SUBJECT: All -Night Parking of Trucks on Murray Street
RECOMMENDED ACTION: That the City Council give direction as to what action to
tame is alley a-te the problems caused by heavy duty commercial vehicles being
parked'all night on Murray Street west of Cherokee Lane.
BACKGROUND INFORMATION: Lawrence Fowler, owner of an apartment complex at
Murray Street, has requested that the City of Lodi take action to prohibit
heavy trucks from parking all night on the street adjacent to his apartments
(see attached police report dated 7/14/81).
Mr. Fowler states that residents of the apartments have complained to him of:
1. Noise from truck refrigeration units;
2. Odors from cattle trucks;
3. Blocking of apartment driveways;
4. Use of the apartment parking lot by trucks as a turning area; and
S. Dust, mud and dirt problems.
Truck parking is attracted to Murray Street because Del Rancho Motel is located
at the southwest corner of Cherokee Lane and Murray Street and it is a convenient
parking area for truckers using the motel.
The following City of Lodi Code prohibits the all-night parking of heavy duty
trucks on most City streets:
Sec. 14-55. 1. All-niglst lurking or heavy duty type ;
connnercial vehicles.

The Police Department has issued numerous citations for thi: infraction on
Murray Street. The penalty for this infraction Is $5 and tc date no driver
or trucking firm has contested. Neither Murray Street nor any other residential
or commercial street in the City has been signed to inform truck drivers of this
section of the City Code.

The attached Police truck survey of 9 days in August shows just 2 trucks parked
in the area during that time. Mr. Fowler has indicated he has seen as many as
six (6) at one time.
Following are several possible alternates to the Murray Street problem that
might be consIL red by the City Council:
1. install signs informing the drivers of the existing Code (No Truck Parking
12:00 a. m. - 5:00 a.m., City Code Section 14-55.1) and increase the penalty
from $5 to a higher amount to discourage infractions. The cost of signing
would be approximately $600 (6 signs). This alternate would still require
Police to make two (2) trips to *the area prior to writing a citation;
2. Do nothing. This is the same as Alternate l but without the installation
of the signing;
3. Prohibit truck traffic on Murray Street by establishing a load iimit on
Murray Street- The cost of signing would be approximately $200 (2 signs).
This action can be expected to generate similar requests from other
citizens for restrictions on other City streets. It is also our under-
standing that if a truck is found parked on such a restricted street, it
can be cited only for a $5 parking violation. The driver can be cited for
a moving traffic violation only'if a police officer observes the truck
boing driven on the restricted street. This alternate requires only one
trip to the area by Police;
4. Establish designated truck routes for the entire City, thereby prohibiting
non-delivery truck traffic on all other streets. The cost of this action
would be difficult to ascertain due to the major problems of implementing
and enforcing such a programa. Designated truck routes should be established
only after a full study by.a traffic engineering firm in cooperation with
the truck companies which will use them;
5. Revise existing ordinance to take care of all truck parking problems. In
reviewing this problem with the other City departments, it has been deter-
mined that the City has been in receipt of many different types of truck
parking problems on City streets and on private property. Some of the
types of complaints received are as follows:
o Trucks hauling hazardous materials parked on City streets;
o Semitrailers with tractor cab detached parked on City streets in or
across from residential areas;
o Semi -tractor cabs being parked without trailer in residential areas,
and driver warming up diesel at 4:00 a.m.;
o Complaints related to aesthetics similar to the prior problem at
Cross Convalescent Home on Turner Road;

o Semi -truck and trailers using residential streets as shortcuts and
for turnaround area; and
o Other complaints received have been similar to those noted on Page 1,
which were received from the occupants of the apartments on Murray
Street.
It is felt that the btst overall solution is a complete revision of the existing
ordinance. This would involve Input and coordination between at least the
Police, Fire, Public Works and Planning Departments, and the City Attorney's
office.
If it is the Council's desire to solve the problem on Murray Street immediately,
it Is felt that the easiest way would be to establish a load limit on Murray
Street and post

vehicles,, as it has on other residential streets. This would then give LPD additional enforce—
ment opportunities and possib3,v alleviate the problem for -the tenants. Additionally,, this. type
traffio must create.!extra wear and increased need for repair on roadways not specifically des
to handle overweight vehicles.

Subject: Request for Truck Survey
Please conduct a daily survey of the trucks parked on Murray Street and
Pioneer Driver in the blocks adjacent to Cherokee Lane. The area car
should sake periodic checks of the area to determine the length of stay
of the vehicles. Hours of major concern are from 2000 hours to 0500
hours.
Use the attached form (making additional copies as needed) and return
same to me by 0800 hours on Monday, August 24, 1981.

RESOLUTION PROHIBITING THE USE OF MURRAY STREET
BY ANY COMMERCIAL VEHICLE OR BY ANY VEHICLE
EXCEEDING A MAXIMUM GROSS WEIGHT LIMIT OF FIVE
TONS
RESOLVED that the City Council of the City of Lodi
does hereby declare that any commercial vehicle or any other
vehicle exceeding a maximum gross weight limit of five tons
is hereby prohibited from using the following street or any
part thereof:
a) Murray Street
BE IT FURTHER RESOLVED that the Public Works Director
is hereby directed to erect and maintain appropriate signs on
the subject street affected by the resolution.
