LODI Following receipt of a report from the Planning Conrdssion
advising that it determined that a zoning hardship did not
CC -53(b) exist and its denial of the request of Gary A. Kroll for a `

730 South Stockton Street within: the boundaries of the
Eastside Moratorium area, Council was apprised that t -.r.
Kroll did not appeal the action of the Planning Commission.
With the tacit concurrence of the Council, the matter was
withdrawn from the agenda.

SUBJECT: VARIANCE REQUEST FROM GARY KROLL ON PROPOSED DUPLEX PRO= LOCATED IN EAST
SIDE MORATORIUM AREA AT 730 SOUTH STOCKTON STREET
Council will recall that at its meeting of September 17, 1986, a letter was
received from Gary Kroll requesting a variance on proposed projects located in
the eastside building Fmratorium area (see Exhibit A attached).
Following discussion, Council referred the matter to the Planning Ccmission.
At its meeting of October 27, 1986, the Planning Commission determined that a
"zoning hardship" did not exist and denied the request.
A letter confirming the action of the Planning Commission and outlining the
appeal procedure to the Council was mailed to Mr. Kroll on October 28, 1986
(see Exhibit B attachT). As of this writing, Mr. Kroll has not appealed the
action.

Construct Duplex Eastside Moratorium Area - 730 S. Stockton. Street
At its meeting of Monday, October 27, 1986 the Lodi City Planning
Commission denied you request for a Zoning Variance to construct a
duplex on a lot located at 730 South Stockton Street within the
boundaries of the Eastside Building Moratorium Area. The underlying
zoning of the property is R -MD, Medium Density Multiple Family
Residential.
In denying your request the Planning Commission determined that a
Zoning Hardship as defined in the Municipal Code did not exist.
Section 17.72.110 of the Lodi Municipal Code provides as follows:
"Appeal to Council. Any applicant or person claiming
to be directly and adversely affected by any action of
the Planning Commission may, within five days (i.e
working days) file a written appeal with the City Clerk
for transmittal to the City Council."
Your appeal, if any, must be in writing and should be directed to Mrs.
Alice M. Reimche, City Clerk, 221 West Pine Street, Lodi. It must be
received by her by 5:00 p.m., Monday, November 3, 1986.

Subject: Transfer of Funds
Please be advised that the Lodi City Council at its Regular Meeting of November
5, 1986 on notion of Mayor Pro Tempore Olson, Hinciman second, approved the
transfer of funds in the amount of $124,205.91 from the 16.1 650.23 - 500
account to the System Equipment Purchase Account - 16.680.01 - 519 for program
implementation of the Electric Utility Load Research Program.
Further, Council, on motion or Mayor Pro Tempore Olson, Reid second, approved
the specifications for the purchase of solid state data recorder aisd associated
softvare and authorized the advertising for bids thereon.
