AVENUE ASSESSMENT called for the Public Hearing to consider the Turner Road
DISTRICT NO. 1 and Cluff Avenue Assessment District.

Council was apprised that a letter had been received from
Timothy J. Hachman, Attorney at Law, Blewett, Garretson
and Hachman advising that the property owners sponsoring
the district have not yet made a determination concerning
the timing for the financing of the project and requesting
that the matter be continued to November 18, 1981.
Council was further apprised that the City had attempted
to contact all interested parties, apprising theta of the
request to continue the matter.
There were no persons in the audience wishing to speak on
the matter.
On motion of Mayor Pro Tempore Murphy, Katn ch second, the
matter was continued to the regular Council Meeting of

BEFORE THE CITY COUNCIL OF THE CITY OF
LODI, CALIFORNIA
TURNER ROAD AND CLUFF AVENUE ASSESSMENT DISTRICT NO. 1
RESOLUTION OVERRULING PROTESTS
ON RESOLUTION NO. 81-39
RESOLVED, by the City Council of the City of Lodi,
California, that
WHEREAS, this Council did on the 15th day of April, 1981,
adopt its Resolution No. 81-39, a Resolution of Intention to Acquire
and/or Construct Improvements in and for said City;
WHEREAS, on August S, 1981, this. Council adopted a resolution
appointing time and place of hearing protests in relation to the
proposed acquisitions and improvements and directing notice;
WHEREAS, notice was given of the time and place therein stated
in the manner provided by law, as appears from the affidavits on
file in the office of the City Clerk;
WHEREAS, said matter came.on regularly for hearing at the
time therein fixed; and
WHEREAS, all written protests and other written communications
were publicly read at said meeting and all persons desiring to be
heard were fully heard;
NOW, THER77ORE, IT IS ORDERED, as follows:
That; protests against said acquisitions and improvements
were not signed by the owners of a majority or more of the area
of the land to be assessed for the improvements.

Gentlemen:
The Council originally heard the protest hearing on this
proposed assessment district on September 16, 1981. At that
time--the-hearing was continued to a later date, and most
recently was -.continued to the Council meeting scheduled .for
Wednesday, November 4, 1981.
At prior City Council -meetings, you have resalve.d the—
issues
issues concerning the LaMae, Reynolds, Kettelman, and Oester
properties.
The property owners sponsoring the district have not yet
made a determination concerning the timing for the financing
of the project. It is my understanding that the property owners
will be meeting on November 11, 1981 to make a final decision
concerning this matter. I respectfully request that you continue
the hearing from November 4, 1981 to November 18, 1981 at 1:00 p.m.
