18 residents of the 800 and 900 blocks of Windsor Drive. The following persons were present and spoke in opposition to the appeal: 1. Mr. Reid Carney, 900 West Vine Street, Lodi. He stated that the people of the area were opposed to further office and parking encroachment into the residential area and presented a petition containing 48 signatures supporting his statement. 2. Mr. Lloyd Brosnikoff, 901 Windsor Drive, Lodi. 3. Mr. Harold L. Roberts, 831 Windsor Drive, Lodi. As there was no one else wishing to be heard on this matter and no additional correspondence to be read, Mayor McCarty declared the public portion of the hearing closed. After discussion on motion of Councilman Hughes, Murphy second, Council, by a 4 to 1 vote with Councilman Katnich noting "No", approved the appeal of Dr. Dennis R. Fairmont Avenue Lodi, CA 95240 Dear Dr. Gilliland: This letter will confirm the actions of the Lodi City Council at its regular meeting of March 17, 1982 whereby the Council, following a public hearing on the matter, introduced Ordinance No. 1253 overturning the denial of the Planning Commission; thereby rezoning the parcel at 1001 Windsor Drive, Lodi (Assessor's Parcel No. 031-103-21), from R-1, Single -Family Residential, to R -C -P, Residential -Commercial -Professional, with conditions. The.full context of the motions approving this rezoning with conditions is set forth below and has been entered into the official minutes of the March 17, 1982 Council Meeting. Councilman Hughes moved that on the following premises that the appeal of Dr. Gilliland, et.al, be approved subject to the fact that (1) the area right now is substandard with respect to parking, that (2) I believe a large, well -landscaped parking lot such as should be depicted in the proposed plan would enhance the property value if, in fact, further encroachment were prevented, (3) that the parcel is subject to Site Plan review and that we direct the SPARC Committee to require that the landscaping be in the City requirements and that it be used as a parking lot, and (4) without including that in the motion, that we follow that with a motion to require that it be dedicated for perpetuity. Further, on motion of Councilman Pinkerton, Hughes second, Council instructed the City Manager and the Chief Building Officials that the City not issue any building permits until such time that the City - ry Pag y Attorney is :.satisfied that the owners of the subject parcels have`"filed for record two things --the necessary crossover agreement and an agreement that requires that those parking IIW serve for perpetuity as parking lots only for those structures.
