TRAFFIC ORDINANCE
ADOPTED
ORDINANCE NO. 1402
Ordinance No. 1402 entitled, "An Ordinance of the Lodi City
Council Repealing Ordinance No. 49:� and All Ordinances and
CC -45(a) -
Parts of Ordinance Amendatory Thereof, Thereby Repealing
CC -48(a)
Title 10, Chapter 10 of the Lodi Municipal Code, Regulatino

Lodi, ano Adding a New Title 10, Chapter 10 to the Lodi
Municipal Code Regulating Vehicles and Traffic Upon the
Streets Within the City of Lodi" having been introduced at
a Regular Meeting of the Lodi City Council held October 21,
1987 was brought up for passag., on motion of Council Member
Reid, Hinchman second. Second reading of the Ordinance was
omitted after reading by title, and the Ordinance was then
adopted and ordered to print by the following vote:
Ayes: Council Members - Ninchman, Pinkerton, Reid,
Snider, and Olson (Mayor)
Noes: Council Members - None
Absent: Council Members - None

SUBJECT: REPEALING ORDINANCE NO. 493 AND ALL ORDINANCES AND PARTS OF ORDINANCES
AMENDATORY THEREOF, THEREBY REPEALING TITLE 10, CHAPTER 10 OF THE LODI
MUNICIPAL CODE, REGULATING VEHICLES AND TRAFFIC UPON THE STREETS WITHIN THE
CITY OF LODI, AND ADDING A NEW TITLE 10, CHAPTER 10 TO THE LODI MUNICIPAL
CODE REGULATING VEHICLES AND TRAFFIC UPON THE STREETS WITHIN THE CITY OF LODI.
Ordinance No. 1402 - "An Ordinance of the Lodi City Council Repealing Ordinance
No. 493 and all Ordinances and Parts of Ordinances Amendatory Thereof, Thereby
Repealing Title 10, Chapter IO of the Lodi Municipal Code, Regulating Vehicles
and Traffic Upon the Streets Within the City of Lodi, and Adding a New Title
10, Chapter 10 to the Lodi Municipal Code Regulating Vehicles and Traffic Upon
the Streets Within the City of Lodi" (see Exhibit A attached) was re -introduced
at the regular meeting of October 21, 1987.
Pursuant to State Statute, Ordinances may be adopted five days after their
introduction following reading by title.
This Ordinance has been approved as to form by the City Attorney.
RECOMMENDED ACTION: Following reading.by title, it would be appropriate for
the Lodi City Council to adopt Ordinance No. 1402.

Dear Mr. Schrteder:
Please be advised that my law firm represents the
Frank C. Alegre Trucking Co., Inc. relative to the hearing
that has been scheduled for November 18, 1987, to discuss
weight limits on the city streets of Lodi.
As you are aware, the Council voted on October 21,
19;1, to refer the issue of truck routes to a future
hearing following the submission to the City of an
Enviromental Impact Report on this issue. Consequently,.in
that the issue of weight limits on the streets are
intergrally involved with the issue of truck routes and
traffic patterns that will be the subject of the upcoming
Environmental Impact Report, any such hearing on weight
limits would be an attempt to circumvent the Council's
decision to refer these issues for an Environmental Impact
Furthermore, please be advised that my client will
intend to pursue any and all remedies including litigation
should the Council discuss and vote on any weight
limitations for the city streets of Lodi absent the
submission and discussion of a full Ervironmental Impact
Report on these issues.
I thank you for your attention to these matters,
and I will assume that the Council will defer on the issues
of weight limits pending the receipt and review of the

Listed below is a synopsis of Ordinance No. 1402 en'.itled "Regulating
The Use Of And Traffic Upon The Streets, Sidewalks An:, Other Public
Places In The City Of Lodi; The Use Parking And Control Of Vehicles
Thereon; And Repealing Ordinance No. 493 And All Ordinances And Parts
Of Ordinances Amendatory Thereof And In Conflict Herewith" which was
introduced by the Lodi City Counr=l at its regular meeting of July 15,
1987 by the following vote:
Ayes: Council Members - Hinchman, Pinkerton, Reid,
Snider and Olson (Mayor)
Noes: Council Members - None
Absent: Council Members - None
Abstain: Council Members - None
Pursuant to State of California Government Code Section 36933 a summary
of the proposed ordinance, as prepared by an official designated by the
City Council (the City Clerk), shall be published at least 5 days prior
to the City Council meeting at which the subject ordinance is to be
adopted and again within 15 days after the adoption of the ordinance by
the Council with the names of those council members voting for and
against the ordinance.
Further, the City Clerk shall post in her office a certified copy of
the full text of the proposed ordinance at least five days prior to the
City Council meeting at which the proposed ordinance is to be adopted.
Information regarding this item and copies of the proposed ordinance
are available in the City Clerk's office, 221 West Pine Street, Lodi,
California, during regular business hours - Monday through Friday, 8:00
a.m. to 5:00 p.m.
SYNOPSIS OF TRAFFIC ORDINANCE
TRAFFIC ORDINANCE SYNOPSIS
ARTICLE I
Words and Phrases Defined - refers to Vehicle Code
definitions and includes definitions not found in the
Vehicle Code, describes Traffic Resolution as document
which contains traffic regulations which are noticed by
devices (i.e. signs and markings).
ARTICLE II
Traffic Administration - describes duties of Traffic
Engineer and establishes Public Works Director as City
Traffic Engineer.
ARTICLE III
Enforcement and Obedience to Traffic Regulations -
descrihes who can lawfully direct traffic, requires
obedience to traffic control devices, prohibits removal
or concealment of chalk marks used in parking
enforcement.
ARTICLE IV
Traffic Control Devices - describes authority ti
install, operate, maintain and remove particular devices
(Council, Public Works Director)
ARTICLE V
Speed Regulations - contains enabling language for
speed limits to be set in Traffic Resolution, allows
variance for timed traffic signals, sets speed limit in
Lodi Lake Park at 15 m.p.h.
ARTICLE VI
Turning Movements - authorizes Public Works Director to
control turning mov-ents`.
ARTICLE VII
Stop and Yield InterseLtions - contains enabling
language for establishment of through streets and
intersections in the Traffic Resolution.
ARTICLE VIII
Railroad Trains - contains restrictions on trains
subject to California Public Utilities.
ARTICLE IX
Pedestrians Rights and Duties - authorizes Public Works
Director to establish crosswalks and prohibit crossings.
ARTICLE X
Regulations fnr Bicycles - required licenses issued by
Police Department, prohibits riding on sidewalk in
Business Districts, requires bicycles on sidewalk to
yield to rigl.--of-way to pedestrians, allows Public
Works Director to regulate bicycle use on sidewalks.

ARTICLE Xi Stopping, Standing and Parking - contains enabling
language for establishment of parking restrictions in
the Traffic Resolution; describes certain hi Parking
areas including parkways, sidewaIP-, alleys, portions of
frontage roads and miscellaneous -eas; prohibits
parking for over 72 hours, for displaying vehicles for
sale and for miscellaneous other purposes; provides for
the Public Works Director to install markings, disabled
person's parking, loading zones and miscellaneous zones.
ARTICLE XII Permit Parking - contains enabling language for
establishment of permit and preferential parking zones
in the Traffic Resolution
ARTICLE XIII Regulation of Commercial Vehicle Routes and Parking -
prohibits vehicles over 5 tons from using or parking on
City streets except for deliveries or on established
truck routes; contains enabling language for
establishment of truck routes in Traffic Resolution;
implements federal and state laws regarding large trucks
by establishment of routes in the Traffic Resolution and
a permit process; prohibits parking of detached trailers
and semi -trailers except for deliveries (does not apply
to utility or travel trailers)
ARTICLE XIV Removal of Vehicles - allows removal of vehicles from
public and private property under certain circumstances
