CITY OF L COUNAWAUNICATION PUBLIC WORKS DEPARTMENT t,6Z SEP0AN r �;i 1 1 6Lc"9� TO: City Counc i i CITY OF LODI y FROM: City Manager •�•`�• DATE: September 8, 1982 SUBJECT: Deferment of Off-site improvements on Cochran Road BACKGROUND INFORMATION: The owners of the property located at 2041 Cochran Road are In the process of making a substantial remodel (of $52,000) to their existing home. As required under the City's Off-site Improvement Ordinance, prior to the issuance of a building permit, the property owner- must dedicate required future rights-of-way, easements, and install those off-site Improve- ments which are not presently existing. The subject parcel is shown on the attached Exhibit "A". The City currently has an agreement with Parcel A.under which the property owner must install off-site improvements upon the City `s request. Parcel' B.has recently under= gone a change in ownership and it is our`understanding that it will be develop- ing in the near future. Therefore, as outlined under Section 5-22(b) of the attached off-site Improvement Ordinance, it is felt that it is in the City's best Interest to defer the off-site improvements at 2041 Cochran Road until Parcel B develops (see attached agreements). At that time, we will call for the improvements of Parcel A, the improvements fronting the subject parcel at 2041 Cochran Road and require improvements on the other two intervening parcels under the 1911 or 1913 Improvement Act. The purpose of this memo is to inform the Council of the staff action and to obtain concurrence in the future calling of improvements on Cochran Road between Pea?and Woodbridge Irrigation District Canal. (Ord. No. 1142, § 4.) Sec. 5-22. Exceptions and deferments. (a) The requirements of section 5-21 shall not apply if the cost of development within any twelve-month period is deter- mined by the public works director to be less than ten thousand dollars. This amount shall be adjusted by the public works director on July 1st of each year based upon the change of the U.S. Average Engineering News -Record Building Cost Index, using the following formula: Amount = $10,000 X ENR Index for June 1936 (ENR Index for June 1980) and that the amount shall be rounded to the nearet one hun- dred dollars. : _ (b) The city may defer eomplianre with�the r cluirements of sectiou 5-21 if the public works director determines that it would be in the best interest of the city to cavise all or a portion of the work to be done on an area -.ride basic; provided, that the property owner enters into an agreement with the city agreeing that the property owner will uadectake and start the construction of the required improvr:ments within ninety days after notice is given by the city. The agreement shall further provide that in the event of default in undertaking and completing the required improvrtnents within the time specified, the city may cause such work to be done and the cosi" thereof to be assessed as a lien a);ainst the property. Swch agreement shall also be considered as a covenant running with the land and shall be recorded in orJer to constitute notice to any prospective buyer of such property. The city manager is authorized to execute such an agreement for and on behalf of the city. (Ord. No. 1142, § 5; Ord. No. 1205, $ 1`.) (r." +41) 52.2 01 § 5-23 Buildings § 5-23 Sec. S-23. Off-site improvement requirements. The off-site improvements required for all under this article are as follows: (a) Curb. gutter, sidewalk, driveways and strz7c improvements shall Esc installed fronting all portions of the developer's property being developed which fronts upon a public street or future public street. Said improvements shall be in accordance with the then current city policies and city standards. (b) Water, sewer. storm drains... and _,landscapin ..shall be installed in accordance with the igen current city policies and city standards. (c) Electrical facilities and street lights shall be installed in accordance with plans prepared and approved by the city utility department. . (d) Plans showing the off-site improvements shalt be prepared by a registered civil engineer unless waived by the public works director. (c) The installation of off-site improvements within existing public right-of-way requires an encroachment permit from the city. (f) If off-site improvements exist that do not mast existing city standards or are inadequate or a hazard to the general public, then these off-site improvements shall be reconstructed to current city standards. (g) No occupancy permit shall be issued or utility connections made unless the required off-site improvements and dedications have been completed and approved. (Ord. No. 1142, § 6.) Sec. 5-24. Standard dedications. The public right-of-way and easement dedications required under this article shall be in conformance with the then current city design standards and adopted specific plans. The required. dedications shall be made prior to the issuance of a building permit or allowing the development to proceed. (Ord. No. 1142, § T.) Sec. S-25 Guarantee and permit issuance. Any person required to construct off-site improvements under this article shall either complete same to city specifications or shall guarantee such completion by furnishing to the city, prior to the issuance of a building permit, or allowing a development. to proceed, a surety bond, instrument of credit, or cash in the amount of the development's construction cost. " tt: _ v',G• WHEREAS, Developer is owner of that certain real property situate in the ` Ccunty of San Joaquin, State of California, and described as follows: 2041 Cochran Road Assessor's Parcel No. 027-080-30 WHEREAS, Developer, at the present time, wishes to make improvements to said property and is desirous of complying with existing City ordinances and policies regarding off-site improvements as set North in Chapter 5, Article V of the Lodi Municipal Code, and this Agreement is being entered into for the purpose of setting forth the rights, duties and obligations of the parties hereto with respect to the following: :. It is understood that the Developer shall be responsible for: a) Design and installation of all necessary off-site improvements in accordance with City Standards; b) Payment of engineering and other applicable fees. r^ 2. The City agrees that the installation of the improvements listed above need not be made at this time with the understanding that - Developer agrees that upon demand of City, he will undertake and start the construction of the required improvements within 90 days after written notice is given by City to Developer, and will complete the improvements within one year. 3. This Agreement shall be binding on the Developer, its heirs, successors or assigns. 4. In the event fhat the aforesaid improvements are not installed upon demand of City, then City is hereby authorized to install said facilities and-ray file suit against Developer, its heirs, successors or assigns for the costs incurred, as well as for a reasonable sum to be allowed as and for the City's attorney's fees incurred in connection with such litigation for the collection of the monies due or may file a lien against said Property for the costs incurred. .f 5.
