The easement was dedicated on the subdivision map of Maxwell
Industrial Park in 1979. The reservation was to provide a

time a tentative parcel map has been submitted for the
development of the "Maggio Parcel" between Century Boulevard
and Maxwell Industrial Park, and a public street is not

SUBJECT: Easement Vacation - 40 Neuharth Drive
RECOMMENDED ACTION: That the City Council adopt an order vacating the ease-
ment reserved for future street as shown on the attached sketch.
BACKGROUND INFORMATION: The easement was dedicated on the subdivision map of
?iaxwE,llIndustrial ark in 1979. The reservation was to provide a large turn-
ing radius for possible truck traffic. Since that time a tentative parcel map
has been submitted for the development of the "Maggio Parcel" between Century
Boulevard and Maxwell Industrial Park, and a public street is not required.
It has been over a year since the easement was dedicated, and no use whatso-
ever has been made of it. Therefore, it is not necessary to set it for hearing
or refer it to the Planning Commission prior to vacation.
MAS International wants to construct an additional building on Lot 2, and
elimination cf this easement will allow them to build closer to the street
and make more efficient use of the land.
It is recommended that the owner's request be granted.

ORDER VACATING EASEMENT ON NEUHARTH DRIVE
THE CITY COUNCIL OF THE CITY OF LODI FINDS:
That on April 19, 1979, there was dedicated an easement for future street
located on Lot 2, Maxwell Industrial Park, Lodi, and filed for record in
Volume 2, Page 47, San Joaquin County Records.
That the easement is no longer used, nor has it been used since it was
dedicated for the purpose for which it was dedicated or for any purpose
whatsoever, and that said described easement is unnecessary for present or
prospective use.
NOW, THEREFORE, pursuant to the foregoing findings and under the authority
of Section 3300 et seq of the Streets and Highway Code of the State of
California, it is hereby ordered that there is hereby abandoned and vacated
the easement which is described on Exhibit. A attached hereto and thereby
made a part hereof.
The City Manager and City Clerk are hereby authorized to execute on behalf
of the City, a Quitclaim Deed to the appropriate persons.
